SectionA.Chapter620,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection620.2460,toreadasfollows:
620.2460.1.Nofederalfundsreceivedbythestate,politicalsubdivision,city,
2town,orvillageshallbeexpendedfortheconstructionofretailbroadbandinternet
3infrastructureunlesstheprojecttobeconstructedislocatedinanunservedareaor
4underservedareaandsuchprojectwillprovidebroadbandinternetservicetocustomers
5atspeedsofonehundredmegabitsper-seconddownloadandtwentymegabitsper-
6seconduploadandscalabletohigherspeeds.
7 2.Priortoapoliticalsubdivision,city,town,orvillageauthorizingan
8expenditurefortheconstructionofbroadbandinfrastructure,theofficeofbroadband
9developmentshallcertifytheprojectislocatedwithinanunservedareaorunderserved
10area.
11 3.Noprojectareawhereaninternetserviceproviderhasbeendesignatedto
12receivefederalfundingtosupportthedeploymentorexpansionofbroadbandnetworks
13thatwillprovidespeedsofonehundredmegabitsper-seconddownloadandone
14hundredmegabitsper-seconduploadmaybeclassifiedasanunservedareaor
15underservedarea.However,anareashallbeconsideredanunservedareaor
16underservedareaifthefederalfundingawardisforfeitedorupondisqualificationofthe
17recipiententityawardedfederalfundingforthatgeographicarea.

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 4.Whentheofficeofbroadbanddevelopmentreceivesarequestfromapolitical
19subdivision,city,town,orvillagetocertifywhetheraprojectisinanunservedareaor
20underservedarea,theofficeshallnotifyinternetserviceprovidersoftheproposed
21projectpriortothecertificationoftheproject.
22 5.Abroadbandinternetserviceprovidermaysubmittothedepartmentof
23economicdevelopment,withinforty-fivedaysofnotificationbytheofficeofbroadband
24development,awrittenchallengetoanapplication.Suchchallengeshallcontain
25informationdemonstratingthat:
26 (1)Theprovidercurrentlyprovidesbroadbandinternetservicetoretail
27customerswithintheproposedarea;
28 (2)Theproviderhastakenaffirmativestepstobegintheprocessofconstruction
29toprovidebroadbandinternetservicetoretailcustomerswithintheproposedarea;or
30 (3)Theproviderhasbeendesignatedfundingthroughfederalprogramsto
31supportthedeploymentorexpansionofbroadbandnetworksintheproposedareathat
32willprovidespeedsofonehundredmegabitsper-seconddownloadandonehundred
33megabitsper-secondupload.
34 6.Withinthreebusinessdaysofthesubmissionofawrittenchallenge,the
35departmentofeconomicdevelopmentshallnotifytheapplicablepoliticalsubdivision,
36municipality,town,orvillage.
37 7.Thedepartmentofeconomicdevelopmentshallevaluateeachchallenge
38submittedunderthissection.Ifthedepartmentdeterminesthechallengetobevalid,the
39projectshallnotbeconsideredtobeinanunservedareaorunderservedareaandthe
40expenditurebythepoliticalsubdivision,municipality,town,orvillageshallbe
41prohibited.
42 8.Forthepurposesofthissection,theterms"unservedarea"and"underserved
43area"shallhavethesamemeaningasdefinedinsection620.2450.
