SectionA.Section36.140,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection36.140,toreadasfollows:
36.140.1.Afterconsultationwithappointingauthoritiesandthestatefiscalofficers,
2andafterapublichearingfollowingsuitablenotice,thedirectorshallprepareandrecommend
3totheboardapayplanforeachclassofpositionssubjecttothischapterpursuantto
4subsection1ofsection36.030andeachclassofpositionssubjecttothissectionpursuantto
5section36.031.Thepayplanshallinclude,foreachclassofpositions,aminimumanda
6maximumrate,andsuchprovisionforintermediateratesasthedirectorconsidersnecessary
7orequitable.Thepayplanmayalsoprovidefortheuseofopen,orstepless,payranges.The
8payplanmayincludeprovisionforgroupingofpositionswithsimilarlevelsofresponsibility
9orexpertiseintobroadclassificationbandsforpurposesofdeterminingcompensationandfor
10suchsalarydifferentialsandotherpaystructuresasthedirectorconsidersnecessaryor
11equitable.Inestablishingtherates,thedirectorshallgiveconsiderationtotheexperiencein
12recruitingforpositionsinthestateservice,theratesofpayprevailinginthestateforthe
13servicesperformed,andforcomparableservicesinpublicandprivateemployment,living
14costs,maintenance,orotherbenefitsreceivedbyemployees,andthefinancialconditionand
15policiesofthestate.Theseconsiderationsshallbemadeonastatewidebasisandshallnot
16makeanydistinctionbasedongeographicalareasorurbanandruralconditions.Thepayplan
17shalltakeeffectwhenapprovedbytheboardandthegovernor,andeachemployeeappointed

22fundsappropriatedandavailabletopaytheadoptedpayplan.Thepayplanshallalsobeused
23asthebasisforpreparingbudgetestimatesforsubmissiontothelegislatureinsofarassuch
24budgetestimatesconcernpaymentforservicesperformedinpositionssubjecttothischapter
25pursuanttosubsection1ofsection36.030andpositionssubjecttothissectionpursuantto
26section36.031.Amendmentstothepayplanmayberecommendedbythedirectorfromtime
27totimeascircumstancesrequireandsuchamendmentsshalltakeeffectwhenapprovedas
28providedbythissection.Theconditionsunderwhichemployeesmaybeappointedatarate
29abovetheminimumprovidedfortheclass,oradvancefromoneratetoanotherwithinthe
30ratesapplicabletotheirpositions,maybedeterminedbytheregulations.
31 2.Anychangeinthepayplanshallbemadeonauniformstatewidebasis.No
32employeeinapositionsubjecttothischaptershallreceivemoreorlesscompensationthan
33anotheremployeesolelybecauseofthegeographicalareainwhichtheemployeelivesor
34works.TheprovisionsofthissubsectionshallnotapplytotheMissouristatehighway
