HCSHB2704 36 4 (2)Foranypersontwenty-oneyearsofageorolderinpossessionofapersonal 5cultivationregistrationcard,cultivatingorpossessingnomorethansixmature, 6floweringmarijuanaplantsfornoncommercial,personaluse.Theauthorityshallmake 7availabletothepublicapplicationformsandapplicationinstructionsforpersonal 8cultivationregistrationcards.Theauthorityshallsetfinesforanypersonwhoexceeds 9thelimitationunderthissubdivisionifthepersonhasnotobtainedamarijuanabusiness 10license; 11 (3)Cultivating,harvesting,processing,manufacturing,packaging,distributing, 12transferring,displaying,orpossessingmarijuana,marijuanaaccessories,ormarijuana 13productsforcommercialpurposes,providedthepersonhascurrentapplicablelicensing 14tooperateamarijuanabusiness; 15 (4)Providingmarijuana,marijuanaaccessories,ormarijuanaproductsforsale 16toconsumerstwenty-oneyearsofageorolder;and 17 (5)Leasingorotherwiseallowingtheuseofpropertyowned,occupied,or 18controlledbyanyperson,corporation,orotherentityforanyoftheactivitiesconducted 19lawfullyinaccordancewithsubdivisions(1)to(4)ofthissubsection. 20 2.Theuseorpossessionofmarijuanashallinnowayimpedeonaperson'slegal 21righttopossessafirearm,aslongasthepersonisnotinanintoxicatedstateasdefined 22undersection577.001. 196.3012.Notwithstandinganyprovisionoflaw,itshallbelawfulforaperson 2twenty-oneyearsofageorolder,oranemancipatedindividualundertwenty-oneyears 3ofagewithaphysician'srecommendationauthorizingtheuseofmarijuana,totransfer 4orgiftmarijuanainanyformincluding,butnotlimitedto,plantmaterial,seeds, 5extract,orconcentrate,toanotheradulttwenty-oneyearsofageorolder,ortoanother 6emancipatedindividualundertwenty-oneyearsofagewithaphysician's 7recommendationauthorizingtheuseofmarijuana,providednocompensationofany 8kindisgivenorreceived;however,nothinginthissectionshallbeconstruedtopermit 9thetransferorgiftingofmarijuanatoapersonundertwenty-oneyearsofage,ifsuch 10personhasaphysician'srecommendationauthorizingtheuseofmarijuana,byanyone 11otherthansuchperson'slegalguardian,underandinaccordancewiththeprovisions 12governingthemedicallyauthorizedadministrationofmarijuanatoapersonunder 13twenty-oneyearsofage. 196.3015.Marijuanafarmers,manufacturers,processors,anddistributorsshall 2notbesubjecttoanyspecialzoningrequirementorlicensingfeethatisexcessive, 3discriminatory,prohibitive,orinanywaycontrarytothatwhichisrelativetoanyother 4commercialoragriculturalfarmer,manufacturer,processor,ordistributor. HCSHB2704 37 196.3018.1.NoMissourilawenforcementpersonnelorstatefundsshallbeused 2toassistoraidintheenforcementoffederalmarijuanalawsinvolvingactsthatareno 3longerillegalinthestateofMissouriundersections196.3000to196.3048. 4 2.Asprovidedundersection610.135,Missouri'scourtsshallexpungeconviction 5recordsofoffensesormunicipalviolationspertainingtononviolentmarijuana-related 6offensesorviolationsthatarenolongerillegalinthestateofMissouriundersections 7196.3000to196.3048. 196.3021.1.Ataxshallbelevieduponthesaleofmarijuanaormarijuana 2productstoconsumersorbuyersnotlicensedforresaleatarateoffourandtwo 3hundredtwenty-fivethousandthspercent.Thedepartmentofrevenueshalldirectthe 4authoritytoestablishproceduresforthecollectionofalltaxeslevied.Thetaxshallbe 5evidencedbystampsthatshallbefurnishedbyandpurchasedfromthedepartmentof 6revenue,andthedepartmentofrevenueshallenforceanysuchtaxinamannersimilar 7totaxesleviedoncigarettesunderchapter149. 8 2.Alltaxrevenuescollectedundersubsection1ofthissectionshallbedeposited 9inthecannabisfreedomfundestablishedundersection196.3045.Moneysinthefund 10shallbeusedtopayforthedirectandindirectcostsassociatedwiththeimplementation, 11administration,andenforcementofsections196.3000to196.3048. 12 3.Afterallcostsundersubsection2ofthissectionhavebeenpaid,moneys 13remaininginthefundshallbedisbursedasfollows: 14 (1)Tenpercentofremainingfundsshallbedepositedtothedeputysheriffsalary 15supplementationfundundersection57.278; 16 (2)Tenpercentofremainingfundsshalldepositedtothepeaceofficerstandards 17andtrainingcommissionfundundersection590.178;and 18 (3)Tenpercentofremainingfundsshallbedisbursedtothestatefiremarshal 19fordisbursementofgrantstovolunteerfireprotectionassociationsforthepurposeof 20fundingsuchassociation'scostsrelatedtoworkers'compensationinsurancepremiums 21forvolunteerfirefightersundersection287.245; 22 (4)Fifteenpercentofremainingfundsshallbedisbursedtothedepartmentto 23establishandadministertheworktrainingprogramundersubsection3ofsection 24557.059;and 25 (5)Fivepercentofremainingfundsshallbeusedtoprovideassistancewith 26smallbusinessloansundersection196.3047. 27 4.Anyexcessmoneysremaininginthefundafterallcostsanddisbursements 28undersubsections2and3ofthissectionhavebeenpaidshallreverttothegeneral 29revenuefund. HCSHB2704 38 30 5.Nothinginthissectionshallprohibitstateandlocalsalestaxasimposedunder 31thesalestaxlawandlocalsalestaxlaw. 196.3024.Allprovisionsofsections196.3000to196.3048shallsupersedeany 2conflictingcity,county,orstatestatute,localcharter,ordinance,orresolution. 196.3026.1.Thedepartmentshallissuerulesoremergencyrulesfora 2marijuanaandmarijuanaproductsindependenttestingandcertificationprogramfor 3marijuanalicenseesundersections196.3000to196.3048,andthedepartmentshallissue 4rulesoremergencyrulesrequiringsuchlicenseestotestmarijuanaandmarijuana 5productsusingoneormoreimpartial,independentlaboratoriestoensure,ata 6minimum,thatproductssoldforhumanconsumptiondonotcontaincontaminantsthat 7areinjurioustohealthandtoensurecorrectlabelingandmeasurepotency.The 8departmentshallnotrequireanymarijuanaormarijuanaproducttobetestedmore 9thanoncepriortosale. 10 2.Thedepartmentshallissuerulesoremergencyrulestoprovideforthe 11certificationofandstandardsformarijuanatestingfacilities,includingthe 12requirementsforequipmentandqualificationsforpersonnel,butshallnotrequire 13certificateholderstohaveanyfederalagencylicensingorhaveanyrelationshipwitha 14federallylicensedtestingfacility.Thedepartmentshallcertify,ifpossible,atleasttwo 15entitiesasmarijuanatestingfacilities.Nomarijuanatestingfacilityshallbeownedby 16anentityundersubstantiallycommoncontrol,ownership,ormanagementasa 17marijuanabusiness. 196.3027.1.Thereisherebyestablishedthe"CannabisEnforcementAuthority" 2underthedepartment.Theauthorityshallhaveoversightandauditingresponsibilities 3toensurethatallmarijuanabeinggrowninMissouriforpersonaluseisaccountedfor 4andshallimplementaninventorytrackingsystemasprovidedundersubsection2ofthis 5section.Theauthorityshallrequirethateachmarijuanabusinesskeeprecordsfor 6everytransactionwithanothermarijuanabusinessorconsumer.Inventoryshallbe 7trackedandupdatedaftereachindividualsaleandreportedtotheauthority. 8 2.Theauthorityshallrequireaseed-to-saletrackingsystemthattracks 9marijuanafromeitherseedorimmatureplantstageuntilthemarijuanaormarijuana 10productissoldtoaconsumeratamarijuanabusinesstoensurethatnomarijuana 11grownorprocessedissoldorotherwisetransferredexceptbyamarijuanabusiness. 12Theauthorityshallcontractwithavendororvendorstomaintainastandardized 13trackingsysteminthestate.Thetrackingsystemshallinclude,ataminimum,the 14following: 15 (1)Notificationofwhenmarijuanaseedsareplanted; 16 (2)Notificationofwhenmarijuanaplantsareharvestedanddestroyed; HCSHB2704 39 17 (3)Notificationofwhenmarijuanaistransported,sold,stolen,diverted,orlost; 18 (4)Acompleteinventoryofallmarijuanaseeds,planttissue,clones,plants, 19usablemarijuanaortrim,leaves,andotherplantmatter,batchesofextract,and 20marijuanaconcentrates; 21 (5)Allsamplessenttoatestinglaboratory,anunusedportionofasample 22returnedtoalicensee,andallsamplesutilizedbyalicenseeforpurposesofnegotiatinga 23sale;and 24 (6)Allsamplesusedforqualitytestingbyalicensee. 196.3028.1.Thereisherebycreatedthemarijuanabusinesslicense,whichshall 2includeapplicationsforthefollowingcategories: 3 (1)Marijuanacommercialgrowers; 4 (2)Marijuanaprocessors;and 5 (3)Marijuanaretailers. 6 2.Theauthority,withtheaidoftheofficeofadministration,shalldevelopa 7websiteformarijuanabusinesslicenseapplications. 8 3.Theauthorityshalldetermineanapplicationfeeforamarijuanabusiness 9licenseinanamountsufficienttocoveradministration,regulation,andenforcement 10costsassociatedundersections196.3000to196.3048,andthefeeshallbedepositedinto 11thecannabisfreedomfundestablishedundersection196.3045. 12 4.Allapplicantsseekinglicensureasamarijuanabusinessshallcomplywiththe 13followinggeneralrequirements: 14 (1)Allapplicationsshallcontainthenameandaddressoftheapplicant; 15 (2)Allapplicationsformarijuanacommercialgrowersandmarijuana 16processorsshallcontainthename,address,andthelegaldescriptionoftheproperty; 17 (3)Allapplicationsforlicensesauthorizedunderthissectionshallbemadeupon 18formsprescribedbytheauthority; 19 (4)Allapplicationsshallidentifythecityorcountyinwhichtheapplicantseeks 20toobtainlicensureasamarijuanabusiness; 21 (5)Applicantsshallsubmitacompleteandaccurateapplicationtotheauthority 22beforetheapplicationmaybeacceptedorconsidered; 23 (6)Allapplicationsshallincludeallattachmentsorsupplementalinformation 24requiredbytheformssuppliedbytheauthority; 25 (7)Allapplicationsshallbeaccompaniedbyafullremittancefortheentire 26amountoftheapplicationfees; 27 (8)Allapplicantsshallbeapprovedforlicensingreviewthat,ataminimum, 28meetthefollowingcriteria: 29 (a)Allapplicantsshallbetwenty-oneyearsofageorolder;and HCSHB2704 40 30 (b)Allapplyingindividualsorentitiesshallberegisteredtoconductbusinessin 31thestateofMissouri,andallapplyingindividualsshallberesidentsofthestateof 32Missouri; 37 (c)Allprincipalofficersofanapplyingentity;and 38 (d)Allownersofanentity, 39 40shallundergoaMissouricriminalbackgroundcheckwithinthirtydayspriorto 41applyingforthelicense; 42 (10)Allapplicablefeeschargedforthecriminalbackgroundcheckarethe 43responsibilityoftheapplicantandshallnotbehigherthanfeeschargedtoanyother 44personorindustryforsuchbackgroundcheck; 45 (11)Allapplicants,orapplyingindividualsifanentity,shallestablishtheir 46identitythroughsubmissionofacolorcopyordigitalimageofoneofthefollowing 47unexpireddocuments: 48 (a)FrontandbackofaMissouridriver'slicense; 59 (2)Financialinformationpertainingtotheoperationsofthemarijuanabusiness, 60whichshallincludethefollowing: 61 (a)Alistoffundsbelongingtotheapplicantheldinsavings,checking,orother 62accountsmaintainedbyafinancialinstitution.Theapplicantshallprovideforeach 63accountthenameofthefinancialinstitution,theaddressofthefinancialinstitution, 64accounttype,accountnumber,andtheamountofmoneysintheaccount; HCSHB2704 41 65 (b)Alistofloansmadetotheapplicant.Foreachloan,theapplicantshall 66providetheamountoftheloan;thedateoftheloan;termoftheloan;securityprovided 67fortheloan;andthename,address,andphonenumberofthelender; 68 (c)Alistofinvestmentsmadeintothemarijuanabusiness.Foreachinvestment, 69theapplicantshallprovidetheamountoftheinvestment;thedateoftheinvestment; 70termoftheinvestment;andthename,address,andphonenumberoftheinvestor; 71 (d)Acompletelistofeveryindividualwhohasafinancialinterestinthe 72marijuanabusinessbutisnotanownerofthemarijuanabusiness; 73 (e)Whethertheapplicanthasanownershiporafinancialinterestinanyother 74marijuanabusinesslicensedinMissouri. 75 6.Iftheapplicantisnotthelandowneroftherealpropertyuponwhichthe 76premisesislocated,theapplicantshallprovidetotheauthorityadocumentfromthe 77landownerortheagentofthelandownerthatstatesthattheapplicanthastherightto 78occupythepropertyandacknowledgestheapplicantmayusethepropertyfor 79marijuanabusinessactivitiesforwhichtheapplicantisapplyingforlicensure.An 80applicantshallalsoprovideacopyoftherentalagreement,asapplicable. 81 7.Iftheapplicantisthelandowneroftherealpropertyuponwhichthepremises 82islocated,theapplicantshallprovidetotheauthorityacopyofthetitleordeedtothe 83property. 84 8.Iftheapplicantisapplyingforamarijuanacommercialgrowerlicense,the 85applicantshallalsosubmitthefollowing: 86 (1)Forindoorandmixedlightcultivation,identificationofallpowersourcesfor 87cultivationactivitiesincluding,butnotlimitedto,illumination,heating,cooling,and 88ventilation; 89 (2)Iftheapplicantisproposingtouseadiversionfromawaterbody, 90groundwaterwell,orraincatchmentsystemasawatersourceforcultivation,the 91followinglocationsonthepropertydiagramwithlocationsalsoprovidedasGPS 92coordinatesinlatitudeandlongitude: 93 (a)Sourcesofthewaterused,includingthelocationofwaterbodydiversion; 94 (b)Pumplocationanddistributionsystem;and 95 (c)Location,type,andcapacityofeachstorageunittobeusedforcultivation; 96 (3)Aproposedcultivationplan,whichshallincludeidentificationofallwater 97sourcesusedforcultivationactivities; 98 (4)Evidenceofinsuranceincluding,butnotlimitedto: 99 (a)Generalliabilityinsurance; 100 (b)Workers'compensationinsurance;and 101 (c)Productliabilityinsurance;and HCSHB2704 42 102 (5)Anyadditionalinformationrequiredbytheauthority. 103 9.Theauthorityshallbeauthorizedtoissuethefollowingtypesofmarijuana 104processorlicensesbasedonthelevelofriskposedbythetypeofprocessingconducted: 105 (1)Anonhazardousmarijuanaprocessorlicense;or 106 (2)Ahazardousmarijuanaprocessorlicense. 107 10.Inadditiontotheapplicationrequirementsunderthissection,amarijuana 108commercialgrowerormarijuanaprocessorshalldemonstratetotheauthoritythatthe 109growerorprocessorhasabankaccountandshallprovidegrowthestimates,processing 110estimates,andpredictedelectricalandwaterusagetogroworprocessmarijuana. 111 11.Allapplicantsshallsubmitinformationtotheauthorityinafull,faithful, 112truthful,andfairmanner.Theauthoritymaydenyanapplicationiftheapplicantmade 113misstatements,omissions,misrepresentations,oruntruthsintheapplicationorin 114connectionwiththebackgroundinvestigationoftheapplicant.Suchconductmaybe 115consideredasthebasisforadditionaladministrativeactionagainsttheapplicant.Typos 116andscrivener'serrorsshallnotbegroundsfordenial.Thecriminalbackgroundofan 117applicant,aslongasitdoesnotincludeanyviolationundersections196.3000to 118196.3048,shallnotbeusedasthesolegroundsfordenialofanapplication. 119 12.Ininvestigatingthequalificationsofanapplicant,theauthoritymayhave 120accesstocriminalhistoryrecordinformationfurnishedbyacriminaljusticeagency, 121subjecttoanyrestrictionsimposedbysuchanagency.Intheeventtheauthority 122considersthecriminalhistoryrecordoftheapplicant,theauthorityshallalsoconsider 123anyinformationprovidedbytheapplicantregardingsuchcriminalhistoryrecord 124including,butnotlimitedto,evidenceofrehabilitation,characterreferences,and 125educationalachievements,andthoseitemspertainingtotheperiodoftimebetweenthe 126lastcriminalconvictionoftheapplicantandtheconsiderationoftheapplicationfora 127statelicense. 128 13.(1)Theauthorityshallreviewthemarijuanabusinesslicenseapplication, 129approveorrejecttheapplication,andmailoremailtheapproval,rejection,orstatus- 130updatelettertotheapplicantwithinninetydaysofreceiptoftheapplication. 131 (2)Theauthoritymayrejectanapplicationforamarijuanabusinesslicenseif 132therequirementsforthemarijuanabusinesslicenseapplicationarenotsatisfied. 133 (3)Ifanapplicationisrejectedforfailuretoprovidetherequiredinformation, 134theapplicantshallhavethirtydaystosubmittherequiredinformationfor 135reconsideration.Noadditionalapplicationfeeshallbechargedforsuch 136reconsideration. 137 14.Thefollowingviolationsshallbegroundsfordenialofamarijuanalicense 138underthissection: HCSHB2704 43 139 (1)Unlawfulsalesorpurchases; 140 (2)Anyfraudulentacts,falsificationofrecords,ormisrepresentationtothe 141authority; 142 (3)Anygrosslyinaccurateorfraudulentreporting; 143 (4)Threateningorharminganymarijuanapatient,caregiver,consumer, 144medicalpractitioner,oremployeeoftheauthority; 145 (5)Knowinglyorintentionallyrefusingtopermittheauthorityaccesstothe 146premisesorrecords; 147 (6)Usingaprohibited,hazardoussubstanceforprocessinginaresidentialarea; 148 (7)Criminalactsrelatingtotheoperationofamarijuanabusiness;or 149 (8)Anyviolationthatendangerspublichealthandsafetyorproductsafety. 150 15.Status-updatelettersshallprovideareasonfordelayineitherapprovalor 151rejectionifasituationarisesinwhichanapplicationwassubmittedproperlybutadelay 152inprocessingtheapplicationoccurred. 153 16.Allmarijuanabusinessapplicantsshallpaytherelevantapplicationfeeprior 154toreceivingalicenseundersection196.3029tooperateamarijuanabusiness,as 155providedunderthissection,foreachcategoryoflicense. 156 17.Theauthorityshallissue,ataminimum,twicethenumberofmarijuana 157commercialgrowerslicensesaswereauthorizedorissuedformedicalmarijuana 158cultivationfacilitiesunderArticleXIV,Section1oftheConstitutionofMissouriasof 159August28,2022,twicethenumberofmarijuanaprocessinglicensesaswereauthorized 160orissuedformedicalmarijuana-infusedproductsmanufacturingfacilitiesunderArticle 161XIV,Section1oftheConstitutionofMissouriasofAugust28,2022,andtwicethe 162numberofmarijuanaretailerslicensesaswereauthorizedorissuedformedical 163marijuanadispensaryfacilitiesunderArticleXIV,Section1oftheConstitutionof 164MissouriasofAugust28,2022.Thedepartmentmayliftoreaseanylimitonthe 165numberoflicenseesorcertificateholdersinordertomeetthedemandformarijuanain 166thestateandtoensureacompetitivemarketwhilealsopreventinganover- 167concentrationofmarijuanafacilitieswithintheboundariesofanyparticularlocal 168government. 196.3029.1.Asusedinthissection,"conditionalmarijuanabusinesslicense" 2meansaconditionallicensethatauthorizesthelicenseetoengageincommercial 3marijuanaactivitiesaswouldbepermittedundertheprivilegesofanannualmarijuana 4businesslicense.Aconditionalmarijuanabusinesslicenseeshallfollowallapplicable 5rulesandregulationsaswouldberequiredifthelicenseeheldanannuallicense. 6 2.Oncetheauthorityhascertifiedtheapplicationiscompleteandaccurate,a 7conditionalmarijuanabusinesslicenseshallbeissuedunderthissection. HCSHB2704 44 8 3.Theauthorityshallcontinueitsreviewofthelicenseeoftheconditional 9marijuanabusinesslicenseandconductallinvestigations,inspections,andinterviews, 10includingasiteinspection,beforeapprovingthelicenseeforanannualmarijuana 11businesslicense.Theauthorityshallpromulgaterulesandregulationsrelatingtothe 12investigations,inspections,andinterviewsrequiredtobeconductedunderthis 13subsection. 14 4.Status-updatelettersshallprovideareasonforanydelayinissuinganannual 15license. 16 5.Anannuallicenseprovidedunderthissectionshallnotbeissueduntilall 17investigations,inspections,andinterviewsrequiredunderthissectionhavebeen 18satisfiedandallrelevantlocallicensesandpermitshavebeenissuedbythemunicipality 19including,butnotlimitedto,anoccupancypermitorcertificateofcompliance. 20 6.Anannuallicenseissuedtoamarijuanabusinessunderthissectionshall 21expireoneyearfromthedateonwhichthelicensewasissued.Suchlicenseshallbe 22renewedbythelicensee,andthelicenserenewalrequirementsandfeeforsuchrenewal 23shallbedeterminedbytheauthority.Amarijuanabusinessthatattemptstorenewits 24licenseaftertheexpirationdateofthelicenseshallpayalaterenewalfeeoftenpercent 25ofthelicensefee.Laterenewalfeesarenonrefundable.Alicensethathasbeenexpired 26formorethanninetydaysshallnotberenewed. 27 7.Amarijuanabusinesslicenseshallnotbeissuedtoorheldby: 28 (1)Apersonuntilallrequiredfeeshavebeenpaid; 29 (2)Apersonundertwenty-oneyearsofage; 30 (3)Apersonlicensedunderthissectionwho,duringaperiodoflicensure,orat 31thetimeofapplicationundersection196.3028,hasfailedto: 32 (a)Filetaxesorreportinterestorpenaltiesdue;or 33 (b)Paytaxes,interest,orpenaltiesdue. 196.3031.1.(1)Alicensedmarijuanacommercialgrowershallsellonlyatthe 2wholesaleleveltoalicensedmarijuanaretailer,anotherlicensedmarijuanacommercial 3grower,oralicensedmarijuanaprocessor. 4 (2)Alicensedmarijuanacommercialgrowershallberequiredtocompleteand 5submitamonthlyyieldandsalesreporttotheauthority.Thereportshallbedueonthe 6fifteenthofeachmonthandprovidereportingforthepreviousmonth.Thereportshall 7detailtheamountofmarijuanaharvestedinpounds,theamountofdryingordried 8marijuanaonhand,theamountofmarijuanasoldtolicensedprocessorsinpounds,the 9amountofwasteinpounds,andtheamountofmarijuanasoldtolicensedmarijuana 10dispensariesinpounds.Additionally,thereportshallshowtotalwholesalesalesin 11dollars. HCSHB2704 45 12 (3)Theauthoritymayinspectagrowingoperationanddeterminethe 13operation'scompliancewithsections196.3000to196.3048.Ifadeficiencyisfound,a 14writtenreportofthedeficiencyshallbeissuedtothelicensedmarijuanacommercial 15grower.Thelicensedmarijuanacommercialgrowershallhaveonemonthtocorrectthe 16deficiencyorbesubjecttofinesasdeterminedbytheauthority. 17 (4)Theauthorityshallhaveoversightandauditingresponsibilitiestoensure 18thatallmarijuanabeinggrownbyalicensedmarijuanacommercialgroweris 19accountedfor. 20 2.(1)Alicensedmarijuanaprocessormaytakemarijuanaplantsanddistillor 21processsuchplantsintoconcentrates,edibles,andotherformsforconsumption. 22 (2)Theauthorityshallmakeavailableasetofstandardsthatshallbeusedby 23licensedmarijuanaprocessorsinthepreparationofediblemarijuanaproducts.The 24standardsshallbeinlinewithcurrentfoodpreparationguidelines.Noexcessiveor 25punitiverulesshallbeestablishedbytheauthority. 26 (3)Theauthoritymayinspectaprocessingoperationanddeterminethe 27operation'scompliancewiththepreparationstandards.Ifadeficiencyisfound,a 28writtenreportofthedeficiencyshallbeissuedtothelicensedmarijuanaprocessor.The 29licensedmarijuanaprocessorshallhaveonemonthtocorrectthedeficiencyorbe 30subjecttofinesasdeterminedbytheauthority. 31 (4)Alicensedmarijuanaprocessormaysellmarijuanaproductstheprocessor 32createstoalicensedmarijuanadispensaryoranyotherlicensedmarijuanaprocessor. 33Allsalesbyalicensedmarijuanacommercialgrowerormarijuanaprocessorshallbe 34consideredwholesalesalesandshallnotbesubjecttotaxation. 35 (5)Alicensedmarijuanaprocessorshallberequiredtocompleteandsubmita 36monthlyyieldandsalesreporttotheauthority.Thereportshallbedueonthefifteenth 37ofeachmonthandshallprovidereportingforthepreviousmonth.Thereportshall 38detailtheamountofmarijuanaandmarijuanaproductspurchasedinpounds,the 39amountofmarijuanacookedorprocessedinpounds,andtheamountofwastein 40pounds.Additionally,thereportshallshowtotalwholesalesalesindollars.The 41authorityshallhaveoversightandauditingresponsibilitiestoensurethatallmarijuana 42beingprocessedisaccountedfor. 196.3032.1.Amarijuanatransporterlicenseshallbeissuedtoqualifying 2applicantsforamarijuanaretailer,marijuanacommercialgrower,ormarijuana 3processorlicense.Themarijuanatransporterlicenseshallbeissuedatthetimeof 4approvalofaconditionalorannualmarijuanabusinesslicense.Thefeesforthe 5marijuanatransporterlicense,includinganyrenewalfees,shallbepaidbytheapplicant 6asdeterminedbytheauthority. HCSHB2704 46 7 2.Amarijuanatransporterlicenseshallallowtheholdertotransportmarijuana 8fromaMissouri-licensedmarijuanaretailer,licensedmarijuanacommercialgrower 9facility,orlicensedmarijuanaprocessorfacilitytoaMissouri-licensedmarijuana 10retailer,licensedmarijuanacommercialgrowerfacility,orlicensedmarijuana 11processingfacility. 12 3.Allmarijuanaormarijuanaproductsshallbetransportedinalocked 13containerandclearlylabeled"MarijuanaorDerivative". 14 4.Nomarijuanabusinessshallpossess,sell,ortransfermarijuanaormarijuana 15productswithoutavalid,unexpiredmarijuanatransporterlicenseissuedbythe 16authority. 17 5.Amarijuanatransporterlicenseshallbevalidforoneyearandshallnotbe 18transferredwithachangeofownership.Alicensedmarijuanatransportershallbe 19responsibleforallmarijuana,marijuanaconcentrate,andmarijuanaproductsoncethe 20transportertakescontroloftheproduct. 21 6.Amarijuanatransporterlicenseshallberequiredforanypersonorentityto 22transportortransfermarijuana,marijuanaconcentrate,ormarijuanaproductsfroma 23licensedmarijuanabusinesstoanotherlicensedmarijuanabusiness. 24 7.Amarijuanatransporterlicenseemaycontractwithmultiplelicensed 25marijuanabusinesses. 26 8.Amarijuanatransporterlicenseeshallusetheseed-to-saletrackingsystem 27developedundersection196.3027tocreateshippingmanifestsdocumentingthe 28transportofmarijuana,marijuanaconcentrate,andmarijuanaproductsthroughout 29thestate. 30 9.Withtheexceptionofalawfultransferbetweenmarijuanabusinessesthatare 31licensedtooperateatthesamephysicaladdress,allmarijuana,marijuanaconcentrate, 32andmarijuanaproductsshallbetransported: 33 (1)Inavehicleequippedwithaglobalpositioningsystem(GPS)trackerorwith 34cellphonetracking; 35 (2)Inalockedandnumber-taggedcontainerclearlylabeled"Marijuanaor 36Derivative";and 37 (3)Inasecuredareaofthevehiclethatisnotaccessiblebythedriverduring 38transit. 39 10.Amarijuanatransporteragentmaypossessmarijuanaatanylocationwhile 40themarijuanatransporteragentistransferringmarijuanatoorfromalicensed 41marijuanabusiness.Thedepartmentshalladministerandenforcetheprovisionsofthis 42sectionconcerningtransportation. HCSHB2704 47 43 11.Theauthorityshallissueamarijuanatransporteragentlicensetoindividual 44agents,employees,officers,orownersofamarijuanatransporterlicenseeinorderfor 45theindividualtoqualifytotransportmarijuana,marijuanaconcentrate,ormarijuana 46products. 47 12.Thefeeforamarijuanatransporteragentlicenseshallbeonehundred 48dollarsandshallbepaidbythemarijuanatransporterlicenseholderortheindividual 49applicant.Marijuanatransporteragentlicensereprintsshallbeonehundreddollars. 50Theauthorityshallissueeachmarijuanatransporteragentaregistryidentificationcard 51withinthirtydaysofreceiptofthename,address,anddateofbirthoftheperson. 52 13.Aregistryidentificationcardforamarijuanatransporteragentshallexpire 53threeyearsafterthedateofissuanceoruponnotificationfromtheholderofthe 54marijuanatransporterlicensethatthemarijuanatransporteragentceasestoworkasa 55marijuanatransporter. 56 14.Thedepartmentmayrevoketheregistryidentificationcardofamarijuana 57transporteragentwhoknowinglyviolatesanyprovisionofthissection,andthe 58marijuanatransportershallbesubjecttoanyotherpenaltiesestablishedbylawforthe 59violation.Thedepartmentmayrevokeorsuspendthemarijuanatransporterlicenseof 60amarijuanatransporterthatthedepartmentdeterminesknowinglyaidedorfacilitated 61aviolationofanyprovisionofthissection,andthelicenseholdershallbesubjecttoany 62otherpenaltiesestablishedinlawfortheviolation. 63 15.Vehiclesusedinthetransportofmarijuanaormarijuanaproductsshall: 64 (1)BeinsuredatorabovethelegalrequirementsinMissouri;and 65 (2)Becapableofsecuringmarijuanaduringtransport. 66 16.Priortothetransportofanymarijuana,marijuanaconcentrate,or 67marijuanaproduct,aninventorymanifestshallbepreparedattheoriginationpointof 68themarijuana.Theinventorymanifestshallincludethefollowinginformation: 69 (1)Fortheoriginationpointofthemarijuana: 70 (a)Thelicensenumberforthecommercialgrower,processor,orretailer; 71 (b)Theaddressoftheoriginationoftransport;and 72 (c)Thenameandcontactinformationfortheoriginatinglicensee; 73 (2)Fortheend-recipientlicenseholderofthemarijuana: 74 (a)Thelicensenumberfortheretailer,commercialgrower,andprocessor; 75 (b)Theaddressofthedestination;and 76 (c)Thenameandcontactinformationforthedestinationlicensee; 77 (3)Quantitiesbyweightorunitofeachtypeofmarijuanaproductcontainedin 78thetransport; 79 (4)Thedateofthetransportandtheapproximatetimeofdeparture; HCSHB2704 48 80 (5)Thearrivaldateandtheestimatedtimeofarrival; 81 (6)Printednamesandsignaturesofthepersonnelaccompanyingthetransport; 82and 83 (7)Notationofthetransportinglicensee. 84 17.Aseparateinventorymanifestshallbepreparedforeachlicenseereceiving 85themarijuana. 86 18.Themarijuanatransporteragentshallprovidetheothermarijuanabusiness 87withacopyoftheinventorymanifestatthetimetheproductchangeshandsandafter 88theotherlicenseeprintshisorhernameandsignstheinventorymanifest. 89 19.Areceivinglicenseeshallrefusetoacceptanymarijuana,marijuana 90concentrate,ormarijuanaproductthatisnotaccompaniedbyaninventorymanifest. 91 20.Originatingandreceivinglicenseesshallmaintaincopiesofinventory 92manifestsandlogsofquantitiesofmarijuanaexchangedforthreeyearsfromthedateof 93receipt. 94 21.Notwithstandingtheprovisionsofthissection,apeaceofficerlicensedbythe 95POSTcommissionundersections590.010to590.195whenoff-dutymaytransport 96marijuanawithoutamarijuanatransportationlicense. 196.3036.Anentitythatwasawardedamedicalmarijuanabusinesslicenseby 2thedepartmentmayapplyforamarijuanabusinesslicenseundersection196.3028so 3longastherequirementsundersections196.3000to196.3048aremet. 196.3042.Ifmarijuanaislegalizedonafederallevel,thestateshallexplorethe 2optiontoenterintoanyinterstatecompactoragreementrelatingtomarijuana. 196.3045.1.Thereisherebycreatedinthestatetreasurythe"Cannabis 2FreedomFund",whichshallconsistofmoneyscollectedundersections196.3021, 3196.3028,and196.3029,andsubsection12ofsection196.3032.Thestatetreasurershall 4becustodianofthefund.Inaccordancewithsections30.170and30.180,thestate 5treasurermayapprovedisbursements.Thefundshallbeadedicatedfundand,upon 6appropriation,moneysinthisfundshallbeusedsolelyasprovidedinsection196.3021. 7 2.Thestatetreasurershallinvestmoneysinthefundinthesamemanneras 8otherfundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbe 9creditedtothefund. 196.3047.Thedepartmentshallestablishaloanprograminwhichwomenand 2minoritybusinessenterprisesmayapplyforasmallbusinessloanthatshallbeinterest- 3freeforaperiodoftwoyears. 196.3048.Theauthorityshallpromulgateallnecessaryrulesandregulationsfor 2theadministrationofsections196.3000to196.3048.Anyruleorportionofarule,as 3thattermisdefinedinsection536.010,thatiscreatedundertheauthoritydelegatedin HCSHB2704 49 4thissectionshallbecomeeffectiveonlyifitcomplieswithandissubjecttoallofthe 5provisionsofchapter536and,ifapplicable,section536.028.Thissectionandchapter 6536arenonseverable,andifanyofthepowersvestedwiththegeneralassembly 7pursuanttochapter536toreview,todelaytheeffectivedate,ortodisapproveandannul 8arulearesubsequentlyheldunconstitutional,thenthegrantofrulemakingauthority 4committedmisconductconnectedwiththeclaimant'swork. 5 2.AtestconductedbyalaboratorycertifiedbytheUnitedStatesDepartmentof 6HealthandHumanServices,oranothercertifyingorganizationsolongasthecertification 7requirementsmeettheminimumstandardsoftheUnitedStatesDepartmentofHealthand 8HumanServices,andthelaboratory'strialpacketshallbeincludedintheadministrative 9recordandconsideredasevidence. 10 3.Theclaimantmusthavepreviouslybeennotifiedoftheemployer'salcoholand 11controlledsubstanceworkplacepolicybyconspicuouslypostingthepolicyintheworkplace, 12byincludingthepolicyinawrittenpersonnelpolicyorhandbook,orbystatementofsuch 13policyinacollectivebargainingagreementgoverningemploymentoftheemployee.The 14policy,publicposting,handbook,collectivebargainingagreementorotherwrittennotice 15providedtotheemployeemuststatethatapositivetestresultmayresultinsuspensionor 16terminationofemployment. 17 4.Testresultsshallbeadmissibleiftheemployer'spolicyclearlystatesanemployee 18maybesubjecttorandom,preemployment,reasonablesuspicionorpost-accidenttesting.An 19employermayrequireapreemploymenttestforalcohol, marijuana,orcontrolledsubstance 20useasaconditionofemployment,andtestresultsshallbeadmissiblesolongastheclaimant 21wasinformedofthetestrequirementpriortotakingthetest.Arandom,preemployment, 22reasonablesuspicionorpost-accidenttestresult,conductedunderthissection,whichis 23positiveforalcohol, marijuana,orcontrolledsubstanceuseshallbeconsideredmisconduct. 24 5.Theapplicationofthissectionforalcohol, marijuana,andcontrolledsubstance 25testing,relatingonlytomethodsoftesting,criteriafortesting,chainofcustodyforsamplesor 26specimensanddueprocessforemployeenotificationproceduresshallnotapplyintheevent 27thattheclaimantissubjecttotheprovisionsofanyapplicablecollectivebargaining 28agreement,solongassaidagreementcontainsmethodsforalcohol, marijuana,orcontrolled 29substancetestingthatmeetorexceedtheminimumstandardsestablishedinthissection. 30Nothinginthischapterisintendedtoauthorizeanyemployertotestanyapplicantor 31employeeforalcohol, marijuana,ordrugsinanymannerinconsistentwithMissourior HCSHB2704 50 32UnitedStatesConstitution,law,statuteorregulation,includingthoseimposedbythe 33AmericanswithDisabilitiesActandtheNationalLaborRelationsAct. 34 6.Allspecimencollectionfordrugsandalcoholunderthischaptershallbeperformed 35inaccordancewiththeproceduresprovidedforbytheUnitedStatesDepartmentof 36Transportationrulesforworkplacedrugandalcoholtestingcompiledat49C.F.R.,Part40. 37Anyemployerthatperformsdrugtestingorspecimencollectionshallusechain-of-custody 38proceduresestablishedbyregulationsoftheUnitedStatesDepartmentof 39Transportation."Specimen"meanstissue,fluid,oraproductofthehumanbodycapableof 40revealingthepresenceofalcohol, marijuana,ordrugsortheirmetabolites."Chainof 41custody"referstothemethodologyoftrackingspecifiedmaterialsorsubstancesforthe 42purposeofmaintainingcontrolandaccountabilityfrominitialcollectiontofinaldisposition 43forallsuchmaterialsorsubstances,andprovidingforaccountabilityateachstagein 44handling,testing,andstoringspecimensandreportingtestresults. 45 7.Theemployeemayrequestthataconfirmationtestonthespecimenbeconducted. 46"Confirmationtest"meansasecondanalyticalprocedureusedtoidentifythepresenceof 47marijuanaoraspecificdrugoralcoholormetaboliteinaspecimen,whichtestmustbe 48differentinscientificprinciplefromthatoftheinitialtestprocedureandmustbecapableof 49providingrequisitespecificity,sensitivityandquantitativeaccuracy.Intheeventthata 50confirmationtestisrequested,suchshallbeobtainedfromaseparate,unrelatedcertified 51laboratoryandshallbeattheemployee'sexpenseonlyifsaidtestconfirmstheoriginal, 52positivetestresults.Forpurposesofthissection,confirmationtestshallbeasplitspecimen 53test. 54 8.Useofacontrolledsubstanceasdefinedundersection195.010underandin 55conformitywiththelawfulorderofahealthcarepractitioner,shallnotbedeemedtobe 56misconductconnectedwithworkforthepurposesofthissection. 57 9.Useofmarijuanaoramarijuana-infusedproductunderArticleXIV,Section 581oftheConstitutionofMissourishallnotbedeemedtobemisconductconnectedwith 59workforthepurposesofthissection. 60 10.Thissectionshallhavenoeffectonemployerswhodonotavailthemselvesofthe 61requirementsandregulationsforalcohol, marijuana,andcontrolleddrugtesting 62determinationsthatarerequiredtoaffirmmisconductconnectedwithworkfindings. 63 [10.]11.AnyemployerthatinitiatesanalcoholanddrugtestingpolicyafterJanuary 641,2005,shallensurethatatleastsixtydayselapsebetweenageneralone-timenoticetoall 65employeesthatanalcoholanddrugtestingworkplacepolicyisbeingimplementedandthe 66effectivedateoftheprogram. Section3.Anypersonundertwenty-oneyearsofagewhopurchasesorattempts 2topurchase,orhasinhisorherpossession,anymarijuanaormarijuanaproductas 3definedinsection650.700,orwhoisvisiblyinanintoxicatedconditionasdefinedin 4section577.001,isguiltyofamisdemeanorunlesssuchpersonisabletopurchaseor 5possessmarijuanaoramarijuana-infusedproductunderArticleXIV,Section1ofthe 6ConstitutionofMissouri.AfirstviolationofthissectionshallbepunishableasaclassD 7misdemeanor.Asecondorsubsequentviolationofthissectionshallbepunishableasa 8classAmisdemeanor.Priorfindingsofguiltshallbepleadedandproveninthesame 9mannerasrequiredbysection558.021.
