5 (3)"Rebate",anydiscount,negotiatedconcession,orotherpaymentprovided

9 2.BeforeMarch1,2025,andannuallythereafter,thepharmacybenefits
10managerutilizedbytheMissouriconsolidatedhealthcareplanshallfileareportwith
11theplanfortheimmediatelyprecedingcalendaryear.Thereportshallcontainthe
12followinginformationregardingtheplan:
13 (1)Theaggregatedollaramountofallrebatesthatthepharmacybenefits
14managercollectedfrompharmaceuticalmanufacturersthatmanufacturedoutpatient
15prescriptiondrugsthat:
16 (a)Werecoveredbytheplanduringsuchcalendaryear;and
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17 (b)Wereattributabletopatientutilizationofsuchdrugsduringsuchcalendar

27formforreportingtheinformationrequiredundersubsection2ofthissection.The
28formshallbedesignedtominimizetheadministrativeburdenandcostofreportingon
29theplananditspharmacybenefitsmanager.
30 4.Nodocuments,materials,orotherinformationsubmittedtotheplanunder
31subsection2ofthissectionshallbesubjecttodisclosureunderchapter610,excepttothe
32extenttheyareincludedonanaggregatedbasisinthereportsrequiredundersubsection
335ofthissection.Theplanshallnotdiscloseinformationsubmittedundersubsection2
34ofthissectioninamannerthat:
35 (1)Islikelytocompromisethefinancial,competitive,orproprietarynatureof
36suchinformation;or
37 (2)Wouldenableathirdpartytoidentifythevalueofarebateprovidedfora

43submittedtotheplanundersubdivision(1)ofsubsection2ofthissectionforthe
44immediatelyprecedingcalendaryearandsuchotherinformationastheplaninits
45discretiondeemsrelevantforthepurposesofthissection.Theplanshallprovideits
46pharmacybenefitsmanagerandanythirdpartyaffectedbysubmissionofareport
47requiredbythissubsectionwithawrittennoticedescribingthecontentofthereport.
48 (2)BeforeJuly1,2025,andannuallythereafter,theplanshallprepareareport
49fortheimmediatelyprecedingcalendaryeardescribingtherebatepracticesoftheplan
50anditspharmacybenefitsmanager.Theplanshallprovidethereporttothestanding
51committeesofthegeneralassemblyhavingjurisdictionoverhealthinsurancematters
52andthedirectorofthedepartmentofcommerceandinsurance.Thereportshall
53contain:

55calculatingpremiumsforsuchyear;

338.015.1.Theprovisionsofsections338.010to338.015shallnotbeconstruedto
2inhibitthepatient'sfreedomofchoicetoobtainprescriptionservicesfromanylicensed
3pharmacistorpharmacy. [However,nothinginsections338.010to338.315abrogatesthe
4patient'sabilitytowaivefreedomofchoiceunderanycontractwithregardtopaymentor
5coverageofprescriptionexpense.]
6 2.Allpharmacistsmayprovidepharmaceuticalconsultationandadvicetopersons
7concerningthesafeandtherapeuticuseoftheirprescriptiondrugs.
8 3.Allpatientsshallhavetherighttoreceiveawrittenprescriptionfromtheir
9prescribertotaketothefacilityoftheirchoiceortohaveanelectronicprescription
10transmittedtothefacilityoftheirchoice.
11 4.Nopharmacybenefitsmanager,asdefinedinsection376.388,shallprohibitor
12redirectbycontract,orotherwisepenalizeorrestrict,acoveredperson,asdefinedin
13section376.387,fromobtainingprescriptionservices,consultation,oradvicefroma
14contractedpharmacy,asdefinedinsection376.388.
376.387.1.Forpurposesofthissection,thefollowingtermsshallmean:

16 (1)Thecopaymentamountasrequiredunderthehealthbenefitplan;or
17 (2)Theamountanindividualwouldpayforaprescriptionifthatindividualpaidwith
18cash.
19 3.Apharmacyorpharmacistshallhavetherighttoprovidetoacoveredperson
20informationregardingtheamountofthecoveredperson'scostshareforaprescriptiondrug,
21thecoveredperson'scostofanalternativedrug,andthecoveredperson'scostofthedrug
22withoutadjudicatingtheclaimthroughthepharmacybenefitsmanager.Neitherapharmacy
23norapharmacistshallbeproscribedbyapharmacybenefitsmanagerfromdiscussingany
24suchinformationorfromsellingamoreaffordablealternativetothecoveredperson.
25 4.Nopharmacybenefitsmanagershall,directlyorindirectly,chargeorholda
26pharmacistorpharmacyresponsibleforanyfeeamountrelatedtoaclaimthatisnotknownat
27thetimeoftheclaim'sadjudication,unlesstheamountisaresultofimproperlypaidclaims
28[orchargesforadministeringahealthbenefitplan].
29 5.[ThissectionshallnotapplywithrespecttoclaimsunderMedicarePartD,orany
30otherplanadministeredorregulatedsolelyunderfederallaw,andtotheextentthissection
31maybepreemptedundertheEmployeeRetirementIncomeSecurityActof1974forself-
32fundedemployer-sponsoredhealthbenefitplans.
33 6.]Apharmacybenefitsmanagershallnotifyinwritinganyhealthcarrierwithwhich
34itcontractsifthepharmacybenefitsmanagerhasaconflictofinterest,anycommonalityof
35ownership,oranyotherrelationship,financialorotherwise,betweenthepharmacybenefits
36managerandanyotherhealthcarrierwithwhichthepharmacybenefitsmanagercontracts.
37 [7.]6.Anyentitythatentersintoacontracttosell,provide,pay,orreimbursea
38pharmacyinthestateforprescriptiondrugsonbehalfofitselforanotherentityshall
39defineandapplytheterm"generic",withrespecttoprescriptiondrugs,tomeanany
40"authorizedgenericdrug",asdefinedin21CFR314.3,approvedundersection505(c)
41oftheFederalFood,Drug,andCosmeticAct,asamended.
42 7.Anyentitythatentersintoacontracttosell,provide,pay,orreimbursea
43pharmacyinthestateforprescriptiondrugsonbehalfofitselforanotherentityshall
44defineandapplytheterm"rebate"ashavingthesamemeaninggiventothetermin
45section103.200.
46 8.Apharmacybenefitsmanagerthathascontractedwithanentitytoprovide
47pharmacybenefitmanagementservicesforsuchanentityshalloweafiduciarydutyto
48thatentity,andshalldischargethatdutyinaccordancewithfederalandstatelaw.
49 9.Thedepartmentofcommerceandinsuranceshallenforcethissection.

2followingtermsshallmean:
3 (1)"Contractedpharmacy"[or"pharmacy"], apharmacylocatedinMissouri
4participatinginthenetworkofapharmacybenefitsmanagerthroughadirectorindirect
5contract;
6 (2)["Healthcarrier",anentitysubjecttotheinsurancelawsandregulationsofthis
7statethatcontractsorofferstocontracttoprovide,deliver,arrangefor,payfor,orreimburse
8anyofthecostsofhealthcareservices,includingasicknessandaccidentinsurancecompany,
9ahealthmaintenanceorganization,anonprofithospitalandhealthservicecorporation,orany
10otherentityprovidingaplanofhealthinsurance,healthbenefits,orhealthservices,except
11thatsuchplanshallnotincludeanycoveragepursuanttoaliabilityinsurancepolicy,workers'
12compensationinsurancepolicy,ormedicalpaymentsinsuranceissuedasasupplementtoa
13liabilitypolicy;
14 (3)] "Maximumallowablecost",theper-unitamountthatapharmacybenefits
15managerreimbursesapharmacistforaprescriptiondrug,excludingadispensingor

32representativeoragent,suchasapharmacyservicesadministrativeorganization,apharmacy
33benefitsmanagershall,withrespecttosuchcontractorrenewal:
34 (1)Includeinsuchcontractorrenewalthesourcesutilizedtodeterminemaximum
35allowablecostandupdatesuchpricinginformationatleasteverysevendays;and
36 (2)Maintainaproceduretoeliminateproductsfromthemaximumallowablecostlist
37ofdrugssubjecttosuchpricingormodifymaximumallowablecostpricingatleastevery
HCSHB197	5 38sevendays,ifsuchdrugsdonotmeetthestandardsandrequirementsofthissection,inorder
39toremainconsistentwithpricingchangesinthemarketplace.
40 3.Apharmacybenefitsmanagershallreimbursepharmaciesfordrugssubjectto
41maximumallowablecostpricingthathasbeenupdatedtoreflectmarketpricingatleastevery
42sevendaysassetforthundersubdivision(1)ofsubsection2ofthissection.
43 4.Apharmacybenefitsmanagershallnotplaceadrugonamaximumallowablecost
44listunlessthereareatleasttwotherapeuticallyequivalentmultisourcegenericdrugs,orat
45leastonegenericdrugavailablefromatleastonemanufacturer,generallyavailablefor
46purchasebynetworkpharmaciesfromnationalorregionalwholesalers.
47 5.(1)Allcontractsbetweenapharmacybenefitsmanagerandacontractedpharmacy
48orbetweenapharmacybenefitsmanagerandapharmacy'scontractingrepresentativeor
49agent,suchasapharmacyservicesadministrativeorganization,shallincludeaprocessto
50internallyappeal,investigate,andresolvedisputesregardingmaximumallowablecost
51pricing.Theprocessshallincludethefollowing:
52 [(1)](a)Therighttoappealshallbelimitedtofourteencalendardaysfollowingthe
53reimbursementoftheinitialclaim;and
54 [(2)](b)Arequirementthatthepharmacybenefitsmanagershallrespondtoan
55appealdescribedinthissubsectionnolaterthanfourteencalendardaysafterthedatethe
56appealwasreceivedbysuchpharmacybenefitsmanager.
57 (2)Ifareimbursementtoacontractedpharmacyisbelowthepharmacy'scostto
58purchasethedrug,thepharmacybenefitsmanagershallsustainanappealandincrease
59reimbursementtothepharmacyandothercontractedpharmaciestocoverthecostof
60purchasingthedrug.
61 (3)Apharmacybenefitsmanagershallnotreimburseapharmacyor
62pharmacistinthestateanamountlessthantheamountthatthepharmacybenefits
63managerreimbursesapharmacybenefitsmanageraffiliateforprovidingthesame
64pharmacistservices.
65 6.Forappealsthataredenied,thepharmacybenefitsmanagershallprovidethe
66reasonforthedenialandidentifythenationaldrugcodeofadrugproductthatmaybe
67purchasedbycontractedpharmaciesatapriceatorbelowthemaximumallowablecostand,
68whenapplicable,maybesubstitutedlawfully.
69 7.Iftheappealissuccessful,thepharmacybenefitsmanagershall:
70 (1)Adjustthemaximumallowablecostpricethatisthesubjectoftheappealeffective
71onthedayafterthedatetheappealisdecided;
72 (2)Applytheadjustedmaximumallowablecostpricetoallsimilarlysituated
73pharmaciesasdeterminedbythepharmacybenefitsmanager;and

75pharmacybenefitsclaimgivingrisetotheappeal.
76 8.Appealsshallbeupheldif:

78costpricinginquestionwasnotreimbursedasrequiredundersubsection3ofthissection;or
79 (2)Thedrugsubjecttothemaximumallowablecostpricinginquestiondoesnotmeet

58thissection.Suchpenaltyshallnotexceedfivethousanddollarsperviolationperday.
59 4.Thedirectorofthedepartmentofcommerceandinsuranceshallpromulgate
60rulestoimplementtheprovisionsofthissection.Anyruleorportionofarule,asthat
61termisdefinedinsection536.010,thatiscreatedundertheauthoritydelegatedinthis
62sectionshallbecomeeffectiveonlyifitcomplieswithandissubjecttoallofthe
63provisionsofchapter536and,ifapplicable,section536.028.Thissectionandchapter
64536arenonseverableandifanyofthepowersvestedwiththegeneralassembly
65pursuanttochapter536toreview,todelaytheeffectivedate,ortodisapproveandannul

5 2.Thissectionappliestoanygrouporindividualpolicyofaccidentandhealth
6insuranceamended,delivered,issued,orrenewedonorafterAugust28,2023.
7 3.Aninsurerthatprovidescoverageforprescriptioninsulindrugsunderthe
8termsofahealthcoverageplantheinsureroffersshalllimitthetotalamountthatan
9insuredisrequiredtopayforathirty-daysupplyofcoveredprescriptioninsulindrugs
10atanamountnottoexceedseventy-fivedollars,regardlessofthequantityortypeof
11coveredprescriptioninsulindrugusedtofilltheinsured'sprescription.
12 4.OnJanuaryfirstofeachyear,thelimitontheamountthataninsuredis
13requiredtopayforathirty-daysupplyofacoveredprescriptioninsulindrugshall
14increasebyapercentageequaltothepercentagechangefromtheprecedingyearinthe
15medicalcarecomponentoftheConsumerPriceIndexoftheBureauofLaborStatistics
16oftheUnitedStatesDepartmentofLabor.
17 5.Thedirectorofthedepartmentofcommerceandinsurancemaypromulgate
18allnecessaryrulesandregulationsfortheadministrationofthissection.Anyruleor
19portionofarule,asthattermisdefinedinsection536.010,thatiscreatedunderthe
20authoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplieswithandis
21subjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.This
22sectionandchapter536arenonseverableandifanyofthepowersvestedwiththe
23generalassemblypursuanttochapter536toreview,todelaytheeffectivedate,orto
24disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof
25rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2023,shallbe
26invalidandvoid.
376.689.1.BeforeNovember2,2023,thedepartmentofcommerceand
2insurance,inconjunctionwiththedepartmentofhealthandseniorservicesandthe
3departmentofsocialservices,shallmakeavailabletothepublicareportthatdetails
4eachdepartment'sfindingsforthefollowing:
5 (1)Asummaryofinsulinpricingpracticesandvariablesthatcontributetothe
6pricingofhealthcoverageplans;
7 (2)Publicpolicyrecommendationstocontrolandpreventoverpricingof
