BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Section160.261,RSMo,isrepealedandonenewsectionenactedinlieu 2thereof,tobeknownassection160.261,toreadasfollows: 160.261.1.Thelocalboardofeducationofeachschooldistrictshallclearlyestablish 2awrittenpolicyofdiscipline,includingthedistrict'sdeterminationontheuseofcorporal 3punishmentandtheproceduresinwhichpunishmentwillbeapplied.Awrittencopyofthe 4district'sdisciplinepolicyandcorporalpunishmentprocedures,ifapplicable,shallbe 5providedtothepupilandparentorlegalguardianofeverypupilenrolledinthedistrictatthe 6beginningofeachschoolyearandalsomadeavailableintheofficeofthesuperintendentof 7suchdistrict,duringnormalbusinesshours,forpublicinspection.Allemployeesofthe 8districtshallannuallyreceiveinstructionrelatedtothespecificcontentsofthepolicyof 9disciplineandanyinterpretationsnecessarytoimplementtheprovisionsofthepolicyinthe 10courseoftheirduties,includingbutnotlimitedtoapprovedmethodsofdealingwithactsof 11schoolviolence,discipliningstudentswithdisabilitiesandinstructioninthenecessityand 12requirementsforconfidentiality. 13 2.Thepolicyshallrequireschooladministratorstoreportactsofschoolviolenceto 14allteachersattheattendancecenterand,inaddition,tootherschooldistrictemployeeswitha 15needtoknow.Forthepurposesofthischapterorchapter167,"needtoknow"isdefinedas 16schoolpersonnelwhoaredirectlyresponsibleforthestudent'seducationorwhootherwise 17interactwiththestudentonaprofessionalbasiswhileactingwithinthescopeoftheir EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18assignedduties.Asusedinthissection,thephrase"actofschoolviolence"or"violent 19behavior"meanstheexertionofphysicalforcebyastudentwiththeintenttodoserious 20physicalinjuryasdefinedinsection556.061toanotherpersonwhileonschoolproperty, 21includingaschoolbusinserviceonbehalfofthedistrict,orwhileinvolvedinschool 22activities.Thepolicyshallataminimumrequireschooladministratorstoreport,assoonas 23reasonablypractical,totheappropriatelawenforcementagencyanyofthefollowingcrimes, 24oranyactwhichifcommittedbyanadultwouldbeoneofthefollowingcrimes: 25 (1)Firstdegreemurderundersection565.020; 62 63committedonschoolproperty,includingbutnotlimitedtoactionsonanyschoolbusin 64serviceonbehalfofthedistrictorwhileinvolvedinschoolactivities.Thepolicyshallrequire 65thatanyportionofastudent'sindividualizededucationprogramthatisrelatedto 66demonstratedorpotentiallyviolentbehaviorshallbeprovidedtoanyteacherandother 67schooldistrictemployeeswhoaredirectlyresponsibleforthestudent'seducationorwho 68otherwiseinteractwiththestudentonaneducationalbasiswhileactingwithinthescopeof 69theirassignedduties.Thepolicyshallalsocontaintheconsequencesoffailuretoobey 70standardsofconductsetbythelocalboardofeducation,andtheimportanceofthestandards 71tothemaintenanceofanatmospherewhereorderlylearningispossibleandencouraged. 72 3.Thepolicyshallprovidethatanystudentwhoisonsuspensionforanyofthe 73offenseslistedinsubsection2ofthissectionoranyactofviolenceordrug-relatedactivity 74definedbyschooldistrictpolicyasaseriousviolationofschooldisciplinepursuantto 75subsection9ofthissectionshallhaveasaconditionofhisorhersuspensiontherequirement 76thatsuchstudentisnotallowed,whileonsuchsuspension,tobewithinonethousandfeetof 77anyschoolpropertyintheschooldistrictwheresuchstudentattendedschooloranyactivity 78ofthatdistrict,regardlessofwhetherornottheactivitytakesplaceondistrictpropertyunless: 79 (1)Suchstudentisunderthedirectsupervisionofthestudent'sparent,legalguardian, 80orcustodianandthesuperintendentorthesuperintendent'sdesigneehasauthorizedthe 81studenttobeonschoolproperty; 82 (2)Suchstudentisunderthedirectsupervisionofanotheradultdesignatedbythe 83student'sparent,legalguardian,orcustodian,inadvance,inwriting,totheprincipalofthe 84schoolwhichsuspendedthestudentandthesuperintendentorthesuperintendent'sdesignee 85hasauthorizedthestudenttobeonschoolproperty; 86 (3)Suchstudentisenrolledinandattendinganalternativeschoolthatislocated 87withinonethousandfeetofapublicschoolintheschooldistrictwheresuchstudentattended 88school;or 89 (4)Suchstudentresideswithinonethousandfeetofanypublicschoolintheschool 90districtwheresuchstudentattendedschoolinwhichcasesuchstudentmaybeontheproperty 91ofhisorherresidencewithoutdirectadultsupervision. HB2095 3 92 4.Anystudentwhoviolatestheconditionofsuspensionrequiredpursuantto 93subsection3ofthissectionmaybesubjecttoexpulsionorfurthersuspensionpursuanttothe 94provisionsofsections167.161,167.164,and167.171.Inmakingthisdetermination 95considerationshallbegiventowhetherthestudentposesathreattothesafetyofanychildor 96schoolemployeeandwhethersuchstudent'sunsupervisedpresencewithinonethousandfeet 97oftheschoolisdisruptivetotheeducationalprocessorunderminestheeffectivenessofthe 98school'sdisciplinarypolicy.Removalofanypupilwhoisastudentwithadisabilityissubject 99tostateandfederalproceduralrights.Thissectionshallnotlimitaschooldistrict'sabilityto: 100 (1)Prohibitallstudentswhoaresuspendedfrombeingonschoolpropertyor 101attendinganactivitywhileonsuspension; 102 (2)Disciplinestudentsforoff-campusconductthatnegativelyaffectstheeducational 103environmenttotheextentallowedbylaw. 104 5.Thepolicyshallprovideforasuspensionforaperiodofnotlessthanoneyear,or 105expulsion,forastudentwhoisdeterminedtohavebroughtaweapontoschool,includingbut 106notlimitedtotheschoolplaygroundortheschoolparkinglot,broughtaweapononaschool 107busorbroughtaweapontoaschoolactivitywhetheronoroffoftheschoolpropertyin 108violationofdistrictpolicy,exceptthat: 109 (1)Thesuperintendentor,inaschooldistrictwithnohighschool,theprincipalofthe 110schoolwhichsuchchildattendsmaymodifysuchsuspensiononacase-by-casebasis;and 111 (2)Thissectionshallnotpreventtheschooldistrictfromprovidingeducational 112servicesinanalternativesettingtoastudentsuspendedundertheprovisionsofthissection. 113 6.Forthepurposeofthissection,theterm"weapon"shallmeanafirearmasdefined 114under18U.S.C.Section921andthefollowingitems,asdefinedinsection571.010:a 115blackjack,aconcealablefirearm,anexplosiveweapon,afirearm,afirearmsilencer,agas 116gun,aknife,knuckles,amachinegun,aprojectileweapon,arifle,ashotgun,aspringgunor 117aswitchbladeknife;exceptthatthissectionshallnotbeconstruedtoprohibitaschoolboard 118fromadoptingapolicytoallowaCivilWarreenactortocarryaCivilWareraweaponon 119schoolpropertyforeducationalpurposessolongasthefirearmisunloaded.Thelocalboard 120ofeducationshalldefineweaponinthedisciplinepolicy.Suchdefinitionshallincludethe 121weaponsdefinedinthissubsectionbutmayalsoincludeotherweapons. 122 7.Allschooldistrictpersonnelresponsibleforthecareandsupervisionofstudents 123areauthorizedtoholdeverypupilstrictlyaccountableforanydisorderlyconductinschoolor 124onanypropertyoftheschool,onanyschoolbusgoingtoorreturningfromschool,during 125school-sponsoredactivities,orduringintermissionorrecessperiods. 126 8.Teachersandotherauthorizeddistrictpersonnelinpublicschoolsresponsiblefor 127thecare,supervision,anddisciplineofschoolchildren,includingvolunteersselectedwith 128reasonablecarebytheschooldistrict,shallnotbecivillyliablewhenactinginconformity HB2095 4 129withtheestablishedpoliciesdevelopedbyeachboard,includingbutnotlimitedtopoliciesof 130studentdisciplineorwhenreportingtohisorhersupervisororotherpersonasmandatedby 131statelawactsofschoolviolenceorthreatenedactsofschoolviolence,withinthecourseand 132scopeofthedutiesoftheteacher,authorizeddistrictpersonnelorvolunteer,whensuch 133individualisactinginconformitywiththeestablishedpoliciesdevelopedbytheboard. 134Nothinginthissectionshallbeconstruedtocreateanewcauseofactionagainstsuchschool 135district,ortorelievetheschooldistrictfromliabilityforthenegligentactsofsuchpersons. 136 9.Eachschoolboardshalldefineinitsdisciplinepolicyactsofviolenceandany 137otheractsthatconstituteaseriousviolationofthatpolicy."Actsofviolence"asdefinedby 138schoolboardsshallincludebutnotbelimitedtoexertionofphysicalforcebyastudentwith 139theintenttodoseriousbodilyharmtoanotherpersonwhileonschoolproperty,includinga 140schoolbusinserviceonbehalfofthedistrict,orwhileinvolvedinschoolactivities.School 141districtsshallforeachstudentenrolledintheschooldistrictcompileandmaintainrecordsof 142anyseriousviolationofthedistrict'sdisciplinepolicy.Suchrecordsshallbemadeavailable 143toteachersandotherschooldistrictemployeeswithaneedtoknowwhileactingwithinthe 144scopeoftheirassignedduties,andshallbeprovidedasrequiredinsection167.020toany 145schooldistrictinwhichthestudentsubsequentlyattemptstoenroll. 146 10.Spanking,whenadministeredbycertificatedpersonnelandinthepresenceofa 147witnesswhoisanemployeeoftheschooldistrict,ortheuseofreasonableforcetoprotect 148personsorproperty,whenadministeredbypersonnelofaschooldistrictinareasonable 149mannerinaccordancewiththelocalboardofeducation'swrittenpolicyofdiscipline,isnot 150abusewithinthemeaningofchapter210.[Theprovisionsofsections210.110to210.165 151notwithstanding,thechildren'sdivisionshallnothavejurisdictionoverorinvestigateany 152reportofallegedchildabusearisingoutoforrelatedtotheuseofreasonableforcetoprotect 153personsorpropertywhenadministeredbypersonnelofaschooldistrictoranyspanking 154administeredinareasonablemannerbyanycertificatedschoolpersonnelinthepresenceofa 155witnesswhoisanemployeeoftheschooldistrictpursuanttoawrittenpolicyofdiscipline 156establishedbytheboardofeducationoftheschooldistrict,aslongasnoallegationofsexual 157misconductarisesfromthespankingoruseofforce. 158 11.Ifastudentreportsallegedsexualmisconductonthepartofateacherorother 159schoolemployeetoapersonemployedinaschoolfacilitywhoisrequiredtoreportsuch 160misconducttothechildren'sdivisionundersection210.115,suchpersonandthe 161superintendentoftheschooldistrictshallreporttheallegationtothechildren'sdivisionas 162setforthinsection210.115.Reportsmadetothechildren'sdivisionunderthissubsection 163shallbeinvestigatedbythedivisioninaccordancewiththeprovisionsofsections210.145to 164210.153andshallnotbeinvestigatedbytheschooldistrictundersubsections12to20ofthis 165sectionforpurposesofdeterminingwhethertheallegationsshouldorshouldnotbe HB2095 5 166substantiated.Thedistrictmayinvestigatetheallegationsforthepurposeofmakingany 167decisionregardingtheemploymentoftheaccusedemployee. 168 12.]11.Uponreceiptofanyreportsofchildabusebythechildren'sdivision[other 169thanreportsprovidedundersubsection11ofthissection,] pursuanttosections210.110to 170210.165whichallegedlyinvolvepersonnelofaschooldistrict,thechildren'sdivisionshall 171notifythesuperintendentofschoolsofthedistrictor,ifthepersonnamedinthealleged 172incidentisthesuperintendentofschools,thepresidentoftheschoolboardoftheschool 173districtwheretheallegedincidentoccurred. 174 [13.If,afteraninitialinvestigation,thesuperintendentofschoolsorthepresidentof 175theschoolboardfindsthatthereportinvolvesanallegedincidentofchildabuseotherthanthe 176administrationofaspankingbycertificatedschoolpersonnelortheuseofreasonableforceto 177protectpersonsorpropertywhenadministeredbyschoolpersonnelpursuanttoawritten 178policyofdisciplineorthatthereportwasmadeforthesolepurposeofharassingapublic 179schoolemployee,thesuperintendentofschoolsorthepresidentoftheschoolboardshall 180immediatelyreferthematterbacktothechildren'sdivisionandtakenofurtheraction.Inall 181mattersreferredbacktothechildren'sdivision,thedivisionshalltreatthereportinthesame 182mannerasotherreportsofallegedchildabusereceivedbythedivision. 183 14.Ifthereportpertainstoanallegedincidentwhicharoseoutoforisrelatedtoa 184spankingadministeredbycertificatedpersonnelortheuseofreasonableforcetoprotect 185personsorpropertywhenadministeredbypersonnelofaschooldistrictpursuanttoawritten 186policyofdisciplineorareportmadeforthesolepurposeofharassingapublicschool 187employee,anotificationofthereportedchildabuseshallbesentbythesuperintendentof 188schoolsorthepresidentoftheschoolboardtothelawenforcementinthecountyinwhichthe 189allegedincidentoccurred. 190 15.Thereportshallbejointlyinvestigatedbythelawenforcementofficerandthe 191superintendentofschoolsor,ifthesubjectofthereportisthesuperintendentofschools,bya 192lawenforcementofficerandthepresidentoftheschoolboardorsuchpresident'sdesignee. 193 16.Theinvestigationshallbeginnolaterthanforty-eighthoursafternotificationfrom 194thechildren'sdivisionisreceived,andshallconsistof,butneednotbelimitedto, 195interviewingandrecordingstatementsofthechildandthechild'sparentsorguardianwithin 196twoworkingdaysafterthestartoftheinvestigation,oftheschooldistrictpersonnelallegedly 197involvedinthereport,andofanywitnessestotheallegedincident. 198 17.Thelawenforcementofficerandtheinvestigatingschooldistrictpersonnelshall 199issueseparatereportsoftheirfindingsandrecommendationsaftertheconclusionofthe 200investigationtotheschoolboardoftheschooldistrictwithinsevendaysafterreceivingnotice 201fromthechildren'sdivision. HB2095 6 202 18.Thereportsshallcontainastatementofconclusionastowhetherthereportof 203allegedchildabuseissubstantiatedorisunsubstantiated. 204 19.Theschoolboardshallconsidertheseparatereportsreferredtoinsubsection17 205ofthissectionandshallissueitsfindingsandconclusionsandtheactiontobetaken,ifany, 206withinsevendaysafterreceivingthelastofthetworeports.Thefindingsandconclusions 207shallbemadeinsubstantiallythefollowingform: 208 (1)Thereportoftheallegedchildabuseisunsubstantiated.Thelawenforcement 209officerandtheinvestigatingschoolboardpersonnelagreethattherewasnotapreponderance 210ofevidencetosubstantiatethatabuseoccurred; 211 (2)Thereportoftheallegedchildabuseissubstantiated.Thelawenforcement 212officerandtheinvestigatingschooldistrictpersonnelagreethatthepreponderanceof 213evidenceissufficienttosupportafindingthattheallegedincidentofchildabusedidoccur; 214 (3)Theissueinvolvedintheallegedincidentofchildabuseisunresolved.Thelaw 215enforcementofficerandtheinvestigatingschoolpersonnelareunabletoagreeontheir 216findingsandconclusionsontheallegedincident. 217 20.Thefindingsandconclusionsoftheschoolboardundersubsection19ofthis 218sectionshallbesenttothechildren'sdivision.Ifthefindingsandconclusionsoftheschool 219boardarethatthereportoftheallegedchildabuseisunsubstantiated,theinvestigationshall 220beterminated,thecaseclosed,andnorecordshallbeenteredinthechildren'sdivisioncentral 221registry.Ifthefindingsandconclusionsoftheschoolboardarethatthereportofthealleged 222childabuseissubstantiated,thechildren'sdivisionshallreporttheincidenttotheprosecuting 223attorneyoftheappropriatecountyalongwiththefindingsandconclusionsoftheschool 224districtandshallincludetheinformationinthedivision'scentralregistry.Ifthefindingsand 225conclusionsoftheschoolboardarethattheissueinvolvedintheallegedincidentofchild 226abuseisunresolved,thechildren'sdivisionshallreporttheincidenttotheprosecuting 227attorneyoftheappropriatecountyalongwiththefindingsandconclusionsoftheschool 228board,however,theincidentandthenamesofthepartiesallegedlyinvolvedshallnotbe 229enteredintothecentralregistryofthechildren'sdivisionunlessanduntiltheallegedchild 230abuseissubstantiatedbyacourtofcompetentjurisdiction. 231 21.Anysuperintendentofschools,presidentofaschoolboardorsuchperson's 232designeeorlawenforcementofficerwhoknowinglyfalsifiesanyreportofanymatter 233pursuanttothissectionorwhoknowinglywithholdsanyinformationrelativetoany 234investigationorreportpursuanttothissectionisguiltyofaclassAmisdemeanor. 235 22.]12.Inordertoensurethesafetyofallstudents,shouldastudentbeexpelledfor 236bringingaweapontoschool,violentbehavior,orforanactofschoolviolence,thatstudent HB2095 7 237shallnot,forthepurposesoftheaccreditationprocessoftheMissourischoolimprovement 238plan,beconsideredadropoutorbeincludedinthecalculationofthatdistrict'seducational 239persistenceratio. ✔ HB2095 8
