Thisbillmodifiesseveralprovisionsrelatingtoprofessional
licensing.
PHYSICALTHERAPISTS(Sections334.530and334.655)
Currently,anindividualapplyingtobelicensedasaphysical
therapistmustprovideevidenceofcompletionofaprogramof
physicaltherapyeducationapprovedasreputablebytheBoardof
theHealingArts.Thisbillallowsfortheapplicanttoprovide
evidenceofeligibilitytograduatefromsuchprogramwithin90
daysinlieuoftheevidenceofcompletionoftheprogram.
Currently,anindividualapplyingtobelicensedasaphysical
therapistassistantmustprovideacertificateofgraduationfrom
anaccreditedhighschooloritsequivalentandevidenceof
completionofanassociatedegreeprogramofphysicaltherapy
educationaccreditedbytheAdvisoryCommissionforPhysical
Therapists. Thisbillallowsfortheapplicanttoprovideevidence
ofeligibilitytograduatefromsuchprogramwithin90daysinlieu
oftheevidenceofcompletionoftheprogram.
Applicantsmustpassanexaminationwithqualitystandard
requirementsestablishedbytheBoardandanyentitycontractedby
theBoardtoadministertheboard-approvedexaminations.
Iftheapplicantfailstheexaminationsixormoretimes,heorshe
isnolongereligibleforlicensure.
HOMEHEALTHLICENSING(Sections197.400and197.445)
Currentlawlimitslicensedhomehealthagenciestothosethat
providetwoormorehomehealthservicesattheresidenceofa
patientaccordingtoaphysician'swrittenandsignedplanof
treatment. Thisbillpermitssuchlicensedentitiestoprovide
treatmentaccordingtowrittenplanssignedbyphysicians,nurse
practitioners, clinicalnursespecialists,orphysicianassistants,
asspecifiedinthebilliftheplanisreviewedbyaphysicianat
leastonceeverysixmonths.
EXEMPTIONSFORPROFESSIONALLICENSING(Sections324.005andB)
Aprofessionalwhohasacurrentlicensetopracticehisorher
professionfromanotherstate,commonwealth,territory,orthe
DistrictofColumbiashallbeexemptfromMissourilicensure
requirementsiftheprofessional:
(1)IsanactivedutyorreservememberoftheArmedForces,a memberoftheNationalGuard,acivilianemployeeoftheU.S.
DepartmentofDefense(DOD),anauthorizedcontractorunderfederal
law,oraprofessionalotherwiseauthorizedundertheDOD;
(2)Practicesthesameoccupationorprofessionforwhichheor
sheholdsacurrentlicense;and
(3)Isengagedinthepracticeofaprofessionthrougha
partnershipwiththefederalInnovativeReadinessTrainingprogram
withintheDOD.
Thisexemptionshallonlyapplywhile:
(1)Theprofessional's practiceisrequiredbytheprogrampursuant
tomilitaryorders;and
(2)Theservicesprovidedbytheprofessionalarewithinthescope
ofpracticeforindividual'srespectiveprofessioninMissouri.
Thisprovisionhasanemergencyclause.
LANDSURVEYORS(Sections327.312,327.313,327.314,and327.331)
BeginningJanuary1,2024,thisbillchangesthenameofaperson
licensedasalandsurveyor-in-trainingtoalandsurveyor-intern.
ApersonmayapplytotheMissouriBoardforArchitects,
ProfessionalEngineers,ProfessionalLandSurveyors,and
ProfessionalLandscapeArchitectsforenrollmentasaland
surveyor-internifsuchpersonisahighschoolgraduateor
possessesacertificateofhighschoolequivalenceandhaspassed
anyexaminationrequiredbytheBoard.BeginningJanuary1,2024,
thisbillinstitutesneweducation,experience,andexamination
requirementsforlicensureasalandsurveyor,asdescribedinthe
bill.
MISSOURIDENTALBOARDPILOTPROJECTS(Section332.325)
ThisbillauthorizestheMissouriDentalBoard,incollaboration
withtheDepartmentofHealthandSeniorServicesandtheOfficeof
DentalHealthwithintheDepartmentofHealthandSeniorServices,
toapprovepilotprojectsdesignedtoexaminenewmethodsof
extendingcaretounder-servedpopulations.Suchprojectsmay
employtechniquesorapproachestocarethatmaynecessitatea
waiverofstatuteorregulationandshallfollowtherequirements
ofthebillregardingscope,content,andreports.
TheprovisionsofthissectionexpireonAugust28,2026,anda
reportofthepilotprojectsapprovedbytheBoardshallbe
submittedtotheGeneralAssemblynolaterthanDecember1,2025. PHYSICIANANDPHARMACISTPRESCRIPTIONANDDISPENSATIONOF
IVERMECTINANDHYDROXYCHLOROQUINE (Sections334.100and338.055)
ThisbillprohibitstheStateBoardofRegistrationfortheHealing
Artsfromtakingadministrative actionagainstacertificateof
registrationorauthority,permit,orlicenserequiredbythis
Chapterforanypersonduetothelawfuldispensing,distributing,
orsellingofivermectintabletsorhydroxychloroquine sulfate
tabletsforhumanuseinaccordancewithprescriberdirections. A
pharmacistcannotcontacttheprescribingphysicianorthepatient
todisputetheefficacyofivermectintabletsorhydroxychloroquine
sulfatetabletsforhumanuseunlessthephysicianorpatient
inquiresofthepharmacistabouttheefficacyofivermectintablets
orhydroxychloroquine sulfatetablets.
AUDIOLOGISTSANDSPEECH-LANGUAGEPATHOLOGISTS(Sections345.015,
345.022,345.050,345.052,and345.085)
Thismodifiesprovisionsrelatingtoaudiologyandspeech-language
pathology. InordertobeeligibleforlicensurebytheState
BoardofRegistrationfortheHealingArtsbyexaminationunder
thisbill,eachapplicantshallpresentwrittenevidenceof
completionofaclinicalfellowship. Anypersoninaclinical
fellowshipshallholdaprovisionallicensetopracticespeech-
languagepathologyoraudiologyandshallbeissuedalicenseif
thepersonmeetsrequirementssetforthinthebill.
Thisalsomodifiesprovisionsrelatingtolicensereciprocity.
Currently,applicantswhoarelicensedinanothercountryorholda
certificateofcompetenceissuedbytheAmericanSpeech-Language-
HearingAssociationmayreceivealicensewithoutanexamination.
Thisbillrepealsthisprovisionandimplementsaprovision
permittinganypersonwho,foratleastoneyear,hasheldavalid,
currentlicenseissuedbyanotherstate,abranchorunitofthe
military,aU.S.territory,ortheDistrictofColumbia,toapply
foranequivalentMissourilicensethroughtheBoard,subjectto
proceduresandlimitationsasprovidedinthebill.
ThisbillalsoadoptstheAudiologyandSpeech-LanguagePathology
InterstateCompact. Thepurposeofthecompactistoincrease
accesstoaudiologyandspeech-languagepathologyservicesby
providingforthemutualrecognitionofothermemberstate
licenses. Thecompactsetsforthrequirementsthatmustbemetin
orderforastatetojointhecompact. Eachmemberstateshall
requireanapplicanttoobtainorretainalicenseinthehome
stateandmeetthehomestate'squalifications forlicensureor
renewaloflicensureaswellasallotherapplicablestatelaws. ThecompactcreatesajointpublicagencyknownastheAudiology
andSpeech-LanguagePathologyCompactCommission. TheCommission
haspowersanddutiesaslistedinthecompactandshallenforce
theprovisionsandrulesofthecompact. TheCommissionshall
provideforthedevelopment,maintenance,andutilizationofa
coordinateddatabaseandreportingsystemcontaininglicensure,
adverseaction,andinvestigativeinformationonalllicensed
individualsinmemberstates.
Thecompactshallcomeintoeffectonthedateonwhichthecompact
isenactedintolawinthe10thmemberstate.Anymemberstatemay
withdrawfromthecompactbyenactingastatuterepealingthesame.
Thecompactshallbebindinguponmemberstatesandshallsupersede
anyconflictwithstatelaw.
