260.221.1.Asusedinthissection,thefollowingtermsmean:
2 (1)"Processedrecycledasphaltshingles",recycledasphaltshinglesthatdonot
3containextraneousmetals,glass,rubber,nails,soil,brick,tars,paper,wood,andplastics
4andthathavebeenreducedinsizetoproduceacommerciallyreasonableusable
5product."Processedrecycledasphaltshingles"shallalsobeconsideredcleanfill,as
6suchtermisdefinedinsection260.200;
7 (2)"Recycledasphaltshingles",manufacturewastescrapshinglesandpost-
8consumer,tear-offscrapshinglesthatareaccumulatedasproductsforcommercial
9purposesrelatedtorecyclingorreuseasprocessedrecycledasphaltshingles.
10 2.Processedrecycledasphaltshinglesmaybeusedforfill,reclamation,and
11otherbeneficialpurposeswithoutapermitundersections260.200to260.345ifsuch
12processedrecycledasphaltshinglesareinspectedfortoxicandhazardoussubstancesin
13accordancewithrequirementsestablishedbythedepartmentofnaturalresources,
14providedthatprocessedrecycledasphaltshinglesshallnotbeusedforsuchpurposes
15withinonehundredfeetofanylake,river,sinkhole,perennialstream,orephemeral
16stream.
17 3.Thissectionshallnotbeconstruedtoauthorizetheabandonment,
18accumulation,placement,orstorageofrecycledasphaltshinglesorprocessed

4toxicandhazardoussubstancesinaccordancewithrequirementsestablishedbythe
5departmentofnaturalresources,providedthatprocessedrecycledasphaltshinglesshall
6notbeusedforsuchpurposeswithinonehundredfeetofanylake,river,sinkhole,
7perennialstream,orephemeralstream.
8 2.Thissectionshallnotbeconstruedtoauthorizetheabandonment,
9accumulation,placement,orstorageofrecycledasphaltshinglesorprocessed
10recycledasphaltshinglesonanyrealpropertywithouttheconsentofthereal
11propertyowner.
