2 (1)Tocausepollutionofanywatersofthestateortoplaceorcauseorpermittobe
3placedanywatercontaminantinalocationwhereitisreasonablycertaintocausepollutionof
4anywatersofthestate;

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 5 (2)Todischargeanywatercontaminantsintoanywatersofthestatewhichreducethe
6qualityofsuchwatersbelowthewaterqualitystandardsestablishedbythecommission;
7 (3)Toviolateanypretreatmentandtoxicmaterialcontrolregulations,ortodischarge
8anywatercontaminantsintoanywatersofthestatewhichexceedeffluentregulationsor
9permitprovisionsasestablishedbythecommissionorrequiredbyanyfederalwaterpollution

11 (4)Todischargeanyradiological,chemical,orbiologicalwarfareagentorhigh-level
12radioactivewasteintothewatersofthestate.
13 2.Itshallbeunlawfulforanypersontooperate,useormaintainanywater
14contaminantorpointsourceinthisstatethatissubjecttostandards,rulesorregulations
15promulgatedpursuanttotheprovisionsofsections644.006to644.141unlesssuchperson
16holdsanoperatingpermitfromthecommission,subjecttosuchexceptionsasthecommission
17mayprescribebyruleorregulation.However,nooperatingpermitshallberequiredofany
18personforanyemissionintopubliclyownedtreatmentfacilitiesorintopubliclyownedsewer
19systemstributarytopubliclyownedtreatmentworks.
20 3.Itshallbeunlawfulforanypersontoconstruct,build,replaceormakemajor
21modificationtoanypointsourceorcollectionsystemthatisprincipallydesignedtoconveyor
22dischargehumansewagetowatersofthestate,unlesssuchpersonobtainsaconstruction
23permitfromthecommission,exceptasprovidedinthissection.Thefollowingactivitiesshall
24beexcludedfromconstructionpermitrequirements:
25 (1)Facilitiesgreaterthanonemilliongallonsperdaythatareauthorizedthrougha
26localsupervisedprogram,andarenotreceivinganydepartmentfinancialassistance;
27 (2)Allsewerextensionsorcollectionprojectsthatareonethousandfeetinlengthor
28lesswithfewerthantwoliftstations;
29 (3)Allsewercollectionprojectsthatareauthorizedthroughalocalsupervised
30program;[and]
31 (4)Anyearthenbasinconstructedtoretainandsettlenontoxic,nonmetallic
32earthenmaterialssuchassoil,silt,androck;and
33 (5)Anyotherexclusionsthecommissionmaypromulgatebyrule.
34 4.Aconstructionpermitmayberequiredbythedepartmentinthefollowing
35circumstances:
36 [(a)](1)Substantialdeviationfromthecommission'sdesignstandards;
37 [(b)](2)Toaddressnoncompliance;
38 [(c)](3)Whenanunauthorizeddischargehasoccurredorhasthepotentialtooccur;
39or
40 [(d)](4)Tocorrectaviolationofwaterqualitystandards.

42structuretohold,convey,contain,storeortreatdomestic,agricultural,orindustrialprocess
43wastewateralsoshallbesubjecttotheconstructionpermitprovisionsofthissubsection.All
44otherconstruction-relatedactivitiesatpointsourcesshallbeexemptfromtheconstruction
45permitrequirements.Allactivitiesthatareexemptedfromtheconstructionpermit
46requirementaresubjecttothefollowingconditions:
47 [a.](1)Anypointsourcesystemdesignedtohold,convey,contain,storeortreat
48domestic,agriculturalorindustrialprocesswastewatershallbedesignedbyaprofessional
49engineerregisteredinMissouriinaccordancewiththecommission'sdesignrules;
50 [b.](2)Suchpointsourcesystemshallbeconstructedinaccordancewiththe
51registeredprofessionalengineer'sdesignandplans;and
52 [c.](3)Suchpointsourcesystemmayreceiveapost-constructionsiteinspectionby
53thedepartmentpriortoreceivingoperatingpermitapproval.Asiteinspectionmaybe
54performedbythedepartment,uponreceiptofacompleteoperatingpermitapplicationor
55submissionofanengineer'sstatementofworkcomplete.
56 6.Agovernmentalunitmayapplytothedepartmentforauthorizationtooperatea
57localsupervisedprogram,andthedepartmentmayauthorizesuchaprogram.Alocal
58supervisedprogramwouldrecognizethegovernmentalunit'sengineeringcapacityandability
59toconductengineeringwork,superviseconstructionandmaintaincompliancewithrelevant
60operatingpermitrequirements.
61 [4.]7.Beforeissuinganypermitrequiredbythissection,thedirectorshallissuesuch
62notices,conductsuchhearings,andconsidersuchfactors,commentsandrecommendationsas
63requiredbysections644.006to644.141oranyfederalwaterpollutioncontrolact.The
64directorshalldetermineifanystateoranyprovisionsofanyfederalwaterpollutioncontrol
65actthestateisrequiredtoenforce,anystateorfederaleffluentlimitationsorregulations,
66waterquality-relatedeffluentlimitations,nationalstandardsofperformance,toxicand
67pretreatmentstandards,orwaterqualitystandardswhichapplytothesource,oranysuch
68standardsinthevicinityofthesource,arebeingexceeded,andshalldeterminetheimpacton
69suchwaterqualitystandardsfromthesource.Thedirector,inordertoeffectuatethepurposes
70ofsections644.006to644.141,shalldenyapermitifthesourcewillviolateanysuchacts,
71regulations,limitationsorstandardsorwillappreciablyaffectthewaterqualitystandardsor
72thewaterqualitystandardsarebeingsubstantiallyexceeded,unlessthepermitisissuedwith
73suchconditionsastomakethesourcecomplywithsuchrequirementswithinanacceptable
74timeschedule.
75 [5.]8.Thedirectorshallgrantordenythepermitwithinsixtydaysafterall
76requirementsoftheFederalWaterPollutionControlActconcerningissuanceofpermitshave
77beensatisfiedunlesstheapplicationdoesnotrequireanypermitpursuanttoanyfederalwater

79andmaintainsuchfacilitiesortoconductsuchtestsandmonitoreffluentsasnecessaryto
80determinethenature,extent,quantityordegreeofwatercontaminantdischargedorreleased
81fromthesource,establishandmaintainrecordsandmakereportsregardingsuch
82determination.
83 [6.]9.Thedirectorshallpromptlynotifytheapplicantinwritingofhisorheraction
84andifthepermitisdeniedstatethereasonsforsuchdenial.Asprovidedbysections621.250
85and640.013,theapplicantmayappealtotheadministrativehearingcommissionfromthe
86denialofapermitorfromanyconditioninanypermitbyfilingapetitionwiththe
87administrativehearingcommissionwithinthirtydaysofthenoticeofdenialorissuanceofthe
88permit.Afterafinalactionistakenonaneworreissuedgeneralpermit,apotentialapplicant
89forthegeneralpermitwhocandemonstratethatheorsheisormaybeadverselyaffectedby
90anypermittermorconditionmayappealthetermsandconditionsofthegeneralpermit
91withinthirtydaysofthedepartment'sissuanceofthegeneralpermit.Innoeventshalla
92permitconstitutepermissiontoviolatethelaworanystandard,ruleorregulationpromulgated
93pursuantthereto.Oncetheadministrativehearingcommissionhasreviewedtheappeal,the
94administrativehearingcommissionshallissuearecommendeddecisiontothecommissionon
95permitissuance,denial,oranyconditionofthepermit.Thecommissionshallissueitsown
96decision,basedontheappeal,forpermitissuance,denial,oranyconditionofthepermit.If
97thecommissionchangesafindingoffactorconclusionoflawmadebytheadministrative
98hearingcommission,ormodifiesorvacatesthedecisionrecommendedbytheadministrative
99hearingcommission,itshallissueitsowndecision,whichshallincludefindingsoffactand
100conclusionsoflaw.Thecommissionshallmailcopiesofitsfinaldecisiontothepartiestothe
101appealortheircounselofrecord.Thecommission'sdecisionshallbesubjecttojudicial
102reviewpursuanttochapter536,exceptthatthecourtofappealsdistrictwithterritorial
103jurisdictioncoextensivewiththecountywherethepointsourceistobelocatedshallhave
104originaljurisdiction.Nojudicialreviewshallbeavailableuntilandunlessalladministrative
105remediesareexhausted.
106 [7.]10.Inanyhearingheldpursuanttothissectionthatinvolvesapermit,license,or
107registration,theburdenofproofisonthepartyspecifiedinsection640.012.Anydecisionof

110 [8.]11.Inanyevent,nopermitissuedpursuanttothissectionshallbeissuedif
111properlyobjectedtobythefederalgovernmentoranyagencyauthorizedtoobjectpursuantto
112anyfederalwaterpollutioncontrolactunlesstheapplicationdoesnotrequireanypermit
113pursuanttoanyfederalwaterpollutioncontrolact.

115permittee.Allrequestsshallbeinwritingandshallcontainfactsorreasonssupportingthe
116request.
117 [10.]13.Nomanufacturingorprocessingplantoroperatinglocationshallberequired
118topaymorethanoneoperatingfee.Operatingpermitsshallbeissuedforaperiodnotto
119exceedfiveyearsafterdateofissuance,exceptthatgeneralpermitsshallbeissuedforafive-
120yearperiod,andalsoexceptthatneitheraconstructionnoranannualpermitshallberequired
121forasingleresidence'swastetreatmentfacilities.Applicationsforrenewalofasite-specific
122operatingpermitshallbefiledatleastonehundredeightydayspriortotheexpirationofthe
123existingpermit.Applicationsseekingtorenewcoverageunderageneralpermitshallbe
124submittedatleastthirtydayspriortotheexpirationofthegeneralpermit,unlessthepermittee
125hasbeennotifiedbythedirectorthatanearlierapplicationmustbemade.Generalpermits
126maybeappliedforandissuedelectronicallyoncemadeavailablebythedirector.
127 [11.]14.Everypermitissuedtomunicipaloranypubliclyownedtreatmentworksor
128facilityshallrequirethepermitteetoprovidethecleanwatercommissionwithadequate
129noticeofanysubstantialnewintroductionsofwatercontaminantsorpollutantsintosuch
130worksorfacilityfromanysourceforwhichsuchnoticeisrequiredbysections644.006to
131644.141oranyfederalwaterpollutioncontrolact.Suchpermitshallalsorequirethe
132permitteetonotifythecleanwatercommissionofanysubstantialchangeinvolumeor
133characterofwatercontaminantsorpollutantsbeingintroducedintoitstreatmentworksor
134facilitybyasourcewhichwasintroducingwatercontaminantsorpollutantsintoitsworksat
135thetimeofissuanceofthepermit.Noticemustdescribethequalityandquantityofeffluent
136beingintroducedortobeintroducedintosuchworksorfacilitybyasourcewhichwas
137introducingwatercontaminantsorpollutantsintoitsworksatthetimeofissuanceofthe
138permit.Noticemustdescribethequalityandquantityofeffluentbeingintroducedortobe
139introducedintosuchworksorfacilityandtheanticipatedimpactofsuchintroductiononthe
140qualityorquantityofeffluenttobereleasedfromsuchworksorfacilityintowatersofthe
141state.
142 [12.]15.Thedirectororthecommissionmayrequirethefilingorpostingofabond
143asaconditionfortheissuanceofpermitsforconstructionoftemporaryorfuturewater
144treatmentfacilitiesorfacilitiesthatutilizeinnovativetechnologyforwastewatertreatmentin
145anamountdeterminedbythecommissiontobesufficienttoensurecompliancewithall
146provisionsofsections644.006to644.141,andanyrulesorregulationsofthecommissionand
147anyconditionastosuchconstructioninthepermit.Forthepurposesofthissection,
148"innovativetechnologyforwastewatertreatment"shallmeanacompletelynewandgenerally
149unproventechnologyinthetypeormethodofitsapplicationthatbenchtestingortheory
150suggesthasenvironmental,efficiency,andcostbenefitsbeyondthestandardtechnologies.
HCSHBs1207&622	5 151Nobondshallberequiredfordesignsapprovedbyanyfederalagencyorenvironmental
152regulatoryagencyofanotherstate.Thebondshallbesignedbytheapplicantasprincipal,
153andbyacorporatesuretylicensedtodobusinessinthestateofMissouriandapprovedbythe
154commission.Thebondshallremainineffectuntilthetermsandconditionsofthepermitare
155metandtheprovisionsofsections644.006to644.141andrulesandregulationspromulgated
156pursuanttheretoarecompliedwith.
157 [13.]16.(1)Thedepartmentshallissueordenyapplicationsforconstructionand
158site-specificoperatingpermitsreceivedafterJanuary1,2001,withinonehundredeightydays
159ofthedepartment'sreceiptofanapplication.Forgeneralconstructionandoperatingpermit
160applicationsreceivedafterJanuary1,2001,thatdonotrequireapublicparticipationprocess,
161thedepartmentshallissueordenythepermitswithinsixtydaysofthedepartment'sreceiptof
162anapplication.Foranapplicationseekingcoverageunderarenewedgeneralpermitthatdoes
163notrequireanindividualpublicparticipationprocess,thedirectorshallissueordenythe
164permitwithinsixtydaysofthedirector'sreceiptoftheapplication,oruponissuanceofthe
165generalpermit,whicheverislater.Inregardtoanapplicationseekingcoverageunderan
166initialgeneralpermitthatdoesnotrequireanindividualpublicparticipationprocess,the
167directorshallissueordenythepermitwithinsixtydaysofthedepartment'sreceiptofthe
168application.Foranapplicationseekingcoverageunderarenewedgeneralpermitthat
169requiresanindividualpublicparticipationprocess,thedirectorshallissueordenythepermit
170withinninetydaysofthedirector'sreceiptoftheapplication,oruponissuanceofthegeneral
171permit,whicheverislater.Inregardtoanapplicationforaninitialgeneralpermitthat
172requiresanindividualpublicparticipationprocess,thedirectorshallissueordenythepermit
173withinninetydaysofthedirector'sreceiptoftheapplication.
174 (2)Ifthedepartmentfailstoissueordenywithgoodcauseaconstructionor
175operatingpermitapplicationwithinthetimeframesestablishedinsubdivision(1)ofthis
176subsection,thedepartmentshallrefundthefullamountoftheinitialapplicationfeewithin
177forty-fivedaysoffailuretomeettheestablishedtimeframe.Ifthedepartmentfailstorefund
178theapplicationfeewithinforty-fivedays,therefundamountshallaccrueinterestatarate

180 (3)Permitfeedisputesmaybeappealedtothecommissionwithinthirtydaysofthe

217 [17.]20.Priortothedevelopmentofanewgeneralpermitorreissuanceofageneral
218permitforaquaculture,landdisturbancerequiringastormwaterpermit,orreissuanceofa
219generalpermitunderwhichfiftyormorepermitswereissuedunderageneralpermitduring
220theimmediatelyprecedingfive-yearperiodforadesignatedcategoryofwatercontaminant
221sources,thedirectorshallimplementapublicparticipationprocesscomplyingwiththe
222followingminimumrequirements:

231permitteesandotherinterestedpersons.Thedirectorshallincludenoticeofthepublic
