BeitresolvedbytheHouseofRepresentatives,theSenateconcurringtherein: ThatatthenextgeneralelectiontobeheldinthestateofMissouri,onTuesdaynext 2followingthefirstMondayinNovember,2022,orataspecialelectiontobecalledbythe 3governorforthatpurpose,thereisherebysubmittedtothequalifiedvotersofthisstate,for 4adoptionorrejection,thefollowingamendmenttoArticleIIIoftheConstitutionofthestate 5ofMissouri: SectionA.Sections49,50,and52(b),ArticleIII,ConstitutionofMissouri,are 2repealedandfournewsectionsadoptedinlieuthereof,tobeknownasSections49,50,50(b), 3and52(b),toreadasfollows: Section49.Thepeoplereservepowertoproposeandenactorrejectlawsand 2amendmentstotheconstitutionbytheinitiative[, independentofthegeneralassembly,]and 3alsoreservepowertoapproveorrejectbyreferendumanyactofthegeneralassembly,except 4ashereinafterprovided. Section50.1.Initiativepetitionsproposingamendmentstotheconstitutionshallbe 2signedbyeightpercentofthelegalvoters, registeredtovoteinMissouriandcitizensofthe 3UnitedStates,ineachof[two-thirdsof]thecongressionaldistrictsinthestate,andpetitions 4proposinglawsshallbesignedbyfivepercentofsuchvoters.[Everysuchpetitionshallbe 5filedwiththesecretaryofstatenotlessthansixmonthsbeforetheelectionandshallcontain 6anenactingclauseandthefulltextofthemeasure.] Petitionsforconstitutionalamendments 7shallnotcontainmorethanoneamendedandrevisedarticleofthisconstitution,oronenew EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 8articlewhichshallnotcontainmorethanonesubjectandmattersproperlyconnected 9therewith,andtheenactingclausethereofshallbe"Beitresolvedbythepeopleofthestateof 10MissourithattheConstitutionbeamended:".Petitionsforlawsshallcontainnotmorethan 11onesubjectwhichshallbeexpressedclearlyinthetitle,andtheenactingclausethereofshall 12be"BeitenactedbythepeopleofthestateofMissouri:".Forpurposesofthisarticle,only 13citizensoftheUnitedStatesofAmericawhoareresidentsoftheStateofMissouriand 14whoareproperlyregisteredtovoteintheStateofMissourishallbeconsideredlegal 15voters. 16 2.NotwithstandingSection2(b)ofArticleXIIofthisconstitutiontothe 17contrary,anyinitiativepetitionproposinganamendmenttotheconstitutionshalltake 18effectattheendofthirtydaysaftertheelectionwhenapprovedbyatleasttwo-thirdsof 19thevotescastthereon,providedthatforanyinitiativepetitionproposinganamendment 20totheconstitutionthatwasapprovedpriortoDecember8,2022,aninitiativepetition 21proposingsolelytorepealallorpartoftheapprovedamendmentwithoutanyadditional 22modificationshalltakeeffectwhenapprovedbyamajorityofthevotescastthereon. 23 3.Anyinitiativepetitionproposinglawsshalltakeeffectwhenapprovedbyat 24leastamajorityofthevotescastthereon. Section50(b).InitiativepetitionsproposingamendmentstotheConstitutionof 2Missourishallbesubjecttoapprovalbythegeneralassemblyaftertheinitiativepetition 3hasreceivedtherequisitenumberofsignaturesbutbeforeitisplacedontheballot.An 4initiativepetitionshallbesubmittedtothegeneralassemblynolaterthanMarchfirstof 5thefirstorsecondsessionofthegeneralassemblyimmediatelypriortothegeneral 6electionwhenthepetitionshallappearontheballot.Initiativepetitionssubmittedto 7thegeneralassemblyunderthissectionshallnotrequirethegovernor'ssignature.The 8generalassemblyshallhaveuntilthefirstFridayfollowingthesecondMondayinMay 9ofthesecondregularsessionofthegeneralassemblypriortothegeneralelectiontoact 10ontheinitiativepetition.Ifbothhousesofthegeneralassemblypasstheinitiative 11petitionasproposed,itshallbecomelawwhenapprovedbyamajorityofthevotescast 12thereon,andnototherwise.Ifbothhousesofthegeneralassemblypassanidentical 13amendedversionoftheinitiativepetition,thesponsorsmaychoosetosubmiteitherthe 14originalversionortheamendedversiontothesecretaryofstateasprovidedinthis 15section.Ifthesponsorssubmittheamendedversion,itshallbecomelawwhenapproved 16byamajorityofthevotescastthereon,andnototherwise.Ifthesponsorssubmitthe 17originalversion,itshallbecomelawwhenapprovedbytwo-thirdsofthevotescast 18thereon,andnototherwise.Ifbothhousesofthegeneralassemblyfailtopassthe 19initiativepetitionasproposedorasamended,thesponsorsmaysubmittheoriginal 20version,whichshallbecomelawwhenapprovedbytwo-thirdsofthevotescastthereon, HCSHJR91 2 21andnototherwise.Theinitiativepetitionshallbereturnedtoitssponsorsafter6:00 22p.m.onthefirstFridayfollowingthesecondMondayinMay.Thesponsorsshallhave 23untilMaythirtiethtosubmiteithertheoriginalversionortheamendedversionofthe 24initiativepetitiontothesecretaryofstate.
