BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Sections37.850and37.1090,RSMo,arerepealedandtwonewsections 2enactedinlieuthereof,tobeknownassections37.850and37.1090,toreadasfollows: 37.850.1.ThecommissionerofadministrationshallmaintaintheMissouri 2accountabilityportalestablishedinexecutiveorder07-24asafree,internet-basedtool 3allowingcitizenstodemandfiscaldisciplineandresponsibility. 4 2.TheMissouriaccountabilityportalshallconsistofaneasy-to-searchdatabaseof 5financialtransactionsrelatedtothepurchaseofgoodsandservices, includingallformsof 6compensationandbenefitspaidtooronbehalfofemployees,andthedistributionoffunds 7forstateprograms;allbondsissuedbyanypublicinstitutionofhighereducation, public 8schooldistrict,orpoliticalsubdivisionofthisstateoritsdesignatedauthorityafterAugust 928,2013;allobligationsissuedorincurredpursuanttosection99.820byanypolitical 10subdivisionofthisstateoritsdesignatedauthority;andtherevenuestreampledgedtorepay 11suchbondsorobligations;andalldebtincurredbyanypubliccharterschool. 12 3.TheMissouriaccountabilityportalshallbeupdatedeachstatebusinessdayand 13maintainedastheprimarysourceofinformationabouttheactivityofMissouri'sgovernment. 14 4.Upontheconductingofawithholdingorareleaseoffunds,thegovernorshall 15submitareportstatingallamountswithheldfromthestate'soperatingbudgetforthecurrent 16fiscalyear,asauthorizedbyArticleIV,Section27oftheMissouriConstitutionwhichshall 17be: EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 (1)Conspicuouslypostedontheaccountabilityportalwebsite; 19 (2)Searchablebytheamountswithheldorreleasedfromeachindividualfund;and 20 (3)Searchablebythetotalamountwithheldorreleasedfromtheoperatingbudget. 21 5.Everypoliticalsubdivisionofthestate,includingpublicinstitutionsofhigher 22education[butexcluding] andpublicschooldistricts,shallsupplyallinformationdescribed 23insubsection2ofthissectiontotheofficeofadministrationwithinsevendaysofissuingor 24incurringsuchcorrespondingbondorobligation.Forallsuchbondsorobligationsissuedor 25incurredpriortoAugust28,2013,everysuchpoliticalsubdivisionandpublicinstitutionof 26highereducationshallhaveninetydaystosupplysuchinformationtotheofficeof 27administration. 28 6.Everyschooldistrictandpubliccharterschoolshallsupplyallinformation 29describedinsubsection2ofthissectiontothedepartmentofelementaryandsecondary 30educationwithinsevendaysofissuingsuchbond,orincurringsuchdebt.Thedepartmentof 31elementaryandsecondaryeducationshallhaveforty-eighthourstodeliversuchinformation 32totheofficeofadministration.ForallsuchbondsissuedordebtincurredpriortoAugust28, 332013,everyschooldistrictandpubliccharterschoolshallhaveninetydaystosupplysuch 34informationtothedepartmentofelementaryandsecondaryeducation.Thedepartmentof 35elementaryandsecondaryeducationshallhaveforty-eighthourstodeliversuchinformation 36totheofficeofadministration. 37.1090.Asusedinsections37.1090to37.1098,thefollowingtermsmean: 2 (1)"Employee",anypersonregularlyemployedbyamunicipalityorcounty 3whoreceivescompensationfromthemunicipalityorcountyforpersonalservices 4renderedthemunicipalityorcounty,includinganyelectedofficialofthemunicipalityor 5countywhosepositionrequireshisorherregularpersonalservicesandwhois 6compensatedwhollyorinpartonafeebasis,andincludingtheemployeesofsuch 7electedfeeofficialswhomaybecompensatedbysuchelectedfeeofficials.Theterm 8"employee"mayincludeanyelectedcountyofficial. 9 (2)"Expenditure",anymonetarypaymentfromamunicipalityorcountytoany 10vendororemployeeincluding,butnotlimitedto,apayment,distribution,loan,advance, 11reimbursement,deposit,[or]gift,oranyotherformofcompensationorbenefit; 12 [(2)](3)"Municipality",acity,town,orvillagethatisincorporatedinaccordance 13withthelawsofthisstate; 14 [(3)](4)"Stateentity",thegeneralassembly;thesupremecourtofMissouri;the 15officeofanelectedstateofficial;oranagency,board,commission,department,institution, 16instrumentality,office,orothergovernmentalentityofthisstate,excludingmunicipalities, 17counties,institutionsofhighereducation,andanypublicemployeeretirementsystem; HB2359 2 18 [(4)](5)"Vendor",anyperson,partnership,corporation,association,organization, 19stateentity,orotherpartythat: 20 (a)Sells,leases,orotherwiseprovidesequipment,materials,goods,supplies,or 21servicestoamunicipalityorcounty;or 22 (b)Receivesreimbursementfromamunicipalityorcountyforanyexpense. ✔ HB2359 3
