1011 Be it enacted by the General Assembly of the State of Missouri, as follows:
11-SectionA.Sections195.206and196.1050,RSMo,arerepealedandtwonewsections
12-2enactedinlieuthereof,tobeknownassections195.206and196.1050,toreadasfollows:
13-195.206.1.Asusedinthissection,thefollowingtermsshallmean:
14-2 (1)"Addictionmitigationmedication",naltrexonehydrochloridethatis
15-3administeredinamannerapprovedbytheUnitedStatesFoodandDrug
16-4Administrationoranyacceptedmedicalpracticemethodofadministering;
17-5 [(1)](2)"Opioidantagonist",naloxonehydrochloridethatblockstheeffectsofan

25-13 2.Notwithstandinganyotherlaworregulationtothecontrary:
26-14 (1)Thedirectorofthedepartmentofhealthandseniorservices,ifalicensed
27-15physician,mayissueastatewidestandingorderforanopioidantagonistoranaddiction
28-16mitigationmedication;
29-EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
30-intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17 (2)Inthealternative,thedepartmentmayemployorcontractwithalicensed

33-20 3.Notwithstandinganyotherlaworregulationtothecontrary,anylicensed
34-21pharmacistinMissourimaysellanddispenseanopioidantagonistoranaddiction
35-22mitigationmedicationunderphysicianprotocolorunderastatewidestandingorderissued
36-23undersubsection2ofthissection.
37-24 4.Alicensedpharmacistwho,actingingoodfaithandwithreasonablecare,sellsor
38-25dispensesanopioidantagonistoranaddictionmitigationmedicationandanappropriate
39-26devicetoadministerthedrug,andtheprotocolphysician,shallnotbesubjecttoanycriminal
40-27orcivilliabilityoranyprofessionaldisciplinaryactionforprescribingordispensingthe
41-28opioidantagonistoranaddictionmitigationmedicationoranyoutcomeresultingfromthe
42-29administrationoftheopioidantagonistoranaddictionmitigationmedication. Aphysician
43-30issuingastatewidestandingorderundersubsection2ofthissectionshallnotbesubjectto
44-31anycriminalorcivilliabilityoranyprofessionaldisciplinaryactionforissuingthestanding
45-32orderorforanyoutcomerelatedtotheorderortheadministrationoftheopioidantagonistor
46-33anaddictionmitigationmedication.
47-34 5.Notwithstandinganyotherlaworregulationtothecontrary,itshallbepermissible
48-35foranypersontopossessanopioidantagonistoranaddictionmitigationmedication.
49-36 6.Anypersonwhoadministersanopioidantagonisttoanotherpersonshall,
50-37immediatelyafteradministeringthedrug,contactemergencypersonnel.Anypersonwho,
51-38actingingoodfaithandwithreasonablecare,administersanopioidantagonisttoanother
52-39personwhomthepersonbelievestobesufferinganopioid-relatedoverdoseshallbeimmune
53-40fromcriminalprosecution,disciplinaryactionsfromhisorherprofessionallicensingboard,
54-41andcivilliabilityduetotheadministrationoftheopioidantagonist.
55-196.1050.1.Theproceedsofanymonetarysettlementorportionofaglobal
56-2settlementbetweentheattorneygeneralofthestateandanydrugmanufacturers,distributors,
57-3orcombinationthereoftoresolveanopioid-relatedcauseofactionagainstsuchdrug
58-4manufacturers,distributors,orcombinationthereofinastateorfederalcourtshallonlybe
59-5utilizedtopayforopioidaddictiontreatmentandpreventionservicesandhealthcareandlaw
60-6enforcementcostsrelatedtoopioidaddictiontreatmentandprevention.Underno
61-7circumstancesshallsuchsettlementmoneysbeutilizedtofundotherservices,programs,
62-8orexpensesnotreasonablyrelatedtoopioidaddictiontreatmentandprevention.
63-9 2.(1)Thereisherebyestablishedinthestatetreasurythe"OpioidAddiction
64-10TreatmentandRecoveryFund",whichshallconsistoftheproceedsofanysettlement
65-11describedinsubsection1ofthissection,aswellasanyfundsappropriatedbythegeneral
66-12assembly,orgifts,grants,donations,orbequests.Thestatetreasurershallbecustodianofthe
67-SSHB2162 2 13fund.Inaccordancewithsections30.170and30.180,thestatetreasurermayapprove
68-14disbursements.Thefundshallbeadedicatedfundandmoneyinthefundshallbeusedbythe
69-15departmentofmentalhealth,thedepartmentofhealthandseniorservices,thedepartmentof
70-16socialservices,[and]thedepartmentofpublicsafety, thedepartmentofcorrections,and
71-17thejudiciaryforthepurposessetforthinsubsection1ofthissection.
72-18 (2)Notwithstandingtheprovisionsofsection33.080tothecontrary,anymoneys
73-19remaininginthefundattheendofthebienniumshallnotreverttothecreditofthegeneral
74-20revenuefund.
75-21 (3)Thestatetreasurershallinvestmoneysinthefundinthesamemannerasother
76-22fundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbecreditedto

12+ Section A. Sections 195.206 and 196.1050, RSMo, are 1
13+repealed and two new sections enacted in lieu thereof, to be 2
14+known as sections 195.206 and 196.1050, to read as follows:3
15+ 195.206. 1. As used in this section, the following 1
16+terms shall mean: 2
17+ (1) "Addiction mitigation medication", naltrexone 3
18+hydrochloride that is administered in a manner approved by 4
19+the United States Food and Drug Administration or any 5
20+accepted medical practice method of administering; 6
21+ [(1)] (2) "Opioid antagonist", naloxone hydrochloride 7
22+that blocks the effects of an opioid overdose that is 8
23+administered in a manner approved by the United States Food 9
24+and Drug Administration or any accepted medical practice 10
25+method of administering; 11
26+ [(2)] (3) "Opioid-related drug overdose", a condition 12
27+including, but not limited to, extreme physical illness, 13
28+decreased level of consciousness, respiratory depression, 14
29+coma, or death resulting from the consumption or use of an 15
30+opioid or other substance with which an opioid was combined 16
31+or a condition that a layperson would reasonably believe to 17
32+be an opioid-related drug overdose that requires medical 18
33+assistance. 19
34+ 2. Notwithstanding any other law or regulation to the 20
35+contrary: 21
36+ 2
37+ (1) The director of the departmen t of health and 22
38+senior services, if a licensed physician, may issue a 23
39+statewide standing order for an opioid antagonist or an 24
40+addiction mitigation medication ; 25
41+ (2) In the alternative, the department may employ or 26
42+contract with a licensed physician who may issue a statewide 27
43+standing order for an opioid antagonist or an addiction 28
44+mitigation medication with the express written consent of 29
45+the department director. 30
46+ 3. Notwithstanding any other law or regulation to the 31
47+contrary, any licensed pha rmacist in Missouri may sell and 32
48+dispense an opioid antagonist or an addiction mitigation 33
49+medication under physician protocol or under a statewide 34
50+standing order issued under subsection 2 of this section. 35
51+ 4. A licensed pharmacist who, acting in go od faith and 36
52+with reasonable care, sells or dispenses an opioid 37
53+antagonist or an addiction mitigation medication and an 38
54+appropriate device to administer the drug, and the protocol 39
55+physician, shall not be subject to any criminal or civil 40
56+liability or any professional disciplinary action for 41
57+prescribing or dispensing the opioid antagonist or an 42
58+addiction mitigation medication or any outcome resulting 43
59+from the administration of the opioid antagonist or an 44
60+addiction mitigation medication . A physician issuing a 45
61+statewide standing order under subsection 2 of this section 46
62+shall not be subject to any criminal or civil liability or 47
63+any professional disciplinary action for issuing the 48
64+standing order or for any outcome related to the order or 49
65+the administration of the opioid antagonist or an addiction 50
66+mitigation medication . 51
67+ 5. Notwithstanding any other law or regulation to the 52
68+contrary, it shall be permissible for any person to possess 53
69+an opioid antagonist or an addiction mitigation medication . 54

71+ 6. Any person who administers an opioid antagonist to 55
72+another person shall, immediately after administering the 56
73+drug, contact emergency personnel. Any person who, acting 57
74+in good faith and with reasonable care, administers an 58
75+opioid antagonist to another person whom the person believes 59
76+to be suffering an opioid -related overdose shall be immune 60
77+from criminal prosecution, disciplinary actions from his or 61
78+her professional licensing board, and civil liability due to 62
79+the administration of the opioid antagonist. 63
80+ 196.1050. 1. The proceeds of any monetary settlement 1
81+or portion of a global settlement between the attorney 2
82+general of the state and any drug manufacturers, 3
83+distributors, or combination thereof to resolve an opioid - 4
84+related cause of action against such drug manufacturers, 5
85+distributors, or combination thereof in a state or federal 6
86+court shall only be utilized to pay for opioid addiction 7
87+treatment and prevention services and health care and law 8
88+enforcement costs rela ted to opioid addiction treatment and 9
89+prevention. Under no circumstances shall such settlement 10
90+moneys be utilized to fund other services, programs, or 11
91+expenses not reasonably related to opioid addiction 12
92+treatment and prevention. 13
93+ 2. (1) There is hereby established in the state 14
94+treasury the "Opioid Addiction Treatment and Recovery Fund", 15
95+which shall consist of the proceeds of any settlement 16
96+described in subsection 1 of this section, as well as any 17
97+funds appropriated by the general assembly, or gifts, 18
98+grants, donations, or bequests. The state treasurer shall 19
99+be custodian of the fund. In accordance with sections 20
100+30.170 and 30.180, the state treasurer may approve 21
101+disbursements. The fund shall be a dedicated fund and money 22
102+in the fund shall be used by the department of mental 23
103+health, the department of health and senior services, the 24

105+department of social services, [and] the department of 25
106+public safety, the department of corrections, and the 26
107+judiciary for the purposes set forth in subsecti on 1 of this 27
108+section. 28
109+ (2) Notwithstanding the provisions of section 33.080 29
110+to the contrary, any moneys remaining in the fund at the end 30
111+of the biennium shall not revert to the credit of the 31
112+general revenue fund. 32
113+ (3) The state treasurer shal l invest moneys in the 33
114+fund in the same manner as other funds are invested. Any 34
115+interest and moneys earned on such investments shall be 35
116+credited to the fund. 36
