Thestatetreasurershallbecustodianofthe 1 6 fundandmayapprovedisbursementsfromthefundinaccordancewith 7 sections30.170and30.180.Uponappropriation,moneyinthefund 8 shallbeusedsolelyforthepurposeofprovidingautomated 9 systems,andthepaymentofassociatedcosts,toimprovethe 10 administrationofthestate'sunemploymentinsuranceprogram. 11 Notwithstanding theprovisionsofsection33.080tothecontrary, 12 allmoneysremaininginthefundattheendofthebienniumshall 13 notreverttothecreditofthegeneralrevenuefund.Thestate 14 treasurershallinvestmoneysinthefundinthesamemanneras 15 otherfundsareinvested. Anyinterestandmoneyearnedonsuch 16 investmentsshallbecreditedtothefund. 17 2.Theunemploymentautomationfundshallnotbeusedin 18 wholeorinpartforanypurposeorinanymannerthatwouldpermit 19 itssubstitutionfor,oracorrespondingreductionin,federal 20 fundsthatwouldbeavailableinitsabsencetofinance 21 expendituresfortheadministrationofthischapter,orcausethe 22 appropriateagencyoftheUnitedStatesgovernmenttowithholdany 23 partofanadministrativegrantwhichwouldotherwisebemade. 288.133.1.Eachemployerliableforcontributionspursuant 2 tothischapter,exceptemployerswithacontributionrateequalto 3 zero,shallpayanannualunemploymentautomationadjustmentinan 4 amountequaltotwoone-hundredthsofonepercentofsuch 5 employer'stotaltaxablewagesforthetwelve-monthperiodending 6 theprecedingJunethirtieth. 7 2.Notwithstanding subsection1ofthissectiontothe 8 contrary,thedivisionmayreducetheautomationadjustment 9 percentagetoensurethatthetotalamountofadjustmentduefrom 2 10 allemployersunderthissectionshallnotexceedfivemillion 11 dollarsannually. 12 3.Eachemployerliabletopayanautomationadjustmentshall 13 benotifiedoftheamountdueunderthissectionbyMarchthirty- 14 firstofeachyearandsuchamountshallbeconsidereddelinquent 15 thirtydaysthereafter. Delinquentunemploymentautomation 16 adjustmentamountsmaybecollectedinthemannerprovidedunder 17 sections288.160and288.170.Allmoneyscollectedunderthis 18 sectionshallbedepositedintheunemploymentautomationfund 19 establishedinsection288.132. 20 4.Forthefirstquarterofeachcalendaryear,thetotal 21 amountofcontributionotherwiseduefromeachemployerliableto 22 paycontributionsunderthischaptershallbereducedbythedollar 23 amountofunemploymentautomationadjustmentduefromsuch 24 employerpursuanttosubsection1ofthissection.However,the 25 amountofcontributionsduefromsuchemployerforthefirst 26 quarterofthecalendaryearinquestionshallnotbereducedbelow 27 zero. 303.025.1.Noownerofamotorvehicleregisteredinthis 2 state,orrequiredtoberegisteredinthisstate,shalloperate, 3 registerormaintainregistrationofamotorvehicle,orpermit 4 anotherpersontooperatesuchvehicle,unlesstheownermaintains 5 thefinancialresponsibilitywhichconformstotherequirementsof 6 thelawsofthisstate.Nononresidentshalloperateorpermit 7 anotherpersontooperateinthisstateamotorvehicleregistered 8 tosuchnonresidentunlessthenonresidentmaintainsthefinancial 9 responsibilitywhichconformstotherequirementsofthelawsof 3 10 thenonresident'sstateofresidence. Furthermore,noperson 11 shalloperateamotorvehicleownedbyanotherwiththeknowledge 12 thattheownerhasnotmaintainedfinancialresponsibilityunless 13 suchpersonhasfinancialresponsibilitywhichcoverstheperson's 14 operationoftheother'svehicle;however,noownerornonresident 15 shallbeinviolationofthissubsectionifheorshefailsto 16 maintainfinancialresponsibilityonamotorvehiclewhichis 17 inoperableorbeingstoredandnotinoperation. Thedirectorof 18 thedepartmentofrevenueshallestablishbyruleaprocessfor 19 voluntarysuspensionofmotorvehicleregistrationforvehicles 20 whichareinoperableorbeingstoredandnotinoperation. The 21 ownerornonresidentshallnotfurtheroperatethevehicleuntil 22 theownerornonresidentnotifiesthedepartmentofrevenuethat 23 thevehiclewillbeinuse,andthedepartmentshallreinstatethe 24 motorvehicleregistrationuponreceiptofproofoffinancial 25 responsibility. Ownersornonresidentswhooperateamotor 26 vehicleduringaperiodofinoperabilityorstorageclaimedunder 27 thissubsectionshallbeguiltyofaclassBmisdemeanorandmay 28 additionallybeguiltyofaviolationofthissubsection. 29 Notwithstanding anyprovisionoflawtothecontrary,the 30 departmentofrevenuemayverifymotorvehiclefinancial 31 responsibilityasprovidedbylaw,butshallnototherwisetake 32 legaloradministrativeactiontoenforcetherequirementsofthis 33 sectionunless,inthediscretionofthedirector,themotor 34 vehicleisdeterminedtohavebeenoperatedinviolationofthis 35 section,amotorvehicleregistrationisappliedforinviolation 36 ofthissection,orthemotorvehicleontwoseparateoccasions 4 37 thirtydaysapartisdeterminedtohaveitsregistration 38 maintainedinviolationofthissection.Thedirectormay 39 prescriberulesandregulationsfortheimplementationofthis 40 section. 41 2.Amotorvehicleownershallmaintaintheowner'sfinancial 42 responsibilityinamannerprovidedforinsection303.160,orwith 43 amotorvehicleliabilitypolicywhichconformstothe 44 requirementsofthelawsofthisstate.Anonresidentmotor 45 vehicleownershallmaintaintheowner'sfinancialresponsibility 46 whichconformstotherequirementsofthelawsofthenonresident's 47 stateofresidence. 48 3.Anypersonwhoviolatesthissectionisguiltyofa 49 misdemeanor. Exceptasotherwiseprovidedinthissection,afirst 50 violationofthissectionshallbepunishableasaclassD 51 misdemeanor. Asecondorsubsequentviolationofthissection 52 [shall] maybe[punishable] punishedbyimprisonmentinthecounty 53 jailforatermnottoexceedfifteendays[and/or] andshallbe 54 punishedbyafinenotlessthantwohundreddollarsbutnotto 55 exceedfivehundreddollars.Priorpleasofguiltyandprior 56 findingsofguiltyshallbepleadedandproveninthesamemanner 57 asrequiredbysection558.021.However,nopersonshallbefound 58 guiltyofviolatingthissectioniftheoperatordemonstratesto 59 thecourtthatheorshemetthefinancialresponsibility 60 requirementsofthissectionatthetimethepeaceofficer, 61 commercialvehicleenforcementofficerorcommercialvehicle 62 inspectorwrotethecitation.Inadditiontoanyotherauthorized 63 punishment,thecourtshallnotifythedirectorofrevenueofany 5 64 personconvictedpursuanttothissectionandshalldooneofthe 65 following: 66 (1)Enteranordersuspendingthedrivingprivilegeasofthe 67 dateofthecourtorder.Ifthecourtordersthesuspensionofthe 68 drivingprivilege,thecourtshallrequirethedefendantto 69 surrendertoitanydriver'slicensethenheldbysuchperson.The 70 lengthofthesuspensionshallbeasprescribedinsubsection2of 71 section303.042.Thecourtshallforwardtothedirectorof 72 revenuetheorderofsuspensionofdrivingprivilegeandany 73 licensesurrenderedwithintendays; 74 (2)Forwardtherecordoftheconvictionforanassessmentof 75 fourpoints; 76 (3)Inlieuofanassessmentofpoints,renderanorderof 77 supervisionasprovidedinsection302.303.Anorderof 78 supervisionshallnotbeusedinlieuofpointsmorethanonetime 79 inanythirty-six-month period.Everycourthavingjurisdiction 80 pursuanttotheprovisionsofthissectionshallforwardarecord 81 ofconvictiontotheMissouristatehighwaypatrol,oratthe 82 writtendirectionoftheMissouristatehighwaypatrol,tothe 83 departmentofrevenue,inamannerapprovedbythedirectorofthe 84 departmentofpublicsafety.Thedirectorshallestablish 85 proceduresfortherecordkeepingandadministrationofthis 86 section;or 87 (4)Foranonresident,suspendthenonresident'sdriving 88 privilegesinthisstateinaccordancewithsection303.030and 89 notifytheofficialinchargeoftheissuanceoflicensesand 90 registrationcertificatesinthestateinwhichsuchnonresident 6 91 residesinaccordancewithsection303.080. 92 4.Nothinginsections303.010to303.050,303.060,303.140, 93 303.220,303.290,303.330and303.370shallbeconstruedas 94 prohibitingthedepartmentofcommerceandinsurancefrom 95 approvingorauthorizingthoseexclusionsandlimitationswhich 96 arecontainedinautomobileliabilityinsurancepoliciesandthe 97 uninsuredmotoristprovisionsofautomobileliabilityinsurance 98 policies. 99 5.Ifacourtentersanorderofsuspension,theoffendermay 100 appealsuchorderdirectlypursuanttochapter512andthe 101 provisionsofsection302.311shallnotapply. 102 6.Anyfinesowedtothestatepursuanttothissectionmay 103 beeligibleforpaymentininstallments. Thedirectorshall 104 promulgaterulesfortheapplicationofpaymentplans,whichshall 105 takeintoaccountindividuals'abilitytopay. 303.041.1.Ifthedirectordetermines[thatasaresultof 2 averificationsampleoraccidentreportthattheownerofamotor 3 vehiclehasnotmaintainedfinancialresponsibility, orifthe 4 directordeterminesasaresultofanorderofsupervision] that 5 theowneroroperatorofamotorvehiclehasnotmaintainedthe 6 financialresponsibilityasrequiredinthischapter,thedirector 7 shallthirty-threedaysaftermailingnotice,suspendthedriving 8 privilegeoftheowneroroperatorand/ortheregistrationofthe 9 vehiclefailingtomeetsuchrequirement. Thenoticeofsuspension 10 shallbemailedtothepersonatthelastknownaddressshownon 11 thedepartment'srecords.Thenoticeofsuspensionisdeemed 12 receivedthreedaysaftermailing.Thenoticeofsuspensionshall 7 13 clearlyspecifythereasonandstatutorygroundsforthe 14 suspensionandtheeffectivedateofthesuspension,therightof 15 thepersontorequestahearing,theprocedureforrequestinga 16 hearing,andthedatebywhichthatrequestforahearingmustbe 17 made.Iftherequestforahearingisreceivedbythedepartment 18 priortotheeffectivedateofthesuspension,theeffectivedate 19 ofthesuspensionwillbestayeduntilafinalorderisissued 20 followingthehearing. 21 2.Exceptasotherwiseprovidedbylaw,neitherthefactthat 22 subsequenttothedateofverificationorconviction,theowner 23 acquiredtherequiredliabilityinsurancepolicynorthefactthat 24 theownerterminatedownershipofthemotorvehicle,shallhaveany 25 bearinguponthedirector'sdecisiontosuspend.Untilitis 26 terminated,thesuspensionshallremaininforceafterthe 27 registrationisrenewedoranewregistrationisacquiredforthe 28 motorvehicle.Thesuspensionalsoshallapplytoanymotor 29 vehicletowhichtheownertransferstheregistration. Effective 30 January1,2000,thedepartmentshallnotextendanysuspensionfor 31 failuretopayadelinquentlatesurrenderfeepursuanttothis 32 subsection. 319.129.1.Thereisherebycreatedaspecialtrustfundto 2 beknownasthe"PetroleumStorageTankInsuranceFund"withinthe 3 statetreasurywhichshallbethesuccessortotheunderground 4 storagetankinsurancefund.Moneysinsuchspecialtrustfund 5 shallnotbedeemedtobestatefunds.Notwithstanding the 6 provisionsofsection33.080tothecontrary,moneysinthefund 7 shallnotbetransferredtogeneralrevenueattheendofeach 8 8 biennium. 9 2.Theowneroroperatorofanyundergroundstoragetank, 10 includingthestateofMissourianditspoliticalsubdivisionsand 11 publictransportationsystems,inserviceonAugust28,1989, 12 shallsubmittothedepartmentafeeofonehundreddollarsper 13 tankonorbeforeDecember31,1989.Theowneroroperatorofany 14 undergroundstoragetankwhoseekstoparticipateinthepetroleum 15 storagetankinsurancefund,includingthestateofMissouriand 16 itspoliticalsubdivisionsandpublictransportationsystems,and 17 whoseundergroundstoragetankisbroughtintoserviceafter 18 August28,1998,shalltransmitonehundreddollarspertanktothe 19 boardwithhisorherinitialapplication. Suchamountshallbea 20 one-timepayment,andshallbeinadditiontothepaymentrequired 21 bysection319.133.Theowneroroperatorofanyaboveground 22 storagetankregulatedbythischapter,includingthestateof 23 Missourianditspoliticalsubdivisionsandpublictransportation 24 systems,whoseekstoparticipateinthepetroleumstoragetank 25 insurancefund,shalltransmitonehundreddollarspertanktothe 26 boardwithhisorherinitialapplication. Suchamountshallbea 27 one-timepaymentandshallbeinadditiontothepaymentrequired 28 bysection319.133.Moneysreceivedpursuanttothissectionshall 29 betransmittedtothedirectorofrevenuefordepositinthe 30 petroleumstoragetankinsurancefund. 31 3.Thestatetreasurermaydepositmoneysinthefundinany 32 ofthequalifieddepositoriesofthestate.Allsuchdeposits 33 shallbesecuredinamanneranduponthetermsasareprovidedby 34 lawrelativetostatedeposits.Interestearnedshallbecredited 9 35 tothepetroleumstoragetankinsurancefund. 36 4.Thegeneraladministrationofthefundandthe 37 responsibilityfortheproperoperationofthefund,includingall 38 decisionsrelatingtopaymentsfromthefund,areherebyvestedin 39 aboardoftrustees. Theboardoftrusteesshallconsistofthe 40 commissionerofadministrationorthecommissioner'sdesignee,the 41 directorofthedepartmentofnaturalresourcesorthedirector's 42 designee,thedirectorofthedepartmentofagricultureorthe 43 director'sdesignee,andeightcitizensappointedbythegovernor 44 withtheadviceandconsentofthesenate.Threeoftheappointed 45 membersshallbeownersoroperatorsofretailpetroleumstorage 46 tanks,includingonetankowneroroperatorofgreaterthanone 47 hundredtanks;onetankowneroroperatoroflessthanonehundred 48 tanks;andoneabovegroundstoragetankowneroroperator. One 49 appointedtrusteeshallrepresentafinanciallendinginstitution, 50 andoneappointedtrusteeshallrepresenttheinsurance 51 underwritingindustry. Oneappointedtrusteeshallrepresent 52 industrialorcommercialusersofpetroleum. Thetworemaining 53 appointedcitizensshallhavenopetroleum-related business 54 interest,andshallrepresentthenonregulatedpublicatlarge. 55 Themembersappointedbythegovernorshallservefour-yearterms 56 exceptthatthegovernorshalldesignatetwooftheoriginal 57 appointeestobeappointedforoneyear,twotobeappointedfor 58 twoyears,twotobeappointedforthreeyearsandtwotobe 59 appointedforfouryears.Anyvacanciesoccurringontheboard 60 shallbefilledinthesamemannerasprovidedinthissection. 61 5.[TheboardshallmeetinJeffersonCity,Missouri,within 10 62 thirtydaysfollowingAugust28,1996.Thereafter,] Theboard 63 shallmeetuponthewrittencallofthechairmanoftheboardorby 64 theagreementofanysixmembersoftheboard.Noticeofeach 65 meetingshallbedeliveredtoallothertrusteesinpersonorby 66 registeredmailnotlessthansixdayspriortothedatefixedfor 67 themeeting.Theboardmaymeetatanytimebyunanimousmutual 68 consent.Thereshallbeatleastonemeetingineachquarter. 69 6.Sixtrusteesshallconstituteaquorumforthetransaction 70 ofbusiness,andanyofficialactionoftheboardshallbebasedon 71 amajorityvoteofthetrusteespresent. 72 7.Thetrusteesshallservewithoutcompensationbutshall 73 receivefromthefundtheiractualandnecessaryexpensesincurred 74 intheperformanceoftheirdutiesfortheboard. 75 8.TheboardoftrusteesshallbeatypeIIIagencyandshall 76 appointanexecutivedirectorandotheremployeesasneeded,who 77 shallbestateemployeesandbeeligibleforallcorresponding 78 benefits.Theexecutivedirectorshallhavechargeoftheoffices, 79 operations,records,andotheremployeesoftheboard,subjectto 80 thedirectionoftheboard.Employeesoftheboardshallreceive 81 suchsalariesandnecessaryexpensesasshallbefixedbythe 82 board. 83 9.StaffresourcesfortheMissouripetroleumstoragetank 84 insurancefundmaybeprovidedbythedepartmentofnatural 85 resourcesoranotherstateagencyasotherwisespecifically 86 determinedbytheboard.Thefundshallcompensatethedepartment 87 ofnaturalresourcesorotherstateagencyforallcostsof 88 providingstaffrequiredbythissubsection. Suchcompensation 11 89 shallbemadepursuanttocontractsnegotiatedbetweentheboard 90 andthedepartmentofnaturalresourcesorotherstateagency. 91 10.Inordertocarryoutthefiduciarymanagementofthe 92 fund,theboardmayselectandemploy,ormaycontractwith, 93 personsexperiencedininsuranceunderwriting,accounting,the 94 servicingofclaimsandratemaking,andlegalcounseltodefend 95 third-partyclaims,whoshallserveattheboard'spleasure. 96 Invoicesforsuchservicesshallbepresentedtotheboardin 97 sufficientdetailtoallowathoroughreviewofthecostsofsuch 98 services. 99 11.[Atthefirstmeetingoftheboard,] Theboardshall 100 electoneofitsmembersaschairman. Thechairmanshallpreside 101 overmeetingsoftheboardandperformsuchotherdutiesasshall 102 berequiredbyactionoftheboard. 103 12.Theboardshallelectoneofitsmembersasvice 104 chairman,andthevicechairmanshallperformthedutiesofthe 105 chairmanintheabsenceofthelatteroruponthechairman's 106 inabilityorrefusaltoact. 107 13.Theboardshalldetermineandprescribeallrulesand 108 regulationsastheyrelatetofiduciarymanagementofthefund, 109 pursuanttothepurposesofsections319.100to319.137.Inno 110 caseshalltheboardhaveoversightregardingenvironmental 111 cleanupstandardsforpetroleumstoragetanks. 112 14.Notrusteeorstaffmemberofthefundshallreceiveany 113 gainorprofitfromanymoneysortransactionsofthefund.This 114 shallnotprecludeanyeligibletrusteefrommakingaclaimor 115 receivingbenefitsfromthepetroleumstoragetankinsurancefund 12 116 asprovidedbysections319.100to319.137. 117 15.Theboardmayreinsurealloraportionofthefund's 118 liability. Anyinsurerwhosellsenvironmentalliability 119 insuranceinthisstatemay,attheoptionoftheboard,reinsure 120 someportionofthefund'sliability. 121 16.Thepetroleumstoragetankinsurancefundshallexpireon 122 December31,[2025] 2030,unlessextendedbyactionofthegeneral 123 assembly. AfterDecember31,[2025] 2030,theboardoftrustees 124 maycontinuetofunctionforthesolepurposeofcompletingpayment 125 ofclaimsmadepriortoDecember31,[2025] 2030. 126 17.Theboardshallannuallycommissionanindependent 127 financialauditofthepetroleumstoragetankinsurancefund.The 128 boardshallbienniallycommissionanactuarialanalysisofthe 129 petroleumstoragetankinsurancefund.Theresultsofthe 130 financialauditandtheactuarialanalysisshallbemadeavailable 131 tothepublic.Theboardmaycontractwiththirdpartiestocarry 132 outtherequirementsofthissubsection. 133 18.Theboardoftrusteesshallpromulgateallnecessary 134 rulesandregulationsfortheadministrationofthissection.Any 135 ruleorportionofarule,asthattermisdefinedinsection 136 536.010,thatiscreatedundertheauthoritydelegatedinthis 137 sectionshallbecomeeffectiveonlyifitcomplieswithandis 138 subjecttoalloftheprovisionsofchapter536and,ifapplicable, 139 section536.028.Thissectionandchapter536arenonseverableand 140 ifanyofthepowersvestedwiththegeneralassemblypursuantto 141 chapter536toreview,todelaytheeffectivedate,orto 142 disapproveandannularulearesubsequentlyheld 13 143 unconstitutional, thenthegrantofrulemakingauthorityandany 144 ruleproposedoradoptedafterAugust28,2022,shallbeinvalid 145 andvoid. 375.159.1.Asusedinthissection,thefollowingterms 2 shallmean: 3 (1)"Aggregatorsite",awebsitethatprovidesinformation 4 regardinginsuranceproductsfrommorethanoneinsurer,including 5 productandinsurerinformation,foruseincomparisonshopping; 6 (2)"Blankettravelinsurance",apolicyoftravelinsurance 7 issuedtoanyeligiblegroupprovidingcoverageforspecific 8 classesofpersonsdefinedinthepolicy,withcoverageprovidedto 9 allmembersoftheeligiblegroupwithoutaseparatechargeto 10 individualmembersoftheeligiblegroup; 11 (3)"Cancellationfeewaiver",acontractualagreement 12 betweenasupplieroftravelservicesanditscustomertowaive 13 someorallofthenonrefundablecancellationfeeprovisionsofthe 14 supplier'sunderlyingtravelcontractwithorwithoutregardto 15 thereasonforthecancellationorformofreimbursement. 33 (b)Anycollege,school,orotherinstitutionoflearning, 34 coveringstudents,teachers,employees,orvolunteers; 35 (c)Anyemployercoveringanygroupofemployees, 36 volunteers,contractors,membersofboardsofdirectors, 37 dependents,orguests; (1)Acompanythathaslessthanthreehundredmillion 1070 dollarsofordinarylifepremiumandthatislicensedanddoing 1071 businessinMissouriandthatissubjecttotherequirementsof 1072 subsections6and7ofthissectionmayholdreservesbasedonthe 1073 mortalitytablesandinterestratesdefinedbythevaluation 1074 manualfornetpremiumreservesandusingthemethodologydefined 1075 intheprovisionsofparagraphs(b)through(i)ofsubdivision(2) 1076 ofsubsection1ofthissectionandsubsection3ofsection 1077 376.370astheyapplytoordinarylifeinsuranceinlieuofthe 1078 reservesrequiredbysubsections6and7ofthissection,provided 1079 that: 1080 (a)Ifthecompanyisamemberofagroupoflifeinsurers, 1081 thegrouphascombinedordinarylifepremiumsoflessthansix 1082 hundredmilliondollars; 1083 (b)Thecompanyreportedtotaladjustedcapitalofatleast 1084 fourhundredfiftypercentofauthorizedcontrollevelrisk-based 1085 capitalintherisk-basedcapitalreportforthepriorcalendar 1086 year; 1087 (c)Theappointedactuaryhasprovidedanunqualified 1088 opiniononthereservesinaccordancewithsubsections4and5of 1089 thissectionforthepriorcalendaryear; 70 1090 (d)Thecompanyhasprovidedacertificationbyaqualified 1091 actuarythatanyuniversallifepolicywithasecondaryguarantee 1092 issuedaftertheoperativedateofthevaluationmanualmeetsthe 1093 definitionofanonmaterialsecondaryguaranteeuniversallife 1094 productasdefinedinthevaluationmanual. 1095 (2)Forpurposesofsubdivision(1)ofthissubsection, 1096 ordinarylifepremiumsaremeasuredasdirectpremiumplus 1097 reinsuranceassumedfromanunaffiliatedcompany,asreportedin 1098 thepriorcalendaryearannualstatement. 1099 (3)Adomesticcompanymeetingalloftheaboveconditions 1100 mayfileastatementpriortoJulyfirstwiththedirector 1101 certifyingthattheseconditionsaremetforthecurrentcalendar 1102 yearbasedonpremiumsandothervaluesfromthepriorcalendar 1103 yearfinancialstatements. Thedirectormayrejectsuchstatement 1104 priortoSeptemberfirstandrequireacompanytocomplywiththe 1105 valuationmanualrequirementsforlifeinsurancereserves.] 376.1800. 1.Asusedinthissection,thefollowingterms 2 shallmean: 3 (1)"Medicalretaineragreement",acontractbetweena 4 [physician] providerandanindividualpatientorsuchindividual 5 patient'slegalrepresentativeinwhichthe[physician] provider 6 agreestoprovidecertainhealthcareservicesdescribedinthe 7 agreementtotheindividualpatientforanagreed-uponfeeand 8 periodoftime; 9 (2)["Physician"] "Provider",achiropractorlicensedunder 10 chapter331,adentistlicensedunderchapter332,oraphysician 11 licensedunderchapter334.[Physician] Providerincludesan 71 12 individual[physician] provideroragroupof[physicians] 13 providers. 14 2.Amedicalretaineragreementisnotinsuranceandisnot 15 subjecttothischapter.Enteringintoamedicalretainer 16 agreementisnotthebusinessofinsuranceandisnotsubjectto 17 thischapter. 18 3.A[physician] provideroragentofa[physician] provider 19 isnotrequiredtoobtainacertificateofauthorityorlicense 20 underthissectiontomarket,sell,oroffertosellamedical 21 retaineragreement. 22 4.Tobeconsideredamedicalretaineragreementforthe 23 purposesofthissection,theagreementshallmeetallofthe 24 followingrequirements: 25 (1)Beinwriting; 26 (2)Besignedbythe[physician] provideroragentofthe 27 [physician] providerandtheindividualpatientorsuchindividual 28 patient'slegalrepresentative; 29 (3)Alloweitherpartytoterminatetheagreementonwritten 30 noticetotheotherparty; 31 (4)Describethespecifichealthcareservicesthatare 32 includedintheagreement; 33 (5)Specifythefeefortheagreement; 34 (6)Specifytheperiodoftimeundertheagreement;and 35 (7)Prominentlystateinwritingthattheagreementisnot 36 healthinsurance. 37 5.(1)Foranypatientwhoentersintoamedicalretainer 38 agreementunderthissectionandwhohasestablishedahealth 72 39 savingsaccount(HSA)incompliancewith26U.S.C.Section223,or 40 whohasaflexiblespendingarrangement(FSA)orhealth 41 reimbursementarrangement(HRA),feesunderthepatient'smedical 42 retaineragreementmaybepaidfromsuchhealthsavingsaccountor 43 reimbursedthroughsuchflexiblespendingarrangementorhealth 44 reimbursementarrangement,subjecttoanyfederalorstatelaws 45 regardingqualifiedexpendituresfromahealthsavingsaccount,or 46 reimbursementthroughaflexiblespendingarrangementorahealth 47 reimbursementarrangement. 48 (2)Theemployerofanypatientdescribedinsubdivision(1) 49 ofthissubsectionmay: 50 (a)Makecontributionstosuchpatient'shealthsavings 51 account,flexiblespendingarrangement,orhealthreimbursement 52 arrangementtocoveralloranyportionoftheagreed-uponfees 53 underthepatient'smedicalretaineragreement,subjecttoany 54 federalorstaterestrictionsoncontributionsmadebyanemployer 55 toahealthsavingsaccount,orreimbursementthroughaflexible 56 spendingarrangement,orhealthreimbursementarrangement;or 57 (b)Paytheagreed-uponfeesdirectlytothe[physician] 58 providerunderthemedicalretaineragreement. 59 6.Nothinginthissectionshallbeconstruedasprohibiting, 60 limiting,orotherwiserestrictinga[physician] providerina 61 collaborativepracticearrangementfromenteringintoamedical 62 retaineragreementunderthissection. 379.011.1.Asusedinthissection,thefollowingterms 2 mean: 3 (1)"Deliveredbyelectronicmeans",includesdeliverytoan 73 4 electronicmailaddressatwhichapartyhasconsentedtoreceive 5 noticesordocuments,orpostingonanelectronicnetworkorsite 6 accessibleviatheinternet,mobileapplication,computer,mobile 7 device,tablet,oranyotherelectronicdevice,togetherwitha 8 separatenoticetoapartydirectedtotheelectronicmailaddress 9 atwhichthepartyhasconsentedtoreceivenoticeoftheposting; 10 (2)"Party",anyrecipientofanynoticeordocumentrequired 11 aspartofaninsurancetransaction,includingbutnotlimitedto 12 anapplicant,aninsuredorapolicyholder. 13 2.Subjecttosubsection3ofthissection,anynoticetoa 14 partyoranyotherdocumentrequiredunderapplicablelawinan 15 insurancetransactionorthatistoserveasevidenceofinsurance 16 coveragemaybedelivered,stored,andpresentedbyelectronic 17 meanssolongasitmeetstherequirementsofsections432.200to 18 432.295.Deliveryofanoticeordocumentinaccordancewiththis 19 subsectionshallbeconsideredequivalenttoanydeliverymethod 20 requiredunderapplicablelaw,includingdeliverybyfirstclass 21 mail,firstclassmailpostageprepaid,certifiedmail,or 22 certificateofmailing. 23 3.Anoticeordocumentmaybedeliveredbyelectronicmeans 24 byaninsurertoapartyunderthis[subsection] sectionif: 25 (1)Thepartyhasaffirmativelyconsentedtothatmethodof 26 deliveryandhasnotwithdrawntheconsent; 27 (2)Theparty,beforegivingconsent,isprovidedwitha 28 clearandconspicuousstatementinformingthepartyof: 29 (a)Anyrightoroptiontohavethenoticeordocument 30 providedinpaperoranothernonelectronicformatnoadditional 74 31 cost; 32 (b)Therightofthepartytowithdrawconsenttohavea 33 noticeordocumentdeliveredbyelectronicmeans; 34 (c)Whethertheparty'sconsentappliesonlytothe 35 particulartransactionastowhichthenoticeordocumentmustbe 36 givenortoidentifiedcategoriesofnoticesordocumentsthatmay 37 bedeliveredbyelectronicmeansduringthecourseoftheparties' 38 relationship; 39 (d)Themeans,afterconsentisgiven,bywhichapartymay 40 obtainapapercopyofanoticeordocumentdeliveredbyelectronic 41 meansatnoadditionalcost;and 42 (e)Theprocedureapartymustfollowtowithdrawconsentto 43 haveanoticeordocumentdeliveredbyelectronicmeansandto 44 updateinformationneededtocontactthepartyelectronically; 45 (3)Theparty,beforegivingconsent,isprovidedwitha 46 statementofthehardwareandsoftwarerequirementsforaccessto 47 andretentionofanoticeordocumentdeliveredbyelectronicmeans 48 andconsentselectronically, andconfirmsconsentelectronically, 49 inamannerthatreasonablydemonstratesthatthepartycanaccess 50 informationintheelectronicformthatwillbeusedfornoticesor 51 documentsdeliveredbyelectronicmeansastowhichthepartyhas 52 givenconsent;and 53 (4)Afterconsentofthepartyisgiven,theinsurer,inthe 54 eventachangeinthehardwareorsoftwarerequirementsneededto 55 accessorretainanoticeordocumentdeliveredinelectronicmeans 56 createsamaterialriskthatthepartywillnotbeabletoaccess 57 orretainasubsequentnoticeordocumenttowhichtheconsent 75 58 applies: 59 (a)Providesthepartywithastatementoftherevised 60 hardwareandsoftwarerequirementsforaccesstoandretentionofa 61 noticeordocumentdeliveredbyelectronicmeansandoftheright 62 ofthepartytowithdrawconsentpursuanttoparagraph(b)of 63 subdivision(2)ofthissubsection;and 64 (b)Complieswithsubdivision(2)ofthissubsection. 65 4.Notwithstandinganyotherprovisionsofthissection,ifa 66 policyofinsuranceispurchaseddirectlythroughaninsurer's 67 website,portal,orapplication,andisinitiallydeliveredby 68 electronicmeans,aparty'sconsenttohaveallfuturenoticesand 69 documentsrelatedtothepolicy,orclaimsthereunder,delivered 70 byelectronicmeansshallbepresumed.Nothinginthissubsection 71 shallaffecttherightofapartyunderthissectiontowithdraw 72 itsconsenttohaveanoticeordocumentdeliveredbyelectronic 73 means. 74 5.Thissectiondoesnotaffectrequirementsrelatingto 75 contentortimingofanynoticeordocumentrequiredunder 76 applicablelaw.Ifanyprovisionofapplicablelawrequiringa 77 noticeordocumenttobeprovidedtoapartyexpresslyrequires 78 verificationoracknowledgmentofreceiptofthenoticeor 79 document,thenoticeordocumentmaybedeliveredbyelectronic 80 meansonlyifthemethodusedprovidesforverificationor 81 acknowledgmentofreceipt.Absentverificationoracknowledgment 82 ofreceiptoftheinitialnoticeordocumentonthepartofthe 83 party,theinsurershallsendtwosubsequentnoticesordocuments 84 atintervalsoffivebusinessdays.Thelegaleffectiveness, 76 85 validity,orenforceabilityofanycontractorpolicyofinsurance 86 executedbyapartymaynotbemadecontingentuponobtaining 87 electronicconsentorconfirmationofconsentofthepartyin 88 accordancewithsubdivision(3)ofsubsection3ofthissection. 89 [5.] 6.Awithdrawalofconsentbyapartydoesnotaffect 90 thelegaleffectiveness,validity,orenforceabilityofanotice 91 ordocumentdeliveredbyelectronicmeanstothepartybeforethe 92 withdrawalofconsentiseffective. Awithdrawalofconsentbya 93 partyiseffectivewithinthirtydaysafterreceiptofthe 94 withdrawalbytheinsurer.Failurebyaninsurertocomplywith 95 subdivision(4)ofsubsection3ofthissectionmaybetreated,at 96 theelectionoftheparty,asawithdrawalofconsentforpurposes 97 ofthissection. 98 [6.] 7.Thissectiondoesnotapplytoanoticeordocument 99 deliveredbyaninsurerinanelectronicformbeforeAugust28, 100 2013,toapartywho,beforethatdate,hasconsentedtoreceive 101 noticesordocumentsinanelectronicformotherwiseallowedby 102 law.Iftheconsentofapartytoreceivecertainnoticesor 103 documentsinanelectronicformisonfilewithaninsurerbefore 104 August28,2013,andpursuanttothissection,aninsurerintends 105 todeliveradditionalnoticesordocumentstosuchpartyinan 106 electronicform,thenpriortodeliveringsuchadditionalnotices 107 ordocumentselectronically, theinsurershallnotifytheparty 108 of: 109 (1)Thenoticesordocumentsthatmaybedeliveredby 110 electronicmeansunderthissectionthatwerenotpreviously 111 deliveredelectronically; and 77 112 (2)Theparty'srighttowithdrawconsenttohavenoticesor 113 documentsdeliveredbyelectronicmeans. 114 [7.] 8.Apartywhodoesnotconsenttodeliveryofnotices 115 ordocumentsundersubsection3ofthissection,orwhowithdraws 116 theirconsent,shallnotbesubjecttoanyadditionalfeesorcosts 117 forhavingnoticesordocumentsprovidedormadeavailabletothem 118 inpaperoranothernonelectronicform. 119 [8.] 9.Ifanyprovisionofapplicablelawrequiresa 120 signatureornoticeordocumenttobenotarized,acknowledged, 121 verified,ormadeunderoath,therequirementissatisfiedifthe 122 electronicsignatureofthepersonauthorizedtoperformthose 123 acts,togetherwithallotherinformationrequiredtobeincluded 124 bytheprovision,isattachedtoorlogicallyassociatedwiththe 125 signature,notice,ordocument. 126 [9.] 10.Thissectionmaynotbeconstruedtomodify,limit, 127 orsupercedetheprovisionsofsections354.442,376.1450,or 128 432.200to432.295.Theprovisionsofthissectionshallapplyto 129 noticesanddocumentsissuedbyinsurersorganizedunderthis 130 chapterorchapter380andtonoticesanddocumentsrelatingto 131 lifeinsuranceproductsissuedbyinsurersorganizedunderchapter 132 376. 133 [10.] 11.Nothinginthissectionshallpreventaninsurer 134 fromofferingadiscounttoaninsuredwhoelectstoreceive 135 noticesanddocumentselectronicallyinaccordancewiththis 136 section.
