SectionA.Sections321.130,321.210,and321.228,RSMo,arerepealedandthree
2newsectionsenactedinlieuthereof,tobeknownassections321.130,321.210,and321.228,
3toreadasfollows:
321.130.Aperson,tobequalifiedtoserveasadirector,shallbearesidentandvoter
2ofthedistrictforatleastoneyearbeforetheelectionorappointmentandbeovertheageof
3twenty-fouryears.Intheeventthepersonisnolongeraresidentofthedistrict,theperson's
4officeshallbevacated,andthevacancyshallbefilledasprovidedinsection321.200.
5Nominationsanddeclarationsofcandidacyshallbefiledattheheadquartersofthefire
6protectiondistrictby[payingafilingfeeequaltotheamountofacandidateforcountyoffice
7assetforthundersection115.357,and]filingastatementunderoaththatsuchperson
8possessestherequiredqualifications.Thereafter,suchcandidateshallhavethecandidate's
9nameplacedontheballotasacandidatefordirector.
321.210.OnthefirstTuesdayinAprilaftertheexpirationofatleasttwofullcalendar
2yearsfromthedateoftheelectionofthefirstboardofdirectors,andonthefirstTuesdayin
3Aprileverytwoyearsthereafter,anelectionformembersoftheboardofdirectorsshallbe
4heldinthedistrict.Nominationsshallbefiledattheheadquartersofthefireprotection
5districtinwhichamajorityofthedistrictislocatedby[payingafilingfeeequaltotheamount
6ofacandidateforcountyofficeassetforthundersection115.357and]filingastatement
7underoaththatthecandidatepossessestherequiredqualifications.Thecandidatereceiving

321.228.1.Asusedinthissection,thefollowingtermsshallmean:
2 (1)"Residentialconstruction",newconstructionanderectionofdetachedsingle-
3familyortwo-familydwellingsorthedevelopmentoflandtobeusedfordetachedsingle-
4familyortwo-familydwellings;
5 (2)"Residentialconstructionregulatorysystem",anybylaw,ordinance,order,rule,or
6regulationadopted,implemented,orenforcedbyanycity,town,village,orcountythat
7pertainstoresidentialconstruction,toanypermittingsystem,orprogramrelatingto
8residentialconstruction,includingbutnotlimitedtotheuseoroccupancybytheinitial
9occupantthereof,ortoanysystemorprogramfortheinspectionofresidentialconstruction.
10Residentialconstructionregulatorysystemalsoincludesthewholeoranypartofanationally
11recognizedmodelcode,withorwithoutamendmentsspecifictosuchcity,town,village,or
12county.
13 2.Notwithstandingtheprovisionsofanyotherlawtothecontrary,ifacity,town,
14village,orcountyadoptsorhasadopted,implements,andenforcesaresidentialconstruction
15regulatorysystemapplicabletoresidentialconstructionwithinitsjurisdiction,anyfire
16protectiondistrictswhollyorpartlylocatedwithinsuchcity,town,village,orcountyshallbe
17withoutpower,authority,orprivilegetoenforceorimplementaresidentialconstruction
18regulatorysystempurportingtobeapplicabletoanyresidentialconstructionwithinsuchcity,
19town,village,orcounty.Notwithstandingtheprovisionsofanyotherlawtothecontrary,
20anysuchresidentialconstructionregulatorysystemadoptedbyafireprotectiondistrictorits
21boardshallbetreatedasadvisoryonlyandshallnotbeenforcedbysuchfireprotection
22districtoritsboard.
23 3.Notwithstandingtheprovisionsofanyotherlawtothecontrary,fireprotection
24districts:
25 (1)Shallhavefinalregulatoryauthorityregardingthelocationandspecificationsof
26firehydrants,firehydrantflowrates,andfirelanes,allasitrelatestoresidentialconstruction.
27Nothinginthissubdivisionshallbeconstruedtorequirethepoliticalsubdivisionsupplying
28watertoincuranycoststomodifyitswatersupplyinfrastructure;and
29 (2)Mayinspectthealteration,enlargement,replacementorrepairofadetached
30single-familyortwo-familydwelling;and
31 (3)Shallnotcollectafeefortheservicesdescribedinsubdivisions(1)and(2)ofthis
32subsection.
33 4.Innoeventshallafireprotectiondistrictoritsboardenact,adopt,or
34implementanybylaws,ordinances,orders,rules,orregulationsthatpertain,inany
35manner,toeitherthesubdivisionoflandforthepurposeofresidentialconstructionorto
HCSHB514 2 36theconstruction,installation,anderectionofanyimprovements,infrastructure,and
37utilityfacilitiesrelatedtoorforthepurposeofservingresidentialconstruction.
38 5.Notwithstandinganyprovisioninthissectiontothecontrary,afireprotection
39districtmayenterintoacontractwithacounty,city,town,orvillagetoassistinthe
40implementationoftheresidentialconstructionregulatorysystemofsuchcounty,city,
41town,orvillageasitrelatestofireprotectionissuesaslongasthecounty,city,town,or
42villageretainsjurisdictionovertheimplementationandenforcementofsuchsystem.
43 6.Ifanycity,town,village,orcountyhasnotadoptedabuildingcodeorother
44residentialconstructionregulatorysystemandthecity,town,village,orcountyisunder
45thejurisdictionofafireprotectiondistrictwithafirecode,notwithstandinganyfire
46codeprovisiontothecontrary,thefireprotectiondistrictshallonlyissuepermitsrelated
47directlytofireprotection.
