caninesearchandrescueteams,withpenaltyprovisions.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section307.175,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection307.175,toreadasfollows:
307.175.1.Motorvehiclesandequipmentwhichareoperatedbyanymemberofan
2organizedfiredepartment,ambulanceassociation,orrescuesquad,includingacanine
3searchandrescueteam,whetherpaidorvolunteer,maybeoperatedonstreetsandhighways
4inthisstateasanemergencyvehicleundertheprovisionsofsection304.022while
5respondingtoafirecall[or],ambulancecall,oranemergencycallrequiringsearchand
6rescueoperations,oratthesceneofafirecall[or],ambulancecall,oranemergencycall
7requiringsearchandrescueoperations,andwhileusingorsoundingawarningsirenand
8usingordisplayingthereonfixed,flashingorrotatingbluelights,butsirensandbluelights
9shallbeusedonlyinbonafideemergencies.
10 2.(1)Notwithstandingsubsection1ofthissection,thefollowingvehiclesmayuseor
11displayfixed,flashing,orrotatingredorredandbluelights:
12 (a)Emergencyvehicles,asdefinedinsection304.022,whenrespondingtoan
13emergency;
14 (b)Vehiclesoperatedasdescribedinsubsection1ofthissection;
15 (c)Vehiclesandequipmentownedorleasedbyacontractororsubcontractor
16performingworkforthedepartmentoftransportation,exceptthattheredorredandblue
17lightsshallbedisplayedonvehiclesorequipmentdescribedinthisparagraphonlybetween

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18duskanddawn,whensuchvehiclesorequipmentarestationary,suchvehiclesorequipment
19arelocatedinaworkzoneasdefinedinsection304.580,highwayworkersasdefinedin
20section304.580arepresent,andsuchworkzoneisdesignatedbyasignorsigns.Nomore
21thantwovehiclesorpiecesofequipmentinaworkzonemaydisplayfixed,flashing,or
22rotatinglightsunderthissubdivision;
23 (d)Vehiclesandequipmentowned,leased,oroperatedbyacoroner,medical
24examiner,orforensicinvestigatorofthecountymedicalexaminer'sofficeorasimilarentity,
25whenrespondingtoacrimescene,motorvehicleaccident,workplaceaccident,orany
26locationatwhichtheservicesofsuchprofessionalshavebeenrequestedbyalaw
27enforcementofficer.
28 (2)Thefollowingvehiclesandequipmentmayuseordisplayfixed,flashing,or
29rotatingamberoramberandwhitelights:
30 (a)Vehiclesandequipmentownedorleasedbythestatehighwaysandtransportation
31commissionandoperatedbyanauthorizedemployeeofthedepartmentoftransportation;
32 (b)Vehiclesandequipmentownedorleasedbyacontractororsubcontractor
33performingworkforthedepartmentoftransportation,exceptthattheamberoramberand
34whitelightsshallbedisplayedonvehiclesdescribedinthisparagraphonlywhensuch
35vehiclesorequipmentarelocatedinaworkzoneasdefinedinsection304.580,highway
36workersasdefinedinsection304.580arepresent,andsuchworkzoneisdesignatedbyasign
37orsigns;
38 (c)Vehiclesandequipmentoperatedbyautilityworkerperformingworkforthe
39utility,exceptthattheamberoramberandwhitelightsshallbedisplayedonvehicles
40describedinthisparagraphonlywhensuchvehiclesarestationary,suchvehiclesor
41equipmentarelocatedinaworkzoneasdefinedinsection304.580,autilityworkeris
42present,andsuchworkzoneisdesignatedbyasignorsigns.Asusedinthisparagraph,the
43term"utilityworker"meansanyemployeewhileinperformanceofhisorherjobduties,
44includinganypersonemployedundercontractofautilitythatprovidesgas,heat,electricity,
45water,steam,telecommunicationsorcableservices,orsewerservices,whetherprivately,
46municipally,orcooperativelyowned.
47 3.Permitsfortheoperationofsuchvehiclesequippedwithsirensorbluelightsshall
48beinwritingandshallbeissuedandmayberevokedbythechiefofanorganizedfire
49department,organizedambulanceassociation,rescuesquad,orthestatehighwaysand
50transportationcommissionandnopersonshalluseordisplayasirenorbluelightsonamotor
51vehicle,fire,ambulance,orrescueequipmentwithoutavalidpermitauthorizingtheuse.A
52permittouseasirenorlightsasheretoforesetoutdoesnotrelievetheoperatorofthevehicle
HB1228 2 53soequippedwithcomplyingwithallothertrafficlawsandregulations.Violationofthis
54sectionconstitutesaclassAmisdemeanor.
