4028H.06T SECOND REGULAR SESSION [TRULY AGREED TO AND FINALLY PASSED] CONFERENCE COMMITTEE SUBSTITUTE NO. 2 FOR SENATE SUBSTITUTE FOR HOUSE BILL NO. 2149 101ST GENERAL ASSEMBLY 2022 AN ACT To repeal sections 197.400, 197.445, 327.312, 327.313, 327.314, 327.331, 334.100, 334.530, 334.655, 338.055, 345.015, and 345.050, RSMo, and to enact in lieu thereof seventeen new sections relating to professional licensing, with an emergency clause for a certain section. Be it enacted by the General Assembly of the state of Missouri, as follows: Section A. Sections 197.400, 197.445, 327.312, 327.313, 327.314, 327.331, 334.100, 2 334.530, 334.655, 338.055, 345.015, and 345.050, RSMo, are repealed and seventeen new 3 sections enacted in lieu thereof, to be known as sections 197.400, 197.445, 324.005, 327.312, 4 327.313, 327.314, 327.331, 332.325, 334.100, 334.530, 334.655, 338.055, 345.015, 345.022, 5 345.050, 345.052, and 345.085, to read as follows: 197.400. As used in sections 197.400 to 197.475, unless the context otherwise 2 requires, the following terms mean: 3 (1) "Council", the home health services advisory council created by sections 197.400 4 to 197.475; 5 (2) "Department", the department of health and senior services; 6 (3) "Home health agency", a public agency or private organization or a subdivision or 7 subunit of an agency or organization that provides two or more home health services at the 8 residence of a patient according to a[physician's] written[and signed] plan of treatment 9signed by a physician, nurse practitioner, clinical nurse specialist, or physician assistant; EXPLANATION — Matter enclosed in bold-faced brackets[thus] in the above bill is not enacted and is intended to be omitted from the law. Matter inbold-facetype in the above bill is proposed language. 10 (4)"Homehealthservices",anyofthefollowingitemsandservicesprovidedatthe 11residenceofthepatientonapart-timeorintermittentbasis:nursing,physicaltherapy,speech 12therapy,occupationaltherapy,homehealthaid,ormedicalsocialservice; 13 (5)"Nursepractitioner,clinicalnursespecialist",apersonrecognizedbythe 14stateboardofnursingpursuanttotheprovisionsofchapter335topracticeinthisstate 15asanursepractitionerorclinicalnursespecialist; 16 (6)"Part-timeorintermittentbasis",theprovidingofhomehealthservicesinan 17interruptedintervalsequenceontheaverageofnottoexceedthreehoursinanytwenty-four- 18hourperiod; 19 [(6)](7)"Patient'sresidence",theactualplaceofresidenceofthepersonreceiving 20homehealthservices,includinginstitutionalresidencesaswellasindividualdwellingunits; 21 [(7)](8)"Physician",apersonlicensedbythestateboardofregistrationforthe 22healingartspursuanttotheprovisionsofchapter334topracticeinthisstateasaphysician 23andsurgeon; 24 (9)"Physicianassistant",apersonlicensedbythestateboardofregistrationfor 25thehealingartspursuanttotheprovisionsofchapter334topracticeinthisstateasa 26physicianassistant; 27 [(8)](10)"Planoftreatment",aplanreviewedandsignedasoftenas[medically] 28necessarybyaphysician[or],podiatrist,nursepractitioner,clinicalnursespecialist,ora 29physicianassistant,nottoexceedsixtydaysinduration,andreviewedbyaphysicianat 30leastonceeverysixmonths,prescribingitemsandservicesforanindividualpatient's 31condition; 32 [(9)](11)"Podiatrist",apersonlicensedbythestateboardofpodiatrypursuanttothe 33provisionsofchapter330topracticeinthisstateasapodiatrist; 34 [(10)] (12)"Subunit"or"subdivision",anyorganizationalunitofalarger 35organizationwhichcanbeclearlydefinedasaseparateentitywithinthelargerstructure, 36whichcanmeetalloftherequirementsofsections197.400to197.475independentofthe 37largerorganization,whichcanbeheldaccountableforthecareofpatientsitisserving,and 38whichprovidestoallpatientscareandservicesmeetingthestandardsandrequirementsof 39sections197.400to197.475. 197.445.1.Thedepartmentmayadoptreasonablerulesandstandardsnecessaryto 2carryouttheprovisionsofsections197.400to197.477.Therulesandstandardsadopted 3shallnotbelessthanthestandardsestablishedbythefederalgovernmentforhomehealth 4agenciesunderTitleXVIIIoftheFederalSocialSecurityAct.Thereasonablerulesand 5standardsshallbeinitiallypromulgatedwithinoneyearofSeptember28,1983. 6 2.Therulesandstandardsadoptedbythedepartmentpursuanttotheprovisionsof 7sections197.400to197.477shallapplytoallhealthservicescoveredbysections197.400to CCS#2SSHB2149 2 8197.477renderedtoanypatientbeingservedbyahomehealthagencyregardlessofsourceof 9paymentfortheservice,patient'scondition,orplaceofresidence,atwhichthehomehealth 10servicesareorderedbythephysician[or],podiatrist, nursepractitioner,clinicalnurse 11specialist,orphysicianassistant. Noruleorportionofarulepromulgatedpursuanttothe 12authorityofsections197.400to197.477shallbecomeeffectiveunlessithasbeen 13promulgatedpursuanttotheprovisionsofsection536.024. 324.005.1.Notwithstandinganyrequirementsforlicensureforallprofessional 2boards,commissions,committees,andofficeswithinthedivisionofprofessional 3registrationtothecontrary,aprofessionalwhohasacurrentlicensetopracticefrom 4anotherstate,commonwealth,territory,ortheDistrictofColumbiashallbeexempt 5fromthelicensurerequirementsofhisorherrespectivelicensureboardinthisstateif: 6 (1)TheprofessionalisanactivedutyorreservememberoftheArmedForcesof 7theUnitedStates,amemberoftheNationalGuard,acivilianemployeeoftheUnited 8StatesDepartmentofDefense,anauthorizedservicescontractorunder10U.S.C. 9Section1091,oraprofessionalotherwiseauthorizedbytheUnitedStatesDepartmentof 10Defense; 11 (2)Theprofessionalpracticesthesameoccupationorprofessionatthesame 12practicelevelforwhichheorsheholdsacurrentlicense;and 13 (3)Theprofessionalisengagedinthepracticeofaprofessionalthrougha 14partnershipwiththefederalInnovativeReadinessTrainingprogramwithintheUnited 15StatesDepartmentofDefense. 16 2.Theexemptionprovidedinthissectionshallnotpermitaprofessionalto 17engageinpracticeexceptaspartofthefederalInnovativeReadinessTrainingprogram 18withintheUnitedStatesDepartmentofDefense.Theexemptionshallonlyapplywhile: 19 (1)Theprofessional'spracticeisrequiredbytheprogrampursuanttomilitary 20orders;and 21 (2)Theservicesprovidedbytheprofessionalarewithinthescopeofpracticefor 22theindividual'srespectiveprofessioninthisstate. 327.312.1.PriortoJanuary1,2024,anypersonmayapplytotheboardfor 2enrollmentasalandsurveyor-in-trainingwhoisahighschoolgraduate,orwhoholdsa 3Missouricertificateofhighschoolequivalence(GED),andeither: 4 (1)Hasgraduatedandreceivedabaccalaureatedegreeinanapprovedcurriculumas 5definedbyboardregulationwhichshallincludeatleasttwelvesemesterhoursofapproved 6surveyingcourseworkasdefinedbyboardregulationofwhichatleasttwosemesterhours 7shallbeinthelegalaspectsofboundarysurveying;or 8 (2)Haspassedatleastsixtyhoursofcollegecreditwhichshallincludecreditforat 9leasttwentysemesterhoursofapprovedsurveyingcourseworkasdefinedbyboard CCS#2SSHB2149 3 10regulationofwhichatleasttwosemesterhoursshallbeinlegalaspectsofboundary 11surveyingandpresentevidencesatisfactorytotheboardthatinadditiontheretosuchperson 12hasatleastoneyearofcombinedprofessionalofficeandfieldexperienceinlandsurveying 13projectsundertheimmediatepersonalsupervisionofaprofessionallandsurveyor;or 14 (3)Haspassedatleasttwelvesemesterhoursofapprovedsurveyingcourseworkas 15definedbyboardregulationofwhichatleasttwosemesterhoursshallbeinlegalaspectsof 16landsurveyingandinadditiontheretohasatleasttwoyearsofcombinedprofessionaloffice 17andfieldexperienceinlandsurveyingprojectsundertheimmediatepersonalsupervisionofa 18professionallandsurveyor.Pursuanttothisprovision,notmorethanoneyearofsatisfactory 19postsecondaryeducationworkshallcountasequivalentyearsofsatisfactorylandsurveying 20workasaforementioned. 21 2.Theboardshallissueacertificateofcompletiontoeachapplicantwhosatisfiesthe 22requirementsoftheaforementionedlandsurveyor-in-trainingprogramandpassessuch 23examinationorexaminationsasshallberequiredbytheboard. 24 3.BeginningJanuary1,2024,anypersonmayapplytotheboardforenrollment 25asalandsurveyor-internwhoisahighschoolgraduate,orwhoholdsacertificateof 26highschoolequivalence(GED),andhaspassedanyexaminationrequiredbytheboard 27pursuanttosection327.331. 327.313.Applicationsforenrollmentasaland[surveyor-in-training] surveyor- 2internshallbetypewrittenonprescribedformsfurnishedtotheapplicant.Theapplication 3shallcontainapplicant'sstatementsshowingtheapplicant'seducation,experience,andsuch 4otherpertinentinformationastheboardmayrequire.Eachapplicationshallcontaina 5statementthatitismadeunderoathoraffirmationandthattherepresentationsaretrueand 6correcttothebestknowledgeandbeliefoftheapplicant,subjecttothepenaltiesofmakinga 7falseaffidavitordeclarationandshallbeaccompaniedbytherequiredfee. 327.314.1.PriortoJanuary1,2024,anypersonmayapplytotheboardfor 2licensureasaprofessionallandsurveyorwhohasbeenenrolledasalandsurveyor-in-training 3andhaspresentedevidencetothesatisfactionoftheboardthatsaidpersonhasacquiredat 4leastfouryearsofsatisfactoryprofessionalfieldandofficeexperienceinlandsurveyingfrom 5thedateofenrollmentasalandsurveyor-in-training.Thisexperienceshallhavebeenunder 6theimmediatepersonalsupervisionofaprofessionallandsurveyor. 7 2.BeginningJanuary1,2024,anypersonmayapplytotheboardforlicensure 8whopresentsevidencesatisfactorytotheboardthattheapplicanthasmetthe 9requirementsasprovidedinthissubsection: 10 (1)Anapplicantshallbeahighschoolgraduateorholdacertificateofhigh 11schoolequivalence(GED),andeither: CCS#2SSHB2149 4 12 (a)Hasgraduatedandreceivedabaccalaureatedegreeinanapproved 13curriculum,asdefinedbytheboard,whichshallincludeatleastfifteensemesterhours 14ofapprovedsurveyingcoursework,asdefinedbytheboard,ofwhichatleastsix 15semesterhoursshallbeinthelegalaspectsofboundarysurveying;or 16 (b)Haspassedatleastsixtyhoursofcollegecreditwhichshallincludeatleast 17fifteensemesterhoursofapprovedsurveyingcoursework,asdefinedbytheboard,of 18whichatleastsixsemesterhoursshallbeinlegalaspectsofboundarysurveying;or 19 (c)Haspassedatleastfifteensemesterhoursofapprovedsurveyingcoursework, 20asdefinedbytheboard,ofwhichatleastsixsemesterhoursshallbeinlegalaspectsof 21landsurveying; 22 (d)Anapplicantmeetingtherequirementsofparagraph(a)ofthissubdivision 23shallhaveacquiredatleastfouryearsofsatisfactoryfieldandofficeexperienceinland 24surveyingundertheimmediatepersonalsupervisionofaprofessionallandsurveyor; 25 (e)Anapplicantmeetingtherequirementsofparagraph(b)ofthissubdivision 26shallhaveacquiredatleastfiveyearsofsatisfactoryfieldandofficeexperienceinland 27surveyingundertheimmediatepersonalsupervisionofaprofessionallandsurveyor; 28 (f)Anapplicantmeetingtherequirementsofparagraph(c)ofthissubdivision 29shallhaveacquiredatleastsixyearsofsatisfactoryfieldandofficeexperienceinland 30surveyingundertheimmediatepersonalsupervisionofaprofessionallandsurveyor. 31Pursuanttothisprovision,uptooneyearofpost-secondaryeducation,approvedbythe 32board,maycountasequivalentworkexperience; 33 (2)Anapplicantshallpassanyexaminationsrequiredbytheboardpursuantto 34section327.331; 35 (3)Anypersonenrolledasalandsurveyor-in-trainingpriortoJanuary1,2024, 36shallonlyberequiredtomeettherequirementsinplacepursuanttotheirenrollment. 327.331.1.Afterithasbeendeterminedthatanapplicantpossessesthe 2qualificationsentitlingtheapplicanttobeexamined,eachapplicantforexaminationand 3enrollmentasalandsurveyor-in-trainingandforexaminationandlicensureasaprofessional 4landsurveyorinMissourishallappearbeforetheboardoritsrepresentativesforexamination 5atthetimeandplacespecified. 6 2.Theexaminationorexaminationsshallbeofsuchform,contentanddurationas 7shallbedeterminedbytheboardtothoroughlytestthequalificationsofeachapplicantto 8becomeenrolledasaland[surveyor-in-training] surveyor-internortobecomelicensedasa 9professionallandsurveyorinMissouri. 10 3.Anyapplicanttobeeligibleforenrollmentorforlicensemustmakeagradeonthe 11applicableexaminationofatleastseventypercent. CCS#2SSHB2149 5 12 4.Anypersonwhopassestheexaminationhereinabovespecifiedshallbeentitledto 13beenrolledasaland[surveyor-in-training] surveyor-internorlicensedasaprofessionalland 14surveyor,asthecasemaybe,inMissouriandshallreceiveacertificateofenrollmentora 15license,asthecasemaybe. 332.325.1.TheMissouridentalboardmaycollaboratewiththedepartmentof 2healthandseniorservicesandtheofficeofdentalhealthwithinthedepartmentofhealth 3andseniorservicestoapprovepilotprojectsdesignedtoexaminenewmethodsof 4extendingcaretomedicallyunderservedpopulations,asdefinedin42U.S.C.Section 5300e-1(7).Thesepilotprojectsmayemploytechniquesorapproachestocarethatmay 6necessitateawaiveroftherequirementsofthischapterandregulationspromulgated 7thereunder;provided: 8 (1)Theprojectplanhasaclearlystatedobjectiveofservingaspecific 9underservedpopulationthatwarrants,intheopinionofamajorityoftheboard, 10grantingapprovalforapilotproject; 11 (2)Theprojecthasafinitestartdateandterminationdate; 12 (3)Theprojectclearlydefinesthenewtechniquesorapproachesitintendsto 13examinetodetermineifitresultsinanimprovementinaccessorqualityofcare; 14 (4)Theprojectplanidentifiesspecificandlimitedlocationsandpopulationsto 15participateinthepilotproject; 16 (5)Theprojectplanclearlyestablishesminimumguidelinesandstandardsfor 17thepilotproject,including,butnotlimitedto,provisionsforprotectingsafetyof 18participatingpatients; 19 (6)Theprojectplanclearlydefinesthemeasurementcriteriaitwilluseto 20evaluatetheoutcomesofthepilotprojectonaccessandqualityofcare;and 21 (7)Theprojectplanidentifiesreportingintervalstocommunicateinterimand 22finaloutcomestotheboard. 23 2.Theboardmaypromulgaterulesandregulationstoimplementtheprovisions 24ofthissection.Anyruleorportionofarule,asthattermisdefinedinsection536.010, 25thatiscreatedundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyif 26itcomplieswithandissubjecttoalloftheprovisionsofchapter536and,ifapplicable, 27section536.028.Thissectionandchapter536arenonseverableandifanyofthepowers 28vestedwiththegeneralassemblypursuanttochapter536toreview,todelaythe 29effectivedate,ortodisapproveandannularulearesubsequentlyheldunconstitutional, 30thenthegrantofrulemakingauthorityandanyruleproposedoradoptedafterAugust 3128,2022,shallbeinvalidandvoid. 32 3.TheprovisionsofthissectionshallexpireonAugust28,2026.Theboardshall 33provideafinalreportonapprovedprojectsandrelateddataorfindingstothegeneral CCS#2SSHB2149 6 34assemblyonorbeforeDecember31,2025.Thename,location,approvaldates,and 35generaldescriptionofanapprovedpilotprojectshallbedeemedapublicrecord 36pursuanttochapter610. 334.100.1.Theboardmayrefusetoissueorrenewanycertificateofregistrationor 2authority,permitorlicenserequiredpursuanttothischapterforoneoranycombinationof 3causesstatedinsubsection2ofthissection.Theboardshallnotifytheapplicantinwritingof 4thereasonsfortherefusalandshalladvisetheapplicantoftheapplicant'srighttofilea 5complaintwiththeadministrativehearingcommissionasprovidedbychapter621.Asan 6alternativetoarefusaltoissueorrenewanycertificate,registrationorauthority,theboard 7may,atitsdiscretion,issuealicensewhichissubjecttoprobation,restrictionorlimitationto 8anapplicantforlicensureforanyoneoranycombinationofcausesstatedinsubsection2of 9thissection.Theboard'sorderofprobation,limitationorrestrictionshallcontainastatement 10ofthedisciplineimposed,thebasistherefor,thedatesuchactionshallbecomeeffective,anda 11statementthattheapplicanthasthirtydaystorequestinwritingahearingbeforethe 12administrativehearingcommission.Iftheboardissuesaprobationary,limitedorrestricted 13licensetoanapplicantforlicensure,eitherpartymayfileawrittenpetitionwiththe 14administrativehearingcommissionwithinthirtydaysoftheeffectivedateoftheprobationary, 15limitedorrestrictedlicenseseekingreviewoftheboard'sdetermination.Ifnowrittenrequest 16forahearingisreceivedbytheadministrativehearingcommissionwithinthethirty-day 17period,therighttoseekreviewoftheboard'sdecisionshallbeconsideredaswaived. 18 2.Theboardmaycauseacomplainttobefiledwiththeadministrativehearing 19commissionasprovidedbychapter621againstanyholderofanycertificateofregistrationor 20authority,permitorlicenserequiredbythischapteroranypersonwhohasfailedtorenewor 21hassurrenderedtheperson'scertificateofregistrationorauthority,permitorlicenseforany 22oneoranycombinationofthefollowingcauses: 23 (1)Useofanycontrolledsubstance,asdefinedinchapter195,oralcoholicbeverage 24toanextentthatsuchuseimpairsaperson'sabilitytoperformtheworkofanyprofession 25licensedorregulatedbythischapter; 26 (2)Thepersonhasbeenfinallyadjudicatedandfoundguilty,orenteredapleaof 27guiltyornolocontendere,inacriminalprosecutionunderthelawsofanystateorofthe 28UnitedStates,foranyoffensereasonablyrelatedtothequalifications,functionsordutiesof 29anyprofessionlicensedorregulatedpursuanttothischapter,foranyoffenseinvolvingfraud, 30dishonestyoranactofviolence,orforanyoffenseinvolvingmoralturpitude,whetherornot 31sentenceisimposed; 32 (3)Useoffraud,deception,misrepresentationorbriberyinsecuringanycertificateof 33registrationorauthority,permitorlicenseissuedpursuanttothischapterorinobtaining 34permissiontotakeanyexaminationgivenorrequiredpursuanttothischapter; CCS#2SSHB2149 7 35 (4)Misconduct,fraud,misrepresentation,dishonesty,unethicalconductor 36unprofessionalconductintheperformanceofthefunctionsordutiesofanyprofession 37licensedorregulatedbythischapter,including,butnotlimitedto,thefollowing: 38 (a)Obtainingorattemptingtoobtainanyfee,charge,tuitionorothercompensation 39byfraud,deceptionormisrepresentation;willfullyandcontinuallyoverchargingor 40overtreatingpatients;orchargingforvisitstothephysician'sofficewhichdidnotoccur 41unlesstheserviceswerecontractedforinadvance,orforserviceswhichwerenotrenderedor 42documentedinthepatient'srecords; 43 (b)Attempting,directlyorindirectly,bywayofintimidation,coercionordeception, 44toobtainorretainapatientordiscouragetheuseofasecondopinionorconsultation; 45 (c)Willfullyandcontinuallyperforminginappropriateorunnecessarytreatment, 46diagnostictestsormedicalorsurgicalservices; 47 (d)Delegatingprofessionalresponsibilitiestoapersonwhoisnotqualifiedby 48training,skill,competency,age,experienceorlicensuretoperformsuchresponsibilities; 49 (e)Misrepresentingthatanydisease,ailmentorinfirmitycanbecuredbyamethod, 50procedure,treatment,medicineordevice; 51 (f)Performingorprescribingmedicalserviceswhichhavebeendeclaredbyboard 52ruletobeofnomedicalorosteopathicvalue; 53 (g)Finaldisciplinaryactionbyanyprofessionalmedicalorosteopathicassociationor 54societyorlicensedhospitalormedicalstaffofsuchhospitalinthisoranyotherstateor 55territory,whetheragreedtovoluntarilyornot,andincluding,butnotlimitedto,anyremoval, 56suspension,limitation,orrestrictionoftheperson'slicenseorstafforhospitalprivileges, 57failuretorenewsuchprivilegesorlicenseforcause,orotherfinaldisciplinaryaction,ifthe 58actionwasinanywayrelatedtounprofessionalconduct,professionalincompetence, 59malpracticeoranyotherviolationofanyprovisionofthischapter; 60 (h)Signingablankprescriptionform;ordispensing,prescribing,administeringor 61otherwisedistributinganydrug,controlledsubstanceorothertreatmentwithoutsufficient 62examinationincludingfailingtoestablishavalidphysician-patientrelationshippursuantto 63section334.108,orforotherthanmedicallyacceptedtherapeuticorexperimentalor 64investigativepurposesdulyauthorizedbyastateorfederalagency,ornotinthecourseof 65professionalpractice,ornotingoodfaithtorelievepainandsuffering,ornottocurean 66ailment,physicalinfirmityordisease,exceptasauthorizedinsection334.104; 67 (i)Exercisinginfluencewithinaphysician-patientrelationshipforpurposesof 68engagingapatientinsexualactivity; 69 (j)Beinglistedonanystateorfederalsexualoffenderregistry; 70 (k)Terminatingthemedicalcareofapatientwithoutadequatenoticeorwithout 71makingotherarrangementsforthecontinuedcareofthepatient; 90 (s)Anyotherconductthatisunethicalorunprofessionalinvolvingaminor; 91 (5)Anyconductorpracticewhichisormightbeharmfulordangeroustothemental 92orphysicalhealthofapatientorthepublic;orincompetency,grossnegligenceorrepeated 93negligenceintheperformanceofthefunctionsordutiesofanyprofessionlicensedor 94regulatedbythischapter.Forthepurposesofthissubdivision,"repeatednegligence"means 95thefailure,onmorethanoneoccasion,tousethatdegreeofskillandlearningordinarilyused 96underthesameorsimilarcircumstancesbythememberoftheapplicant'sorlicensee's 97profession; Acandidatewhopresents 5satisfactoryevidenceoftheperson'sgraduationfromaschoolofphysicaltherapyapprovedas 6reputablebytheAmericanMedicalAssociationor,ifgraduatedbefore1936,bytheAmerican 7PhysicalTherapyAssociation,orifgraduatedafter1988,theCommissiononAccreditation 8forPhysicalTherapyEducationoritssuccessor,isdeemedtohavecompliedwiththe 9educationalqualificationsofthissubsection. 10 2.Personsdesiringtopracticeasphysicaltherapistsinthisstateshallappearbefore 11theboardatsuchtimeandplaceastheboardmaydirectandbeexaminedastotheirfitnessto 12engageinsuchpractice.Applicantsshallmeetthequalifyingstandardsforsuch 13examinations,includinganyrequirementsestablishedbyanyentitycontractedbythe 14boardtoadministertheboard-approvedexamination.Applicationsforexaminationshall 15beinwriting,onaformfurnishedbytheboardandshallincludeevidencesatisfactorytothe 16boardthattheapplicantpossessesthequalificationssetforthinsubsection1ofthissection 17andmeetstherequirementsestablishedtoqualifyforexamination. Eachapplication 18shallcontainastatementthatitismadeunderoathoraffirmationandthatitsrepresentations 19aretrueandcorrecttothebestknowledgeandbeliefoftheapplicant,subjecttothepenalties 20ofmakingafalseaffidavitordeclaration. 21 3.Theexaminationofqualifiedcandidatesforlicensestopracticephysicaltherapy 22shalltestentry-levelcompetenceasrelatedtophysicaltherapytheory,examinationand 23evaluation,physicaltherapydiagnosis,prognosis,treatment,intervention,prevention,and 24consultation. 25 4.Theexaminationshallembrace,inrelationtothehumanbeing,thesubjectsof 26anatomy,chemistry,kinesiology,pathology,physics,physiology,psychology,physical 27therapytheoryandproceduresasrelatedtomedicine,surgeryandpsychiatry,andsuch 28othersubjects,includingmedicalethics,astheboarddeemsusefultotestthefitnessofthe 29candidatetopracticephysicaltherapy. 30 5.Nopersonwhohasfailedonsixormoreoccasionstoachieveapassingscore 31ontheexaminationrequiredbythissectionshallbeeligibleforlicensurebyexamination 32underthissection. 33 6.Theapplicantshallpassatestadministeredbytheboardonthelawsandrules 34relatedtothepracticeofphysicaltherapyinMissouri. 334.655.1.Acandidateforlicensuretopracticeasaphysicaltherapistassistantshall 2furnishevidenceoftheperson'seducationalqualifications.Theeducationalrequirementsfor 3licensureasaphysicaltherapistassistantare: 4 (1)Acertificateofgraduationfromanaccreditedhighschooloritsequivalent;and CCS#2SSHB2149 13 5 (2)Satisfactoryevidenceofcompletionofanassociatedegreeprogramofphysical 6therapyeducationaccreditedbythecommissiononaccreditationofphysicaltherapy 7educationoreligibilitytograduatefromsuchaprogramwithinninetydays. 8 2.Personsdesiringtopracticeasaphysicaltherapistassistantinthisstateshall 9appearbeforetheboardatsuchtimeandplaceastheboardmaydirectandbeexaminedasto 10theperson'sfitnesstoengageinsuchpractice.Applicantsshallmeetthequalifying 11standardsforsuchexaminations,includinganyrequirementsestablishedbyanyentity 12contractedbytheboardtoadministertheboard-approvedexamination.Applications 13forexaminationshallbeonaformfurnishedbytheboardandshallincludeevidence 14satisfactorytotheboardthattheapplicantpossessesthequalificationsprovidedinsubsection 151ofthissectionandmeetstherequirementsestablishedtoqualifyforexamination. Each 16applicationshallcontainastatementthatthestatementismadeunderoathofaffirmationand 17thatitsrepresentationsaretrueandcorrecttothebestknowledgeandbeliefoftheperson 18signingthestatement,subjecttothepenaltiesofmakingafalseaffidavitordeclaration. 19 3.Theexaminationofqualifiedcandidatesforlicensuretopracticeasphysical 20therapistassistantsshallembraceanexaminationwhichshallcoverthecurriculumtaughtin 21accreditedassociatedegreeprogramsofphysicaltherapyassistanteducation.Such 22examinationshallbesufficienttotestthequalificationofthecandidatesaspractitioners. 23 4.Theexaminationshallinclude,asrelatedtothehumanbody,thesubjectsof 24anatomy,kinesiology,pathology,physiology,psychology,physicaltherapytheoryand 25proceduresasrelatedtomedicineandsuchothersubjects,includingmedicalethics,asthe 26boarddeemsusefultotestthefitnessofthecandidatetopracticeasaphysicaltherapist 27assistant. 28 5.Nopersonwhohasfailedonsixormoreoccasionstoachieveapassingscore 29ontheexaminationrequiredbythissectionshallbeeligibleforlicensurebyexamination 30underthissection. 31 6.Theapplicantshallpassatestadministeredbytheboardonthelawsandrules 32relatedtothepracticeasaphysicaltherapistassistantinthisstate. 33 [6.]7.Theboardshalllicensewithoutexaminationanylegallyqualifiedpersonwho 34isaresidentofthisstateandwhowasactivelyengagedinpracticeasaphysicaltherapist 35assistantonAugust28,1993.Theboardmaylicensesuchpersonpursuanttothissubsection 36untilninetydaysaftertheeffectivedateofthissection. 37 [7.]8.Acandidatetopracticeasaphysicaltherapistassistantwhodoesnotmeetthe 38educationalqualificationsmaysubmittotheboardanapplicationforexaminationifsuch 39personcanfurnishwrittenevidencetotheboardthatthepersonhasbeenemployedinthis 40stateforatleastthreeofthelastfiveyearsunderthesupervisionofalicensedphysical 41therapistandsuchpersonpossessestheknowledgeandtrainingequivalenttothatobtainedin CCS#2SSHB2149 14 42anaccreditedschool.Theboardmaylicensesuchpersonspursuanttothissubsectionuntil 43ninetydaysafterrulesdevelopedbythestateboardofhealingartsregardingphysical 44therapistassistantlicensingbecomeeffective. 338.055.1.Theboardmayrefusetoissueanycertificateofregistrationorauthority, 2permitorlicenserequiredpursuanttothischapterforoneoranycombinationofcausesstated 3insubsection2ofthissectionorifthedesignatedpharmacist-in-charge,manager-in-charge, 4oranyofficer,owner,manager,orcontrollingshareholderoftheapplicanthascommittedany 5actorpracticeinsubsection2ofthissection.Theboardshallnotifytheapplicantinwriting 6ofthereasonsfortherefusalandshalladvisetheapplicantofhisorherrighttofilea 7complaintwiththeadministrativehearingcommissionasprovidedbychapter621. 8 2.Theboardmaycauseacomplainttobefiledwiththeadministrativehearing 9commissionasprovidedbychapter621againstanyholderofanycertificateofregistrationor 10authority,permitorlicenserequiredbythischapteroranypersonwhohasfailedtorenewor 11hassurrenderedhisorhercertificateofregistrationorauthority,permitorlicenseforanyone 12oranycombinationofthefollowingcauses: 13 (1)Useofanycontrolledsubstance,asdefinedinchapter195,oralcoholicbeverage 14toanextentthatsuchuseimpairsaperson'sabilitytoperformtheworkofanyprofession 15licensedorregulatedbythischapter; 11 2.Enhancethestates'abilitytoprotectthepublic'shealthandsafety; 12 3.Encouragethecooperationofmemberstatesinregulatingmultistate 13audiologyandspeech-languagepathologypractice; CCS#2SSHB2149 25 14 4.Supportspousesofrelocatingactivedutymilitarypersonnel; 15 5.Enhancetheexchangeoflicensure,investigativeanddisciplinaryinformation 16betweenmemberstates; 17 6.Allowaremotestatetoholdaproviderofserviceswithacompactprivilegein 18thatstateaccountabletothatstate'spracticestandards;and 19 7.Allowfortheuseoftelehealthtechnologytofacilitateincreasedaccessto 20audiologyandspeech-languagepathologyservices. 21 SECTION2.DEFINITIONS 22 AsusedinthisCompact,andexceptasotherwiseprovided,thefollowing 23definitionsshallapply: 24 A."Activedutymilitary"meansfull-timedutystatusintheactiveuniformed 25serviceoftheUnitedStates,includingmembersoftheNationalGuardandReserveon 26activedutyorderspursuantto10U.S.C.Chapter1209and1211. 27 B."Adverseaction"meansanyadministrative,civil,equitableorcriminal 28actionpermittedbyastate'slawswhichisimposedbyalicensingboardorother 29authorityagainstanaudiologistorspeech-languagepathologist,includingactions 30againstanindividual'slicenseorprivilegetopracticesuchasrevocation,suspension, 31probation,monitoringofthelicensee,orrestrictiononthelicensee'spractice. 32 C."Alternativeprogram"meansanon-disciplinarymonitoringprocess 33approvedbyanaudiologyorspeech-languagepathologylicensingboardtoaddress 34impairedpractitioners. 35 D."Audiologist"meansanindividualwhoislicensedbyastatetopractice 36audiology. 37 E."Audiology"meansthecareandservicesprovidedbyalicensedaudiologist 38assetforthinthememberstate'sstatutesandrules. 39 F."AudiologyandSpeech-LanguagePathologyCompactCommission"or 40"Commission"meansthenationaladministrativebodywhosemembershipconsistsof 41allstatesthathaveenactedtheCompact. 42 G."Audiologyandspeech-languagepathologylicensingboard,""audiology 43licensingboard,""speech-languagepathologylicensingboard,"or"licensingboard" 44meanstheagencyofastatethatisresponsibleforthelicensingandregulationof 45audiologistsand/orspeech-languagepathologists. 46 H."Compactprivilege"meanstheauthorizationgrantedbyaremotestateto 47allowalicenseefromanothermemberstatetopracticeasanaudiologistorspeech- 48languagepathologistintheremotestateunderitslawsandrules.Thepracticeof 49audiologyorspeech-languagepathologyoccursinthememberstatewherethepatient/ 50client/studentislocatedatthetimeofthepatient/client/studentencounter. CCS#2SSHB2149 26 51 I."Currentsignificantinvestigativeinformation"meansinvestigative 52informationthatalicensingboard,afteraninquiryorinvestigationthatincludes 53notificationandanopportunityfortheaudiologistorspeech-languagepathologistto 54respond,ifrequiredbystatelaw,hasreasontobelieveisnotgroundlessand,ifproved 55true,wouldindicatemorethanaminorinfraction. 56 J."Datasystem"meansarepositoryofinformationaboutlicensees,including, 57butnotlimitedto,continuingeducation,examination,licensure,investigative,compact 58privilegeandadverseaction. 59 K."Encumberedlicense"meansalicenseinwhichanadverseactionrestricts 60thepracticeofaudiologyorspeech-languagepathologybythelicenseeandsaidadverse 61actionhasbeenreportedtotheNationalPractitionersDataBank(NPDB). 62 L."ExecutiveCommittee"meansagroupofdirectorselectedorappointedto 63actonbehalfof,andwithinthepowersgrantedtothemby,theCommission. 64 M."Homestate"meansthememberstatethatisthelicensee'sprimarystateof 65residence. 66 N."Impairedpractitioner"meansindividualswhoseprofessionalpracticeis 67adverselyaffectedbysubstanceabuse,addiction,orotherhealth-relatedconditions. 68 O."Licensee"meansanindividualwhocurrentlyholdsanauthorizationfrom 69thestatelicensingboardtopracticeasanaudiologistorspeech-languagepathologist. 70 P."Memberstate"meansastatethathasenactedtheCompact. 71 Q."Privilegetopractice"meansalegalauthorizationpermittingthepracticeof 72audiologyorspeech-languagepathologyinaremotestate. 73 R."Remotestate"meansamemberstateotherthanthehomestatewherea 74licenseeisexercisingorseekingtoexercisethecompactprivilege. 75 S."Rule"meansaregulation,principleordirectivepromulgatedbythe 76Commissionthathastheforceoflaw. 77 T."Single-statelicense"meansanaudiologyorspeech-languagepathology 78licenseissuedbyamemberstatethatauthorizespracticeonlywithintheissuingstate 79anddoesnotincludeaprivilegetopracticeinanyothermemberstate. 80 U."Speech-languagepathologist"meansanindividualwhoislicensedbyastate 81topracticespeech-languagepathology. 82 V."Speech-languagepathology"meansthecareandservicesprovidedbya 83licensedspeech-languagepathologistassetforthinthememberstate'sstatutesand 84rules. 85 W."State"meansanystate,commonwealth,districtorterritoryoftheUnited 86StatesofAmericathatregulatesthepracticeofaudiologyandspeech-language 87pathology. CCS#2SSHB2149 27 88 X."Statepracticelaws"meansamemberstate'slaws,rulesandregulationsthat 89governthepracticeofaudiologyorspeech-languagepathology,definethescopeof 90audiologyorspeech-languagepathologypractice,andcreatethemethodsandgrounds 91forimposingdiscipline. 92 Y."Telehealth"meanstheapplicationoftelecommunicationtechnologyto 93deliveraudiologyorspeech-languagepathologyservicesatadistanceforassessment, 94interventionand/orconsultation. 95 SECTION3.STATEPARTICIPATIONINTHECOMPACT 96 A.Alicenseissuedtoanaudiologistorspeech-languagepathologistbyahome 97statetoaresidentinthatstateshallberecognizedbyeachmemberstateasauthorizing 98anaudiologistorspeech-languagepathologisttopracticeaudiologyorspeech-language 99pathology,underaprivilegetopractice,ineachmemberstate. 100 B.Astatemustimplementorutilizeproceduresforconsideringthecriminal 101historyrecordsofapplicantsforinitialprivilegetopractice.Theseproceduresshall 102includethesubmissionoffingerprintsorotherbiometric-basedinformationby 103applicantsforthepurposeofobtaininganapplicant'scriminalhistoryrecord 104informationfromtheFederalBureauofInvestigationandtheagencyresponsiblefor 105retainingthatstate'scriminalrecords. 106 1.Amemberstatemustfullyimplementacriminalbackgroundcheck 107requirement,withinatimeframeestablishedbyrule,byreceivingtheresultsofthe 108FederalBureauofInvestigationrecordsearchoncriminalbackgroundchecksanduse 109theresultsinmakinglicensuredecisions. 110 2.Communicationbetweenamemberstate,theCommissionandamong 111memberstatesregardingtheverificationofeligibilityforlicensurethroughthe 112CompactshallnotincludeanyinformationreceivedfromtheFederalBureauof 113Investigationrelatingtoafederalcriminalrecordscheckperformedbyamemberstate 114underPublicLaw92-544. 115 C.Uponapplicationforaprivilegetopractice,thelicensingboardintheissuing 116remotestateshallascertain,throughthedatasystem,whethertheapplicanthasever 117held,oristheholderof,alicenseissuedbyanyotherstate,whetherthereareany 118encumbrancesonanylicenseorprivilegetopracticeheldbytheapplicant,whetherany 119adverseactionhasbeentakenagainstanylicenseorprivilegetopracticeheldbythe 120applicant. 121 D.Eachmemberstateshallrequireanapplicanttoobtainorretainalicensein 122thehomestateandmeetthehomestate'squalificationsforlicensureorrenewalof 123licensure,aswellas,allotherapplicablestatelaws. 124 E.Foranaudiologist: CCS#2SSHB2149 28 125 1.Mustmeetoneofthefollowingeducationalrequirements: 126 a.Onorbefore,Dec.31,2007,hasgraduatedwithamaster'sdegreeordoctorate 127inaudiology,orequivalentdegreeregardlessofdegreename,fromaprogramthatis 128accreditedbyanaccreditingagencyrecognizedbytheCouncilforHigherEducation 129Accreditation,oritssuccessor,orbytheUnitedStatesDepartmentofEducationand 130operatedbyacollegeoruniversityaccreditedbyaregionalornationalaccrediting 131organizationrecognizedbytheboard;or 132 b.Onorafter,Jan.1,2008,hasgraduatedwithaDoctoraldegreeinaudiology, 133orequivalentdegree,regardlessofdegreename,fromaprogramthatisaccreditedby 134anaccreditingagencyrecognizedbytheCouncilforHigherEducationAccreditation,or 135itssuccessor,orbytheUnitedStatesDepartmentofEducationandoperatedbyacollege 136oruniversityaccreditedbyaregionalornationalaccreditingorganizationrecognized 137bytheboard;or 138 c.Hasgraduatedfromanaudiologyprogramthatishousedinaninstitutionof 139highereducationoutsideoftheUnitedStates(a)forwhichtheprogramandinstitution 140havebeenapprovedbytheauthorizedaccreditingbodyintheapplicablecountryand 141(b)thedegreeprogramhasbeenverifiedbyanindependentcredentialsreviewagency 142tobecomparabletoastatelicensingboard-approvedprogram. 143 2.Hascompletedasupervisedclinicalpracticumexperiencefromanaccredited 144educationalinstitutionoritscooperatingprogramsasrequiredbytheCommission; 169 6.Hasnotbeenconvictedorfoundguilty,andhasnotenteredintoanagreed 170disposition,ofafelonyrelatedtothepracticeofspeech-languagepathology,under 171applicablestateorfederalcriminallaw; 172 7.HasavalidUnitedStatesSocialSecurityorNationalPractitioner 173Identificationnumber. 174 G.Theprivilegetopracticeisderivedfromthehomestatelicense. 175 H.Anaudiologistorspeech-languagepathologistpracticinginamemberstate 176mustcomplywiththestatepracticelawsofthestateinwhichtheclientislocatedatthe 177timeserviceisprovided.Thepracticeofaudiologyandspeech-languagepathologyshall 178includeallaudiologyandspeech-languagepathologypracticeasdefinedbythestate 179practicelawsofthememberstateinwhichtheclientislocated.Thepracticeof 180audiologyandspeech-languagepathologyinamemberstateunderaprivilegeto 181practiceshallsubjectanaudiologistorspeech-languagepathologisttothejurisdictionof 182thelicensingboard,thecourtsandthelawsofthememberstateinwhichtheclientis 183locatedatthetimeserviceisprovided. 184 I.Individualsnotresidinginamemberstateshallcontinuetobeabletoapply 185foramemberstate'ssingle-statelicenseasprovidedunderthelawsofeachmember 186state.However,thesingle-statelicensegrantedtotheseindividualsshallnotbe 187recognizedasgrantingtheprivilegetopracticeaudiologyorspeech-languagepathology 188inanyothermemberstate.NothinginthisCompactshallaffecttherequirements 189establishedbyamemberstatefortheissuanceofasingle-statelicense. 190 J.Memberstatesmaychargeafeeforgrantingacompactprivilege. 191 K.Memberstatesmustcomplywiththebylawsandrulesandregulationsofthe 192Commission. 193 SECTION4.COMPACTPRIVILEGE 194 A.Toexercisethecompactprivilegeunderthetermsandprovisionsofthe 195Compact,theaudiologistorspeech-languagepathologistshall: 196 1.Holdanactivelicenseinthehomestate; 197 2.Havenoencumbranceonanystatelicense; CCS#2SSHB2149 30 198 3.Beeligibleforacompactprivilegeinanymemberstateinaccordancewith 199Section3; 200 4.Havenothadanyadverseactionagainstanylicenseorcompactprivilege 201withintheprevious2yearsfromdateofapplication; 202 5.NotifytheCommissionthatthelicenseeisseekingthecompactprivilege 203withinaremotestate(s); 204 6.Payanyapplicablefees,includinganystatefee,forthecompactprivilege; 205 7.ReporttotheCommissionadverseactiontakenbyanynon-memberstate 206within30daysfromthedatetheadverseactionistaken. 207 B.Forthepurposesofthecompactprivilege,anaudiologistorspeech-language 208pathologistshallonlyholdonehomestatelicenseatatime. 209 C.ExceptasprovidedinSection6,ifanaudiologistorspeech-language 210pathologistchangesprimarystateofresidencebymovingbetweentwo-memberstates, 211theaudiologistorspeech-languagepathologistmustapplyforlicensureinthenewhome 212state,andthelicenseissuedbythepriorhomestateshallbedeactivatedinaccordance 213withapplicablerulesadoptedbytheCommission. 214 D.Theaudiologistorspeech-languagepathologistmayapplyforlicensurein 215advanceofachangeinprimarystateofresidence. 216 E.Alicenseshallnotbeissuedbythenewhomestateuntiltheaudiologistor 217speech-languagepathologistprovidessatisfactoryevidenceofachangeinprimarystate 218ofresidencetothenewhomestateandsatisfiesallapplicablerequirementstoobtaina 219licensefromthenewhomestate. 220 F.Ifanaudiologistorspeech-languagepathologistchangesprimarystateof 221residencebymovingfromamemberstatetoanon-memberstate,thelicenseissuedby 222thepriorhomestateshallconverttoasingle-statelicense,validonlyintheformerhome 223state. 224 G.Thecompactprivilegeisvaliduntiltheexpirationdateofthehomestate 225license.ThelicenseemustcomplywiththerequirementsofSection4Atomaintainthe 226compactprivilegeintheremotestate. 227 H.Alicenseeprovidingaudiologyorspeech-languagepathologyservicesina 228remotestateunderthecompactprivilegeshallfunctionwithinthelawsandregulations 229oftheremotestate. 230 I.Alicenseeprovidingaudiologyorspeech-languagepathologyservicesina 231remotestateissubjecttothatstate'sregulatoryauthority.Aremotestatemay,in 232accordancewithdueprocessandthatstate'slaws,removealicensee'scompactprivilege 233intheremotestateforaspecificperiodoftime,imposefines,and/ortakeanyother 234necessaryactionstoprotectthehealthandsafetyofitscitizens. CCS#2SSHB2149 31 235 J.Ifahomestatelicenseisencumbered,thelicenseeshalllosethecompact 236privilegeinanyremotestateuntilthefollowingoccur: 237 1.Thehomestatelicenseisnolongerencumbered;and 238 2.Twoyearshaveelapsedfromthedateoftheadverseaction. 239 K.Onceanencumberedlicenseinthehomestateisrestoredtogoodstanding, 240thelicenseemustmeettherequirementsofSection4Atoobtainacompactprivilegein 241anyremotestate. 242 L.OncetherequirementsofSection4Jhavebeenmet,thelicenseemustmeet 243therequirementsinSection4Atoobtainacompactprivilegeinaremotestate. 244 SECTION5.COMPACTPRIVILEGETOPRACTICETELEHEALTH 245 Memberstatesshallrecognizetherightofanaudiologistorspeech-language 246pathologist,licensedbyahomestateinaccordancewithSection3andunderrules 247promulgatedbytheCommission,topracticeaudiologyorspeech-languagepathologyin 248anymemberstateviatelehealthunderaprivilegetopracticeasprovidedinthe 249CompactandrulespromulgatedbytheCommission. 250 SECTION6.ACTIVEDUTYMILITARYPERSONNELORTHEIRSPOUSES 251 Activedutymilitarypersonnel,ortheirspouse,shalldesignateahomestate 252wheretheindividualhasacurrentlicenseingoodstanding.Theindividualmayretain 253thehomestatedesignationduringtheperiodtheservicememberisonactiveduty. 254Subsequenttodesignatingahomestate,theindividualshallonlychangetheirhome 255statethroughapplicationforlicensureinthenewstate. 256 SECTION7.ADVERSEACTIONS 257 A.Inadditiontotheotherpowersconferredbystatelaw,aremotestateshall 258havetheauthority,inaccordancewithexistingstatedueprocesslaw,to: 259 1.Takeadverseactionagainstanaudiologist'sorspeech-languagepathologist's 260privilegetopracticewithinthatmemberstate. 261 2.Issuesubpoenasforbothhearingsandinvestigationsthatrequirethe 262attendanceandtestimonyofwitnessesaswellastheproductionofevidence.Subpoenas 263issuedbyalicensingboardinamemberstatefortheattendanceandtestimonyof 264witnessesortheproductionofevidencefromanothermemberstateshallbeenforcedin 265thelatterstatebyanycourtofcompetentjurisdiction,accordingtothepracticeand 266procedureofthatcourtapplicabletosubpoenasissuedinproceedingspendingbeforeit. 267Theissuingauthorityshallpayanywitnessfees,travelexpenses,mileageandotherfees 268requiredbytheservicestatutesofthestateinwhichthewitnessesorevidenceare 269located. 270 3.Onlythehomestateshallhavethepowertotakeadverseactionagainstan 271audiologist'sorspeech-languagepathologist'slicenseissuedbythehomestate. 497 2.Licensuredata; 498 3.Adverseactionsagainstalicenseorcompactprivilege; 499 4.Non-confidentialinformationrelatedtoalternativeprogramparticipation; 500 5.Anydenialofapplicationforlicensure,andthereason(s)fordenial;and 501 6.OtherinformationthatmayfacilitatetheadministrationofthisCompact,as 502determinedbytherulesoftheCommission. 503 C.Investigativeinformationpertainingtoalicenseeinanymemberstateshall 504onlybeavailabletoothermemberstates. 505 D.TheCommissionshallpromptlynotifyallmemberstatesofanyadverse 506actiontakenagainstalicenseeoranindividualapplyingforalicense.Adverseaction 507informationpertainingtoalicenseeinanymemberstateshallbeavailabletoanyother 508memberstate. 509 E.Memberstatescontributinginformationtothedatasystemmaydesignate 510informationthatmaynotbesharedwiththepublicwithouttheexpresspermissionof 511thecontributingstate. 512 F.Anyinformationsubmittedtothedatasystemthatissubsequentlyrequiredto 513beexpungedbythelawsofthememberstatecontributingtheinformationshallbe 514removedfromthedatasystem. 515 SECTION10.RULEMAKING 516 A.TheCommissionshallexerciseitsrulemakingpowerspursuanttothecriteria 517setforthinthisSectionandtherulesadoptedthereunder.Rulesandamendmentsshall 518becomebindingasofthedatespecifiedineachruleoramendment. 519 B.Ifamajorityofthelegislaturesofthememberstatesrejectsarule,by 520enactmentofastatuteorresolutioninthesamemannerusedtoadopttheCompact 521within4yearsofthedateofadoptionoftherule,theruleshallhavenofurtherforceand 522effectinanymemberstate. 523 C.Rulesoramendmentstotherulesshallbeadoptedataregularorspecial 524meetingoftheCommission. 525 D.Priortopromulgationandadoptionofafinalruleorrulesbythe 526Commission,andatleastthirty(30)daysinadvanceofthemeetingatwhichtherule CCS#2SSHB2149 39 527shallbeconsideredandvotedupon,theCommissionshallfileaNoticeofProposed 528Rulemaking: 529 1.OnthewebsiteoftheCommissionorotherpubliclyaccessibleplatform;and 530 2.Onthewebsiteofeachmemberstateaudiologyorspeech-languagepathology 531licensingboardorotherpubliclyaccessibleplatformorthepublicationinwhicheach 532statewouldotherwisepublishproposedrules. 533 E.TheNoticeofProposedRulemakingshallinclude: 534 1.Theproposedtime,date,andlocationofthemeetinginwhichtheruleshallbe 535consideredandvotedupon; CCS#2SSHB2149 41 600 2.TheCommissionshallpromulgatearuleprovidingforbothmediationand 601bindingdisputeresolutionfordisputesasappropriate. 602 B.Enforcement 603 1.TheCommission,inthereasonableexerciseofitsdiscretion,shallenforcethe 604provisionsandrulesofthisCompact. 605 2.Bymajorityvote,theCommissionmayinitiatelegalactionintheUnited 606StatesDistrictCourtfortheDistrictofColumbiaorthefederaldistrictwherethe 607Commissionhasitsprincipalofficesagainstamemberstateindefaulttoenforce 608compliancewiththeprovisionsoftheCompactanditspromulgatedrulesandbylaws. 609Thereliefsoughtmayincludebothinjunctivereliefanddamages.Intheeventjudicial 610enforcementisnecessary,theprevailingmembershallbeawardedallcostsoflitigation, 611includingreasonableattorney'sfees. 612 3.TheremedieshereinshallnotbetheexclusiveremediesoftheCommission. 613TheCommissionmaypursueanyotherremediesavailableunderfederalorstatelaw. 614 SECTION12.DATEOFIMPLEMENTATIONOFTHEINTERSTATE 615COMMISSION FORAUDIOLOGY ANDSPEECH-LANGUAGE PATHOLOGY 616PRACTICEANDASSOCIATEDRULES,WITHDRAWAL,ANDAMENDMENT 617 A.TheCompactshallcomeintoeffectonthedateonwhichtheCompactstatute 618isenactedintolawinthe10thmemberstate.Theprovisions,whichbecomeeffectiveat 619thattime,shallbelimitedtothepowersgrantedtotheCommissionrelatingtoassembly 620andthepromulgationofrules.Thereafter,theCommissionshallmeetandexercise 621rulemakingpowersnecessarytotheimplementationandadministrationofthe 622Compact. 623 B.AnystatethatjoinstheCompactsubsequenttotheCommission'sinitial 624adoptionoftherulesshallbesubjecttotherulesastheyexistonthedateonwhichthe 625Compactbecomeslawinthatstate.Anyrulethathasbeenpreviouslyadoptedbythe 626CommissionshallhavethefullforceandeffectoflawonthedaytheCompactbecomes 627lawinthatstate. 628 C.AnymemberstatemaywithdrawfromthisCompactbyenactingastatute 629repealingthesame. 630 1.Amemberstate'swithdrawalshallnottakeeffectuntilsix(6)monthsafter 631enactmentoftherepealingstatute. 632 2.Withdrawalshallnotaffectthecontinuingrequirementofthewithdrawing 633state'saudiologyorspeech-languagepathologylicensingboardtocomplywiththe 634investigativeandadverseactionreportingrequirementsofthisactpriortotheeffective 635dateofwithdrawal. CCS#2SSHB2149 42 636 D.NothingcontainedinthisCompactshallbeconstruedtoinvalidateorprevent 637anyaudiologyorspeech-languagepathologylicensureagreementorothercooperative 638arrangementbetweenamemberstateandanon-memberstatethatdoesnotconflict 639withtheprovisionsofthisCompact. 640 E.ThisCompactmaybeamendedbythememberstates.Noamendmenttothis 641Compactshallbecomeeffectiveandbindinguponanymemberstateuntilitisenacted 642intothelawsofallmemberstates. 643 SECTION13.CONSTRUCTION ANDSEVERABILITY 644 ThisCompactshallbeliberallyconstruedsoastoeffectuatethepurposes 645thereof.TheprovisionsofthisCompactshallbeseverableandifanyphrase,clause, 646sentenceorprovisionofthisCompactisdeclaredtobecontrarytotheconstitutionof 647anymemberstateoroftheUnitedStatesortheapplicabilitythereoftoanygovernment, 648agency,personorcircumstanceisheldinvalid,thevalidityoftheremainderofthis 649Compactandtheapplicabilitythereoftoanygovernment,agency,personor 650circumstanceshallnotbeaffectedthereby.IfthisCompactshallbeheldcontraryto 651theconstitutionofanymemberstate,theCompactshallremaininfullforceandeffect 652astotheremainingmemberstatesandinfullforceandeffectastothememberstate 653affectedastoallseverablematters. 654 SECTION14.BINDINGEFFECTOFCOMPACTANDOTHERLAWS 655 A.Nothinghereinpreventstheenforcementofanyotherlawofamemberstate 656thatisnotinconsistentwiththeCompact. 657 B.AlllawsinamemberstateinconflictwiththeCompactaresupersededtothe 658extentoftheconflict. 659 C.AlllawfulactionsoftheCommission,includingallrulesandbylaws 660promulgatedbytheCommission,arebindinguponthememberstates. 661 D.AllagreementsbetweentheCommissionandthememberstatesarebinding 662inaccordancewiththeirterms. 663 E.IntheeventanyprovisionoftheCompactexceedstheconstitutionallimits 664imposedonthelegislatureofanymemberstate,theprovisionshallbeineffectivetothe 665extentoftheconflictwiththeconstitutionalprovisioninquestioninthatmemberstate. SectionB.Becauseoftheurgentneedoflow-incomeMissouriresidentsforaccessto 2qualityhealthcareservices,theenactmentofsection324.005ofthisactisdeemednecessary 3fortheimmediatepreservationofthepublichealth,welfare,peace,andsafety,andishereby 4declaredtobeanemergencyactwithinthemeaningoftheconstitution,andtheenactmentof 5section324.005ofthisactshallbeinfullforceandeffectuponitspassageandapproval. ✔ CCS#2SSHB2149 43
