BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Section160.516,RSMo,isrepealedandfournewsectionsenactedinlieu 2thereof,tobeknownassections160.516,161.023,161.852,and170.360,toreadasfollows: 160.516.1.Notwithstandingtheprovisionsofsection160.514,thestateboardof 2educationandthedepartmentofelementaryandsecondaryeducationshallnotbeauthorized 3tomandateandareexpresslyprohibitedfrommandatingorpromotingthecurriculum, 4textbooks,orotherinstructionalmaterialstobeusedinpublicschools.Eachlocalschool 5boardshallbe[responsiblefortheapprovalandadoptionof]requiredtoapproveandadopt 6thecurriculumusedbytheschooldistrictatleastsixmonthspriortoimplementation. The 7provisionsofthissubsectionshallnotapplytoschoolsandinstructionalprograms 8administeredbythestateboardofeducationandthedepartmentofelementaryand 9secondaryeducationortoschooldistrictsthatareclassifiedasunaccredited. 10 2.Thestateboardofeducationandthedepartmentofelementaryandsecondary 11educationshallnotrequiredistrictstouseanyappendixtothecommoncorestatestandards. 12 3.Theschoolboardforeachschooldistrictshalladoptpoliciesandprocedures 13toensuretheapprovedandadoptedcurriculapresentedundersubsection1ofthis 14sectionareproperlyimplementedintheclassroom.Thechoiceofacademicclass 15offeringsandcurriculummaterials: 16 (1)Shallnotbebasedonsurveys,inventories,orotherevaluations,analyses,or 17assessmentsof: EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 (a)Student,family,orcommunityimmutableandotheridentifying 19characteristicsincluding,butnotlimitedto,race,binarysex,genderchoices,religion, 20disabilities,orincome; 21 (b)Psychologicalorsocialemotionaldata;or 22 (c)Traumaandotherpsychologicalandemotionalproblems;and 23 (2)Shallensureschoolsmeetthepurposeofeducationasprovidedinthe 24MissouriConstitutionanddisseminatetheknowledgeandintelligenceneededtoensure 25therightsandlibertiesoflegalUnitedStatescitizensinMissouri. 26 4.Atleastfiveyearsofdatashowingpercentagesofstudentsbygradelevel, 27subject,andpercentagelevelofproficiencybasedonstateassessmentscoresshallbe 28postedinthesamesectionasthecurriculaonthedistrict'swebsiteandshallalsobe 29availableforinspectionateachschoolwithinthedistrict. 161.023.1.Alladministrator,teacher,andstaffprofessionaldevelopmentand 2instructionalprogramsofferedtoschoolsthatarepaidforwithstatefunds,whether 3offereddirectlybythedepartmentofelementaryandsecondaryeducation,another 4stateagency,orbyathird-partycontractor,shallbefullytransparentandavailableto 5thepublicasfollows: 6 (1)Allprogrammaterials,videos,links,andresourcesshallbepubliclyavailable 7atnochargeonthedepartment'swebsite; 8 (2)Allprogramofferingsshallbeopenforpublicattendance.Allprogram 9offeringsshallbelistedinonelocationonthedepartment'swebsitebydateandshow 10thetitleoftheprogram,programdescription,location,andtime.Programsshallbe 11publiclypostedatleastthirtydaysinadvance,withexceptionsapplyingonlywhenthe 12programisaddedwithfewerthanthirtydaysnoticebasedonanemergencyasdetailed 13bytheschool.Anyresidentofthestateshallbeallowedaccessinsomemannertothe 14program.Audioandvideorecordingsoftheseprogramsshallberequiredand 15accessibletothepublicfreeofchargeforatleastthreeyearsaftertheeventdate.Ifa 16programrecordingwasnotmadeormaintained,theprogramdate,name,and 17descriptionshallstillbelistedonthewebsiteforthreeyearsaftertheeventdatehas 18passedwithaclearexplanationastowhyarecordingisnotavailable; 19 (3)Listsbyschooldistrictshowingdateofattendance,nameandpositionof 20districtattendee,programname,anddescriptionshallbeprovidedbyrequestandfree 21ofchargetoMissouriresidentsforthepriorthreeyears; 22 (4)Noon-siteprogramshallbeprovidedbyaschoolpriortothelocalschool 23boardapprovingandadoptingthestateprogram;and 24 (5)Listsoflocalschoolboardsthathaveapprovedthestateprogramshallbe 25providedonthedepartment'swebsite. HCSHB2189 2 26 2.Forprogramsofferedtoschoolsbythird-partycontractors,thedepartment 27shallmaintaindataandinformationonthedepartment'swebsiterelatedtothose 28programsincluding,butnotlimitedto,abreakdownbyschooldistrictforeachMissouri 29state-fundedprogramshowingtheamountpaidtothethird-partycontractorbyyear 30andbyprogram,detailingthepublicfundsspentoncategoriesofprogrampromotion, 31development,training,localimplementation,andothermiscellaneouscostssuchas 32travelandphysicalmaterialsforthepriorthreeyears. 33 3.Informationdescribingallitemsrequiredtobemadeavailabletothepublic 34underthissectionandinstructionsforviewingsuchinformationonthedepartment's 35websiteshallbepostedontheMissourieducationtransparencyandaccountability 36portalcreatedundersection161.852. 161.852.1.Thecommissionerofeducationshallestablishthe"Missouri 2EducationTransparencyandAccountabilityPortal",whichshallbeaninternet-based 3toolcreatingtransparencyinMissouri'spubliceducationsystemandprovidingcitizens 4accesstoeveryschooldistrict'scurricula,sourcematerials,andprofessional 5developmentmaterials. 6 2.Theportalshallconsistofaneasy-to-searchdatabaseincluding,butnot 7limitedto,thefollowing: 8 (1)Allcurriculataughtbytheschooldistrict; 9 (2)Allsourcematerialsusedtodevelopadistrict'scurricula; 10 (3)Alldocumentsusedbyaschooldistrictintheprofessionaldevelopmentofthe 11district'sfacultyandstaffincluding,butnotlimitedto,administrators,teachers, 12counselors,andclassroomsupportstaff; 13 (4)Allsourcematerialsusedtodevelopthedocumentsusedbyaschooldistrict 14initsprofessionaldevelopmentmaterialsasoutlinedinsubdivision(3)ofthis 15subsection; 16 (5)Allspeakersandguestsusedbyaschooldistrictinitsprofessional 17developmentactivities; 18 (6)Thecostsassociatedwithspeakersandguestsusedbyaschooldistrictinits 19professionaldevelopmentactivities;and 20 (7)Informationrequiredtobepostedontheportalundersections161.023and 21170.360. 22 3.Thecommissionerofeducationshallestablishanonlineformthateachschool 23districtinthisstateshallcompletewithinformationrequiredundersubsection2ofthis 24section. 25 4.Aschooldistrictshallsubmitanyupdatestotheinformationoutlinedin 26subsection2ofthissectionwithinfivebusinessdaysoftheinformationchanging. HCSHB2189 3 27 5.Thecommissionerofeducationshallupdatetheportalwiththeinformation 28requiredbythissectiontobesubmittedbyeachschooldistrictnolessthanweeklyand 29shallensurethattheportalismaintainedastheprimarycentralizedsourceof 30informationaboutthecurriculaandinstructionalmaterialsusedbypublicschool 31districts. 32 6.Thedepartmentofelementaryandsecondaryeducationmaypromulgate 33rulestoimplementthissection.Anyruleorportionofarule,asthattermisdefinedin 34section536.010,thatiscreatedundertheauthoritydelegatedinthissectionshall 35becomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter 36536and,ifapplicable,section536.028.Thissectionandchapter536arenonseverable, 37andifanyofthepowersvestedwiththegeneralassemblypursuanttochapter536to 38review,todelaytheeffectivedate,ortodisapproveandannularulearesubsequently 39heldunconstitutional,thenthegrantofrulemakingauthorityandanyruleproposedor 40adoptedafterAugust28,2022,shallbeinvalidandvoid. 170.360.1.(1)Schooldistrictsandcharterschoolsshalldisplaythefollowing 2informationontheschoolwebsiteinaneasilyaccessiblelocation: 3 (a)Alltrainingmaterialsusedforstaffandfacultytrainingrelatedto 4nondiscrimination,diversity,equity,inclusion,race,ethnicity,sex,orbias; 5 (b)Allinstructionalorcurricularmaterialsrelatingtonondiscrimination, 6diversity,equity,inclusion,race,ethnicity,sex,orbias.Suchinstructionalmaterials 7shallidentify,ataminimum: 8 a.Thetitle,author,organization,andanywebsiteassociatedwitheachmaterial 9andactivity; 10 b.Abriefdescriptionoftheinstructionalmaterial; 11 c.Alinktotheinstructionalmaterial,ifpubliclyavailableontheinternet,or 12informationonhowtorequestreviewofacopyoftheinstructionalmaterial;and 13 d.Iftheinstructionalmaterialwascreatedbyastafforfacultymember,the 14identityofsuchperson;and 15 (c)Anyproceduresforthedocumentation,review,orapprovalofthetraining, 16instructional,orcurricularmaterialsusedforstaffandfacultytrainingorstudent 17instructionattheschool,includingbytheprincipal,curriculumadministrators,orother 18teachers. 19 (2)Nothinginthissubsectionshallbeconstruedtorequirethedigital 20reproductionorpostingofcopiesofinstructionalmaterialsifsuchreproductionor 21postingwouldinfringeuponacopyright;providedthat,suchcopyrightedmaterialshall 22bemadeavailableuponrequesttotheextentauthorizedbylaw. HCSHB2189 4 23 2.Theinformationrequiredbysubsection1ofthissectionshallbedisplayed 24onlinewithinsevendaysafterthefirstinstanceoftrainingorinstructioninwhichthe 25materialsareused.Suchinformationshallremaindisplayedontheschoolwebsiteforat 26leasttwoyears.Informationdescribingallitemsrequiredtobemadeavailabletothe 27publicunderthissectionandinstructionsforviewingsuchinformationontheschool 28websiteshallbepostedontheMissourieducationtransparencyandaccountability 29portalcreatedundersection161.852. 30 3.Anyemployeeofaschooldistrictthatdisclosesaviolationofthissectionshall 31beprotectedfromanymannerofretaliationassetforthinsection105.055. 32 4.(1)Suitforallegedviolationsofthissectionmaybebroughtbythe 33departmentofelementaryandsecondaryeducation;theattorneygeneral;the 34prosecutingattorney,countycounselor,orcircuitattorneyforthecityorcountyin 35whichtheschooldistrict,publicschool,orcharterschoolallegedtohaveviolatedthis 36sectionislocated;oranyaggrievedperson,taxpayer,orcitizenresidinginsuchcityor 37county. 38 (2)Suchsuitshallbeinitiatedinthecircuitcourtforthecityorcountyinwhich 39theschooldistrict,publicschool,orcharterschoolallegedtohaveviolatedthissectionis 40located. 41 (3)Uponafindingbyapreponderanceoftheevidencethataschooldistrict, 42publicschool,orcharterschoolhasviolatedthissection,thecourtshallissuesuch 43injunctivereliefreasonablynecessarytocorrectsuchviolation. 44 (4)Uponafindingbyapreponderanceoftheevidencethataschooldistrict, 45publicschool,orcharterschoolhasknowinglyviolatedthissection,thecourtshallissue 46acivilpenaltyinanamountuptoonethousanddollarsandmayorderthepaymentby 47suchdistrictorschoolofallcostsandreasonableattorney'sfeestoanyparty 48successfullyestablishingsuchviolation. 49 (5)Uponafindingbyapreponderanceoftheevidencethataschooldistrict, 50publicschool,orcharterschoolhaspurposefullyviolatedthissection,thecourtshall 51issueacivilpenaltyinanamountuptotenthousanddollarsandmayorderthepayment 52bysuchdistrictorschoolofallcostsandreasonableattorney'sfeestoanyparty 53successfullyestablishingsuchviolation. 54 5.Aschooldistrictorcharterschoolthatdoubtswhetheranyactionordecision 55wouldviolatethissectionmaybringsuitatsuchdistrict'sorschool'sexpenseinthe 56circuitcourtofthecityorcountyinwhichsuchdistrictorschoolislocatedtoascertain 57theproprietyofanysuchactionordecision.Reviewofsuchactionordecisionmay 58includeconsiderationofaproposeduseofschoolresourcesorofparticularpiecesof 59training,instructional,orcurricularmaterial. HCSHB2189 5 60 6.Aschooldistrictorcharterschoolthatdoubtswhetheranyactionordecision 61wouldviolatethissectionmayseekaformalopinionoftheattorneygeneraltoascertain 62theproprietyofanysuchactionordecision.Reviewofsuchactionordecisionmay 63includeconsiderationofaproposeduseofschoolresourcesorofparticularpiecesof 64training,instructional,orcurricularmaterial.
