56.601.1.Ifthegovernordeterminesthatathreattopublicsafetyandhealth
2existsinacircuitorprosecutingattorney'sjurisdictionafter:
3 (1)Reviewingfederal,state,orlocalcrimestatistics;and
4 (2)Findingthatthenumberofoccurrencesofhomicidecasesinthetwelve
5monthsimmediatelyprecedingexceedsarateofthirty-fivecasespereveryonehundred
6thousandpeoplewithinthecircuitorprosecutingattorney'sjurisdiction,
7
8thegovernormayappointaspecialprosecutorwhoshallserveforaperiodofuptofive
9years.Thespecialprosecutorshallbeemployedatthewillofthegovernor,shallnotbe
10requiredtoresideinthejurisdictiontowhichheorshewasappointedtoserve,andshall
11beanattorney.
12 2.(1)Thespecialprosecutorshallhaveexclusivejurisdictiontoinitiateand

37generalrevenuefund.Thespecialprosecutorshallbepaidthesamesalaryasan
38associatecircuitcourtjudgeand,uponhisorherappointment,shallbecomeamember
39oftheprosecutingattorneysandcircuitattorneys'retirementsystemassetforthunder
40sections56.800to56.840.
41 (2)Thespecialprosecutorshallhaveabudget,whichshallbeprovidedbythe
42statefromthegeneralrevenuefund,tohireuptofifteenassistantspecialprosecuting
43attorneysanduptofifteenstaffmembersincluding,butnotlimitedto,assistants,clerks,
44reporters,grandjuryreporters,legalinvestigators,andstenographers,asthespecial
45prosecutordeemsnecessary.Theassistantspecialprosecutingattorneysandstaffofthe

55andhealthstillexists,thegovernormaycontinuetoappointthespecialprosecutorfor
56five-yeartermsasprovidedunderthissection.
217.830.Thedepartmentofcorrectionsshalldevelopapolicyandprocedures
2outliningforoffendershowtoapplyforMedicaidandhowtoobtainabirthcertificate,
3SocialSecuritycard,andstateidentificationpriortoreleasefromacorrectionalcenter.
4Thepolicyshallbemadeavailabletotheoffenderpopulation.Ifanoffenderdoesnot
5haveaccesstohisorherbirthcertificate,SocialSecuritycard,orstateidentification
6uponrelease,thedepartmentshallassistsuchoffenderinobtainingthedocumentsprior
7torelease.Anyeducationalorspecialtrainingcertificateshallbeprovidedtothe
8offenderatthetimeheorsheisreleasedfromcustody.
301.3175.1.Anyvehicleownermayapplyfor"BacktheBlue"licenseplatesforany
2motorvehiclethepersonowns,eithersolelyorjointly,otherthananapportionedmotor
3vehicleoracommercialmotorvehiclelicensedinexcessoftwenty-fourthousandpounds
4grossweight.UponmakingatendollarcontributiontotheMissouriLawEnforcement
5MemorialFoundation,thevehicleownermayapplyforthe"BacktheBlue"plate.Ifthe
6contributionismadedirectlytotheMissouriLawEnforcementMemorialFoundation,the
7foundationshallissuetheindividualmakingthecontributionareceipt,verifyingthe
8contribution,thatmaybeusedtoapplyforthe"BacktheBlue"licenseplate.Ifthe
9contributionismadedirectlytothedirectorofrevenuepursuanttosection301.3031,the
10directorshallnotethecontributionandtheownermaythenapplyforthe"BacktheBlue"
11plate.Theapplicantforsuchplateshallpayafifteendollarfeeinadditiontotheregular
12registrationfeesandpresentanyotherdocumentationrequiredbylawforeachsetof"Back
13theBlue"platesissuedpursuanttothissection.Notwithstandingtheprovisionsofsection
14301.144,noadditionalfeeshallbechargedforthepersonalizationoflicenseplatesissued
15pursuanttothissection.Notwithstandinganyprovisionoflawtothecontrary,the
16departmentofrevenueshallissuethelicenseplateorplates,asauthorizedinthis
17section,fornonapportionedvehiclesofanyclassificationforwhichitissuesalicense
18plateorplates.
19 2.The"BacktheBlue"plateshallbeartheemblemofathinbluelineencompassedin
20blackasprescribedbythedirectorofrevenueandshallhavethewords"BACKTHEBLUE".
21Suchlicenseplatesshallbemadewithfullyreflectivematerialwithacommoncolorscheme
22anddesign,shallbeclearlyvisibleatnight,andshallbeaestheticallyattractive,asprescribed
23bysection301.130.
SCSHCSHB301	3 24 [2.]3.Thedirectorofrevenuemaypromulgaterulesandregulationsforthe
25administrationofthissection.Anyruleorportionofarule,asthattermisdefinedinsection
26536.010,thatiscreatedundertheauthoritydelegatedinthissectionshallbecomeeffective
27onlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,
28section536.028.Thissectionandchapter536arenonseverableandifanyofthepowers
29vestedwiththegeneralassemblypursuanttochapter536toreview,todelaytheeffective
30date,ortodisapproveandannularulearesubsequentlyheldunconstitutional,thenthegrant
31ofrulemakingauthorityandanyruleproposedoradoptedafterAugust28,2019,shallbe
32invalidandvoid.
544.453.Notwithstandinganyprovisionofthelaworcourtruletothecontrary,
2ajudgeorjudicialofficer,whensettingbailorconditionsofreleaseinallcourtsin
3Missouriforanyoffensecharged,shallconsider,inadditiontoanyfactorrequiredby
4law,whether:
5 (1)Adefendantposesadangertoavictimofacrime,thecommunity,any
6witnesstothecrime,ortoanyotherperson;
7 (2)Adefendantisaflightrisk;
8 (3)Adefendanthascommittedamisdemeanoroffenseinvolvingacrimeof
9violence,sexualoffense,orfelonyoffenseinthisstateoranyotherstateinthelastfive
10years;and
11 (4)Adefendanthasfailedtoappearincourtasarequiredconditionof
12probationorparoleforamisdemeanorinvolvingacrimeofviolenceorfelonyora
13sexualoffensewithinthelastthreeyears.
558.019.1.Thissectionshallnotbeconstruedtoaffectthepowersofthegovernor
2underArticleIV,Section7,oftheMissouriConstitution.Thisstatuteshallnotaffectthose
3provisionsofsection565.020,section566.125,orsection571.015,whichsetminimumterms
4ofsentences,ortheprovisionsofsection559.115,relatingtoprobation.
5 2.Theprovisionsofsubsections2to5ofthissectionshall[only] beapplicableto[the

21bythedepartmentofcorrectionsofanoffenderaftersentencing.Forpurposesofthissection,
22priorprisoncommitmentstothedepartmentofcorrectionsshallnotincludeanoffender'sfirst
23incarcerationpriortoreleaseonprobationundersection217.362or559.115.Other
24provisionsofthelawtothecontrarynotwithstanding,anyoffenderwhohasbeenfoundguilty
25ofafelonyotherthanadangerousfelonyasdefinedinsection556.061andiscommittedto
26thedepartmentofcorrectionsshallberequiredtoservethefollowingminimumprisonterms:
27 (1)Iftheoffenderhasonepreviousprisoncommitmenttothedepartmentof
28correctionsforafelonyoffense,theminimumprisontermwhichtheoffendermustserveshall
29befortypercentofhisorhersentenceoruntiltheoffenderattainsseventyyearsofage,and
30hasservedatleastthirtypercentofthesentenceimposed,whicheveroccursfirst;
31 (2)Iftheoffenderhastwopreviousprisoncommitmentstothedepartmentof
32correctionsforfeloniesunrelatedtothepresentoffense,theminimumprisontermwhichthe
33offendermustserveshallbefiftypercentofhisorhersentenceoruntiltheoffenderattains
34seventyyearsofage,andhasservedatleastfortypercentofthesentenceimposed,whichever
35occursfirst;
36 (3)Iftheoffenderhasthreeormorepreviousprisoncommitmentstothedepartment
37ofcorrectionsforfeloniesunrelatedtothepresentoffense,theminimumprisontermwhich
38theoffendermustserveshallbeeightypercentofhisorhersentenceoruntiltheoffender
39attainsseventyyearsofage,andhasservedatleastfortypercentofthesentenceimposed,
40whicheveroccursfirst.
41 3.Otherprovisionsofthelawtothecontrarynotwithstanding,anyoffenderwhohas
42beenfoundguiltyofadangerousfelonyasdefinedinsection556.061andiscommittedtothe
43departmentofcorrectionsshallberequiredtoserveaminimumprisontermofeighty-five
44percentofthesentenceimposedbythecourtoruntiltheoffenderattainsseventyyearsofage,
45andhasservedatleastfortypercentofthesentenceimposed,whicheveroccursfirst.
46 4.Forthepurposeofdeterminingtheminimumprisontermtobeserved,the
47followingcalculationsshallapply:
48 (1)Asentenceoflifeshallbecalculatedtobethirtyyears;
49 (2)Anysentenceeitheraloneorintheaggregatewithotherconsecutivesentencesfor
50offensescommittedatornearthesametimewhichisoverseventy-fiveyearsshallbe
51calculatedtobeseventy-fiveyears.
SCSHCSHB301	5 52 5.Forpurposesofthissection,theterm"minimumprisonterm"shallmeantime
53requiredtobeservedbytheoffenderbeforeheorsheiseligibleforparole,conditional
54releaseorotherearlyreleasebythedepartmentofcorrections.
55 6.[Anoffenderwhowasconvictedof,orpledguiltyto,afelonyoffenseotherthan
56thoseoffenseslistedinsubsection2ofthissectionpriortoAugust28,2019,shallnolonger
57besubjecttotheminimumprisontermprovisionsundersubsection2ofthissection,andshall
58beeligibleforparole,conditionalrelease,orotherearlyreleasebythedepartmentof
59correctionsaccordingtotherulesandregulationsofthedepartment.
60 7.](1)Asentencingadvisorycommissionisherebycreatedtoconsistofeleven
61members.Onemembershallbeappointedbythespeakerofthehouse.Onemembershallbe
62appointedbythepresidentprotemofthesenate.Onemembershallbethedirectorofthe
63departmentofcorrections.Sixmembersshallbeappointedbyandserveatthepleasureofthe
64governorfromamongthefollowing:thepublicdefendercommission;privatecitizens;a
65privatememberoftheMissouriBar;theboardofprobationandparole;andaprosecutor.
66Twomembersshallbeappointedbythesupremecourt,onefromametropolitanareaandone
67fromaruralarea.Allmembersshallbeappointedtoafour-yearterm.Allmembersofthe
68sentencingcommissionappointedpriortoAugust28,1994,shallcontinuetoserveonthe
69sentencingadvisorycommissionatthepleasureofthegovernor.
70 (2)Thecommissionshallstudysentencingpracticesinthecircuitcourtsthroughout
71thestateforthepurposeofdeterminingwhetherandtowhatextentdisparitiesexistamong
72thevariouscircuitcourtswithrespecttothelengthofsentencesimposedandtheuseof
73probationforoffendersconvictedofthesameorsimilaroffensesandwithsimilarcriminal
74histories.Thecommissionshallalsostudyandexaminewhetherandtowhatextent
75sentencingdisparityamongeconomicandsocialclassesexistsinrelationtothesentenceof
76deathandifso,thereasonstherefor,ifsentencesarecomparabletootherstates,ifthelength
77ofthesentenceisappropriate,andtherateofrehabilitationbasedonsentence.Itshall
78compilestatistics,examinecases,drawconclusions,andperformotherdutiesrelevanttothe
79researchandinvestigationofdisparitiesindeathpenaltysentencingamongeconomicand
80socialclasses.
81 (3)Thecommissionshallstudyalternativesentences,prisonworkprograms,work
82release,home-basedincarceration,probationandparoleoptions,andanyotherprogramsand
83reportthefeasibilityoftheseoptionsinMissouri.
84 (4)Thegovernorshallselectachairpersonwhoshallcallmeetingsofthecommission
85asrequiredorpermittedpursuanttothepurposeofthesentencingcommission.
86 (5)Themembersofthecommissionshallnotreceivecompensationfortheirduties
87onthecommission,butshallbereimbursedforactualandnecessaryexpensesincurredinthe
SCSHCSHB301	6 88performanceofthesedutiesandforwhichtheyarenotreimbursedbyreasonoftheirother
89paidpositions.
90 (6)Thecircuitandassociatecircuitcourtsofthisstate,theofficeofthestatecourts
91administrator,thedepartmentofpublicsafety,andthedepartmentofcorrectionsshall
92cooperatewiththecommissionbyprovidinginformationoraccesstoinformationneededby
93thecommission.Theofficeofthestatecourtsadministratorwillprovideneededstaffing
94resources.
95 [8.]7.Courtsshallretaindiscretiontolowerorexceedthesentencerecommendedby
96thecommissionasotherwiseallowablebylaw,andtoorderrestorativejusticemethods,when
97applicable.
98 [9.]8.Iftheimpositionorexecutionofasentenceissuspended,thecourtmayorder
99anyorallofthefollowingrestorativejusticemethods,oranyothermethodthatthecourt
100findsjustorappropriate:
101 (1)Restitutiontoanyvictimorastatutorilycreatedfundforcostsincurredasaresult
102oftheoffender'sactions;
103 (2)Offendertreatmentprograms;
104 (3)Mandatorycommunityservice;
105 (4)Workreleaseprogramsinlocalfacilities;and
106 (5)Community-basedresidentialandnonresidentialprograms.
107 [10.]9.Pursuanttosubdivision(1)ofsubsection[9]8ofthissection,thecourtmay
108ordertheassessmentandpaymentofadesignatedamountofrestitutiontoacountylaw
109enforcementrestitutionfundestablishedbythecountycommissionpursuanttosection
11050.565.Suchcontributionshallnotexceedthreehundreddollarsforanychargedoffense.
111Anyrestitutionmoneysdepositedintothecountylawenforcementrestitutionfundpursuant

113 [11.]10.Ajudgemayorderpaymenttoarestitutionfundonlyifsuchfundhadbeen

117 [12.]11.Apersonwhofailstomakeapaymenttoacountylawenforcement
118restitutionfundmaynothavehisorherprobationrevokedsolelyforfailingtomakesuch
119paymentunlessthejudge,afterevidentiaryhearing,makesafindingsupportedbya
120preponderanceoftheevidencethatthepersoneitherwillfullyrefusedtomakethepaymentor
121thatthepersonwillfully,intentionally,andpurposefullyfailedtomakesufficientbonafide
122effortstoacquiretheresourcestopay.
