SCSHCSHB301 5 52 5.Forpurposesofthissection,theterm"minimumprisonterm"shallmeantime 53requiredtobeservedbytheoffenderbeforeheorsheiseligibleforparole,conditional 54releaseorotherearlyreleasebythedepartmentofcorrections. 55 6.[Anoffenderwhowasconvictedof,orpledguiltyto,afelonyoffenseotherthan 56thoseoffenseslistedinsubsection2ofthissectionpriortoAugust28,2019,shallnolonger 57besubjecttotheminimumprisontermprovisionsundersubsection2ofthissection,andshall 58beeligibleforparole,conditionalrelease,orotherearlyreleasebythedepartmentof 59correctionsaccordingtotherulesandregulationsofthedepartment. 60 7.](1)Asentencingadvisorycommissionisherebycreatedtoconsistofeleven 61members.Onemembershallbeappointedbythespeakerofthehouse.Onemembershallbe 62appointedbythepresidentprotemofthesenate.Onemembershallbethedirectorofthe 63departmentofcorrections.Sixmembersshallbeappointedbyandserveatthepleasureofthe 64governorfromamongthefollowing:thepublicdefendercommission;privatecitizens;a 65privatememberoftheMissouriBar;theboardofprobationandparole;andaprosecutor. 66Twomembersshallbeappointedbythesupremecourt,onefromametropolitanareaandone 67fromaruralarea.Allmembersshallbeappointedtoafour-yearterm.Allmembersofthe 68sentencingcommissionappointedpriortoAugust28,1994,shallcontinuetoserveonthe 69sentencingadvisorycommissionatthepleasureofthegovernor. 70 (2)Thecommissionshallstudysentencingpracticesinthecircuitcourtsthroughout 71thestateforthepurposeofdeterminingwhetherandtowhatextentdisparitiesexistamong 72thevariouscircuitcourtswithrespecttothelengthofsentencesimposedandtheuseof 73probationforoffendersconvictedofthesameorsimilaroffensesandwithsimilarcriminal 74histories.Thecommissionshallalsostudyandexaminewhetherandtowhatextent 75sentencingdisparityamongeconomicandsocialclassesexistsinrelationtothesentenceof 76deathandifso,thereasonstherefor,ifsentencesarecomparabletootherstates,ifthelength 77ofthesentenceisappropriate,andtherateofrehabilitationbasedonsentence.Itshall 78compilestatistics,examinecases,drawconclusions,andperformotherdutiesrelevanttothe 79researchandinvestigationofdisparitiesindeathpenaltysentencingamongeconomicand 80socialclasses. 81 (3)Thecommissionshallstudyalternativesentences,prisonworkprograms,work 82release,home-basedincarceration,probationandparoleoptions,andanyotherprogramsand 83reportthefeasibilityoftheseoptionsinMissouri. 84 (4)Thegovernorshallselectachairpersonwhoshallcallmeetingsofthecommission 85asrequiredorpermittedpursuanttothepurposeofthesentencingcommission. 86 (5)Themembersofthecommissionshallnotreceivecompensationfortheirduties 87onthecommission,butshallbereimbursedforactualandnecessaryexpensesincurredinthe SCSHCSHB301 6 88performanceofthesedutiesandforwhichtheyarenotreimbursedbyreasonoftheirother 89paidpositions. 90 (6)Thecircuitandassociatecircuitcourtsofthisstate,theofficeofthestatecourts 91administrator,thedepartmentofpublicsafety,andthedepartmentofcorrectionsshall 92cooperatewiththecommissionbyprovidinginformationoraccesstoinformationneededby 93thecommission.Theofficeofthestatecourtsadministratorwillprovideneededstaffing 94resources. 95 [8.]7.Courtsshallretaindiscretiontolowerorexceedthesentencerecommendedby 96thecommissionasotherwiseallowablebylaw,andtoorderrestorativejusticemethods,when 97applicable. 98 [9.]8.Iftheimpositionorexecutionofasentenceissuspended,thecourtmayorder 99anyorallofthefollowingrestorativejusticemethods,oranyothermethodthatthecourt 100findsjustorappropriate: 101 (1)Restitutiontoanyvictimorastatutorilycreatedfundforcostsincurredasaresult 102oftheoffender'sactions; 103 (2)Offendertreatmentprograms; 104 (3)Mandatorycommunityservice; 105 (4)Workreleaseprogramsinlocalfacilities;and 106 (5)Community-basedresidentialandnonresidentialprograms. 107 [10.]9.Pursuanttosubdivision(1)ofsubsection[9]8ofthissection,thecourtmay 108ordertheassessmentandpaymentofadesignatedamountofrestitutiontoacountylaw 109enforcementrestitutionfundestablishedbythecountycommissionpursuanttosection 11050.565.Suchcontributionshallnotexceedthreehundreddollarsforanychargedoffense. 111Anyrestitutionmoneysdepositedintothecountylawenforcementrestitutionfundpursuant 112tothissectionshallonlybeexpendedpursuanttotheprovisionsofsection50.565. 113 [11.]10.Ajudgemayorderpaymenttoarestitutionfundonlyifsuchfundhadbeen 114createdbyordinanceorresolutionofacountyofthestateofMissouripriortosentencing.A 115judgeshallnothaveanydirectsupervisoryauthorityoradministrativecontroloveranyfund 116towhichthejudgeisorderingapersontomakepayment. 117 [12.]11.Apersonwhofailstomakeapaymenttoacountylawenforcement 118restitutionfundmaynothavehisorherprobationrevokedsolelyforfailingtomakesuch 119paymentunlessthejudge,afterevidentiaryhearing,makesafindingsupportedbya 120preponderanceoftheevidencethatthepersoneitherwillfullyrefusedtomakethepaymentor 121thatthepersonwillfully,intentionally,andpurposefullyfailedtomakesufficientbonafide 122effortstoacquiretheresourcestopay. 4 (2)"Personalinformation",thesamemeaningasdefinedinsection407.1500. 5 2.Apersoncommitstheoffenseofunlawfuldisclosureofpersonallyidentifiable 6informationifheorsheknowinglyreleases,publicizes,orotherwisepubliclydiscloses 7thename,homeaddress,SocialSecuritynumber,telephonenumber,orotherpersonal 8informationofanelectedofficialorafamilymemberoftheelectedofficialwiththe 9purposetoharass,intimidate,orcausedeathorbodilyinjurytotheelectedofficialora 10familymemberoftheelectedofficial. 11 3.Theoffenseofunlawfuldisclosureofpersonallyidentifiableinformationisa 12classAmisdemeanor.However,ifaviolationofthissectionisdonewiththepurposeto SCSHCSHB301 14 13influenceanelectedofficialintheperformanceofsuchofficial'sofficialduties,the 14offenseisaclassDfelony. 590.060.1.ThePOSTcommissionshallestablishminimumstandardsfortraining 2instructorsandtrainingcenters,andthedirectorshallestablishminimumqualificationsfor 3admittanceintoabasictrainingcourse. 4 2.Thedirectorshalllicensetraininginstructors,centers,andcurricula,andmay 5probate,suspendandrevokesuchlicensesuponwrittennoticestatingthereasonsforsuch 6action.Anypersonaggrievedbyadecisionpursuanttothissubsectionmayappealas 7providedinchapter536. 8 3.Eachpersonseekingentranceintoabasictrainingprogramshallsubmita 9fingerprintcardandauthorizationforacriminalhistorybackgroundchecktoincludethe 10recordsoftheFederalBureauofInvestigationtothetrainingcenterwheresuchpersonis 11seekingentrance.Thetrainingcentershallcauseacriminalhistorybackgroundchecktobe 12madeandshallcausetheresultingreporttobeforwardedtothedirector.Thepersonseeking 13entrancemaybechargedafeeforthecostofthisprocedure. 14 4.InstructorsatMissouripoliceacademiesshallbeapprovedbythePOST 15commission. 590.1070.1.Thereisherebyestablishedwithinthedepartmentofpublicsafety 2the"PeaceOfficerBasicTrainingTuitionReimbursementProgram".Anymoneys 3appropriatedbythegeneralassemblyforthisprogramshallbeusedtoprovidetuition 4reimbursementfor: 5 (1)QualifyingMissouriresidentswhohavepaidtuitionatastatelicensedbasic 6lawenforcementtrainingcenterforthebasiclawenforcementtrainingrequiredfora 7peaceofficerlicenseinthisstateandwhohavebeenemployedasfull-timepeaceofficers 8inthisstateforaspecifiedperiod;and 9 (2)Qualifyinggovernmententitiesthathavepaidtuitionforanemployeeto 10receivethebasiclawenforcementtrainingrequiredforapeaceofficerlicenseinthis 11stateatalicensedbasiclawenforcementtrainingcenterwhensuchemployeehasbeen 12employedasafull-timepeaceofficerforaspecifiedperiod. 13 2.ThePOSTcommissionshallbetheadministrativeagencyforthe 14implementationofthetuitionreimbursementprogramestablishedunderthissection, 15andshall: 16 (1)Prescribetheformandthetimeandmethodofawardingtuition 17reimbursementunderthissectionandshallsupervisetheprocessingthereof;and 18 (2)Selectqualifyingrecipientstoreceivereimbursementunderthissectionand 19determinethemannerandmethodofpaymenttotherecipient.
