5555 43oxygentherapyavailabletoaneligiblepatientwhohasrequestedsuchtherapyunder
5656 44theprovisionsofthissubsection.
5757 45 (2)Suchahealthcareproviderorhealthcarefacilitymay:
5858 46 (a)Providethehyperbaricoxygentherapywithoutreceivingcompensation;
5959 47 (b)Requireaneligiblepatienttopayforthecostofthehyperbaricoxygen
6060 48therapyandanyassociatedcosts,ataratethatshallnotexceedthemaximumrate
6161 49allowedbyMedicare;or
6262 50 (c)Allowaneligiblepatienttoutilizealternativesourcesoffundingtocoverthe
6363 51costofthehyperbaricoxygentherapyandanyassociatedcosts.Suchalternative
6464 52sourcesoffundingmayinclude,butshallnotbelimitedto,gifts,grants,donations,
6565 53reimbursementsfromfederalprograms,andcontributionsfromthirdparties.The

6767 55anyportionofcostsnotcoveredbyalternativesourcesoffunding.
6868 56 (3)Notwithstandinganyprovisionoflawtothecontrary,aneligiblepatientshall
6969 57beentitledtoreceivehyperbaricoxygentherapyunderthissubsectioniftheeligible
7070 58patient:
7171 59 (a)HasreceivedadiagnosisofPTSDorTBI;
7272 60 (b)Hasreceivedanofficialrecommendationforhyperbaricoxygentherapy
7373 61fromthehealthcareproviderthattreatstheeligiblepatient;and
7474 62 (c)Residesinthisstate.
7575 63 6.Alicensingboardshallnotrevoke,suspend,orfailtorenewthelicenseofa
7676 64healthcareprovider,ortakeanyotherpunitiveactionagainstahealthcareprovider,
7777 65basedonarecommendationorcounselingbythehealthcareproviderrelatingtoaccess
7878 66toortreatmentwithahyperbaricoxygenchamberforaneligiblepatient.
7979 67 7.Nopersonactingonbehalfofthisstateshallblockorattempttoblockan
8080 68eligiblepatientfromreceivingaccesstohyperbaricoxygentreatment.
8181 69 8.Nopersonshallimposerestrictionsonaccesstohyperbaricoxygentherapy
8282 70greaterthantherestrictionsimposedunderthissectionandanyotherapplicable
8383 71provisionsoflaw.
8484 72 9.(1)Thereisherebycreatedinthestatetreasurythe"HyperbaricOxygen
8585 73TherapyforMilitaryVeteransFund",whichshallconsistofmoneyscollectedunderthis
8686 74subsection.Thestatetreasurershallbecustodianofthefund.Inaccordancewith
8787 75sections30.170and30.180,thestatetreasurermayapprovedisbursements.Thefund
8888 76shallbeadedicatedfundand,uponappropriation,moneysinthefundshallbeused
8989 77solelyforthepurposesdescribedundersubdivision(2)ofthissubsection.

9595 83 (b)a.Thereisherebyestablishedthe"HyperbaricOxygenTherapyAdvisory
9696 84Committee",whichshallconsistofateamofvolunteermemberstobeappointedbythe
9797 85governorofthisstate.Thecommitteeshallinclude,butshallnotbelimitedto,activeor
9898 86retiredmembersoftheArmedForces,physicians,medicalexperts,andnonmedical
