3thework,whencomplete,shallbereadyforserviceforitsintendedpurposeandshallrequire
4nootherworktobeacompletedsystemorcomponent.
5 2.Allcontractsforprojects,thecostofwhichexceedstwenty-fivethousanddollars,
6enteredintobyanycitycontainingfivehundredthousandinhabitantsormoreshallbeletto

14 3.Allcontractsforprojects,thecostofwhichexceedsonehundredthousanddollars,
15enteredintobyanofficeroragencyofthisstateshallbelettothelowest,responsive,
16responsiblebidderorbiddersbasedonpreestablishedcriteriaafternoticeandpublicationof

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17anadvertisementforfivedaysinadailynewspaperinthecountywheretheworkislocated,
18oratleasttwiceoveraperiodoftendaysormoreinanewspaperinthecountywherethe
19workislocatedandinonedailynewspaperinthestatewhichdoesnothavelessthanfifty
20thousanddailycirculationandbysuchothermeansasdeterminedtobemostlikelytoreach
21potentialbiddersorbypostinganinvitationforbidonthewebsiteoftheofficeroragency
22orthroughanelectronicprocurementsystem. Forallcontractsforprojectsbetween
23twenty-fivethousanddollarsandonehundredthousanddollars,aminimumofthree
24contractorsshallbesolicitedwiththeawardbeingmadetothelowestresponsive,responsible
25bidderbasedonpreestablishedcriteria.
26 4.Thenumberofsuchpublicbidsshallnotberestrictedorcurtailed,butshallbe
27opentoallpersonscomplyingwiththetermsuponwhichthebidsarerequestedorsolicited
28unlessdebarredforcause.Nocontractshallbeawardedwhentheamountappropriatedfor
29sameisnotsufficienttocompletetheworkreadyforservice.
30 5.Dividingaprojectintocomponentlaborormaterialallocationsforthepurposeof
31avoidingbiddingoradvertisingprovisionsrequiredbythissectionisspecificallyprohibited.
415.415.1.Theoperatorofaself-servicestoragefacilityhasalienonallpersonal
2propertystoredwithineachleasedspaceforrent,labor,orothercharges,andforexpenses
3reasonablyincurredinsaleofsuchpersonalproperty,asprovidedinsections415.400to
4415.425.Thelienestablishedbythissubsectionshallhavepriorityoverallotherliensexcept
5thoseliensthathavebeenperfectedandrecordedonpersonalproperty.Therentalagreement
6shallcontainastatement,inboldtype,advisingtheoccupantoftheexistenceofsuchlienand
7thatpropertystoredintheleasedspacemaybesoldtosatisfysuchlieniftheoccupantisin
8default,andthatanyproceedsfromthesaleofthepropertywhichremainaftersatisfactionof
9thelienwillbepaidtothestatetreasurerifunclaimedbytheoccupantwithinoneyearafter
10thesaleoftheproperty.
11 2.Iftheoccupantisindefaultforaperiodofmorethanforty-fivedays,theoperator
12mayenforcetheliengrantedinsubsection1ofthissectionandsellthepropertystoredinthe
13leasedspaceforcash.Saleofthepropertystoredonthepremisesmaybedoneatapublicor
14privatesale,maybedoneasaunitorinparcels,ormaybebywayofoneormorecontracts,
15andmaybeatanytimeorplaceandonanytermsaslongasthesaleisdoneina
16commerciallyreasonablemannerinaccordancewiththeprovisionsofsection400.9-627.
17Theoperatormayotherwisedisposeofanypropertywhichhasnocommercialvalue.
18 3.Theproceedsofanysalemadeunderthissubsectionshallbeappliedtosatisfythe
19lien,withanysurplusbeingheldfordeliveryondemandtotheoccupantoranyother
20lienholderswhichtheoperatorknowsoforwhicharecontainedinthestatementfiledbythe
21occupantpursuanttosubsection3ofsection415.410foraperiodofoneyearafterreceiptof
22proceedsofthesaleandsatisfactionofthelien.Noproceedsshallbepaidtoanoccupant
HCSHB2289	2 23untilsuchoccupantfilesaswornaffidavitwiththeoperatorstatingthattherearenoother
24validliensoutstandingagainstthepropertysoldandthatheorshe,theoccupant,shall
25indemnifytheoperatorforanydamagesincurredormoneyspaidbytheoperatordueto
26claimsarisingfromotherlienholdersofthepropertysold.Aftertheone-yearperiodsetin
27thissubsection,anyproceedsremainingaftersatisfactionofthelienshallbeconsidered
28abandonedpropertytobereportedandpaidtothestatetreasurerinaccordancewithlaws
29pertainingtothedispositionofunclaimedproperty.
30 4.Beforeconductingasaleundersubsection2ofthissection,theoperatorshall:
31 (1)Atleastforty-fivedaysbeforeanydispositionofpropertyunderthissection,
32whichshallrunconcurrentlywithsubsection2ofthissection,notifytheoccupantandeach
33lienholderwhichiscontainedinanystatementfiledbytheoccupantpursuanttosubsection3
34ofsection415.410ofthedefaultbyfirst-classmailorelectronicmailattheoccupant'sor
35lienholder'slastknownaddress,andshallnotifyanythird-partyowneridentifiedbythe
36occupantpursuanttosubsection3ofsection415.410;
37 (2)Nosoonerthantendaysaftermailingthenoticerequiredinsubdivision(1)ofthis
38subsection,mailasecondnoticeofdefault,byverifiedmailorelectronicmail,tothe
39occupantattheoccupant'sorlienholder'slastknownaddress,whichnoticeshallinclude:
40 (a)Astatementthatthecontentsoftheoccupant'sleasedspacearesubjecttothe
41operator'slien;
42 (b)Astatementoftheoperator'sclaim,indicatingthechargesdueonthedateofthe
43notice,theamountofanyadditionalchargeswhichshallbecomeduebeforethedateof
44releaseforsaleandthedatethoseadditionalchargesshallbecomedue;
45 (c)Ademandforpaymentofthechargesduewithinaspecifiedtime,notlessthanten
46daysafterthedateonwhichthesecondnoticewasmailed;
47 (d)Astatementthatunlesstheclaimispaidwithinthetimestated,thecontentsofthe
48occupant'sspacewillbesoldafteraspecifiedtime;and
49 (e)Thename,streetaddressandtelephonenumberoftheoperator,oradesignated
50agentwhomtheoccupantmaycontact,torespondtothenotice;
51 (3)Atleastsevendaysbeforethesale,advertisethetime,place, andtermsofthesale
52intheclassifiedsectionofanewspaperofgeneralcirculationinthejurisdictionwherethe
53saleistobeheldorinanyothercommerciallyreasonablemanner. [Such] Themannerof
54advertisementshallbe[intheclassifiedsectionofthenewspaperandshallstatethattheitems
55willbereleasedforsale]deemedcommerciallyreasonableifatleastthreeindependent
56biddersattendorviewthesaleatthetimeandplaceadvertised.
57 5.Ifthepropertyisavehicle,watercraft,ortrailerandrentandotherchargesremain
58unpaidforsixtydays,theownermaytreatthevehicle,watercraft,ortrailerasanabandoned
59vehicleandhavethevehicle,watercraft,ortrailertowedfromtheself-servicestoragefacility.
HCSHB2289	3 60Whenthevehicle,watercraft,ortraileristowedfromtheself-servicestoragefacility,the
61ownershallnotbeliableforthevehicle,watercraft,ortrailerforanydamagestothemotor
62vehicle,watercraft,ortraileroncethetowertakespossessionoftheproperty.
63 6.Atanytimebeforeasaleunderthissection,theoccupantmaypaytheamount
64necessarytosatisfythelienandredeemtheoccupant'spersonalproperty.
493.050.Allpublicadvertisementsandordersofpublicationrequiredbylawtobe
2madeandalllegalpublicationsaffectingthetitletorealestateshallbepublishedinsome
3daily,triweekly,semiweeklyorweeklynewspaperofgeneralcirculationinthecountywhere
4located, and[which] suchanewspapershallhave:
5 (1)Beenadmittedtothepostofficeasperiodicalsclassmatterinthecityof
6publication;[shallhave]
7 (2)Beeneither:
8 (a)Publishedregularlyandconsecutivelyforaperiodof[threeyears] oneyear,
9exceptthatanewspaperofgeneralcirculationmaybedeemedtobethesuccessortoadefunct
10newspaperofgeneralcirculation,andsubjecttoalloftherightsandprivilegesofsaidprior
11newspaperunderthisstatute,ifthesuccessornewspapershallbeginpublicationnolaterthan
12[thirty] ninetyconsecutivedaysaftertheterminationofpublicationofthepriornewspaper;
13[shallhave] or
14 (b)Purchasedornewlyestablishedbyanewspaperthatsatisfiesthe
15requirementsofparagraph(a)ofthissubdivision;and
16 (3)Alistofbonafidesubscribersvoluntarilyengagedassuch,whohavepaidor
17agreedtopayastatedpriceforasubscriptionforadefiniteperiodoftime[; provided,that
18when].

20Ifapublicnotice,requiredbylawtobepublishedonceaweekforagivennumberofweeks,
21[shall] istobepublishedinadaily,triweekly,semiweeklyorweeklynewspaper,thenotice
22shallappearonceaweek,onthesamedayofeachweek[, andfurtherprovided,that].Every
23affidavittoproofofpublicationshallstatethatthenewspaperinwhichsuchnoticewas
24publishedhascompliedwiththeprovisionsofthissection[; providedfurther,that].The
25durationofconsecutivepublicationprovidedforinthissectionshallnotaffectnewspapers
26whichhavebecomelegalpublicationspriortoSeptember6,1937[; provided,however,that
27when]. Ifanynewspapershallbeforcedtosuspendpublicationinanytimeofwar,duetothe
28ownerorpublisherbeinginductedintotheArmedForcesoftheUnitedStates,thenewspaper
29maybereinstatedwithinoneyearafteractualhostilitieshaveceased,withallthebenefits
30providedpursuanttotheprovisionsofthissection,uponthefilingwiththesecretaryofstate
31ofnoticeofintentionofsuchownerorpublisher,theowner'ssurvivingspouseorlegalheirs,
32torepublishsuchnewspaper,settingforththenameofthepublication,itsvolumeand

34previouslyenteredasperiodicalsclassmailmatter,and[when] ifit[shallhave] hasalistof
35bonafidesubscribersvoluntarilyengagedassuchwhohavepaidoragreedtopayastated
36priceforsubscriptionforadefiniteperiodoftime.Alllawsorpartsoflawsinconflictwith
37thissectionexceptsections493.070to493.120,areherebyrepealed.
493.070.Inallcitiesofthisstatewhichnowhave,orshallhereafterhave,a
2populationofonehundredthousandinhabitantsormore,allpublicnoticesand
3advertisements,directedbyanycourt[,] orrequiredbylawtobepublishedinanewspaper,
4shallbepublishedinsomedailynewspaperofsuchcity,ofgeneralcirculationtherein,which
5shallhavebeenestablishedandcontinuouslypublishedassuchforaperiodofatleast[three
6consecutiveyears] oneyearnextpriortothepublicationofanysuchnotice.
