No. 4852H.01I Bill No. HB 2095 Page 3 of February 9, 2022 JLH:LR:OD FISCAL ANALYSIS ASSUMPTION Officials from the Department of Elementary and Secondary Education assume the proposal will have no fiscal impact on their organization. Officials from Department of Social Services (DSS) - Division of Youth Services state they already have a developed web form report for tracking ‘violent acts’ and other illegal activities carried out by youth in secure facilities and related locations (school busses etc.). It’s the CIR and when certain acts are committed a check box is revealed that a police report has been filed. It’s optional whether the reporter filed a police report, but if the fiscal note deems it necessary, the check box can be automatically checked and a pop-up window made to remind the reporter to file a police report. The ITSD costs are estimated $7,490 ($95 x 78.84 hours). # Based on a revised response, officials from the DSS state, per section 160.261, the Children’s Division may need additional investigators to investigate allegations in schools. The Department estimates a need of 0 – 2 staff for this workload. #Oversight will show a range of impact to DSS of $0 (no additional investigators needed) to a cost of two investigators. Per DSS, the cost of the FTE will be split between General Revenue (56%) and Federal Funds (44%). Officials from the Phelps County Sheriff, Kansas City Police Department and the St. Louis County Police Department each assume the proposal will have no fiscal impact on their respective organizations. Oversight does not anticipate a fiscal impact to school districts. However, Oversight did not receive any responses from school districts related to the fiscal impact of this proposal. Oversight has presented this fiscal note on the best current information available. Upon the receipt of additional responses, Oversight will review to determine if an updated fiscal note should be prepared and seek the necessary approval to publish a new fiscal note. Oversight only reflects the responses received from state agencies and political subdivisions; however, school districts were requested to respond to this proposed legislation but did not. FISCAL DESCRIPTION # The bill repeals language related to the jurisdiction of the Children's Division within the Department of Social Services and its ability to investigate reports of alleged child abuse by personnel of a school district, a teacher, or other school employee. It also repeals language related to how a school and school district are to handle reports of alleged child abuse. This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
