2enactedinlieuthereof,tobeknownassections44.028and44.032,toreadasfollows:
44.028.1.Wheneverthefederalgovernmentorofficeroragencythereofshalloffer
2tothestate,orthroughthestatetoanypoliticalsubdivisionthereof,services,equipment,
3supplies,materialsorfundsbywayofgift,grantorloan,forthepurposeofemergency
4management,thestateactingthroughtheagency,orthepoliticalsubdivision,throughits
5executiveofficerwiththeconsentofthegovernor,mayaccepttheofferandmayreceivethese
6services,equipment,supplies,materialsorfundsonbehalfofthestateorthepolitical
7subdivisionsubjecttothetermsoftheoffer.
8 2.TheagencymayenterintocontractswiththeU.S.ArmyCorpsofEngineers
9toleaseanydredgingequipmentownedbytheCorpsthatisnotbeingusedatthetime
10thecontractisenteredintoandthattheCorpswillnotuseforthedurationofthe
11contract.Thecontractsauthorizedinthissubsectionshallbelimitedtoleasing
12equipmentfordredgingsiltfromports,rivers,andstreamsforfloodprevention
13purposes.
44.032.1.(1)Asusedinthissection,theterm"ruralelectriccooperative"
2meansanyruralelectriccooperativeorganizedoroperatingundertheprovisionsof
3chapter394,anycorporationorganizedonanonprofitoracooperativebasisas
4describedinsubsection1ofsection394.200,oranyelectricalcorporationoperating
5underacooperativebusinessplanasdescribedinsubsection2ofsection393.110.
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 6 (2)Thegeneralassemblyrecognizesthenecessityforanticipatingandmaking
7advanceprovisionstocarefortheunusualandextraordinaryburdensimposedbydisasters
8oremergenciesonthisstate[and],itspoliticalsubdivisions[bydisastersoremergencies],
9andruralelectriccooperatives. Tomeetsuchsituations,itistheintentionofthegeneral
10assemblytoconferemergencypowersonthegovernor,actingthroughthedirector,and
11vestingthegovernorwithadequatepowerandauthoritywithinthelimitationofavailable
12fundsintheMissouridisasterfundtomeetanysuchemergencyordisaster.
13 2.Thereisherebyestablishedafundtobeknownasthe"MissouriDisasterFund",to
14whichthegeneralassemblymayappropriatefundsandfromwhichfundsmaybe
15appropriatedannuallytothestateemergencymanagementagency.Thefundsappropriated
16shallbeexpendedduringastateemergencyatthedirectionofthegovernoranduponthe
17issuanceofanemergencydeclarationwhichshallsetforththeemergencyandshallstatethat
18itrequirestheexpenditureofpublicfundstofurnishimmediateaidandrelief.Thedirectorof
19thestateemergencymanagementagencyshalladministerthefund.
20 3.Expendituresmaybemadeupondirectionofthegovernorforemergency
21management,asdefinedinsection44.010,ortoimplementthestatedisasterplans.
22Expendituresmayalsobemadetomeetthematchingrequirementsofstateandfederal
23agenciesforanyapplicableassistanceprograms.
24 4.AssistancemaybeprovidedfromtheMissouridisasterfundtopolitical
25subdivisionsofthisstate[which] andruralelectriccooperativesthathavesufferedfroma
26disastertosuchanextentastoimposeaseverefinancialburdenexceedingtheordinary
27reservecapacityofthesubdivisionorruralelectriccooperativeaffected.Applicationsfor
28aidunderthissectionshallbemadetothestateemergencymanagementagencyonsuch
29formsasmaybeprescribedandfurnishedbytheagency,whichformsshallrequirethe
30furnishingofsufficientinformationtodetermineeligibilityforaidandtheextentofthe
31financialburdenincurred.Theagencymaycalluponotheragenciesofthestateinevaluating
32suchapplications.Thedirectorofthestateemergencymanagementagencyshallrevieweach
33applicationforaidundertheprovisionsofthissectionandrecommenditsapprovalor
34disapproval,inwholeorinpart,tothegovernor.Ifapproved,thegovernorshalldetermine
35andcertifytothedirectorofthestateemergencymanagementagencytheamountofaidtobe
36furnished.Thedirectorofthestateemergencymanagementagencyshallthereuponissue
37[his]thedirector'svouchertothecommissionerofadministration,whoshallissue[his]the
38commissioner'swarrantstherefortotheapplicant.
39 5.Whenadisasteroremergencyhasbeenproclaimedbythegovernororthereisa
40nationalemergency,thedirectorofthestateemergencymanagementagency,uponorderof
41thegovernor,shallhaveauthoritytoexpendfundsforthefollowing:

43andthestateemergencymanagementagencyasoutlinedinsections44.010to44.130;
44 (2)Employing,forthedurationoftheresponseandrecoverytoemergency,additional
45personnelandcontractingorotherwiseprocuringnecessaryappliances,supplies,equipment,
46andtransport;
47 (3)Performingservicesforandfurnishingmaterialsandsuppliestostategovernment
48agencies,counties,[and] municipalities, andruralelectriccooperativeswithrespectto
49performanceofanydutiesenjoinedbylawuponsuchagencies,counties,[and]
50municipalities, andruralelectriccooperativeswhichtheyareunabletoperformbecause
51ofextremenaturalorman-madephenomena,andreceivingreimbursementinwholeorinpart
52fromsuchagencies,counties,[and]municipalities, andruralelectriccooperativesableto
53paythereforundersuchtermsandconditionsasmaybeagreeduponbythedirectorofthe
54stateemergencymanagementagencyandanysuchagency,county,[or]municipality, or
55ruralelectriccooperative;
56 (4)Performingservicesforandfurnishingmaterialstoanyindividualinconnection
57withalleviatinghardshipanddistressgrowingoutofextremenaturalorman-made
58phenomena,andreceivingreimbursementinwholeorinpartfromsuchindividualundersuch
59termsasmaybeagreeduponbythedirectorofthestateemergencymanagementagencyand
60suchindividual;
61 (5)Providingservicestocountiesandmunicipalitieswithrespecttoquellingriotsand
62civildisturbances;
63 (6)Repairingandrestoringpublicinfrastructure;
64 (7)Furnishingtransportationforsuppliestoalleviatesufferinganddistress;
65 (8)Furnishingmedicalservicesandsuppliestopreventthespreadofdiseaseand
66epidemics;
67 (9)Quellingriotsandcivildisturbances;
68 (10)Trainingindividualsorgovernmentalagenciesforthepurposeofperfectingthe
69performanceofemergencyassistancedutiesasdefinedinthestatedisasterplans;
70 (11)Procurement,storage,andtransportofspecialemergencysuppliesorequipment
71determinedbythedirectortobenecessarytoproviderapidresponsebystategovernmentto
72assistcountiesandmunicipalitiesinimpendingoractualemergencies;
73 (12)Clearingorremovingfrompubliclyorprivatelyownedlandorwater,debrisand
74wreckagewhichmaythreatenpublichealthorsafety;
75 (13)Reimbursementtoanyurbansearchandrescuetaskforceforanyreasonableand
76necessaryexpendituresincurredinthecourseofrespondingtoanydeclaredemergencyunder
77thissection;and

79casesofcatastropheordisaster.
80 6.Thegovernormayreceivesuchvoluntarycontributionsasmaybemadefromany
81sourcetoaidincarryingoutthepurposesofthissectionandshallcreditthesametothe
82Missouridisasterfund.
83 7.Allobligationsandexpensesincurredbythegovernorintheexerciseofthepowers
84anddutiesvestedbytheprovisionsofthissectionshallbepaidbythestatetreasureroutof
85availablefundsintheMissouridisasterfund,andthecommissionerofadministrationshall
86drawwarrantsuponthestatetreasurerforthepaymentofsuchsum,orsomuchthereofas
87mayberequired,uponreceiptofpropervouchersprovidedbythedirectorofthestate
88emergencymanagementagency.
89 8.Theprovisionsofthissectionshallbeliberallyconstruedinordertoaccomplish
90thepurposesofsections44.010to44.130andtopermitthegovernortocopeadequatelywith
91anyemergencywhichmayarise,andthepowersvestedinthegovernorbythissectionshall
92beconstruedasbeinginadditiontoallotherpowerspresentlyvestedinthegovernorandnot
93inderogationofanyexistingpowers.
94 9.SuchfundsasmaybemadeavailablebythegovernmentoftheUnitedStatesfor
95thepurposeofalleviatingdistressfromdisastersmaybeacceptedbythestatetreasurerand
96shallbecreditedtotheMissouridisasterfund,unlessotherwisespecificallyprovidedinthe
97actofCongressmakingsuchfundsavailable.
98 10.Theforegoingprovisionsofthissectionnotwithstanding,anyexpenditureor
99proposedseriesofexpenditureswhichtotalinexcessofonethousanddollarsperprojectshall
100beapprovedbythegovernorpriortotheexpenditure.
