JOINTRESOLUTION
SubmittingtothequalifiedvotersofMissourianamendmentrepealingSections40(a)and40
(b)ofArticleIVoftheConstitutionofMissouri,andadoptingonenewsectioninlieu
thereofrelatingtotheconservationcommission.
BeitresolvedbytheHouseofRepresentatives,theSenateconcurringtherein:
ThatatthenextgeneralelectiontobeheldinthestateofMissouri,onTuesdaynext
2followingthefirstMondayinNovember,2022,orataspecialelectiontobecalledbythe
3governorforthatpurpose,thereisherebysubmittedtothequalifiedvotersofthisstate,for
4adoptionorrejection,thefollowingamendmenttoArticleIVoftheConstitutionofthestate
5ofMissouri:
SectionA.Sections40(a)and40(b),ArticleIV,ConstitutionofMissouri,are
2repealedandonenewsectionadoptedinlieuthereof,tobeknownasSection40(a),toreadas
3follows:
Section40(a).1.Thecontrol,management,restoration,conservation, andregulation
2ofthebird,fish,game,forestry, andallwildliferesourcesofthestate,includinghatcheries,
3sanctuaries,refuges,reservations, andallotherpropertyowned,acquired, orusedforsuch
4purposesandtheacquisitionandestablishmentthereof,andtheadministrationofalllaws
5pertainingthereto,shallbevestedinaconservationcommission[consisting] electedas
6providedinthissection.
7 2.Untiltheelectionofeightmembersundersubsection3ofthissection,the
8commissionshallconsistoffourmembersappointedbythegovernor,byandwiththeadvice

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 9andconsentofthesenate,notmorethantwoofwhomshallbeofthesamepoliticalparty.
10Themembersshallhaveknowledgeofandinterestinwildlifeconservation.Themembers
11shallholdofficefortermsofsixyearsbeginningonthefirstdayofJulyofconsecutiveodd
12years.Twoofthetermsshallbeconcurrent;oneshallbegintwoyearsbeforeandonetwo
13yearsaftertheconcurrentterms.
14 3.(1)BeginningonJanuary1,2025,membersoftheconservationcommission
15shallbeelectedasprovidedinthissubsection.Commissionmembersshallbe
16nonpartisanandshallhaveknowledgeofandinterestinwildlifeconservation.
17 (2)(a)Theconservationcommissionshallconsistofeightmembers.Such
18membersshallbeelectedonthestategeneralelectionday,asdefinedbystatelaw,
19immediatelyprecedingthemembers'terms.Suchmembersshallrepresentthe
20congressionaldistrictsassuchdistrictsexistonJanuary1,2023.Eachmembershall
21representonecongressionaldistrict,resideinsuchdistrict,andbeelectedbythe
22qualifiedvotersresidinginsuchdistrict.Electionsforsuchmembersshallbeconducted
23asprovidedbylaw.
24 (b)Themembersinitiallyelectedunderthissubsectionshallbeelectedonthe
25generalelectiondayinNovember,2024.Themembersrepresentingthefirst,second,
26andseventhdistrictsshallserveaninitialtermoftwoyears;themembersrepresenting
27thethird,fourth,andfifthdistrictsshallserveaninitialtermoffouryears;andthe
28membersrepresentingthesixthandeighthdistrictsshallserveaninitialtermofsix
29years.
30 (c)Aftertheexpirationofaninitialtermasprovidedinthissubsection,each
31commissionershallserveatermofsixyearsuntilasuccessoriselectedorappointedand
32qualified.
33 (3)Exceptinthecaseofanappointmentbythegovernortofillavacancy,each
34membershalltakeofficeonJanuaryfirstoftheyearfollowingthemember'selection.
35 (4)Ifanymember'sofficebecomesvacantforanyreason,thegovernorshall
36appointamembertofillthevacancyfortheremainderoftheunexpiredterm.Ifthe
37governorfailstofillavacancywithinthirtydays,theremainingmembersshallfillthe
38vacancyfortheunexpiredterm.
39 4.Themembersshallreceivenosalaryorothercompensationfortheirservicesas
40members,butshallreceivetheirnecessarytravelingandotherexpensesincurredwhile
41actuallyengagedinthedischargeoftheirofficialduties.
