AN ACT
To repeal sections 197.400, 197.445, 327.312, 327.313, 327.314, 327.331, 334.100, 334.530,
334.655, 338.055, 345.015, and 345.050, RSMo, and to enact in lieu thereof seventeen
new sections relating to professional licensing, with an emergency clause for a certain
section.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Sections 197.400, 197.445, 327.312, 327.313, 327.314, 327.331, 334.100,
2 334.530, 334.655, 338.055, 345.015, and 345.050, RSMo, are repealed and seventeen new
3 sections enacted in lieu thereof, to be known as sections 197.400, 197.445, 324.005, 327.312,
4 327.313, 327.314, 327.331, 332.325, 334.100, 334.530, 334.655, 338.055, 345.015, 345.022,
5 345.050, 345.052, and 345.085, to read as follows:
197.400. As used in sections 197.400 to 197.475, unless the context otherwise
2 requires, the following terms mean:
3 (1) "Council", the home health services advisory council created by sections 197.400
4 to 197.475;
5 (2) "Department", the department of health and senior services;
6 (3) "Home health agency", a public agency or private organization or a subdivision or
7 subunit of an agency or organization that provides two or more home health services at the
8 residence of a patient according to a[physician's] written[and signed] plan of treatment
9signed by a physician, nurse practitioner, clinical nurse specialist, or physician assistant;
EXPLANATION — Matter enclosed in bold-faced brackets[thus] in the above bill is not enacted and is
intended to be omitted from the law. Matter inbold-facetype in the above bill is proposed language. 10 (4)"Homehealthservices",anyofthefollowingitemsandservicesprovidedatthe
11residenceofthepatientonapart-timeorintermittentbasis:nursing,physicaltherapy,speech
12therapy,occupationaltherapy,homehealthaid,ormedicalsocialservice;
13 (5)"Nursepractitioner,clinicalnursespecialist",apersonrecognizedbythe
14stateboardofnursingpursuanttotheprovisionsofchapter335topracticeinthisstate
15asanursepractitionerorclinicalnursespecialist;
16 (6)"Part-timeorintermittentbasis",theprovidingofhomehealthservicesinan
17interruptedintervalsequenceontheaverageofnottoexceedthreehoursinanytwenty-four-
18hourperiod;
19 [(6)](7)"Patient'sresidence",theactualplaceofresidenceofthepersonreceiving
20homehealthservices,includinginstitutionalresidencesaswellasindividualdwellingunits;
21 [(7)](8)"Physician",apersonlicensedbythestateboardofregistrationforthe
22healingartspursuanttotheprovisionsofchapter334topracticeinthisstateasaphysician
23andsurgeon;
24 (9)"Physicianassistant",apersonlicensedbythestateboardofregistrationfor
25thehealingartspursuanttotheprovisionsofchapter334topracticeinthisstateasa
26physicianassistant;
27 [(8)](10)"Planoftreatment",aplanreviewedandsignedasoftenas[medically]
28necessarybyaphysician[or],podiatrist,nursepractitioner,clinicalnursespecialist,ora
29physicianassistant,nottoexceedsixtydaysinduration,andreviewedbyaphysicianat
30leastonceeverysixmonths,prescribingitemsandservicesforanindividualpatient's
31condition;
32 [(9)](11)"Podiatrist",apersonlicensedbythestateboardofpodiatrypursuanttothe
33provisionsofchapter330topracticeinthisstateasapodiatrist;
34 [(10)] (12)"Subunit"or"subdivision",anyorganizationalunitofalarger
35organizationwhichcanbeclearlydefinedasaseparateentitywithinthelargerstructure,
36whichcanmeetalloftherequirementsofsections197.400to197.475independentofthe
37largerorganization,whichcanbeheldaccountableforthecareofpatientsitisserving,and
38whichprovidestoallpatientscareandservicesmeetingthestandardsandrequirementsof
39sections197.400to197.475.
197.445.1.Thedepartmentmayadoptreasonablerulesandstandardsnecessaryto
2carryouttheprovisionsofsections197.400to197.477.Therulesandstandardsadopted
3shallnotbelessthanthestandardsestablishedbythefederalgovernmentforhomehealth
4agenciesunderTitleXVIIIoftheFederalSocialSecurityAct.Thereasonablerulesand
5standardsshallbeinitiallypromulgatedwithinoneyearofSeptember28,1983.
6 2.Therulesandstandardsadoptedbythedepartmentpursuanttotheprovisionsof
7sections197.400to197.477shallapplytoallhealthservicescoveredbysections197.400to
CCS#2SSHB2149	2 8197.477renderedtoanypatientbeingservedbyahomehealthagencyregardlessofsourceof
9paymentfortheservice,patient'scondition,orplaceofresidence,atwhichthehomehealth
10servicesareorderedbythephysician[or],podiatrist, nursepractitioner,clinicalnurse
11specialist,orphysicianassistant. Noruleorportionofarulepromulgatedpursuanttothe
12authorityofsections197.400to197.477shallbecomeeffectiveunlessithasbeen
13promulgatedpursuanttotheprovisionsofsection536.024.
324.005.1.Notwithstandinganyrequirementsforlicensureforallprofessional
2boards,commissions,committees,andofficeswithinthedivisionofprofessional
3registrationtothecontrary,aprofessionalwhohasacurrentlicensetopracticefrom
4anotherstate,commonwealth,territory,ortheDistrictofColumbiashallbeexempt
5fromthelicensurerequirementsofhisorherrespectivelicensureboardinthisstateif:
6 (1)TheprofessionalisanactivedutyorreservememberoftheArmedForcesof
7theUnitedStates,amemberoftheNationalGuard,acivilianemployeeoftheUnited
8StatesDepartmentofDefense,anauthorizedservicescontractorunder10U.S.C.
9Section1091,oraprofessionalotherwiseauthorizedbytheUnitedStatesDepartmentof
10Defense;
11 (2)Theprofessionalpracticesthesameoccupationorprofessionatthesame
12practicelevelforwhichheorsheholdsacurrentlicense;and
13 (3)Theprofessionalisengagedinthepracticeofaprofessionalthrougha
14partnershipwiththefederalInnovativeReadinessTrainingprogramwithintheUnited
15StatesDepartmentofDefense.
16 2.Theexemptionprovidedinthissectionshallnotpermitaprofessionalto
17engageinpracticeexceptaspartofthefederalInnovativeReadinessTrainingprogram
18withintheUnitedStatesDepartmentofDefense.Theexemptionshallonlyapplywhile:
19 (1)Theprofessional'spracticeisrequiredbytheprogrampursuanttomilitary
20orders;and
21 (2)Theservicesprovidedbytheprofessionalarewithinthescopeofpracticefor
22theindividual'srespectiveprofessioninthisstate.
327.312.1.PriortoJanuary1,2024,anypersonmayapplytotheboardfor
2enrollmentasalandsurveyor-in-trainingwhoisahighschoolgraduate,orwhoholdsa
3Missouricertificateofhighschoolequivalence(GED),andeither:
4 (1)Hasgraduatedandreceivedabaccalaureatedegreeinanapprovedcurriculumas
5definedbyboardregulationwhichshallincludeatleasttwelvesemesterhoursofapproved
6surveyingcourseworkasdefinedbyboardregulationofwhichatleasttwosemesterhours
7shallbeinthelegalaspectsofboundarysurveying;or
8 (2)Haspassedatleastsixtyhoursofcollegecreditwhichshallincludecreditforat
9leasttwentysemesterhoursofapprovedsurveyingcourseworkasdefinedbyboard
CCS#2SSHB2149	3 10regulationofwhichatleasttwosemesterhoursshallbeinlegalaspectsofboundary
11surveyingandpresentevidencesatisfactorytotheboardthatinadditiontheretosuchperson
12hasatleastoneyearofcombinedprofessionalofficeandfieldexperienceinlandsurveying
13projectsundertheimmediatepersonalsupervisionofaprofessionallandsurveyor;or
14 (3)Haspassedatleasttwelvesemesterhoursofapprovedsurveyingcourseworkas
15definedbyboardregulationofwhichatleasttwosemesterhoursshallbeinlegalaspectsof
16landsurveyingandinadditiontheretohasatleasttwoyearsofcombinedprofessionaloffice
17andfieldexperienceinlandsurveyingprojectsundertheimmediatepersonalsupervisionofa
18professionallandsurveyor.Pursuanttothisprovision,notmorethanoneyearofsatisfactory
19postsecondaryeducationworkshallcountasequivalentyearsofsatisfactorylandsurveying
20workasaforementioned.
21 2.Theboardshallissueacertificateofcompletiontoeachapplicantwhosatisfiesthe
22requirementsoftheaforementionedlandsurveyor-in-trainingprogramandpassessuch
23examinationorexaminationsasshallberequiredbytheboard.
24 3.BeginningJanuary1,2024,anypersonmayapplytotheboardforenrollment
25asalandsurveyor-internwhoisahighschoolgraduate,orwhoholdsacertificateof
26highschoolequivalence(GED),andhaspassedanyexaminationrequiredbytheboard
27pursuanttosection327.331.
327.313.Applicationsforenrollmentasaland[surveyor-in-training] surveyor-
2internshallbetypewrittenonprescribedformsfurnishedtotheapplicant.Theapplication
3shallcontainapplicant'sstatementsshowingtheapplicant'seducation,experience,andsuch
4otherpertinentinformationastheboardmayrequire.Eachapplicationshallcontaina
5statementthatitismadeunderoathoraffirmationandthattherepresentationsaretrueand
6correcttothebestknowledgeandbeliefoftheapplicant,subjecttothepenaltiesofmakinga
7falseaffidavitordeclarationandshallbeaccompaniedbytherequiredfee.
327.314.1.PriortoJanuary1,2024,anypersonmayapplytotheboardfor
2licensureasaprofessionallandsurveyorwhohasbeenenrolledasalandsurveyor-in-training
3andhaspresentedevidencetothesatisfactionoftheboardthatsaidpersonhasacquiredat
4leastfouryearsofsatisfactoryprofessionalfieldandofficeexperienceinlandsurveyingfrom
5thedateofenrollmentasalandsurveyor-in-training.Thisexperienceshallhavebeenunder
6theimmediatepersonalsupervisionofaprofessionallandsurveyor.
7 2.BeginningJanuary1,2024,anypersonmayapplytotheboardforlicensure
8whopresentsevidencesatisfactorytotheboardthattheapplicanthasmetthe
9requirementsasprovidedinthissubsection:
10 (1)Anapplicantshallbeahighschoolgraduateorholdacertificateofhigh
11schoolequivalence(GED),andeither:
CCS#2SSHB2149	4 12 (a)Hasgraduatedandreceivedabaccalaureatedegreeinanapproved
13curriculum,asdefinedbytheboard,whichshallincludeatleastfifteensemesterhours
14ofapprovedsurveyingcoursework,asdefinedbytheboard,ofwhichatleastsix
15semesterhoursshallbeinthelegalaspectsofboundarysurveying;or
16 (b)Haspassedatleastsixtyhoursofcollegecreditwhichshallincludeatleast
17fifteensemesterhoursofapprovedsurveyingcoursework,asdefinedbytheboard,of
18whichatleastsixsemesterhoursshallbeinlegalaspectsofboundarysurveying;or
19 (c)Haspassedatleastfifteensemesterhoursofapprovedsurveyingcoursework,
20asdefinedbytheboard,ofwhichatleastsixsemesterhoursshallbeinlegalaspectsof
21landsurveying;
22 (d)Anapplicantmeetingtherequirementsofparagraph(a)ofthissubdivision
23shallhaveacquiredatleastfouryearsofsatisfactoryfieldandofficeexperienceinland
24surveyingundertheimmediatepersonalsupervisionofaprofessionallandsurveyor;
25 (e)Anapplicantmeetingtherequirementsofparagraph(b)ofthissubdivision
26shallhaveacquiredatleastfiveyearsofsatisfactoryfieldandofficeexperienceinland
27surveyingundertheimmediatepersonalsupervisionofaprofessionallandsurveyor;
28 (f)Anapplicantmeetingtherequirementsofparagraph(c)ofthissubdivision
29shallhaveacquiredatleastsixyearsofsatisfactoryfieldandofficeexperienceinland
30surveyingundertheimmediatepersonalsupervisionofaprofessionallandsurveyor.
31Pursuanttothisprovision,uptooneyearofpost-secondaryeducation,approvedbythe
32board,maycountasequivalentworkexperience;
33 (2)Anapplicantshallpassanyexaminationsrequiredbytheboardpursuantto
34section327.331;
35 (3)Anypersonenrolledasalandsurveyor-in-trainingpriortoJanuary1,2024,
36shallonlyberequiredtomeettherequirementsinplacepursuanttotheirenrollment.
327.331.1.Afterithasbeendeterminedthatanapplicantpossessesthe
2qualificationsentitlingtheapplicanttobeexamined,eachapplicantforexaminationand
3enrollmentasalandsurveyor-in-trainingandforexaminationandlicensureasaprofessional
4landsurveyorinMissourishallappearbeforetheboardoritsrepresentativesforexamination
5atthetimeandplacespecified.
6 2.Theexaminationorexaminationsshallbeofsuchform,contentanddurationas
7shallbedeterminedbytheboardtothoroughlytestthequalificationsofeachapplicantto
8becomeenrolledasaland[surveyor-in-training] surveyor-internortobecomelicensedasa
9professionallandsurveyorinMissouri.
10 3.Anyapplicanttobeeligibleforenrollmentorforlicensemustmakeagradeonthe
11applicableexaminationofatleastseventypercent.
CCS#2SSHB2149	5 12 4.Anypersonwhopassestheexaminationhereinabovespecifiedshallbeentitledto
13beenrolledasaland[surveyor-in-training] surveyor-internorlicensedasaprofessionalland
14surveyor,asthecasemaybe,inMissouriandshallreceiveacertificateofenrollmentora
15license,asthecasemaybe.
332.325.1.TheMissouridentalboardmaycollaboratewiththedepartmentof
2healthandseniorservicesandtheofficeofdentalhealthwithinthedepartmentofhealth
3andseniorservicestoapprovepilotprojectsdesignedtoexaminenewmethodsof
4extendingcaretomedicallyunderservedpopulations,asdefinedin42U.S.C.Section
5300e-1(7).Thesepilotprojectsmayemploytechniquesorapproachestocarethatmay
6necessitateawaiveroftherequirementsofthischapterandregulationspromulgated
7thereunder;provided:
8 (1)Theprojectplanhasaclearlystatedobjectiveofservingaspecific
9underservedpopulationthatwarrants,intheopinionofamajorityoftheboard,
10grantingapprovalforapilotproject;
11 (2)Theprojecthasafinitestartdateandterminationdate;
12 (3)Theprojectclearlydefinesthenewtechniquesorapproachesitintendsto
13examinetodetermineifitresultsinanimprovementinaccessorqualityofcare;
14 (4)Theprojectplanidentifiesspecificandlimitedlocationsandpopulationsto
15participateinthepilotproject;
16 (5)Theprojectplanclearlyestablishesminimumguidelinesandstandardsfor
17thepilotproject,including,butnotlimitedto,provisionsforprotectingsafetyof
18participatingpatients;
19 (6)Theprojectplanclearlydefinesthemeasurementcriteriaitwilluseto
20evaluatetheoutcomesofthepilotprojectonaccessandqualityofcare;and
21 (7)Theprojectplanidentifiesreportingintervalstocommunicateinterimand
22finaloutcomestotheboard.
23 2.Theboardmaypromulgaterulesandregulationstoimplementtheprovisions
24ofthissection.Anyruleorportionofarule,asthattermisdefinedinsection536.010,
25thatiscreatedundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyif
26itcomplieswithandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,
27section536.028.Thissectionandchapter536arenonseverableandifanyofthepowers
28vestedwiththegeneralassemblypursuanttochapter536toreview,todelaythe
29effectivedate,ortodisapproveandannularulearesubsequentlyheldunconstitutional,
30thenthegrantofrulemakingauthorityandanyruleproposedoradoptedafterAugust
3128,2022,shallbeinvalidandvoid.
32 3.TheprovisionsofthissectionshallexpireonAugust28,2026.Theboardshall
33provideafinalreportonapprovedprojectsandrelateddataorfindingstothegeneral
CCS#2SSHB2149	6 34assemblyonorbeforeDecember31,2025.Thename,location,approvaldates,and
35generaldescriptionofanapprovedpilotprojectshallbedeemedapublicrecord
36pursuanttochapter610.
334.100.1.Theboardmayrefusetoissueorrenewanycertificateofregistrationor
2authority,permitorlicenserequiredpursuanttothischapterforoneoranycombinationof
3causesstatedinsubsection2ofthissection.Theboardshallnotifytheapplicantinwritingof
4thereasonsfortherefusalandshalladvisetheapplicantoftheapplicant'srighttofilea
5complaintwiththeadministrativehearingcommissionasprovidedbychapter621.Asan
6alternativetoarefusaltoissueorrenewanycertificate,registrationorauthority,theboard
7may,atitsdiscretion,issuealicensewhichissubjecttoprobation,restrictionorlimitationto
8anapplicantforlicensureforanyoneoranycombinationofcausesstatedinsubsection2of
9thissection.Theboard'sorderofprobation,limitationorrestrictionshallcontainastatement
10ofthedisciplineimposed,thebasistherefor,thedatesuchactionshallbecomeeffective,anda
11statementthattheapplicanthasthirtydaystorequestinwritingahearingbeforethe
12administrativehearingcommission.Iftheboardissuesaprobationary,limitedorrestricted
13licensetoanapplicantforlicensure,eitherpartymayfileawrittenpetitionwiththe
14administrativehearingcommissionwithinthirtydaysoftheeffectivedateoftheprobationary,
15limitedorrestrictedlicenseseekingreviewoftheboard'sdetermination.Ifnowrittenrequest
16forahearingisreceivedbytheadministrativehearingcommissionwithinthethirty-day
17period,therighttoseekreviewoftheboard'sdecisionshallbeconsideredaswaived.
18 2.Theboardmaycauseacomplainttobefiledwiththeadministrativehearing
19commissionasprovidedbychapter621againstanyholderofanycertificateofregistrationor
20authority,permitorlicenserequiredbythischapteroranypersonwhohasfailedtorenewor
21hassurrenderedtheperson'scertificateofregistrationorauthority,permitorlicenseforany
22oneoranycombinationofthefollowingcauses:
23 (1)Useofanycontrolledsubstance,asdefinedinchapter195,oralcoholicbeverage
24toanextentthatsuchuseimpairsaperson'sabilitytoperformtheworkofanyprofession
25licensedorregulatedbythischapter;
26 (2)Thepersonhasbeenfinallyadjudicatedandfoundguilty,orenteredapleaof
27guiltyornolocontendere,inacriminalprosecutionunderthelawsofanystateorofthe
28UnitedStates,foranyoffensereasonablyrelatedtothequalifications,functionsordutiesof
29anyprofessionlicensedorregulatedpursuanttothischapter,foranyoffenseinvolvingfraud,
30dishonestyoranactofviolence,orforanyoffenseinvolvingmoralturpitude,whetherornot
31sentenceisimposed;
32 (3)Useoffraud,deception,misrepresentationorbriberyinsecuringanycertificateof
33registrationorauthority,permitorlicenseissuedpursuanttothischapterorinobtaining
34permissiontotakeanyexaminationgivenorrequiredpursuanttothischapter;

36unprofessionalconductintheperformanceofthefunctionsordutiesofanyprofession
37licensedorregulatedbythischapter,including,butnotlimitedto,thefollowing:
38 (a)Obtainingorattemptingtoobtainanyfee,charge,tuitionorothercompensation
39byfraud,deceptionormisrepresentation;willfullyandcontinuallyoverchargingor
40overtreatingpatients;orchargingforvisitstothephysician'sofficewhichdidnotoccur
41unlesstheserviceswerecontractedforinadvance,orforserviceswhichwerenotrenderedor
42documentedinthepatient'srecords;
43 (b)Attempting,directlyorindirectly,bywayofintimidation,coercionordeception,
44toobtainorretainapatientordiscouragetheuseofasecondopinionorconsultation;
45 (c)Willfullyandcontinuallyperforminginappropriateorunnecessarytreatment,
46diagnostictestsormedicalorsurgicalservices;
47 (d)Delegatingprofessionalresponsibilitiestoapersonwhoisnotqualifiedby
48training,skill,competency,age,experienceorlicensuretoperformsuchresponsibilities;
49 (e)Misrepresentingthatanydisease,ailmentorinfirmitycanbecuredbyamethod,
50procedure,treatment,medicineordevice;
51 (f)Performingorprescribingmedicalserviceswhichhavebeendeclaredbyboard
52ruletobeofnomedicalorosteopathicvalue;
53 (g)Finaldisciplinaryactionbyanyprofessionalmedicalorosteopathicassociationor
54societyorlicensedhospitalormedicalstaffofsuchhospitalinthisoranyotherstateor
55territory,whetheragreedtovoluntarilyornot,andincluding,butnotlimitedto,anyremoval,
56suspension,limitation,orrestrictionoftheperson'slicenseorstafforhospitalprivileges,
57failuretorenewsuchprivilegesorlicenseforcause,orotherfinaldisciplinaryaction,ifthe
58actionwasinanywayrelatedtounprofessionalconduct,professionalincompetence,
59malpracticeoranyotherviolationofanyprovisionofthischapter;
60 (h)Signingablankprescriptionform;ordispensing,prescribing,administeringor
61otherwisedistributinganydrug,controlledsubstanceorothertreatmentwithoutsufficient
62examinationincludingfailingtoestablishavalidphysician-patientrelationshippursuantto
63section334.108,orforotherthanmedicallyacceptedtherapeuticorexperimentalor
64investigativepurposesdulyauthorizedbyastateorfederalagency,ornotinthecourseof
65professionalpractice,ornotingoodfaithtorelievepainandsuffering,ornottocurean
66ailment,physicalinfirmityordisease,exceptasauthorizedinsection334.104;
67 (i)Exercisinginfluencewithinaphysician-patientrelationshipforpurposesof
68engagingapatientinsexualactivity;
69 (j)Beinglistedonanystateorfederalsexualoffenderregistry;
70 (k)Terminatingthemedicalcareofapatientwithoutadequatenoticeorwithout
71makingotherarrangementsforthecontinuedcareofthepatient;

91 (5)Anyconductorpracticewhichisormightbeharmfulordangeroustothemental
92orphysicalhealthofapatientorthepublic;orincompetency,grossnegligenceorrepeated
93negligenceintheperformanceofthefunctionsordutiesofanyprofessionlicensedor
94regulatedbythischapter.Forthepurposesofthissubdivision,"repeatednegligence"means
95thefailure,onmorethanoneoccasion,tousethatdegreeofskillandlearningordinarilyused

441 8.FinancingoftheCommission:

456 10.TheCommissionshallkeepaccurateaccountsofallreceiptsand
457disbursements.ThereceiptsanddisbursementsoftheCommissionshallbesubject
458totheauditandaccountingproceduresestablishedunderitsbylaws.However,all
459receiptsanddisbursementsoffundshandledbytheCommissionshallbeauditedyearly
