36	36	24development,awrittenchallengetoanapplication.Suchchallengeshallcontain
37	37	25informationdemonstratingthat:
38	38	26 (1)Theprovidercurrentlyprovidesbroadbandinternetservicetoretail
39	39	27customerswithintheproposedarea;
40	40	28 (2)Theproviderhastakenaffirmativestepstobegintheprocessofconstruction
41	41	29toprovidebroadbandinternetservicetoretailcustomerswithintheproposedarea;or
42	42	30 (3)Theproviderhasbeendesignatedfundingthroughfederalprogramsto
43	43	31supportthedeploymentorexpansionofbroadbandnetworksintheproposedareathat
44	44	32willprovidespeedsofonehundredmegabitsper-seconddownloadandonehundred

46	46	34 6.Withinthreebusinessdaysofthesubmissionofawrittenchallenge,the

49	49	37 7.Thedepartmentofeconomicdevelopmentshallevaluateeachchallenge
50	50	38submittedunderthissection.Ifthedepartmentdeterminesthechallengetobevalid,the
51	51	39projectshallnotbeconsideredtobeinanunservedareaorunderservedareaandthe
52	52	40expenditurebythepoliticalsubdivision,municipality,town,orvillageshallbe
