SectionA.Chapter79,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection79.235,toreadasfollows:
79.235.1.Notwithstandinganylawtothecontraryandforanycityofthefourth
2classificationwithnomorethantwothousandinhabitants,ifastatuteorordinance
3authorizesthemayorofacityofthefourthclassificationtoappointamemberofa
4boardorcommission,anyrequirementthattheappointedpersonbearesidentofthe
5cityshallbedeemedsatisfiedifthepersonownsrealpropertyorabusinessinthecity,
6regardlessofwhetherthepositiontowhichtheappointmentismadeisconsideredan
7officerofthecityundersection79.250.
8 2.Notwithstandinganylawtothecontraryandforanycityofthefourth
9classificationwithnomorethantwothousandinhabitants,ifastatuteorordinance
10authorizesamayortoappointamemberofaboardthatmanagesamunicipalutilityof
11thecity,anyrequirementthattheappointedpersonbearesidentofthecityshallbe
12deemedsatisfiedifallofthefollowingconditionsaremet:
13 (1)Theboardhasnoauthoritytosetutilityratesortoissuebonds;
14 (2)Thepersonresideswithinfivemilesofthecitylimits;
15 (3)Thepersonownsrealpropertyorabusinessinthecity;
16 (4)Thepersonortheperson'sbusinessisacustomerofapublicutility,as
17describedundersection91.450,managedbytheboard;and
