Thisbillmodifiesprovisionsrelatingtocredittowardtheservice
ofasentenceofimprisonmentbychangingthebeginningofthe
creditaccrualtoaftertheoffenseoccurred,asopposedtothe
currentprovisionofafterconviction. Thiscreditmustbebased
uponthecertificationofthesheriff,andmaybesupplementedbya
certificateofasherifforothercustodialofficerfromanother
jurisdictionhavingheldthepersononthechargeoftheoffense
forwhichthesentenceisordered.
Thecourt,whenpronouncingsentence,mayawardadditionalcredit
fortimespentinprison,jail,orcustodybeforethecommencement
ofthesentenceforthoseinwhichthepersonwasincarcerated,but
forwhomnodetainerorwarrantwasserved.Thetotalamountof
creditmustnotbemorethanthenumberofdaysbetweenthedateof
theoffenseandthecommencementofthesentence.
Thisbillrepealsfromtheoffenseofdrugtraffickinginthefirst
degreewhenapersonknowinglydistributes,delivers,manufactures,
produces,orattemptstodistribute,deliver,manufacture,or
producemorethaneightgramsofamixtureorspecifiedsubstance
thathasacocainebase.Thebillalsorepealsfromtheoffenseof
drugtraffickingintheseconddegreewhenapersonknowingly
possessesmorethaneightgramsofamixtureorspecifiedsubstance
thathasacocainebase.
