Applicantsshallmeetthequalifyingstandards 18 forsuchexaminations,includinganyrequirementsestablishedby 19 anyentitycontractedbytheboardtoadministertheboard- 20 approvedexamination. Theeducationalrequirements 4 forlicensureasaphysicaltherapistassistantare: 5 (1)Acertificateofgraduationfromanaccreditedhigh 6 schooloritsequivalent;and 7 (2)Satisfactoryevidenceofcompletionofanassociate 8 degreeprogramofphysicaltherapyeducationaccreditedbythe 9 commissiononaccreditationofphysicaltherapyeducationor 10 eligibilitytograduatefromsuchaprogramwithinninetydays. 11 2.Personsdesiringtopracticeasaphysicaltherapist 24 12 assistantinthisstateshallappearbeforetheboardatsuchtime 13 andplaceastheboardmaydirectandbeexaminedastothe 14 person'sfitnesstoengageinsuchpractice.Applicantsshallmeet 15 thequalifyingstandardsforsuchexaminations,includingany 16 requirementsestablishedbyanyentitycontractedbytheboardto 17 administertheboard-approvedexamination. Applicationsfor 18 examinationshallbeonaformfurnishedbytheboardandshall 19 includeevidencesatisfactorytotheboardthattheapplicant 20 possessesthequalificationsprovidedinsubsection1ofthis 21 sectionandmeetstherequirementsestablishedtoqualifyfor 22 examination. 1.Increasepublicaccesstoaudiologyandspeech-language 13 pathologyservicesbyprovidingforthemutualrecognitionof 14 othermemberstatelicenses; 15 2.Enhancethestates'abilitytoprotectthepublic'shealth 16 andsafety; 17 3.Encouragethecooperationofmemberstatesinregulating 18 multistateaudiologyandspeech-language pathologypractice; 19 4.Supportspousesofrelocatingactivedutymilitary 20 personnel; 46 21 activeuniformedserviceoftheUnitedStates,includingmembers 34 oftheNationalGuardandReserveonactivedutyorderspursuantto 35 10U.S.C.Chapter1209and1211. 36 B."Adverseaction"meansanyadministrative, civil, 37 equitableorcriminalactionpermittedbyastate'slawswhichis 38 imposedbyalicensingboardorotherauthorityagainstan 39 audiologistorspeech-language pathologist,includingactions 40 againstanindividual'slicenseorprivilegetopracticesuchas 41 revocation,suspension,probation,monitoringofthelicensee,or 42 restrictiononthelicensee'spractice. 43 120 servicesatadistanceforassessment,interventionand/or 121 consultation. 122 SECTION3.STATEPARTICIPATIONINTHECOMPACT 123 A.Alicenseissuedtoanaudiologistorspeech-language 124 pathologistbyahomestatetoaresidentinthatstateshallbe 125 recognizedbyeachmemberstateasauthorizinganaudiologistor 126 speech-language pathologisttopracticeaudiologyorspeech- 127 languagepathology,underaprivilegetopractice,ineachmember 128 state. 50 129 B.Astatemustimplementorutilizeproceduresfor 130 consideringthecriminalhistoryrecordsofapplicantsforinitial 131 privilegetopractice. 254 2.Havenoencumbranceonanystatelicense; 255 3.Beeligibleforacompactprivilegeinanymemberstatein 256 accordancewithSection3; 257 4.Havenothadanyadverseactionagainstanylicenseor 258 compactprivilegewithintheprevious2yearsfromdateof 259 application; Aremotestatemay,inaccordancewithdue 299 processandthatstate'slaws,removealicensee'scompact 300 privilegeintheremotestateforaspecificperiodoftime,impose 301 fines,and/ortakeanyothernecessaryactionstoprotectthe 302 healthandsafetyofitscitizens. 303 J.Ifahomestatelicenseisencumbered,thelicenseeshall 304 losethecompactprivilegeinanyremotestateuntilthefollowing 305 occur: 306 1.Thehomestatelicenseisnolongerencumbered;and 307 2.Twoyearshaveelapsedfromthedateoftheadverse 308 action. 309 K.Onceanencumberedlicenseinthehomestateisrestored 310 togoodstanding,thelicenseemustmeettherequirementsof 311 Section4Atoobtainacompactprivilegeinanyremotestate. 312 L.OncetherequirementsofSection4Jhavebeenmet,the 313 licenseemustmeettherequirementsinSection4Atoobtaina 314 compactprivilegeinaremotestate. 315 SECTION5.COMPACTPRIVILEGETOPRACTICETELEHEALTH 316 Memberstatesshallrecognizetherightofanaudiologistor 317 speech-language pathologist,licensedbyahomestatein 57 318 accordancewithSection3andunderrulespromulgatedbythe 319 Commission,topracticeaudiologyorspeech-language pathologyin 320 anymemberstateviatelehealthunderaprivilegetopracticeas 321 providedintheCompactandrulespromulgatedbytheCommission. 322 SECTION6.ACTIVEDUTYMILITARYPERSONNELORTHEIRSPOUSES 323 Activedutymilitarypersonnel,ortheirspouse,shall 324 designateahomestatewheretheindividualhasacurrentlicense 325 ingoodstanding. Theindividualmayretainthehomestate 326 designationduringtheperiodtheservicememberisonactiveduty. 327 Subsequenttodesignatingahomestate,theindividualshallonly 328 changetheirhomestatethroughapplicationforlicensureinthe 329 newstate. 330 SECTION7.ADVERSEACTIONS 331 A.Inadditiontotheotherpowersconferredbystatelaw,a 332 remotestateshallhavetheauthority,inaccordancewithexisting 333 statedueprocesslaw,to: 334 1.Takeadverseactionagainstanaudiologist'sorspeech- 335 languagepathologist'sprivilegetopracticewithinthatmember 336 state. 337 2.Issuesubpoenasforbothhearingsandinvestigationsthat 338 requiretheattendanceandtestimonyofwitnessesaswellasthe 339 productionofevidence.Subpoenasissuedbyalicensingboardina 340 memberstatefortheattendanceandtestimonyofwitnessesorthe 341 productionofevidencefromanothermemberstateshallbeenforced 342 inthelatterstatebyanycourtofcompetentjurisdiction, 343 accordingtothepracticeandprocedureofthatcourtapplicableto 344 subpoenasissuedinproceedingspendingbeforeit.Theissuing 58 345 authorityshallpayanywitnessfees,travelexpenses,mileageand 346 otherfeesrequiredbytheservicestatutesofthestateinwhich 347 thewitnessesorevidencearelocated. 348 3.Onlythehomestateshallhavethepowertotakeadverse 349 actionagainstanaudiologist'sorspeech-language pathologist's 350 licenseissuedbythehomestate. 351 B.Forpurposesoftakingadverseaction,thehomestate 352 shallgivethesamepriorityandeffecttoreportedconduct 353 receivedfromamemberstateasitwouldiftheconducthad 354 occurredwithinthehomestate.Insodoing,thehomestateshall 355 applyitsownstatelawstodetermineappropriateaction. 356 C.Thehomestateshallcompleteanypendinginvestigations 357 ofanaudiologistorspeech-language pathologistwhochanges 358 primarystateofresidenceduringthecourseofthe 359 investigations. TheCommissionmaypursueanyotherremedies 786 availableunderfederalorstatelaw. 787 SECTION12.DATEOFIMPLEMENTATIONOFTHEINTERSTATE 788 COMMISSIONFORAUDIOLOGYANDSPEECH-LANGUAGE PATHOLOGYPRACTICE 789 ANDASSOCIATEDRULES,WITHDRAWAL,ANDAMENDMENT 790 A.TheCompactshallcomeintoeffectonthedateonwhich 791 theCompactstatuteisenactedintolawinthe10thmemberstate. 792 Theprovisions,whichbecomeeffectiveatthattime,shallbe 793 limitedtothepowersgrantedtotheCommissionrelatingto 794 assemblyandthepromulgationofrules.Thereafter,the 795 Commissionshallmeetandexerciserulemakingpowersnecessaryto 796 theimplementationandadministrationoftheCompact. 797 B.AnystatethatjoinstheCompactsubsequenttothe 798 Commission'sinitialadoptionoftherulesshallbesubjecttothe 799 rulesastheyexistonthedateonwhichtheCompactbecomeslawin 800 thatstate.Anyrulethathasbeenpreviouslyadoptedbythe 801 Commissionshallhavethefullforceandeffectoflawontheday 802 theCompactbecomeslawinthatstate. 803 C.AnymemberstatemaywithdrawfromthisCompactby 75 804 enactingastatuterepealingthesame. 805 1.Amemberstate'swithdrawalshallnottakeeffectuntil 806 six(6)monthsafterenactmentoftherepealingstatute. 807 2.Withdrawalshallnotaffectthecontinuingrequirementof 808 thewithdrawingstate'saudiologyorspeech-language pathology 809 licensingboardtocomplywiththeinvestigativeandadverse 810 actionreportingrequirementsofthisactpriortotheeffective 811 dateofwithdrawal. 812 D.NothingcontainedinthisCompactshallbeconstruedto 813 invalidateorpreventanyaudiologyorspeech-language pathology 814 licensureagreementorothercooperativearrangementbetweena 815 memberstateandanon-memberstatethatdoesnotconflictwiththe 816 provisionsofthisCompact. 817 E.ThisCompactmaybeamendedbythememberstates.No 818 amendmenttothisCompactshallbecomeeffectiveandbindingupon 819 anymemberstateuntilitisenactedintothelawsofallmember 820 states. 821 SECTION13.CONSTRUCTIONANDSEVERABILITY 822 ThisCompactshallbeliberallyconstruedsoastoeffectuate 823 thepurposesthereof.TheprovisionsofthisCompactshallbe 824 severableandifanyphrase,clause,sentenceorprovisionofthis 825 Compactisdeclaredtobecontrarytotheconstitutionofany 826 memberstateoroftheUnitedStatesortheapplicabilitythereof 827 toanygovernment,agency,personorcircumstanceisheldinvalid, 828 thevalidityoftheremainderofthisCompactandtheapplicability 829 thereoftoanygovernment,agency,personorcircumstanceshall 830 notbeaffectedthereby.IfthisCompactshallbeheldcontraryto 76 831 theconstitutionofanymemberstate,theCompactshallremainin 832 fullforceandeffectastotheremainingmemberstatesandinfull 833 forceandeffectastothememberstateaffectedastoall 834 severablematters. 835 SECTION14.BINDINGEFFECTOFCOMPACTANDOTHERLAWS 836 A.Nothinghereinpreventstheenforcementofanyotherlaw 837 ofamemberstatethatisnotinconsistentwiththeCompact. 838 B.AlllawsinamemberstateinconflictwiththeCompact 839 aresupersededtotheextentoftheconflict. 840 C.AlllawfulactionsoftheCommission,includingallrules 841 andbylawspromulgatedbytheCommission,arebindinguponthe 842 memberstates. 843 D.AllagreementsbetweentheCommissionandthemember 844 statesarebindinginaccordancewiththeirterms. 845 E.IntheeventanyprovisionoftheCompactexceedsthe 846 constitutionallimitsimposedonthelegislatureofanymember 847 state,theprovisionshallbeineffectivetotheextentofthe 848 conflictwiththeconstitutionalprovisioninquestioninthat 849 memberstate.
