Currently,anominationanddeclarationofcandidacyforthe
directororboardmemberofafireprotectiondistrictisrequired
topayafilingfee.Thisbillremovesthefilingfeerequirement.
Thebillprohibitsafireprotectiondistrictfromadoptingany
ordinances,orders,rules,orregulationsrelatedtothe
subdivisionoflandforresidentialpurposesortotheconstruction
orinstallationofimprovementsorinfrastructure orutility
facilitiesrelatedtoservingresidentialconstruction.
Afireprotectiondistrictmayenterintoacontractwithacounty,
city,town,orvillagetoassistintheimplementation ofa
residentialconstructionregulatorysystemasitrelatestofire
protectionissuessolongasthecounty,city,town,orvillage
retainsjurisdictionoftheimplementation andenforcementofthe
system.
Ifacounty,city,town,orvillagehasnotadoptedabuildingcode
orotherresidentialconstructionregulatorysystemandthecounty,
city,town,orvillageisunderthejurisdictionofafire
protectiondistrictwithafirecode,notwithstanding any
provisionsofthefirecodetothecontrary,thefireprotection
districtcanonlyissuepermitsrelateddirectlytofire
protection.
