4 (2)"Healthcarefacility",thesamemeaningasprovidedundersection190.100 5oranyprivatehyberbaricoxygentreatmentcenterlicensedinthisstate; 6 (3)"Healthcareprovider",alicensedphysician,alicensedadvancedpractice 7registerednurse,oralicensedphysicianassistant; 8 (4)"Posttraumaticstressdisorder"or"PTSD",amentalhealthdisorderthatis 9developedafterhavingexperiencedorwitnessedalife-threateningeventincluding,but 10notlimitedto,militarysexualtrauma; 11 (5)"Traumaticbraininjury"or"TBI",anacquiredinjurytothebrain. 12"Traumaticbraininjury"doesnotincludebraindysfunctioncausedbycongenitalor 13degenerativedisordersorbirthtrauma. 14 2.Theveteranscommissionmaycontractwithpublicorprivateinstitutionsof 15highereducationinthisstate,orpublicorprivateclinicsorhospitals,tofurnish 16alternativetreatmentoptionsforveteranswhohavebeencertifiedbytheUnitedStates 17DepartmentofVeteransAffairs,anybranchoftheUnitedStatesArmedForces,orany EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18state-licensedphysicianashavingatraumaticbraininjuryorposttraumaticstress 19disorder.Theinstitutionofhighereducationshallmanage,monitor,andensurethe 20complianceofcontractedprovidersofanyofthefollowingalternativetreatment 21options: 22 (1)Acceleratedresolutiontherapy; 23 (2)Equinetherapy; 24 (3)Hyperbaricoxygentherapy,whichshallbeprovidedataregisteredand 25licensedhyperbaricoxygenfacility; 26 (4)Musictherapy;or 27 (5)Serviceanimaltrainingtherapy. 28 3.Aveteranqualifiestoreceivealternativetreatmentunderthissectionifheor 29she: 30 (1)Hasbeendiagnosed,byahealthcarepractitioner,withservice-connected 31posttraumaticstressdisorderoraservice-connectedtraumaticbraininjury;and 32 (2)Voluntarilyagreestosuchalternativetreatment. 33 4.(1)Theprovisionofalternativetreatmentshallbeunderthedirectionand 34supervisionofanindividuallicensedinthisstatetoperformsuchalternativetreatment. 35 (2)Thesupervisinglicensedprovidershallagreetocooperatewiththeveterans 36commissiontoprovidedatasufficienttoassesstheefficacyofalternativetreatment 37modalities.Acceptabledatamayinclude,butshallnotbelimitedto,institutionalreview 38boardclinicaltrialdata,pretreatmentandposttreatmentMRIbrainscans,cognitive 39testingsuchastheRightEyetestingapprovedbytheUnitedStatesFoodandDrug 40Administration,AutomatedNeuropsychologicalAssessmentMetrics(ANAM)approved 41bytheUnitedStatesDepartmentofDefense,andCNSVitalSigns(CNSVS)metrics. 42 5.(1)Ahealthcareproviderorhealthcarefacilityshallmakehyperbaric 43oxygentherapyavailabletoaneligiblepatientwhohasrequestedsuchtherapyunder 44theprovisionsofthissubsection. 45 (2)Suchahealthcareproviderorhealthcarefacilitymay: 46 (a)Providethehyperbaricoxygentherapywithoutreceivingcompensation; 47 (b)Requireaneligiblepatienttopayforthecostofthehyperbaricoxygen 48therapyandanyassociatedcosts,ataratethatshallnotexceedthemaximumrate 49allowedbyMedicare;or 50 (c)Allowaneligiblepatienttoutilizealternativesourcesoffundingtocoverthe 51costofthehyperbaricoxygentherapyandanyassociatedcosts.Suchalternative 52sourcesoffundingmayinclude,butshallnotbelimitedto,gifts,grants,donations, 53reimbursementsfromfederalprograms,andcontributionsfromthirdparties.The HB2072 2 54eligiblepatientshallremainliabletothehealthcareproviderorhealthcarefacilityfor 55anyportionofcostsnotcoveredbyalternativesourcesoffunding. 56 (3)Notwithstandinganyprovisionoflawtothecontrary,aneligiblepatientshall 57beentitledtoreceivehyperbaricoxygentherapyunderthissubsectioniftheeligible 58patient: 59 (a)HasreceivedadiagnosisofPTSDorTBI; 60 (b)Hasreceivedanofficialrecommendationforhyperbaricoxygentherapy 61fromthehealthcareproviderthattreatstheeligiblepatient;and 62 (c)Residesinthisstate. 63 6.Alicensingboardshallnotrevoke,suspend,orfailtorenewthelicenseofa 64healthcareprovider,ortakeanyotherpunitiveactionagainstahealthcareprovider, 65basedonarecommendationorcounselingbythehealthcareproviderrelatingtoaccess 66toortreatmentwithahyperbaricoxygenchamberforaneligiblepatient. 67 7.Nopersonactingonbehalfofthisstateshallblockorattempttoblockan 68eligiblepatientfromreceivingaccesstohyperbaricoxygentreatment. 69 8.Nopersonshallimposerestrictionsonaccesstohyperbaricoxygentherapy 70greaterthantherestrictionsimposedunderthissectionandanyotherapplicable 71provisionsoflaw. 72 9.(1)Thereisherebycreatedinthestatetreasurythe"HyperbaricOxygen 73TherapyforMilitaryVeteransFund",whichshallconsistofmoneyscollectedunderthis 74subsection.Thestatetreasurershallbecustodianofthefund.Inaccordancewith 75sections30.170and30.180,thestatetreasurermayapprovedisbursements.Thefund 76shallbeadedicatedfundand,uponappropriation,moneysinthefundshallbeused 77solelyforthepurposesdescribedundersubdivision(2)ofthissubsection. 78 (2)(a)Moneysinthefundshallbeusedbythehyperbaricoxygentherapy 79advisorycommittee,establishedunderparagraph(b)ofthissubdivision,toprovide: 80 a.Financialassistancetoeligiblepatientsforhyperbaricoxygentherapy;and 81 b.Directincentivesforthirdpartiestoprovidefinancialassistancetoeligible 82patientsforhyperbaricoxygentherapy. 83 (b)a.Thereisherebyestablishedthe"HyperbaricOxygenTherapyAdvisory 84Committee",whichshallconsistofateamofvolunteermemberstobeappointedbythe 85governorofthisstate.Thecommitteeshallinclude,butshallnotbelimitedto,activeor 86retiredmembersoftheArmedForces,physicians,medicalexperts,andnonmedical 87expertsinrelevantfieldsrelatedtomedicine.Thetermsofthecommitteemembers 88shallbesetbythegovernorupontheirappointmenttothecommittee.Thecommittee 89membersshallserveatthepleasureofthegovernorandmayberemovedfromthe 90committeebythegovernorforanyreason. HB2072 3 91 b.Thehyperbaricoxygentherapyadvisorycommitteeshall: 92 (i)Regularlydeterminehowtoawardmoneysinthefundaccordingtothe 93provisionsofparagraph(a)ofthissubdivision; 94 (ii)Createandmaintainanapplicationforeligiblepatientstoapplyforfinancial 95assistanceforhyperbaricoxygentherapy; 96 (iii)Makerecommendationstothegovernor,asnecessary,relatingtotheuseof 97hyperbaricoxygentherapybymilitaryveterans;and 98 (iv)Submitanannualreporttothegovernordetailingthefinancialstatusofthe 99fundandthedemographicinformationofthepersonstowhomfinancialassistancehas 100beenawardedfromthefund. 101 (3)Notwithstandingtheprovisionsofsection33.080tothecontrary,anymoneys 102remaininginthefundattheendofthebienniumshallnotreverttothecreditofthe 103generalrevenuefund. 104 (4)Thestatetreasurershallinvestmoneysinthefundinthesamemanneras 105otherfundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbe 106creditedtothefund. 107 10.NolaterthanJanuaryfirstofeachyear,beginningin2023,theveterans 108commissionshallprepareareportdetailingeachalternativetreatmentprovidedunder 109thissection,theprovidertype,thenumberofveteransserved,andthetreatment 110outcomesandshallsubmitthereporttothegovernor,thepresidentprotemporeofthe 111senate,andthespeakerofthehouseofrepresentatives. 112 11.Thedepartmentofpublicsafetymaypromulgateallnecessaryrulesand 113regulationsfortheimplementationofthissection.Anyruleorportionofarule,asthat 114termisdefinedinsection536.010,thatiscreatedundertheauthoritydelegatedinthis 115sectionshallbecomeeffectiveonlyifitcomplieswithandissubjecttoallofthe 116provisionsofchapter536and,ifapplicable,section536.028.Thissectionandchapter 117536arenonseverable,andifanyofthepowersvestedwiththegeneralassembly 118pursuanttochapter536toreview,todelaytheeffectivedate,ortodisapproveandannul 119arulearesubsequentlyheldunconstitutional,thenthegrantofrulemakingauthority 120andanyruleproposedoradoptedafterAugust28,2022,shallbeinvalidandvoid. ✔ HB2072 4
