BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section43.401,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection43.401,toreadasfollows:
43.401.1.Thereportingofmissingpersonsbylawenforcementagencies,private
2citizens,andtheresponsibilitiesofthepatrolinmaintainingaccuraterecordsofmissing
3personsareasfollows:
4 (1)Apersonmayfileacomplaintofamissingpersonwithalawenforcementagency
5havingjurisdiction.Thecomplaintshallinclude,butneednotbelimitedto,thefollowing
6information:
7 (a)Thenameofthecomplainant;
8 (b)Thename,address,andphonenumberoftheguardian,ifany,ofthemissing
9person;
10 (c)Therelationshipofthecomplainanttothemissingperson;
11 (d)Thename,age,address,andallidentifyingcharacteristicsofthemissingperson;
12 (e)Thelengthoftimethepersonhasbeenmissing;and
13 (f)Allotherinformationdeemedrelevantbyeitherthecomplainantorthelaw
14enforcementagency;
15 (2)Areportofthecomplaintofamissingpersonshallbeimmediatelyenteredinto
16theMissouriuniformlawenforcementsystem(MULES)[and], theNationalCrime
17InformationCenter(NCIC)system, andtheNationalMissingandUnidentifiedPersons
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18System(NamUs)bythelawenforcementagencyreceivingthecomplaint,anddisseminated
19tootherlawenforcementagencieswhomaycomeincontactwithorbeinvolvedinthe
20investigationorlocationofamissingperson;
21 (3)Thelawenforcementagencyreceivingthecomplaintofamissingperson
22shallattempttolocatecurrentphotosofthemissingpersonandshallscansuchphotos
23andenterthemintoMULES,NCIC,andNamUswithintendaysofreceivingsuch
24complaint;
25 (4)Alawenforcementagencywithwhichacomplaintofamissingchildhasbeen
26filedshallprepare,assoonaspracticable,astandardmissingchildreport.Themissingchild
27reportshallbemaintainedasarecordbythereportinglawenforcementagencyduringthe
28courseofanactiveinvestigation;
29 [(4)](5)Uponthelocationofamissingperson,orthedeterminationbythelaw
30enforcementagencyofjurisdictionthatthepersonisnolongermissing,thelawenforcement
31agencywhichreportedthemissingpersonshallimmediatelyremovetherecordofthemissing
32personfromtheMULES[and],NCIC, andNamUsfiles.
33 2.Nolawenforcementagencyshallpreventanimmediateactiveinvestigationonthe
34basisofanagencyrulewhichspecifiesanautomatictimelimitationforamissingperson
35investigation.
