163.048.1.Thissectionandsection173.088shallbeknownandmaybecitedas

3 2.Asusedinthissection,thefollowingtermsmean:
4 (1)"Athletics",anyinterscholasticathleticgames,contests,programs,activities,
5exhibitions,orothersimilarcompetitionsorganizedandprovidedforstudentsingrades
6sixtotwelve;
7 (2)"Sex",thetwomaincategoriesofmaleandfemaleintowhichindividualsare
8dividedbasedonanindividual'sreproductivebiologyatbirthandtheindividual's
9genome.
10 3.(1)Thegeneralassemblyherebyfindsthefollowing:
11 (a)Anoticeabledisparitycontinuesbetweentheathleticsparticipationratesof
12studentswhoaremaleandstudentswhoarefemale;
13 (b)Courtshaverecognizedalegitimateandimportantgovernmentalinterestin
14redressingpastdiscriminationagainstfemalesinathleticsonthebasisofsexand
15promotingequalityofathleticopportunitybetweenthesexesunderTitleIXofthe
16federalEducationAmendmentsof1972(20U.S.C.Section1681etseq.),asamended;
17and
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 (c)Courtshaverecognizedthatclassificationbysexistheonlyfeasible
19classificationtopromotethegovernmentalinterestofprovidingopportunitiesfor
20athleticsforfemales.
21 (2)Thegeneralassemblyherebydeclaresthatitisthepublicpolicyofthisstate
22tofurtherthegovernmentalinterestofensuringthatsufficientopportunitiesfor
23athleticsremainavailableforfemalestoremedypastdiscriminationonthebasisofsex.
24 4.(1)Exceptasprovidedundersubdivision(3)ofthissubsection,noschool
25districtorcharterschoolshallallowanystudenttocompeteinanathleticscompetition
26thatisdesignatedforthebiologicalsexoppositetothestudent'sbiologicalsexas
27correctlystatedonthestudent'sofficialbirthcertificateasdescribedinsubsection5of
28thissectionor,ifthestudent'sofficialbirthcertificateisunobtainable,another
29governmentrecord.
30 (2)Notwithstandinganyotherprovisionoflawtothecontrary,nopublicschool
31shallbeamemberofanystatewideathleticorganizationthatfailstocomplywiththe
32provisionsofthissubsectionandshallnotcompeteinathleticeventswithaprivateor
33parochialschoolthatdoesnothaveapolicythatissubstantiallysimilartosubdivision
34(1)ofthissubsection.
35 (3)Aschooldistrictorcharterschoolmayallowafemalestudenttocompetein
36anathleticscompetitionthatisdesignatedformalestudentsifnocorresponding
37athleticscompetitiondesignatedforfemalestudentsisofferedoravailable.
38 5.Forpurposesofthissection,astatementofastudent'sbiologicalsexonthe
39student'sofficialbirthcertificateoranothergovernmentrecordshallbedeemedtohave
40correctlystatedthestudent'sbiologicalsexonlyifthestatementwas:
41 (1)Enteredatornearthetimeofthestudent'sbirth;or
42 (2)Modifiedtocorrectanyscrivener'serrorinthestudent'sbiologicalsex.
43 6.Ineachschoolyear,thedepartmentofelementaryandsecondaryeducation
44shallwithholdfromaschooldistrict,charterschool,orprivateschoolthatviolates
45subdivision(1)or(2)ofsubsection4ofthissectionapercentageofanymonthly
46distributionofstateformulafundingandanyotherrevenuesfromthestatethatare
47distributedtosuchschooldistrictorcharterorprivateschool.Thedepartmentshall
48withholdsuchdistributionsforthemonthinwhichtheviolationoccursandallmonths
49remainingintheschoolyearinwhichtheviolationoccursinthefollowingpercentages:
50 (1)Forthefirstviolation,twenty-fivepercent;
51 (2)Forthesecondviolation,fiftypercent;and
52 (3)Forthethirdandsubsequentviolations,onehundredpercent.
53 7.Thedepartmentofelementaryandsecondaryeducationshallpromulgateall
54necessaryrulesandregulationsfortheimplementationandadministrationofthis
HCSHB183	2 55section.Suchrulesandregulationsshallensurecompliancewithstateandfederallaw
56regardingtheconfidentialityofstudentmedicalinformation.Anyruleorportionofa
57rule,asthattermisdefinedinsection536.010,thatiscreatedundertheauthority
58delegatedinthissectionshallbecomeeffectiveonlyifitcomplieswithandissubjectto
59alloftheprovisionsofchapter536and,ifapplicable,section536.028.Thissectionand
60chapter536arenonseverableandifanyofthepowersvestedwiththegeneralassembly
61pursuanttochapter536toreview,todelaytheeffectivedate,ortodisapproveandannul
62arulearesubsequentlyheldunconstitutional,thenthegrantofrulemakingauthority
63andanyruleproposedoradoptedafterAugust28,2023,shallbeinvalidandvoid.
173.088.1.Asusedinthissection,thefollowingtermsmean:
2 (1)"Athletics",anyintercollegiateathleticgames,contests,programs,activities,

4 (2)"Intercollegiateassociation",anationalassociationwithathleticsgovernance
5authoritythatiscomposedofpostsecondaryeducationalinstitutionsandathletic
6conferences,thatsetseligibilityrequirementsforparticipationinsportsatthecollegiate
7level,andthatprovidesthecoordination,supervision,andregulationofthe
8intercollegiatecompetitions;
9 (3)"Postsecondaryeducationalinstitution",anypublicorprivateinstitutionof
10highereducationinthisstatethatissubjecttothecoordinatingboardforhigher
11educationundersection173.005;
12 (4)"Sex",thetwomaincategoriesofmaleandfemaleintowhichindividualsare
13dividedbasedonanindividual'sreproductivebiologyatbirthandtheindividual's
14genome.
15 2.(1)Exceptasprovidedundersubdivision(3)ofthissubsection,no
16postsecondaryeducationalinstitutionshallallowanystudenttocompeteinanathletics
17competitionthatisdesignatedforthebiologicalsexoppositetothestudent'sbiological
18sexascorrectlystatedonthestudent'sofficialbirthcertificateasdescribedin
19subsection3ofthissectionor,ifthestudent'sofficialbirthcertificateisunobtainable,
20anothergovernmentrecord.
21 (2)Nopostsecondaryeducationalinstitutionshallallowastudenttocompetein
22anathleticscompetitionofanyintercollegiateassociationthatdoesnothaveoradopta
23policythatissubstantiallysimilartosubdivision(1)ofthissubsection.
24 (3)Apostsecondaryeducationalinstitutionmayallowafemalestudentto
25competeinanathleticscompetitionthatisdesignatedformalestudentsifno
26correspondingathleticscompetitiondesignatedforfemalestudentsisofferedor
27available.
HCSHB183	3 28 3.Forpurposesofthissection,astatementofastudent'sbiologicalsexonthe
29student'sofficialbirthcertificateoranothergovernmentrecordshallbedeemedtohave
30correctlystatedthestudent'sbiologicalsexonlyifthestatementwas:
31 (1)Enteredatornearthetimeofthestudent'sbirth;or
32 (2)Modifiedtocorrectanyscrivener'serrorinthestudent'sbiologicalsex.
33 4.(1)Ineachfiscalyear,thecoordinatingboardforhighereducationshall
34orderapublicpostsecondaryeducationalinstitution'sthatviolatessubdivision(1)or(2)
35ofsubsection2ofthissectiontoremitafineinanamountofthepostsecondary
36institutionscurrentfiscalyearstateoperatingappropriationinthefollowing
37percentages:
38 (a)Forthefirstviolation,twenty-fivepercent;
39 (b)Forthesecondviolation,fiftypercent;and
40 (c)Forthethirdandsubsequentviolations,onehundredpercent.
41 (2)Anyprivatepostsecondaryeducationalinstitutionthatviolatessubdivision
42(1)ofsubsection2ofthissectionshallbefineduptoonemilliondollarsperviolationas
43determinedbythecoordinatingboardofhighereducation.
44 5.Nothinginthissectionshallpermitanindividualtobringanyclaimagainst
45anypostsecondaryeducationalinstitutionortheemployees,directors,officers,and
46agentsofsuchinstitution,relatingtoorarisingoutofcompliancewith,adherenceto,or
47implementationofsubsection2ofthissectionbysuchinstitution.
48 6.Nopostsecondaryeducationalinstitutionortheemployees,directors,officers,
49andagentsofsuchinstitution,shallbecivillyliableforactsrelatingtoorarisingoutof
50compliancewith,adherenceto,orimplementationofsubsection2ofthissectionbysuch
51institution.
52 7.(1)Anyindividualthatsuffersharmarisingfromaviolationofsubsection2
53ofthissectionbyapostsecondaryeducationinstitutionshallhaveaprivatecauseof
54actionagainstsuchinstitution.
55 (2)Acauseofactionundersubdivision(1)ofthissubsectionshallbebrought
56withintwoyearsaftertheharmhasoccurred.
57 8.Thedepartmentofhighereducationandworkforcedevelopmentshall
58promulgateallnecessaryrulesandregulationsfortheimplementationand
59administrationofthissection.Suchrulesandregulationsshallensurecompliance
60withstateandfederallawregardingtheconfidentialityofstudentmedicalinformation.
61Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatiscreated
62undertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies
63withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section
64536.028.Thissectionandchapter536arenonseverableandifanyofthepowersvested

66ortodisapproveandannularulearesubsequentlyheldunconstitutional,thenthegrant
67ofrulemakingauthorityandanyruleproposedoradoptedafterAugust28,2023,shall
68beinvalidandvoid.
