SectionA.Section302.174,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection302.174,toreadasfollows:
302.174.1.Asusedinthissection,thefollowingtermsmean:
2 (1)"Deafperson",anypersonwho,becauseofhearingloss,isnotableto
3discriminatespeechwhenspokeninanormalconversationtoneregardlessoftheuseof
4amplificationdevices;
5 (2)"DHH",anotationonadriver'slicensethatindicatesthepersonisadeaforhard
6ofhearingpersonwhousesalternativecommunication;
7 (3)"Hardofhearingperson",anypersonwho,becauseofhearingloss,hasa
8diminishedcapacitytodiscriminatespeechwhenspokeninanormalconversationaltone.
9 2.Anyresidentofthisstatewhoisadeaforhardofhearingpersonmayapplytothe
10departmentofrevenuetohavethenotation"DHH"placedontheperson'sdriver'slicense.
11Thedepartmentofrevenue,byrule,mayestablishthecostandcriteriaforplacementofthe
12DHHnotation,suchasrequiringanapplicanttosubmitcertainmedicalproofofdeafnessor
13hearingloss.Thedepartmentmayalso,byrule,electtousethephrase"deaforhardof
14hearing"inlieuofthenotationDHHonadriver'slicense.
15 3.Anyresidentofthisstatewhoappliesforadriver'slicensewithadeaforhard
16ofhearingnotationundersubsection2ofthissectionmayalsoapplytothedepartment
17foranoptionaldeaforhardofhearinglicenseplatestickertobeplacedontherear

23notationunderthissection.ThisvideoshallalsobecaptionedinEnglishandconvertedto
24QR-Codewhichshallbepostedinaconspicuousplaceateverydriver'slicenseofficein
25Missouri.
26 [4.]5.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis
27createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies
28withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.
29Thissectionandchapter536arenonseverableandifanyofthepowersvestedwiththe
30generalassemblypursuanttochapter536toreview,todelaytheeffectivedateorto
31disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof
32rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2001,shallbeinvalid
