197.445.1.Thedepartmentmayadoptreasonablerulesand

324.005.1.Notwithstanding anyrequirementsforlicensure
2 forallprofessionalboards,commissions,committees,andoffices
3 withinthedivisionofprofessionalregistrationtothecontrary,
4 aprofessionalwhohasacurrentlicensetopracticefromanother
5 state,commonwealth,territory,ortheDistrictofColumbiashall
6 beexemptfromthelicensurerequirementsofhisorherrespective
7 licensureboardinthisstateif:
8 (1)Theprofessionalisanactivedutyorreservememberof
9 theArmedForcesoftheUnitedStates,amemberoftheNational
10 Guard,acivilianemployeeoftheUnitedStatesDepartmentof
11 Defense,anauthorizedservicescontractorunder10U.S.C.Section
12 1091,oraprofessionalotherwiseauthorizedbytheUnitedStates
13 DepartmentofDefense;
14 (2)Theprofessionalpracticesthesameoccupationor
15 professionatthesamepracticelevelforwhichheorsheholdsa
16 currentlicense;and

4 21 2.Theexemptionprovidedinthissectionshallnotpermita
22 professionaltoengageinpracticeexceptaspartofthefederal
23 InnovativeReadinessTrainingprogramwithintheUnitedStates
24 DepartmentofDefense.Theexemptionshallonlyapplywhile:
25 (1)Theprofessional'spracticeisrequiredbytheprogram
26 pursuanttomilitaryorders;and
27 (2)Theservicesprovidedbytheprofessionalarewithinthe
28 scopeofpracticefortheindividual'srespectiveprofessionin
29 thisstate.
327.312.1.PriortoJanuary1,2024,anypersonmayapply
2 totheboardforenrollmentasalandsurveyor-in-training whoisa
3 highschoolgraduate,orwhoholdsaMissouricertificateofhigh
4 schoolequivalence(GED),andeither:
5 (1)Hasgraduatedandreceivedabaccalaureatedegreeinan
6 approvedcurriculumasdefinedbyboardregulationwhichshall
7 includeatleasttwelvesemesterhoursofapprovedsurveying
8 courseworkasdefinedbyboardregulationofwhichatleasttwo
9 semesterhoursshallbeinthelegalaspectsofboundarysurveying;
10 or
11 (2)Haspassedatleastsixtyhoursofcollegecreditwhich
12 shallincludecreditforatleasttwentysemesterhoursofapproved
13 surveyingcourseworkasdefinedbyboardregulationofwhichat
14 leasttwosemesterhoursshallbeinlegalaspectsofboundary
15 surveyingandpresentevidencesatisfactorytotheboardthatin
16 additiontheretosuchpersonhasatleastoneyearofcombined
17 professionalofficeandfieldexperienceinlandsurveying
18 projectsundertheimmediatepersonalsupervisionofa
5 19 professionallandsurveyor;or
20 (3)Haspassedatleasttwelvesemesterhoursofapproved
21 surveyingcourseworkasdefinedbyboardregulationofwhichat
22 leasttwosemesterhoursshallbeinlegalaspectsofland
23 surveyingandinadditiontheretohasatleasttwoyearsof
24 combinedprofessionalofficeandfieldexperienceinland
25 surveyingprojectsundertheimmediatepersonalsupervisionofa
26 professionallandsurveyor. Pursuanttothisprovision,notmore
27 thanoneyearofsatisfactorypostsecondaryeducationworkshall
28 countasequivalentyearsofsatisfactorylandsurveyingworkas
29 aforementioned.
30 2.Theboardshallissueacertificateofcompletiontoeach
31 applicantwhosatisfiestherequirementsoftheaforementioned
32 landsurveyor-in-training programandpassessuchexaminationor
33 examinationsasshallberequiredbytheboard.
34 3.BeginningJanuary1,2024,anypersonmayapplytothe
35 boardforenrollmentasalandsurveyor-internwhoisahighschool
36 graduate,orwhoholdsacertificateofhighschoolequivalence
37 (GED),andhaspassedanyexaminationrequiredbytheboard
38 pursuanttosection327.331.
327.313.Applicationsforenrollmentasaland[surveyor-in-
2 training] surveyor-intern shallbetypewrittenonprescribedforms
3 furnishedtotheapplicant. Theapplicationshallcontain
4 applicant'sstatementsshowingtheapplicant'seducation,
5 experience,andsuchotherpertinentinformationastheboardmay
6 require.Eachapplicationshallcontainastatementthatitis
7 madeunderoathoraffirmationandthattherepresentations are
6 8 trueandcorrecttothebestknowledgeandbeliefoftheapplicant,
9 subjecttothepenaltiesofmakingafalseaffidavitordeclaration
10 andshallbeaccompaniedbytherequiredfee.
327.314.1.PriortoJanuary1,2024,anypersonmayapply
2 totheboardforlicensureasaprofessionallandsurveyorwhohas
3 beenenrolledasalandsurveyor-in-training andhaspresented
4 evidencetothesatisfactionoftheboardthatsaidpersonhas
5 acquiredatleastfouryearsofsatisfactoryprofessionalfield
6 andofficeexperienceinlandsurveyingfromthedateofenrollment
7 asalandsurveyor-in-training. Thisexperienceshallhavebeen
8 undertheimmediatepersonalsupervisionofaprofessionalland
9 surveyor.
10 2.BeginningJanuary1,2024,anypersonmayapplytothe
11 boardforlicensurewhopresentsevidencesatisfactorytothe
12 boardthattheapplicanthasmettherequirementsasprovidedin
13 thissubsection:
14 (1)Anapplicantshallbeahighschoolgraduateorholda
15 certificateofhighschoolequivalence(GED),andeither:
16 (a)Hasgraduatedandreceivedabaccalaureatedegreeinan
17 approvedcurriculum,asdefinedbytheboard,whichshallinclude
18 atleastfifteensemesterhoursofapprovedsurveyingcoursework,
19 asdefinedbytheboard,ofwhichatleastsixsemesterhoursshall
20 beinthelegalaspectsofboundarysurveying;or
21 (b)Haspassedatleastsixtyhoursofcollegecreditwhich
22 shallincludeatleastfifteensemesterhoursofapproved
23 surveyingcoursework,asdefinedbytheboard,ofwhichatleast
24 sixsemesterhoursshallbeinlegalaspectsofboundarysurveying;

26 (c)Haspassedatleastfifteensemesterhoursofapproved

327.331.1.Afterithasbeendeterminedthatanapplicant
8 2 possessesthequalificationsentitlingtheapplicanttobe
3 examined,eachapplicantforexaminationandenrollmentasaland
4 surveyor-in-training andforexaminationandlicensureasa
5 professionallandsurveyorinMissourishallappearbeforethe
6 boardoritsrepresentatives forexaminationatthetimeandplace
7 specified.
8 2.Theexaminationorexaminationsshallbeofsuchform,
9 contentanddurationasshallbedeterminedbytheboardto
10 thoroughlytestthequalificationsofeachapplicanttobecome
11 enrolledasaland[surveyor-in-training]	surveyor-intern orto
12 becomelicensedasaprofessionallandsurveyorinMissouri.
13 3.Anyapplicanttobeeligibleforenrollmentorforlicense
14 mustmakeagradeontheapplicableexaminationofatleastseventy
15 percent.
16 4.Anypersonwhopassestheexaminationhereinabove
17 specifiedshallbeentitledtobeenrolledasaland[surveyor-in-
18 training] surveyor-intern orlicensedasaprofessionalland
19 surveyor,asthecasemaybe,inMissouriandshallreceivea
20 certificateofenrollmentoralicense,asthecasemaybe.
332.325.1.TheMissouridentalboardmaycollaboratewith
2 thedepartmentofhealthandseniorservicesandtheofficeof
3 dentalhealthwithinthedepartmentofhealthandseniorservices
4 toapprovepilotprojectsdesignedtoexaminenewmethodsof
5 extendingcaretomedicallyunderservedpopulations,asdefinedin
6 42U.S.C.Section300e-1(7). Thesepilotprojectsmayemploy
7 techniquesorapproachestocarethatmaynecessitateawaiverof
8 therequirementsofthischapterandregulationspromulgated
9 9 thereunder;provided:
10 (1)Theprojectplanhasaclearlystatedobjectiveof
11 servingaspecificunderservedpopulationthatwarrants,inthe
12 opinionofamajorityoftheboard,grantingapprovalforapilot
13 project;
14 (2)Theprojecthasafinitestartdateandterminationdate;
15 (3)Theprojectclearlydefinesthenewtechniquesor
16 approachesitintendstoexaminetodetermineifitresultsinan
17 improvementinaccessorqualityofcare;
18 (4)Theprojectplanidentifiesspecificandlimited
19 locationsandpopulationstoparticipateinthepilotproject;
20 (5)Theprojectplanclearlyestablishesminimumguidelines
21 andstandardsforthepilotproject,including,butnotlimitedto,
22 provisionsforprotectingsafetyofparticipatingpatients;
23 (6)Theprojectplanclearlydefinesthemeasurement
24 criteriaitwillusetoevaluatetheoutcomesofthepilotproject
25 onaccessandqualityofcare;and
26 (7)Theprojectplanidentifiesreportingintervalsto
27 communicateinterimandfinaloutcomestotheboard.
28 2.Theboardmaypromulgaterulesandregulationsto
29 implementtheprovisionsofthissection.Anyruleorportionofa
30 rule,asthattermisdefinedinsection536.010,thatiscreated
31 undertheauthoritydelegatedinthissectionshallbecome
32 effectiveonlyifitcomplieswithandissubjecttoallofthe
33 provisionsofchapter536and,ifapplicable,section536.028.
34 Thissectionandchapter536arenonseverableandifanyofthe
35 powersvestedwiththegeneralassemblypursuanttochapter536to
10 36 review,todelaytheeffectivedate,ortodisapproveandannula
37 rulearesubsequentlyheldunconstitutional, thenthegrantof
38 rulemakingauthorityandanyruleproposedoradoptedafterAugust
39 28,2022,shallbeinvalidandvoid.
40 3.TheprovisionsofthissectionshallexpireonAugust28,
41 2026.Theboardshallprovideafinalreportonapprovedprojects
42 andrelateddataorfindingstothegeneralassemblyonorbefore
43 December31,2025.Thename,location,approvaldates,andgeneral
44 descriptionofanapprovedpilotprojectshallbedeemedapublic
45 recordpursuanttochapter610.
334.530.1.Acandidateforlicensetopracticeasa
2 physicaltherapistshallfurnishevidenceofsuchperson's
3 educationalqualificationsbysubmittingsatisfactoryevidenceof
4 completionofaprogramofphysicaltherapyeducationapprovedas
5 reputablebytheboardoreligibilitytograduatefromsucha
6 programwithinninetydays.Acandidatewhopresentssatisfactory
7 evidenceoftheperson'sgraduationfromaschoolofphysical
8 therapyapprovedasreputablebytheAmericanMedicalAssociation
9 or,ifgraduatedbefore1936,bytheAmericanPhysicalTherapy
10 Association,orifgraduatedafter1988,theCommissionon
11 AccreditationforPhysicalTherapyEducationoritssuccessor,is
12 deemedtohavecompliedwiththeeducationalqualificationsof
13 thissubsection.
14 2.Personsdesiringtopracticeasphysicaltherapistsin
15 thisstateshallappearbeforetheboardatsuchtimeandplaceas
16 theboardmaydirectandbeexaminedastotheirfitnesstoengage
17 insuchpractice. Applicantsshallmeetthequalifyingstandards
11 18 forsuchexaminations,includinganyrequirementsestablishedby
19 anyentitycontractedbytheboardtoadministertheboard-
20 approvedexamination. Applicationsforexaminationshallbein
21 writing,onaformfurnishedbytheboardandshallinclude
22 evidencesatisfactorytotheboardthattheapplicantpossesses
23 thequalificationssetforthinsubsection1ofthissectionand
24 meetstherequirementsestablishedtoqualifyforexamination.
25 Eachapplicationshallcontainastatementthatitismadeunder
26 oathoraffirmationandthatitsrepresentations aretrueand
27 correcttothebestknowledgeandbeliefoftheapplicant,subject
28 tothepenaltiesofmakingafalseaffidavitordeclaration.
29 3.Theexaminationofqualifiedcandidatesforlicensesto
30 practicephysicaltherapyshalltestentry-levelcompetenceas
31 relatedtophysicaltherapytheory,examinationandevaluation,
32 physicaltherapydiagnosis,prognosis,treatment,intervention,
33 prevention,andconsultation.
34 4.Theexaminationshallembrace,inrelationtothehuman
35 being,thesubjectsofanatomy,chemistry,kinesiology,pathology,
36 physics,physiology,psychology,physicaltherapytheoryand
37 proceduresasrelatedtomedicine,surgeryandpsychiatry,and
38 suchothersubjects,includingmedicalethics,astheboarddeems
39 usefultotestthefitnessofthecandidatetopracticephysical
40 therapy.
41 5.Nopersonwhohasfailedonsixormoreoccasionsto
42 achieveapassingscoreontheexaminationrequiredbythissection
43 shallbeeligibleforlicensurebyexaminationunderthissection.
44 6.Theapplicantshallpassatestadministeredbytheboard
12 45 onthelawsandrulesrelatedtothepracticeofphysicaltherapy
46 inMissouri.
334.655.1.Acandidateforlicensuretopracticeasa
2 physicaltherapistassistantshallfurnishevidenceofthe
3 person'seducationalqualifications. Theeducationalrequirements
4 forlicensureasaphysicaltherapistassistantare:
5 (1)Acertificateofgraduationfromanaccreditedhigh
6 schooloritsequivalent;and
7 (2)Satisfactoryevidenceofcompletionofanassociate
8 degreeprogramofphysicaltherapyeducationaccreditedbythe
9 commissiononaccreditationofphysicaltherapyeducationor
10 eligibilitytograduatefromsuchaprogramwithinninetydays.
11 2.Personsdesiringtopracticeasaphysicaltherapist
12 assistantinthisstateshallappearbeforetheboardatsuchtime
13 andplaceastheboardmaydirectandbeexaminedastothe
14 person'sfitnesstoengageinsuchpractice.Applicantsshallmeet
15 thequalifyingstandardsforsuchexaminations,includingany
16 requirementsestablishedbyanyentitycontractedbytheboardto
17 administertheboard-approvedexamination. Applicationsfor
18 examinationshallbeonaformfurnishedbytheboardandshall
19 includeevidencesatisfactorytotheboardthattheapplicant
20 possessesthequalificationsprovidedinsubsection1ofthis
21 sectionandmeetstherequirementsestablishedtoqualifyfor
22 examination. Eachapplicationshallcontainastatementthatthe
23 statementismadeunderoathofaffirmationandthatits
24 representations aretrueandcorrecttothebestknowledgeand
25 beliefofthepersonsigningthestatement,subjecttothe
13 26 penaltiesofmakingafalseaffidavitordeclaration.
27 3.Theexaminationofqualifiedcandidatesforlicensureto
28 practiceasphysicaltherapistassistantsshallembracean
29 examinationwhichshallcoverthecurriculumtaughtinaccredited
30 associatedegreeprogramsofphysicaltherapyassistanteducation.
31 Suchexaminationshallbesufficienttotestthequalificationof
32 thecandidatesaspractitioners.
33 4.Theexaminationshallinclude,asrelatedtothehuman
34 body,thesubjectsofanatomy,kinesiology,pathology,physiology,
35 psychology,physicaltherapytheoryandproceduresasrelatedto
36 medicineandsuchothersubjects,includingmedicalethics,asthe
37 boarddeemsusefultotestthefitnessofthecandidatetopractice
38 asaphysicaltherapistassistant.
39 5.Nopersonwhohasfailedonsixormoreoccasionsto
40 achieveapassingscoreontheexaminationrequiredbythissection
41 shallbeeligibleforlicensurebyexaminationunderthissection.
42 6.Theapplicantshallpassatestadministeredbytheboard
43 onthelawsandrulesrelatedtothepracticeasaphysical
44 therapistassistantinthisstate.
45 [6.] 7.Theboardshalllicensewithoutexaminationany
46 legallyqualifiedpersonwhoisaresidentofthisstateandwho
47 wasactivelyengagedinpracticeasaphysicaltherapistassistant
48 onAugust28,1993.Theboardmaylicensesuchpersonpursuantto
49 thissubsectionuntilninetydaysaftertheeffectivedateofthis
50 section.
51 [7.] 8.Acandidatetopracticeasaphysicaltherapist
52 assistantwhodoesnotmeettheeducationalqualificationsmay
14 53 submittotheboardanapplicationforexaminationifsuchperson
54 canfurnishwrittenevidencetotheboardthatthepersonhasbeen
55 employedinthisstateforatleastthreeofthelastfiveyears
56 underthesupervisionofalicensedphysicaltherapistandsuch
57 personpossessestheknowledgeandtrainingequivalenttothat
58 obtainedinanaccreditedschool.Theboardmaylicensesuch
59 personspursuanttothissubsectionuntilninetydaysafterrules
60 developedbythestateboardofhealingartsregardingphysical
61 therapistassistantlicensingbecomeeffective.
338.055.1.Theboardmayrefusetoissueanycertificateof
2 registrationorauthority,permitorlicenserequiredpursuantto
3 thischapterforoneoranycombinationofcausesstatedin
4 subsection2ofthissectionorifthedesignatedpharmacist-in-
5 charge,manager-in-charge, oranyofficer,owner,manager,or
6 controllingshareholderoftheapplicanthascommittedanyactor
7 practiceinsubsection2ofthissection.Theboardshallnotify
8 theapplicantinwritingofthereasonsfortherefusalandshall
9 advisetheapplicantofhisorherrighttofileacomplaintwith
10 theadministrativehearingcommissionasprovidedbychapter621.
11 2.Theboardmaycauseacomplainttobefiledwiththe
12 administrativehearingcommissionasprovidedbychapter621

793 limitedtothepowersgrantedtotheCommissionrelatingto

795 Commissionshallmeetandexerciserulemakingpowersnecessaryto

797 B.AnystatethatjoinstheCompactsubsequenttothe
798 Commission'sinitialadoptionoftherulesshallbesubjecttothe
799 rulesastheyexistonthedateonwhichtheCompactbecomeslawin
800 thatstate.Anyrulethathasbeenpreviouslyadoptedbythe
801 Commissionshallhavethefullforceandeffectoflawontheday

803 C.AnymemberstatemaywithdrawfromthisCompactby

805 1.Amemberstate'swithdrawalshallnottakeeffectuntil

821 SECTION13.CONSTRUCTIONANDSEVERABILITY
822 ThisCompactshallbeliberallyconstruedsoastoeffectuate
823 thepurposesthereof.TheprovisionsofthisCompactshallbe
824 severableandifanyphrase,clause,sentenceorprovisionofthis
825 Compactisdeclaredtobecontrarytotheconstitutionofany
826 memberstateoroftheUnitedStatesortheapplicabilitythereof
827 toanygovernment,agency,personorcircumstanceisheldinvalid,
828 thevalidityoftheremainderofthisCompactandtheapplicability

835 SECTION14.BINDINGEFFECTOFCOMPACTANDOTHERLAWS
836 A.Nothinghereinpreventstheenforcementofanyotherlaw
837 ofamemberstatethatisnotinconsistentwiththeCompact.
838 B.AlllawsinamemberstateinconflictwiththeCompact
839 aresupersededtotheextentoftheconflict.
840 C.AlllawfulactionsoftheCommission,includingallrules
841 andbylawspromulgatedbytheCommission,arebindinguponthe
842 memberstates.
843 D.AllagreementsbetweentheCommissionandthemember
844 statesarebindinginaccordancewiththeirterms.
