JOINTRESOLUTION
SubmittingtothequalifiedvotersofMissourianamendmentrepealingSections49,50,and
52(b)ofArticleIIIoftheConstitutionofMissouri,andadoptingfournewsectionsin
lieuthereofrelatingtoinitiativepetitionsproposingamendmentstotheconstitution.
BeitresolvedbytheHouseofRepresentatives,theSenateconcurringtherein:
ThatatthenextgeneralelectiontobeheldinthestateofMissouri,onTuesdaynext
2followingthefirstMondayinNovember,2022,orataspecialelectiontobecalledbythe
3governorforthatpurpose,thereisherebysubmittedtothequalifiedvotersofthisstate,for
4adoptionorrejection,thefollowingamendmenttoArticleIIIoftheConstitutionofthestate
5ofMissouri:
SectionA.Sections49,50,and52(b),ArticleIII,ConstitutionofMissouri,are
2repealedandfournewsectionsadoptedinlieuthereof,tobeknownasSections49,50(a),50
3(b),and52(b),toreadasfollows:
Section49.Thepeoplereservepowertoproposeandenactorrejectlawsand
2amendmentstotheconstitutionbytheinitiative[, independentofthegeneralassembly,]and
3alsoreservepowertoapproveorrejectbyreferendumanyactofthegeneralassembly,except
4ashereinafterprovided.
[Section50.]Section50(a).1.Initiativepetitionsproposingamendmentstothe
2constitutionshallbesignedbyeightpercentofthelegalvoters, registeredtovotein
3MissouriandcitizensoftheUnitedStates,ineachof[two-thirdsof]thecongressional
4districtsinthestate,andpetitionsproposinglawsshallbesignedbyfivepercentofsuch
5voters.[Everysuchpetitionshallbefiledwiththesecretaryofstatenotlessthansixmonths
6beforetheelectionandshallcontainanenactingclauseandthefulltextofthemeasure.]
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 7Petitionsforconstitutionalamendmentsshallnotcontainmorethanoneamendedandrevised
8articleofthisconstitution,oronenewarticlewhichshallnotcontainmorethanonesubject
9andmattersproperlyconnectedtherewith,andtheenactingclausethereofshallbe"Beit
10resolvedbythepeopleofthestateofMissourithattheConstitutionbeamended:".Petitions
11forlawsshallcontainnotmorethanonesubjectwhichshallbeexpressedclearlyinthetitle,
12andtheenactingclausethereofshallbe"BeitenactedbythepeopleofthestateofMissouri:".
13OnlycitizensoftheUnitedStatesofAmericawhoareresidentsoftheStateofMissouri
14andwhoareproperlyregisteredtovoteintheStateofMissourishallbeconsideredlegal
15voters.
16 2.NotwithstandingSection2(b)ofArticleXIIofthisconstitutiontothe
17contrary,anyballotmeasureproposinganamendmenttotheconstitution,whether
18proposedbyinitiativepetitionorbythegeneralassembly,shalltakeeffectattheendof
19thirtydaysaftertheelectionwhenapprovedbyatleasttwo-thirdsofthevotescast
20thereon,providedthatanysuchballotmeasureproposingtorepealallorpartofthe
21constitutionthatwasapprovedbythevoterspriortoDecember10,2022,shalltake
22effectwhenapprovedbyamajorityofthevotescastthereon,andmayamendother
23languageinthesamearticleasisnecessaryandproperonlytomakegrammaticaland
24logicalsenseoftheamendedarticle.
25 3.Anyinitiativepetitionproposinglawsshalltakeeffectwhenapprovedbyat
26leastamajorityofthevotescastthereon.
Section50(b).InitiativepetitionsproposingamendmentstotheConstitutionof
2Missourishallbesubjecttoreviewbybothhousesofthegeneralassemblyafterthe
3initiativepetitionhasreceivedtherequisitenumberofsignatures,butbeforeitisplaced
4ontheballot.Aninitiativepetitionshallbesubmittedtothegeneralassemblynolater
5thanMarchfirstofthefirstorsecondsessionofthegeneralassemblyimmediatelyprior
6tothegeneralelectionwhenthepetitionshallappearontheballot.Initiativepetitions
7submittedtothegeneralassemblyunderthissectionshallnotrequirethegovernor's
8signature.ThegeneralassemblyshallhaveuntilthefirstFridayfollowingthesecond
9MondayinMayofthesecondregularsessionofthegeneralassemblypriortothe
10generalelectiontoactontheinitiativepetition.Theinitiativepetitionshallbeactedon
11inthesamemannerasabillfiledinthegeneralassembly.Ifbothhousesofthegeneral
12assemblyfailtopasstheinitiativepetitionasproposedorpasstheinitiativepetition
13unamended,thesponsorsmaysubmittheoriginalversiontothesecretaryofstateas
14providedinthissection.Ifbothhousesofthegeneralassemblypassanidentical
15amendedversionoftheinitiativepetition,thesponsorsmaychoosetosubmiteitherthe
16originalversionortheamendedversiontothesecretaryofstateasprovidedinthis
17section.Theinitiativepetitionshallbereturnedtoitssponsorsafter6:00p.m.onthe
HCSHJR91	2 18firstFridayfollowingthesecondMondayinMay.ThesponsorsshallhaveuntilMay
19thirtiethtosubmittheinitiativepetitiontothesecretaryofstate,whichshallbecomelaw
20whenapprovedbytwo-thirdsofthevotescastthereon,andnototherwise.
Section52(b).Thevetopowerofthegovernorshallnotextendtomeasuresreferred
2tothepeople.Allelectionsonmeasuresreferredtothepeople, exceptasotherwise
3providedbythisconstitution,shallbehadatthegeneralstateelections,exceptwhenthe
4generalassemblyshallorderaspecialelection.Anymeasurereferredtothepeopleshalltake
5effectwhenapprovedbyamajorityofthevotescastthereon,andnototherwise.Thissection
6shallnotbeconstruedtodepriveanymemberofthegeneralassemblyoftherighttointroduce
7anymeasure.
SectionB.Pursuanttochapter116,andotherapplicableconstitutionalprovisionsand
2lawsofthisstateallowingthegeneralassemblytoadoptballotlanguageforthesubmissionof
3thisjointresolutiontothevotersofthisstate,theofficialsummarystatementofthis
