BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Sections306.127and306.185,RSMo,arerepealedandtwonewsections
2enactedinlieuthereof,tobeknownassections306.127and306.185,toreadasfollows:
306.127.1.BeginningJanuary1,2005,everypersonbornafterJanuary1,1984,or
2asrequiredpursuanttosection306.128,whooperatesavesselonthelakesofthisstateshall
3possess,onthevessel,aboatingsafetyidentificationcardissuedbythewaterpatroldivision
4oritsagentwhichshowsthatheorshehas:
5 (1)SuccessfullycompletedaboatingsafetycourseapprovedbytheNational
6AssociationofStateBoatingLawAdministratorsandcertifiedbythewaterpatroldivision.
7TheboatingsafetycoursemayincludeacoursesponsoredbytheUnitedStatesCoastGuard
8AuxiliaryortheUnitedStatesPowerSquadron.Thewaterpatroldivisionmayappoint
9agentstoadministeraboatereducationcourseorcourseequivalencyexaminationandissue
10boateridentificationcardsunderguidelinesestablishedbythewaterpatrol.Thewaterpatrol
11divisionshallmaintainalistofapprovedcourses;or
12 (2)Successfullypassedanequivalencyexaminationpreparedbythewaterpatrol
13divisionandadministeredbythewaterpatroldivisionoritsagent.Theequivalency
14examinationshallhaveadegreeofdifficultyequalto,orgreaterthan,thatofthe
15examinationsgivenattheconclusionofanapprovedboatingsafetycourse;or
16 (3)Avalidmaster's,mate's,oroperator'slicenseissuedbytheUnitedStatesCoast
17Guard.
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 2.Thewaterpatroldivisionoritsagentshallissueapermanentboatingsafety
19identificationcardtoeachpersonwhocomplieswiththerequirementsofthissectionwhichis
20validforlifeunlessinvalidatedpursuanttolaw.
21 3.Thewaterpatroldivisionmaychargeafeeforsuchcardoranyreplacementcard
22thatdoesnotsubstantiallyexceedthecostsofadministratingthissection.Thewaterpatrol
23divisionoritsdesignatedagentshallcollectsuchfees.Thesefundsshallbeforwardedto
24[generalrevenue] thewaterpatroldivisionfundtobeusedsolelyforstatewideboating
25safetyinitiatives.
26 4.Theprovisionsofthissectionshallnotapplytoanypersonwho:
27 (1)IslicensedbytheUnitedStatesCoastGuardtoserveasmasterofavessel;
28 (2)Operatesavesselonlyonaprivatelakeorpondthatisnotclassifiedaswatersof
29thestate;
30 (3)UntilJanuary1,2006,isanonresidentwhoisvisitingthestateforsixtydaysor
31less;
32 (4)Isparticipatinginaneventorregattaapprovedbythewaterpatrol;
33 (5)Isanonresidentwhohasproofofavalidboatingcertificateorlicenseissuedby
34anotherstateiftheboatingcourseisapprovedbytheNationalAssociationofStateBoating
35LawAdministrators(NASBLA);
36 (6)Isexemptedbyruleofthewaterpatrol;
37 (7)IscurrentlyservinginanybranchoftheUnitedStatesArmedForces,reserves,or
38MissouriNationalGuard,oranyspouseofapersoncurrentlyinsuchservice;or
39 (8)Haspreviouslysuccessfullycompletedaboatingsafetyeducationcourse
40approvedbytheNationalAssociationofStateBoatingLawAdministrators(NASBLA).
41 5.Thewaterpatroldivisionshallinformotherstatesoftherequirementsofthis
42section.
43 6.Noindividualshallbedetainedorstoppedstrictlyforthepurposeofchecking
44whethertheindividualpossessesaboatingsafetyidentificationcardoratemporaryboater
45educationpermit.
46 7.Anypersonorcompanythatrentsorsellsvesselsmayissueatemporaryboating
47safetyidentificationcardtoanindividualtooperatearentedvesseloravesselbeing
48consideredforsale,foraperiodofuptosevendays,providedthattheindividualmeetsthe
49minimumagerequirementsforoperatingavesselinthisstate.Inordertoqualifyforthe
50temporaryboatingsafetyidentificationcard,theapplicantshallprovideavaliddriver's
51licenseandshallsignanaffidavitthatheorshehasreviewedtheMissouristatehighway
52patrolhandbookofMissouriboatinglawsandresponsibilities.Anyindividualholdinga
53validtemporaryboatingsafetyidentificationcardshallbedeemedincompliancewiththe
54requirementsofthissection.TheMissouristatehighwaypatrolshallchargeafeeofnine
HB152	2 55dollarsforsuchtemporaryboatingsafetyidentificationcard.Individualsshallnotbeeligible
56formorethanonetemporaryboatingsafetyidentificationcard.Nopersonorcompanymay
57issueatemporaryboatingsafetyidentificationcardtoanindividualundertheprovisionsof
58thissubsectionunlesssuchpersonorcompanyiscapableofsubmittingtheapplicant's
59temporaryboatingsafetyidentificationcardinformationandpaymentinanelectronicformat
60asprescribedbytheMissouristatehighwaypatrol.Thebusinessentityissuingatemporary
61boatingsafetyidentificationcardtoanindividualundertheprovisionsofthissubsectionshall
62transmittheapplicant'stemporaryboatingsafetyidentificationcardinformation
63electronicallytotheMissouristatehighwaypatrol,inamannerandformatprescribedby
64thesuperintendent,usinganelectroniconlineregistrationprocessdevelopedandprovidedby
65theMissouristatehighwaypatrol.Theelectroniconlineprocessdevelopedandprovidedby
66theMissouristatehighwaypatrolshallallowtheapplicanttopaythetemporaryboating
67safetyidentificationcardfeebycreditcardordebitcard.Notwithstandinganyprovisionin
68section306.185tothecontrary,allfeescollectedundertheauthorityofthissubsectionshall
69bedepositedinthewaterpatroldivisionfund.TheMissouristatehighwaypatrolshall
70promulgaterulesfordevelopingthetemporaryboatingsafetyidentificationcardandany
71requirementsnecessarytotheissuance,processing,andpaymentofthetemporaryboating
72safetyidentificationcard.TheMissouristatehighwaypatrolshall,byrule,developaboating
73safetychecklistforeachapplicantseekingatemporaryboatingsafetyidentificationcard.
74Nothinginthissubsectionshallallowaholderofatemporaryboatingsafetyidentification
75cardtoreceiveanotationontheperson'sdriver'slicenseornondriveridentificationunder
76section302.184.TheprovisionsofthissubsectionshallexpireonDecember31,2032.
306.185.1.Thereisherebycreatedinthestatetreasurythe"WaterPatrolDivision
2Fund",whichshallconsistofmoneycollectedundersection306.030andsection306.127.
3Thestatetreasurershallbecustodianofthefundandshallapprovedisbursementsfromthe
4fundinaccordancewithsections30.170and30.180.Uponappropriation,moneyinthefund
5shallbeusedsolelyfortheexpensesoftheMissouristatehighwaypatrol,waterpatrol
6division,includingbutnotlimitedtopersonnelexpense,trainingexpense,andequipment
7expenseforthepurposeofenforcingthelawsofthischapter.
8 2.Notwithstandingtheprovisionsofsection33.080,anymoneysremaininginthe
9fundattheendofthebienniumshallnotreverttothecreditofthegeneralrevenuefund.
10 3.Thestatetreasurershallinvestmoneysinthefundinthesamemannerasother
11fundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbecreditedto
12thefund.
