BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section168.110,RSMo,isrepealedandthreenewsectionsenactedinlieu
2thereof,tobeknownassections105.1750,168.093,and168.110,toreadasfollows:
105.1750.1.Exceptasprovidedundersubsection2ofthissection,personnel
2paymentsmadetoapublicemployeebyapublicemployer,assuchtermsaredefinedin
3section105.055,toencourageretentionorexceptionalemploymentachievement,
4establishedbyformallyadoptedpolicyorcontractatleastoneyearpriortothe
5applicableemploymentachievement,shallnotbeconsideredabonusinviolationof
6ArticleIII,Section39oftheConstitutionofMissouri.Theretentionorachievement
7paymentsinclude,butarenotlimitedto,paymentsthatdonotexceedtwentypercentof
8basewagesorsalary,tobeawardedoncompletionoftheretentionperiodinquestion
9andnotmorefrequentthanannually.Paymentsforexceptionalemployment
10achievementshallbemadeaccordingtospecific,writtencriteriapredeterminedand
11approvedbythepublicemployerinwritingatleastoneyearpriortotheexceptional
12employmentachievement.
13 2.Theprovisionsofthissectionshallnotapplytoanypublicemployeeholdinga
14positionofemploymentforwhichthesalaryissetbystatute.
168.093.1.Acontractbetweenaschooldistrictandanyindividualschool
2districtemployeemayincludeaprovisionspecifyingthattheschooldistrictmayoffer
3andawardtheschooldistrictemployeepaymentsforexceptionalemployment

6 2.Eachschooldistrictprovidingpaymentstoencourageretentionorfor
7exceptionalemploymentachievementshalladoptawrittenpolicydescribingspecific
8predeterminedcriteriaapprovedbytheschoolboardatleastoneyearpriortothe
9exceptionalemploymentachievement.
168.110.1.Asusedinthissection,thefollowingtermsmean:
2 (1)"Hard-to-staffschools",attendancecenterswherethepercentageof
3certificatedpositionsintheattendancecenterthatwereleftvacantorwerefilledwith
4ateachernotfullyqualifiedintheprioracademicyearexceedsfivepercentasreported
5tothedepartmentofelementaryandsecondaryeducation;
6 (2)"Hard-to-staffsubjectareas",contentareasforwhichpositionswereleft
7vacantorwerefilledwithateachernotfullyqualifiedintheprioracademicyearas
8reportedtothedepartmentofelementaryandsecondaryeducation.
9 2.Theboardofeducationofaschooldistrictmaymodifyanindefinitecontract
10annuallyonorbeforethefifteenthdayofMayinthefollowingparticulars:
11 (1)Determinationofthedateofbeginningandlengthofthenextschoolyear;
12 (2)Fixingtheamountofannualcompensationforthefollowingschoolyearas
13providedbythesalaryscheduleadoptedbytheboardofeducationapplicabletoallteachers.
14 3.Theboardofeducationofaschooldistrictmayincludedifferentiated
15placementofteachersonthesalaryscheduletoincreasecompensationinorderto
16recruitandretainteachersinhard-to-staffsubjectareasorhard-to-staffschools.The
17boardmayannuallyreviewitshard-to-staffsubjectareasandhard-to-staffschools.No
18modificationstotheidentificationofhard-to-staffsubjectareasorhard-to-staffschools,
19orboth,forthepurposeofplacementonthesalaryscheduleshallresultinthedemotion
20ofateacherinthesalaryschedule.
21 4.Anysalaryschedulethatincludesdifferentiatedplacementofteachersonthe
22salaryscheduleundersubsection3ofthissectionforhard-to-staffsubjectareasor
23hard-to-staffschools,orboth,shallbesetpriortoapprovalbysuchboardofeducation.
24 5.Themodificationsshallbeeffectiveatthebeginningofthenextschoolyear.All
25teachersaffectedbythemodificationshallbefurnishedwrittencopiesofthemodifications
26withinthirtydaysaftertheiradoptionbytheboardofeducation.
27 6.Eachschooldistrictthatincludesdifferentiatedplacementofteachersonthe
28districtsalaryscheduleshallannuallyprovidetothedepartmentofelementaryand
29secondaryeducationareportcontainingthefollowinginformation:
30 (1)Thesalaryscheduleadoptedbythedistrict;

32hard-to-staffsubjectareas;
33 (3)Thenumberofpositionsfilledwithdifferentiatedplacementofteachersfor
34hard-to-staffschools;
35 (4)Thenumberofstepsandadditionalcompensationthatteacherswith
36differentiatedplacementreceivedfortheschoolyear;and
37 (5)Anyotherrelevantinformationrequiredbythedepartment.
