4thereon,interest,penaltyandcostsprovidedbylaw,thensuchcountycollectorshallatthe 5nextregulartaxsaleoflandsfordelinquenttaxessellsametothehighestbidder,exceptthe 31 (3)Nopublicofficershallbeeligibletoserveasaboardmember.Forpurposes 32ofthissubdivision,"publicofficer"meansapersonwhoisholdinganelectedpublic 33office.Anypublicemployeeshallbeeligibletoserveasaboardmember; 34 (4)Themembersoftheboardshallselectannuallyfromamongthemselvesa 35chair,avicechair,atreasurer,andsuchotherofficersastheboardmaydetermineand 36shallestablishtheirduties,asmayberegulatedbyrulesadoptedbytheboard; Notwithstandinganyotherlawtothecontrary,anypolitical 26subdivisionmaytransfertothelandbankagencyrealpropertyandinterestsinrealproperty 27ofthepoliticalsubdivisiononsuchtermsandconditionsandaccordingtosuchproceduresas 28determinedbythepoliticalsubdivision. 29 4.Alandbankagencyshallmaintainallofitsrealpropertyinaccordancewiththe 30lawsandordinancesofthejurisdictionsinwhichtherealpropertyislocated. 31 5.Uponissuanceofadeedtoaparcelof[adelinquentlandtaxauction] realestate 32toalandbankagencyundersubsection4ofsection140.250,subsection5ofsection 33140.405,[or]othersaleconductedundersection140.190,140.240,or140.250[ofaparcelof 34realestatetoalandbankagency], orsection141.550,thelandbankagencyshallpayonly 35theamountofthelandbankagency'sbidthatexceedstheamountofalltaxbillsincludedin 36thejudgment,interest,penalties,attorney'sfees,taxes,andcoststhenduethereon.Ifthereal 37estateisacquiredinadelinquentlandtaxauctionundersubsection4ofsection140.250, 38subsection5ofsection140.405,orothersaleconductedundersection140.190,140.240, 39or140.250, suchexcessshallbeappliedanddistributedinaccordancewithsection140.230. 40Iftherealestateisacquiredinadelinquentlandtaxauctionundersection141.550,such 41excessshallbeappliedanddistributedinaccordancewithsubsections3and4ofsection 42141.580,exclusiveofsubdivision(3)ofsubsection3ofsection141.580.Uponissuanceof 43adeed,thecountycollectorshallmarkthetaxbillsincludedinthejudgmentas"cancelledby 44saletothelandbank"andshalltakecreditforthefullamountofsuchtaxbills,including 45principalamount,interest,penalties,attorney'sfees,andcosts,on[hisorher]thecounty 46collector'sbooksandin[hisorher]thecountycollector'sstatementswithanyothertaxing 47authorities. 48 6.Alandbankshallnotownrealpropertyunlessthepropertyiswhollylocated 49withintheboundariesofthe[city] countyormunicipalitythatestablishedthelandbank 50agency. 51 7.Withinoneyearoftheeffectivedateoftheordinance,resolution,orrule 52passedestablishingamunicipallandbankagencyundersubsection2ofsection140.981, HCSHB587 11 53thetitletoanyrealpropertythatislocatedwhollywithinthemunicipalitythatcreated 54thelandbankagencyandthatisheldbyalandtrustcreatedundersubsection1of 55section141.821shallbetransferredbydeedfromthelandtrusttosuchlandbank 56agency,atthelandbankagency'srequest. 140.985.1.Alandbankagencyshallholdinitsownnameallrealpropertyacquired 2bysuchlandbankagencyirrespectiveoftheidentityofthetransferorofsuchproperty. 3 2.Alandbankagencyshallmaintainandmakeavailableforpublicreviewand 4inspectionaninventoryandhistoryofallrealpropertythelandbankagencyholdsor 5formerlyheld.Thisinventoryandhistoryshallbeavailableonthelandbankagency's 6websiteandincludeataminimum: 7 (1)Whetheraparcelisavailableforsale; 8 (2)Theaddressoftheparcelifanaddresshasbeenassigned; 9 (3)Theparcelnumberifnoaddresshasbeenassigned; 10 (4)Theyearthataparcelenteredthelandbankagency'sinventory; 11 (5)Whetheraparcelhassold;[and] 12 (6)Ifaparcelhassold,thenameofthepersonorentitytowhichitwassold;and 13 (7)Whethertheparcelwasacquiredbythelandbankagencythroughjudicial 14foreclosure,nonjudicialforeclosure,donation,orsomeothermanner. 15 3.Thelandbankagencyshalldetermineandsetforthinpoliciesandproceduresthe 16generaltermsandconditionsforconsiderationtobereceivedbythelandbankagencyforthe 17transferofrealpropertyandinterestsinrealproperty.Considerationmaytaketheformof 18monetarypaymentsandsecuredfinancialobligations,covenants,andconditionsrelatedtothe 19presentandfutureuseoftheproperty;contractualcommitmentsofthetransferee;andsuch 20otherformsofconsiderationasthelandbankagencydeterminestobeinthebestinterestof 21[itspurpose] thelandbankagency. 22 4.Alandbankagencymayconvey,exchange,sell,transfer,lease,grant,releaseand 23demise,pledge,andhypothecateanyandallinterestsin,upon,ortopropertyofthelandbank 24agency.Alandbankagencymaygiftanyinterestin,upon,ortopropertytothe[city]county 25ormunicipalitythatestablishedthelandbankagency. 26 5.A[city] countyormunicipalitymay,initsresolution[or],ordinance, orrule 27creatingalandbankagency,establishahierarchicalrankingofprioritiesfortheuseofreal 28propertyconveyedbysuchlandbankagency,[subjecttosubsection7ofthissection,] 29including,butnotlimitedto: 30 (1)Useforpurelypublicspacesandplaces; 31 (2)Useforaffordablehousing; 32 (3)Useforretail,commercial,andindustrialactivities; 33 (4)Useaswildlifeconservationareas;and HCSHB587 12 34 (5)Suchotherusesandinsuchhierarchicalorderasdeterminedbysuch[city] 35countyormunicipality. 36 37Ifa[city]countyormunicipality, initsresolution[or],ordinance, orrulecreatingaland 38bankagency,establishesprioritiesfortheuseofrealpropertyconveyedbythelandbank 39agency,suchprioritiesshallbeconsistentwithandnomorerestrictivethanmunicipal 40planningandzoningordinances. 41 6.Thelandbankagencymaydelegatetoofficersandemployeestheauthorityto 42enterintoandexecuteagreements,instrumentsofconveyance,andallotherrelated 43documentspertainingtotheconveyanceofpropertybythelandbankagency. 44 7.[Alandbankagencyshallonlyacceptwrittenoffersequaltoorgreaterthanthe 45fullamountofalltaxbills,interest,penalties,attorney'sfees,andcostsonrealpropertyto 46purchasetherealpropertyheldbythelandbankagency. 47 8.]Whenanyparcelofrealestateacquiredbyalandbankagencyissoldorotherwise 48disposedofbysuchlandbankagency,theproceedstherefromshallbeappliedanddistributed 49inthefollowingorder: 50 (1)Tothepaymentoftheexpensesofthesale; 51 (2)Tofulfilltherequirementsoftheresolution,indenture,orotherfinancing 52documentsadoptedorenteredintoinconnectionwithbonds,notes,orotherobligationsofthe 53landbankagency,totheextentthatsuchrequirementsmayapplywithrespecttosuchparcel 54ofrealestate; 55 (3)To[thebalancetoberetainedby]thelandbankagencytopaythesalariesand 56otherexpensesofsuchlandbankagencyandofitsemployeesasprovidedforinitsannual 57budget;and 58 (4)Anyfundsinexcessofthosenecessarytomeettheexpensesoftheannualbudget 59ofthelandbankagencyinanyfiscalyearandareasonablesumtocarryoverintothenext 60fiscalyeartoassurethatsufficientfundswillbeavailabletomeetinitialexpensesforthat 61nextfiscalyear[, 69agency,theproceedstherefromshallbeappliedanddistributedinthefollowingorder: 70 (1)Tothepaymentofalllandtaxesandrelatedchargesthendueonsuchparcel; HCSHB587 13 71 (2)Tothepaymentoftheexpensesofsale; 82nextfiscalyear,shallbepaidinaccordancewithsubdivision(4)ofsubsection8ofthis 83section. 84 10.Ifalandbankagencyownsmorethanfiveparcelsofrealpropertyinasinglecity 85blockandnowrittenoffertopurchaseanyofthosepropertieshasbeensubmittedtothe 86agencyinthepasttwelvemonths,thelandbankagencyshallreduceitsrequestedpricefor 87thosepropertiesandadvertisethediscountpublicly.] 140.986.1.Nolaterthan[two]fiveyearsfromthedateitacquiredtheproperty,a 2landbankagencyshalleithersell,puttoaproductiveuse,orshowsignificantprogress 3towardssellingorputtingtoaproductiveuseaparcelofrealproperty.Aproductiveusemay 4berentingtheproperty;demolishingallstructuresoftheproperty;restoringpropertyof 5historicvalue;orusingthepropertyforacommunitygarden,park,orotheropenpublic 6space. 7 2.Thegoverningbodyofthe[city]countyormunicipalitymaygrantthelandbank 8agencyaone-yearextensionifthebodydeterminesbyamajorityvotethatunforeseen 9circumstanceshavedelayedthesaleorproductiveuseofaparcelofproperty. 10 3.Ifalandbankagencyownsaparcelofrealpropertythatdoesnothaveaproductive 11useafter[two]fiveyears,ordoesnotreceiveanextensionundersubsection2ofthissection, 12thepropertyshallbeofferedforpublicsaleusingtheproceduresundersections140.170to 13140.190. 140.987.1.Alandbankagencyshall[ensurethatanycontractforthesaleof 2residentialpropertyownedbythelandbankagencyshallhaveaclausethatthebuyershall 3ownthepropertyforthreeyearsfollowingthebuyer'spurchaseofthepropertyfromtheland 4bank.Theclauseshallstatethataviolationofthosetermsmakesthebuyercivillyliableto 5thelandbankagencyforanamountequaltotwicethesalepriceoftheproperty] have 6discretiontorequirethatanybuyerdemonstratethatthebuyerisnottheownerofany 7parcelofrealestatewithinthecountyormunicipalitythatcreatedthelandbankagency HCSHB587 14 8forwhichataxbillhasbeendelinquentformorethanoneyearorisinviolationofany 9municipalbuildingorhousingcode. 10 2.Noforeignordomesticcorporationorlimitedliabilitycompanythathasfailed 11toappointormaintainaregisteredagentunderchapter347or351shallbeeligibleto 12buypropertyfromthelandbankagency.Noforeigncorporateentityshallbeeligibleto 13buypropertyfromthelandbankagencyunlessithasacertificateofauthorityto 14transactbusinessinMissouriundersection351.572. 15 3.Asaconditionofthesaleorotherauthorizedconveyanceofownershipofany 16parceloflandownedbythelandbankagencytoaprivateowner,suchownermaybe 17requiredtoenterintoacontract,whichmaybesecuredbyadeedoftrustinfavorofthe 18landbankagency,stipulatingthatsuchownerortheowner'ssuccessoragreethatsuch 19ownerortheowner'ssuccessormakecertainimprovementstotheparcel.Iftheland 20bankagencyfindsbyresolutionthatthetermsofthecontracthavenotbeensatisfied, 21thelandbankagencyshallbeauthorizedtobringsuittorecoverdamagesforthebreach 22andtoseekajudicialforeclosureoftheparcelundersections443.190to443.260,except 23thatuponfinaljudgmentofthecourt,titleshallreverttothelandbankagencywithout 24necessityofsale.Asanalternativeto,orinadditionto,seekingajudicialforeclosure, 25thelandbankagencymay,onlybygift,assignorconveyitsrighttoforecloseunder 26sections443.190to443.260toany501(c)(3)tax-exemptnonprofitorganizationor 27exercisetherightofreentryunderchapter524,527,or534.Thelandbankagencyorits 28assigneeshallassumetitletothelandbyfilingacopyofthejudgmentwiththerecorder 29ofdeedsinthecountywherethepropertyislocated.Anypropertyredeemedbythe 30landbankagencyundertheprovisionsofthissectionshallbeadministeredinthesame 31mannerasotherpropertysoldtothelandbankagency. 140.988.1.Alandbankagencymayreceivefundingthroughgrants,gifts,andloans 2frompoliticalsubdivisions,thestate,thefederalgovernment,andotherpublicandprivate 3sources. 4 2.Exceptasotherwiseprovidedin[subsections8and9]subsection7ofsection 5140.985,alandbankagencymayreceiveandretainpaymentsforservicesrendered,forrents 6andleaseholdpaymentsreceived,forconsiderationfordispositionofrealandpersonal 7property,forproceedsofinsurancecoverageforlossesincurred,forincomefrom 8investments,andforanyotherassetandactivitylawfullypermittedtoalandbankagency 9underthechapter140landbankact. 10 3.Ifalandbankagencysellsorotherwisedisposesofaparcelofrealestateheldby 11it,anylandtaxesassessedagainstsuchparcelforthethreetaxyearsfollowingsuchsaleor 12dispositionbysuchlandbankagencythatarecollectedbythecountycollectorinacalendar 13yearandnotrefunded,lessthefeesprovidedundersection52.260andsubsection4ofthis HCSHB587 15 14sectionandlesstheamountstobedeductedundersection137.720,shallbedistributedbythe 15countycollectortosuchlandbankagencynolaterthanMarchfirstofthefollowingcalendar 16year,providedthatlandtaxesimpoundedundersection139.031orotherwisepaidunder 17protestshallnotbesubjecttodistributionunderthissubsection.Anyamountrequiredtobe 18distributedtoalandbankagencyunderthissubsectionshallbesubjecttooffsetforamounts 19previouslydistributedtosuchlandbankagencythatwereassessed,collected,ordistributedin 20error. 21 4.Inadditiontoanyotherprovisionsoflawrelatedtocollectionfees,thecounty 22collectorshallcollectonbehalfofthecountyafeeoffourpercentofreserveperiodtaxes 23collectedandsuchfeescollectedshallbedepositedinthecountygeneralfund. 24 5.Ifacountyhasestablishedalandbankagencyundersubsection1ofsection 25140.981,thecollectormaycollectonbehalfofthecountyafeeforthecollectionof 26delinquentandbacktaxesofuptofivepercentonallsumscollectedtobeaddedtothe 27faceofthetaxbillandcollectedfromthepartypayingthetax.Allfeescollectedunder 28theprovisionsofthissubsectionshallbepaidtothelandbankagencyestablishedunder 29subsection1ofsection140.981. 140.991.1.Thereshallbeanannualauditoftheaffairs,accounts,expenses,and 2financialtransactionsofalandbankagencybyacertifiedpublicaccountantbeforeApril 3thirtiethofeachyear,whichaccountantshallbeemployedbythelandbankagencyonor 4beforeMarchfirstofeachyear.Certifiedcopiesoftheauditshallbefurnishedtothe[city] 5countyormunicipalitythatestablishedthelandbankagency,andthe[city] countyor 6municipalityshallposttheauditonitspublicwebsite.Copiesoftheauditshallalsobe 7availableforpublicinspectionattheofficeofthelandbankagency. 8 2.Thelandbankagencymaybeperformanceauditedatanytimebythestateauditor 9orbytheauditorofthe[city]countyormunicipalitythatestablishedthelandbankagency. 10The[cost] landbankagencyshallmakecopiesofsuchaudit[shallbepaidbythelandbank 11agency,andcopiesshallbemade] availabletothepublicand[posted] shallpostacopyof 12theauditonthelandbankagency'swebsitewithinthirtydaysofthecompletionoftheaudit. 140.994.1.Alandbankagencyshallhavepowertoissuebonds,withapproval 2ofthecountyormunicipalitythatcreatedthelandbankagency,foranyofitscorporate 3purposes.Thebondsshallbespecial,limitedobligationsofthelandbankagency,the 4principalofandinterestonwhichshallbepayablesolelyfromtheincomeandrevenue 5derivedfromthesale,lease,orotherdispositionoftheassetsofthelandbankagency,or 6suchportionthereofasmaybedesignatedintheresolution,indenture,orother 7financingdocumentsrelatingtotheissuanceofthebonds.Inthediscretionoftheland 8bankagency,anyofsuchbondsmaybesecuredbyapledgeofadditionalrevenues, 9includinggrants,contributions,orguaranteesfromthestate,thefederalgovernment,or HCSHB587 16 10anyagencyorinstrumentalitythereof,orbyamortgageorothersecuritydevice 11coveringallorpartofthepropertyfromwhichtherevenuessopledgedmaybederived. 12 2.Bondsissuedbyalandbankagencyshallnotbedeemedtobeanindebtedness 13withinthemeaningofanyconstitutionalorstatutorylimitationupontheincurringof 14indebtedness.Thebondsshallnotconstituteadebt,liability,orobligationofthestateor 15ofanypoliticalsubdivisionthereof,exceptinaccordancewithsubsection4ofthis 23redemptionatsuchtimesandonsuchterms,andshallbeexecutedbyoneormore 24membersoftheboard,asprovidedintheresolutionauthorizingtheissuancethereofor 25assetoutintheindentureorotherfinancingdocumentauthorizedandapprovedby 26suchresolution.Theboardmaysellsuchbondsinsuchmanner,eitheratpublicorat 27privatesale,andforsuchpriceastheboardmaydeterminetobeinthebestinterestsof 28thelandbankagency. 29 4.Anypoliticalsubdivisionmayelecttoguarantee,insure,orotherwisebecome 30primarilyorsecondarilyobligatedwithrespecttothebondsissuedbyalandbank 31agency,subject,however,totheprovisionsofMissourilawapplicabletotheincurrence 32ofindebtednessbysuchpoliticalsubdivision.Nopoliticalsubdivisionshallhaveany 33suchobligationifthepoliticalsubdivisiondoesnotsoelect. 34 5.Alandbankagencymayfromtimetotime,asauthorizedbyresolutionofthe 35board,issuerefundingbondsforthepurposeofrefunding,extending,andunifyingall 36oranypartofitsvalidoutstandingbonds.Suchrefundingbondsmaybepayablefrom 37anyofthesourcesidentifiedinsubsections1and4ofthissectionandfromthe 38investmentofanyoftheproceedsoftherefundingbonds. 39 6.Thebondsissuedbyalandbankagencyshallbenegotiableinstrumentsunder 40chapter400. 41 7.Bondsissuedunderthissectionandallincomeorinterestthereonshallbe 42exemptfromallstatetaxes,exceptestateandtransfertaxes. 43 8.Alandbankagencyshallhavethepowertoissuetemporarynotesuponthe 44sametermsandsubjecttoallprovisionsandrestrictionsapplicabletobondsunderthis 45section.Suchnotesissuedbyalandbankagencymayberefundedbynotesorbonds 46authorizedunderthissection. HCSHB587 17 140.1000.1.Noboardmemberoremployeeofalandbankagencyshallreceive 2anycompensation,emolument,orotherprofitdirectlyorindirectlyfromtherental, 3management,acquisition,sale,demolition,repair,rehabilitation,use,operation,ownership,or 4dispositionofanylandsheldbysuchlandbankagencyotherthanthesalaries,expenses,and 5emolumentsprovidedforinthechapter140landbankact. 6 2.Nomemberoftheboardoremployeeofalandbankagencyshallown,directly 7orindirectly,anylegalorequitableinterestinortoanylandsheldbysuchlandbankagency 8otherthanthesalaries,expenses,andemolumentsprovidedforinsections140.980to 9140.1015. 10 3.AviolationofthissectionisaclassDfelony. 11 4.Thelandbankagencymayadoptsupplementalrulesandregulationsaddressing 12potentialconflictsofinterestandethicalguidelinesforboardmembersandlandbank 13agencyemployees,providedthatsuchrulesandregulationsarenotinconsistentwiththis 14chapteroranyotherapplicablelaw. 15 5.Anypersonwhoisrelatedtoaboardmemberoremployeeofalandbank 16agencywithintheseconddegreeofconsanguinityoraffinityshallbeconsideredaboard 17memberoremployeeofalandbankagencyforpurposesofthissectionandsubjecttoits 18provisions. 140.1009.1.Alandbankagencyshallbeauthorizedtofileanactiontoquiettitle 2undersection527.150astoanyrealpropertyinwhichthelandbankagencyhasaninterest. 3Forpurposesofanyandallsuchactions,thelandbankagencyshallbedeemedtobethe 4holderofsufficientlegalandequitableinterests,andpossessoryrights,soastoqualifythe 5landbankagencyasanadequatepetitionerinsuchaction. 6 2.Priortothefilingofanactiontoquiettitle,thelandbankagencyshallconductan 7examinationoftitletodeterminetheidentityofanyandallpersonsandentitiespossessinga 8claimorinterestinortotherealproperty.Serviceofthepetitiontoquiettitleshallbe 9providedtoallsuchinterestedpartiesbythefollowingmethods: 10 (1)Registeredorcertifiedmailtosuchidentityandaddressasreasonably 11ascertainablebyaninspectionofpublicrecords; 12 (2)Inthecaseofoccupiedrealproperty,byfirstclassmailaddressedto"Occupant"; 13 (3)Bypostingacopyofthenoticeontherealproperty; 14 (4)Bypublicationinanewspaperofgeneralcirculationinthe[city] countyor 15municipalityinwhichthepropertyislocated;and 16 (5)Suchothermethodsasthecourtmayorderorasmayberequiredbyprevailing 17notionsofdueprocess. 49provided,however,thattaxbillsimposedagainstrealestate,locatedinthatpartofsuch[city] 50municipalityoutsideofthelimitsofanysuch[classone]county,shallbecollectedunder[the 51provisionsofthecharterofanysuchcity,orundersuch]otherprovisionsasmaybeprovided 52bylaw. 141.250.1.Therespectiveliensofthetaxbillsforgeneraltaxesofthestateof 2Missouri,thecounty,anymunicipalityandanyschooldistrict,forthesametaxyear,shallbe 3equalandfirstliensupontherealestatedescribedintherespectivetaxbillsthereof;provided, 4however,thattheliensofsuchtaxbillsforthelatestyearforwhichtaxbillsareunpaidshall 5takepriorityovertheliensoftaxbillsleviedandassessedforlessrecentyears,andthelienof 6suchtaxbillsshallrateinpriorityintheorderoftheyearsforwhich[they] thetaxbillsare 7delinquent,thelienofthetaxbilllongestdelinquentbeingjuniorinprioritytothelienofthe 8taxbillforthenextmostrecenttaxyear. 9 2.Alltaxbillsforotherthangeneraltaxesshallconstituteliensjuniortotheliensfor 10generaltaxesupontherealestatedescribedtherein;provided,however,thatataxbillfor 11otherthangeneraltaxes,ofthemorerecentissueshalllikewisebeseniortoanysuchtaxbill 12oflessrecentdate. 13 3.Theproceedsderivedfromthesaleofanylandsencumberedwithataxlienorliens 14[,orheldbythelandtrustees,oracquiredbyalandbankagencypursuanttoadeemedsale 15undersubsection3ofsection141.560,bydeedfromalandtrustundersubsection1ofsection 16141.984,orpursuanttoasaleundersubdivision(2)ofsubsection2ofsection141.550] shall 17bedistributedtotheownersofsuchliensintheorderoftheseniorityoftheliens[, ortheir 18respectiveinterestsasshownbytherecordsofthelandtrustorthelandbankagency]. Those 19holdingliensofequalrankshallshareindirectproportiontotheamountsoftheirrespective 20liens. 141.270.1.OnorbeforethefifthdayofJanuaryineachyear,alltaxingauthorities 2andanyothertaxbillownershall[, andanyothertaxbillownermay,]filewiththecollector HCSHB587 23 3[eightcopiesof]alistonaformapprovedbythecollector,ofallparcelsofrealestateaffected 4bytaxliensheldandownedbysuchtaxingauthorityorpersonwhichhavebeendelinquent 5fortwoyearsormore.Suchlistshallalsoincludealldelinquenttaxbillsforanyandall 6years. 7 2.Thetaxingauthorityorpersonfilingsuchlistshallpaytothecollectorafilingfee 8ofonedollarandfiftycentsforeachparcelofrealestatedescribedtherein,whichfeeshallbe 9chargedagainsteachparcelandcollectedandaccountedforbythecollectorasothercosts. 10 3.Noschooldistrictnoranyothertaxingauthoritywhosetaxesarerequiredbylawto 11becollectedbythecollectorshallfileanylistnorpaythefilingfeehereinprovided. 12 4.Ifthetaxesofanytaxingauthorityaretwoormoreyearsdelinquent,theother 13taxingauthorities[shall,] andothertaxbillowners[may,]shallincludeinthesaidlistalltax 14liensagainstthesaidparcel,eventhough[they] thetaxesarenottwoyearsdelinquent. 141.290.1.Thecollectorshallcompilelistsofallstate,county,school,andothertax 2billscollectibleby[himwhich] thecollectorthataredelinquentaccordingto[his]the 3collector'srecords, and[he]thecollectorshallcombinesuchlistswiththelistfiledbyany 4taxingauthorityortaxbillowner. 5 2.Forpartialopt-incounties,thecollectorshalldecidewhichtax-delinquent 6parcelsshallproceedaccordingtotheprovisionscontainedherein.Theremaining 7parcelsshallproceedundersuchotherprovisionsasmaybeprovidedbylaw. 8 3.Thecollectorshallassignaserialnumbertoeachparcelofrealestateineachlist 9andifsuithasbeenfiledinthecircuitcourtofthecountyonanydelinquenttaxbillincluded 10inanylist,thecollectorshallgivethecourtdocketnumberofsuchsuitandsomeappropriate 11designationoftheplacewheresuchsuitispending,andsuchpendingsuitsolistedinany 12petitionfiledpursuanttotheprovisionsofsections141.210to141.810andsections141.980 13to141.1015shall,withoutfurtherprocedureorcourtorder,bedeemedtobeconsolidated 14withthesuitbroughtundersections141.210to141.810andsections141.980to141.1015, 15andsuchpendingsuitshallthereuponbeabated. 16 [3.]4.Thecollectorshalldeliversuchcombinedliststothedelinquentlandtax 17attorneyfromtimetotimebutnotlaterthanApril[the]firstofeachyear. 18 [4.]5.Thedelinquentlandtaxattorneyshallincorporatesuchlistsinpetitionsinthe 19formprescribedinsection141.410,andshallfilesuchpetitionswiththecircuitclerknotlater 20thanJunefirstofeachyear. 141.300.1.Thecollectorshallreceiptfortheaggregateamountofsuchdelinquent 2taxbillsappearingonthelistorlistsfiledwith[him] thecollectorundertheprovisionsof 3section141.290,whichreceiptshallbeheldbytheownerorholderofthetaxbillsorbythe 4treasurerorothercorrespondingfinancialofficerofthetaxingauthoritysofilingsuchlist 5withthecollector. HCSHB587 25 24 5.Thecompensationhereinprovidedshallbethetotalcompensationforadelinquent 25landtaxattorneywhoisnotalsoacountycounselor,[his]andtheattorney'sassistantsand 26employees[, andwhenthecompensationreceivedbyhimorowingtohimbythecollector 27exceedstenthousanddollarsinanyonecalendaryearbyvirtueofthesumschargedand 28collectedpursuanttotheprovisionsofsection141.150,thesurplusshallbecreditedand 29appliedbythecollectortotheexpenseofthedelinquentlandtaxattorneyandtothe 21provided,however,thatsuchtitleshallalsobesubjecttotheliensofanytaxbills[whichmay 22haveattachedtosuchparcelofrealestatepriortothetimeofthefilingofthepetition 23affectingsuchparcelofrealestatenotthendelinquent,or]whichmayhaveattachedafterthe 24[filingofthepetitionandpriorto]sheriff'ssale[andnotincludedinanyanswertosuch 25petition], butifsuchparcelofrealestateisdeemedsoldtothelandtrustpursuantto 26subsection2ofsection141.560,ordeemedsoldtoalandbankagencypursuanttosubsection 273ofsection141.560,orsoldtoalandbankagencypursuanttosubdivision(2)ofsubsection2 28ofsection141.550,thetitletheretoshallbefreeofanysuchlienstotheextentoftheinterest 29ofanytaxingauthorityinsuchrealestate;providedfurther,that[suchtitleshallnotbesubject 30tothelienofspecialtaxbillswhichhaveattachedtotheparcelofrealestatepriorto 31November22,1943,but]thelienof[such] specialtaxbillsshallattachtotheproceedsofthe 32sheriff'ssale,ifany,or[totheproceedsoftheultimatesaleofsuchparcelbythelandtrustor 33landbankagency] shallotherwisebeforeverbarredandforeclosed. 141.580.1.Withinsixmonthsafterthesheriffsellsanyparcelofrealestate,the 2courtshall,uponitsownmotionoruponmotionofanyinterestedparty,setthecausedown 3forhearingtoconfirmorsetasidetheforeclosuresalethereof,eventhoughsuchparcelsare 4notalloftheparcelsofrealestatedescribedinthenoticeofsheriff'sforeclosuresale.Notice 5ofthehearing,orofthecourtmovingtoconfirmtheforeclosuresale,shallbesentby 6anyinterestedpartytoeachpersonwhowassentnoticeofthesaleandtoanyinterested 7partiesasrequiredbyprevailingnotionsofdueprocess.Atthetimeofsuchhearing,the HCSHB587 39 8sheriffshallmakereportofthesale,andthecourtshallhearevidenceofthevalueofthe 9propertyofferedonbehalfofanyinterestedpartytothesuit,andshallforthwithdetermine 10whetheranadequateconsiderationhasbeenpaidforeachsuchparcel.Thecourt's 11judgmentshallincludeaspecificfindingthatadequatenoticewasprovidedtoall 12interestedpartiesunderprevailingnotionsofdueprocessandsections141.210to 13141.810andsections141.980to141.1015,recitingthenoticeeffortsofthecollector, 14sheriff,andtaxsalepurchaser.Nothinginthissectionshallbeinterpretedtoprecludea 15successfultaxsalepurchaserfromassertingaclaimtoquiettitletothebid-uponparcel 16undersection527.150. 17 2.Forthispurposethecourtshallhavepowertosummonanycityorcountyofficial 18oranyprivatepersontotestifyastothereasonablevalueoftheproperty,andifthecourtfinds 19thatadequateconsiderationhasbeenpaid,thecourtshallconfirmthesaleandorderthe 20sherifftoissueadeedtothepurchaser.Ifthecourtfindsthattheconsiderationpaidis 21inadequate,thecourtshallconfirmthesaleifthepurchaserincreases[his]thepurchaser's 22bidtosuchamountasthecourtdeemstobeadequateandmakessuchadditionalpayment,or 23ifalltaxbillsincludedinthejudgment,interest,penalties,attorney'sfeesandcoststhendue 24thereonarenotpaidinfullbyoneormoreinterestedpartiestothesuit.Ifthecourtfindsthat 25theconsiderationisinadequate,butthepurchaserdeclinestoincrease[his]thepurchaser's 26bidtosuchamountasthecourtdeemsadequateandmakesuchadditionalpayment,thenthe 27saleshallbedisapprovedifalltaxbillsincludedinthejudgment,interest,penalties,attorney's 28feesandcoststhenduethereonarepaidinfullbyoneormoreinterestedpartiestothesuit, 29thelienofthejudgmentcontinued,andsuchparcelofrealestateshallbeagainadvertisedand 30offeredforsalebythesherifftothehighestbidderatpublicauctionforcashatany 31subsequentsheriff'sforeclosuresale.Unlessthecourtrequiresevidenceofthevalueofthe 32propertyconveyedtolandtrustoralandbankagency,noneshallberequired,andtheamount 33bidbytheland[trustees] trustorsuchlandbankagencyshallbedeemedadequate 34consideration. 35 3.[Exceptasotherwiseprovidedinsubsection6ofsection141.984,] Ifthesaleis 36confirmed,thecourtshallordertheproceedsofthesaleappliedinthefollowingorder: 37 (1)Tothepaymentofthecostsofthepublicationofthenoticeofforeclosureandof 38thesheriff'sforeclosuresale; 39 (2)Tothepaymentofallofthecollector'sandsheriff'scostsincludingappraiser's 40feeandattorney'sfees; 41 (3)Tothepaymentofalltaxbillsadjudgedtobedueintheorderoftheirpriority, 42includingprincipal,interestandpenaltiesthereon, exceptintheeventofasaletoanyland 43bankagency,forwhichthissubdivisionshallnotapply. 44 HCSHB587 40 45If,aftersuchpayment,thereisanysumremainingoftheproceedsofthesheriff'sforeclosure 46sale,thecourtshallthereupontryanddeterminetheotherissuesinthesuitinaccordancewith 47section141.480.Ifanyansweringpartieshavespeciallyappealedasprovidedinsection 48141.570,thecourtshallretainthecustodyofsuchfundspendingdispositionofsuchappeal, 49andupondispositionofsuchappealshallmakesuchdistribution.Iftherearenotsufficient 50proceedsofthesaletopayallclaimsinanyclassdescribed,thecourtshallorderthesameto 51bepaidproratainaccordancewiththepriorities. 52 4.Ifthereareanyfundsremainingoftheproceedsafterthesheriff'ssaleandafterthe 53distributionofsuchfundsashereinsetoutandnopersonentitledtoanysuchfunds,whether 54ornotapartytothesuit,shall,withintwoyearsaftersuchsale,appearandclaimthefunds, 55[they] thefundsshallbedistributedtotheappropriatetaxingauthorities, exceptinpartial 56opt-incounties,wherethefundsshallbedistributedtotheschoolfundforthecounty. 57 5.Anycountyoperatingundertheprovisionsofsections141.210to141.810and 58sections141.980to141.1015mayelecttoallocateaportionofitsshareoftheproceeds 59towardafundforthepurposeofdefendingagainstclaimschallengingthesufficiencyof 60noticeprovisionsunderthissection. 61 6.Anyinterestedparty,otherthanthesheriff'ssalepurchaser,whomovesthe 62courttosetasideasheriff'ssaleaftertheissuanceofasheriff'sdeedmadeunderthe 63provisionsofsections141.210to141.810andsections141.980to141.1015shallbe 64requiredtopayintothecourttheredemptionamountotherwisenecessaryunder 65sections141.420and141.530priortothecourthearinganysuchmotiontosetaside. 141.610.Eachcourtadministrator'sorsheriff'sdeedgivenpursuanttotheprovisions 2ofthelandtaxcollectionlawshallbe[presumptive] primafacieevidencethatthesuitandall 3proceedingsthereinandallproceedingspriortheretofromandincludingassessmentofthe 4landsaffectedtherebyandallnoticesrequiredbylawwereregularandinaccordancewithall 5provisionsofthelawrelatingthereto.Thecourtadministratororsheriffshallrecorditsdeed 6andshallcollectsaidrecordingfeeatthetimeofsale.[Afteroneyearfromthedateofthe 7courtadministrator'sforeclosuresale,thepresumptionshallbeconclusivepursuantto 8sections141.210to141.810.Notwithstandingsection516.010,nosuittosetasideorto 9attackthevalidityofanysuchcourtadministrator'sorsheriff'sdeedshallbecommencedor 10maintainedunlessthesuitisfiledwithinoneyearfromthedateofthecourtadministrator's 11foreclosuresale.] 141.620.1.Inadditiontoallamountsdueonanytaxbill,includingprincipal, 2interest,penalties,attorney'sfeesandcosts,asnowfixedbylaw,thereshallbeimposedand 3chargedasapartofthecostsoneachsuchtaxbillasuitpenaltyoffivepercentofthe 4principalamountofthetaxbilltobeduetothecollectoruponthefilingofthepetitionwith 5thecircuitclerk. HCSHB587 41 6 2.Thecollectorshallsetupaseparatefundin[his]thecollector'saccountstowhich 7[he]thecollectorshallcreditsuchfivepercentsuitpenaltieswhenpaid,togetherwithall 8otherpenaltiesandcostsrecoveredunderthisaction,andshallretainsuchportionthereofas 9maybeneededforthepurposeofpayingtheexpensesandcostsrequiredtobeadvanced 10undersections141.210to141.810,includingcompensationtothedelinquentlandtax 11attorney,[his]theattorney'sassistants,andstenographicandclericalhelp,andfundsforthe 12costsofpublication,notices,forcourtcosts,sheriff'sexpensesandothercostshereunder,and 13shalltransfertheremainderofsuchfundsannually,onJanuaryfirstofeachyear,totheland 14[trustees] trustfortheuseandexpensesofthelandtrust.Wherenolandtrustexists,the 15collectorshallretaintheremainderofsuchfunds. 141.680.1.Exceptforpartialopt-incounties,theremediesandproceduresset 2forthinsections141.210to141.810shallbetheexclusiveremediesandproceduresavailable 3forthecollectionofdelinquentandbacklandtaxesinacountyelectingtocomeunderor 4whichhascomeundertheirauthority.Sections141.210to141.810shallnotbeaffectednor 5infringeduponbyanyotherlawsorpartsoflawinconflictherewith. 6 2.Anytaxingauthorityorownerofanytaxbillisherebyprohibitedfromadvertising 7forsaleorsellinganyparcelofrealestateforthecollectionofdelinquentlandtaxesdue 8thereon,exceptafterjudgmentofacourthavingjurisdictionorderingsuchadvertisingorsale, 9whensuchparcelisatsuchtimeincludedinanypetitionfiledpursuanttotheprovisionsof 10thislaw. 11 3.Attheoptionofthetaxingauthorityortaxbillowner,allclaimsforlandtaxes 12againstanyparcelofrealestate,whichhasbeenincludedinanypetitionfiledunderthislaw, 13wheresuchtaxeshavebecomedueandpayableafteranytaxlistorpetitionthereonhasbeen 14filed,maybeassertedbyamendedpetitionorbyanswerfiledbeforejudgment,and,if 15allowedbythecourt,shallbeincludedinthejudgmentagainstsuchparcelofrealestate. 141.700.Inallcountieselectingtooperateundersections141.210to141.810 2priortoJanuary1,2024,thereisherebycreatedacommissionforthemanagement,saleand 3otherdispositionoftaxdelinquentlands,whichcommissionshallbeknownas"TheLand 4Trustof______County,Missouri",andthemembersthereofshallbeknownaslandtrustees. 5Suchlandtrustshallhaveandexerciseallthepowersthatareconferredbysections141.210 6to141.810necessaryandincidentaltotheeffectivemanagement,saleorotherdispositionof 7realestateacquiredunderandbyvirtueoftheforeclosureofthelienfordelinquentrealestate 8taxes,asprovidedinsaidsections,andintheexerciseofsuchpowers,thelandtrustshallbe 9deemedtobeapubliccorporationactinginagovernmentalcapacity.Whereacountyhas 10electedtoestablishalandbankagencyundersubsection1ofsection140.981,nosuch 11landtrustshallbecreatedundersections141.700to141.810. HCSHB587 42 141.821.1.Inallpartialopt-incounties,priortoaconfirmationbyacourtofa 2deemedbidundersubsection2ofsection141.560,atrustshallbecreatedforthe 3management,sale,andotherdispositionoftaxdelinquentlands,whichshallbeknown 4as"TheLandTrustof______County,Missouri",andtheboardofwhichshallbe 5knownaslandtrustees.Thecountycommissionofsuchcountyshallappointby 6resolutionororderoneorthreelandtrustees.Thefirstappointedlandtrusteeshall 7serveforatermoftwoyearsandtheremaininglandtrusteesshallservefortermsof 8threeyearsrespectively,asapplicable.Thereafter,landtrusteesshallbeappointedby 9thecountycommissionforatermofofficeoftwoyears,exceptthatallvacanciesshallbe 10filledforanunexpiredterm. 11 2.Ifacountyelectedtoestablishalandbankagencyundersubsection1of 12section140.981,nosuchlandtrustshallbecreatedundersections141.700to141.821. 13 3.Suchlandtrust,bymajorityvoteofthelandtrustees,shallhavethepower 14anddutytosell,exchange,orotherwisedisposeofrealestate,provided,however,that 15anysuchsale,exchange,ordisposalshallbeforconsiderationequaltoorinexcessof 16two-thirdsoftheappraisedvalueofsuchrealestatesosoldorconveyed,andifsuch 17considerationislessthantwo-thirdsoftheappraisedvalueofsuchrealestate,theland 18trustshallfirstprocureamajorityvoteofthecountycommission. 19 4.(1)Thelandtrustshallsetupaccountsrelatingtotheoperationand 20managementofthelandtrust. 21 (2)Whenanyparcelofrealestateissoldorotherwisedisposedofbytheland 22trust,theproceedstherefromshallbeappliedanddistributedinthefollowingorder: 23 (a)Tothepaymentoftheexpensesofsale; 24 (b)Tothecostsofthecare,improvement,operation,acquisition,demolition, 25management,andadministrationofparcelsofrealestateownedbythelandtrust;and 26 (c)Tothecounty'sgeneralfund. 27 5.Nolandtrusteeshallreceiveanycompensation,emolument,orotherprofit 28directlyorindirectlyfromtherental,management,acquisition,sale,demolition,repair, 29rehabilitation,use,operation,ownership,ordispositionofanylandsheldbysuchland 30trust. 141.980.1.(1)Sections141.980to141.1015shallbeknownandmaybecitedas 2the"Chapter141MunicipalLandBankAct". 3 (2)Anymunicipalitylocatedwhollyorpartiallywithinacounty[inwhichalandtrust 4createdundersection141.700wasoperatingonJanuary1,2012,] electingtooperatewholly 5undertheprovisionsofsections141.210to141.810mayestablishalandbankagencyfor 6themanagement,sale,transfer,andotherdispositionofinterestsinrealestateownedbysuch 7landbankagency.Anysuchlandbankagencycreatedshallbecreatedtofosterthepublic HCSHB587 43 8purposeofreturningland,includinglandthatisinanonrevenue-generating,nontax- 9producingstatusto[useinprivateownership] productivereuse. Suchlandbankagency 10shallbeestablishedbyordinanceorresolutionasapplicable.Suchlandbankagencyshallnot 11ownanyinterestinrealestatethatislocatedwhollyorpartiallyoutsidesuchestablishing 12municipality.[Suchlandbankagencyshallnotbeauthorizedtosellmorethanfive 13contiguousparcelstothesameentityinthecourseofayear.]Nomunicipalityinapartial 14opt-incountyiseligibletoestablishalandbankagencyunderthissection. 15 2.Thebeneficiariesofthelandbankagencyshallbethetaxingauthoritiesthatheld 16orownedtaxbillsagainsttherespectiveparcelsofrealestateacquiredbysuchlandbank 17agencypursuanttoadeemedsaleundersubsection3ofsection141.560,bydeedfromaland 18trustundersubsection1ofsection141.984,orpursuanttoasaleundersubdivision(2)of 19subsection2ofsection141.550includedinthejudgmentofthecourt,and[their] the 20beneficiaries'respectiveinterestsineachparcelofrealestateshallbetotheextentandinthe 21proportionandaccordingtotheprioritiesdeterminedbythecourtonthebasisthatthe 22principalamountof[their] thebeneficiaries'respectivetaxbillsboretothetotalprincipal 23amountofallofthetaxbillsdescribedinthejudgment. 24 3.Eachlandbankagencycreatedpursuanttothischaptershallbeapublicbody 25corporateandpolitic,andshallhavepermanentandperpetualdurationuntilterminatedand 26dissolvedinaccordancewiththeprovisionsofsection141.1012. 141.984.1.Withinoneyearoftheeffectivedateoftheordinanceorresolution 2passedestablishingalandbankagencyunderthischapter,titletoanyrealpropertyheldbya 3landtrustcreatedpursuanttosection141.700thatislocatedwhollywithinthemunicipality 4thatcreatedthelandbankagencyshallbetransferredbydeedtosuchlandbankagency. 5 2.Theincomeofalandbankagencyshallbeexemptfromalltaxationbythestate 6andbyanyofitspoliticalsubdivisions.Uponacquiringtitletoanyrealestate,alandbank 7agencyshallimmediatelynotifythecountyassessorandthecollectorofsuchownership,and 8suchrealestateshallbeexemptfromalltaxationduringthelandbankagency'sownership 9thereof,inthesamemannerandtothesameextentasanyotherpubliclyownedrealestate, 10anduponthesaleorotherdispositionofanyrealestateheldbyit,suchlandbankagencyshall 11immediatelynotifythecountyassessorandthecollectorofsuchchangeofownership; 12providedhowever,thatsuchtaxexemptionforimprovedandoccupiedrealpropertyheldby 13suchlandbankagencyaslessorpursuanttoagroundleaseshallterminateuponthefirstsuch 14occupancy,andsuchlandbankagencyshallimmediatelynotifythecountyassessorandthe 15collectorofsuchoccupancy. 16 3.Subjecttothelimitationsetforthinsubsection1ofsection141.980,alandbank 17agencymayacquirerealpropertyorinterestsinpropertybygift,devise,transfer,exchange, HCSHB587 44 18foreclosure,lease,purchase,orotherwiseontermsandconditionsandinamannertheland 19bankagencyconsidersproper. 20 4.Subjecttothelimitationsetforthinsubsection1ofsection141.980,alandbank 21agencymayacquirepropertybypurchasecontracts,leasepurchaseagreements,installment 22salescontracts,andlandcontacts,andmayaccepttransfersfrompoliticalsubdivisionsupon 23suchtermsandconditionsasagreedtobythelandbankagencyandthepoliticalsubdivision. 24Subjecttothelimitationsetforthinsubsection1ofsection141.980,alandbankagencymay 25bidonanyparcelofrealestateofferedforsaleatasheriff'sforeclosuresaleheldin 26accordancewithsection141.550[providedthatifthebidisnotadeemedbidunder 27subsection3ofsection141.560,suchparcelmustbelocatedwithinalow-tomoderate- 28incomeareadesignatedasatargetareaforrevitalizationbythemunicipalitythatcreatedthe 29landbankagency]. Notwithstandinganyotherlawtothecontrary,butsubjecttothe 30limitationsetforthinsubsection1ofsection141.980,anypoliticalsubdivisionmaytransfer 31tothelandbankagencyrealpropertyandinterestsinrealpropertyofthepoliticalsubdivision 32onsuchtermsandconditionsandaccordingtosuchproceduresasdeterminedbythepolitical 33subdivision. 34 5.Alandbankagencyshallmaintainallofitsrealpropertyinaccordancewiththe 35lawsandordinancesofthejurisdictionsinwhichtherealpropertyislocated. 36 6.Uponconfirmationundersection141.580ofasheriff'sforeclosuresaleofaparcel 37ofrealestatetoalandbankagencyundersubdivision(2)ofsubsection2ofsection141.550, 38saidlandbankagencyshallpaytheamountofthelandbankagency'sbidthatexceedsthe 39amountofalltaxbillsincludedinthejudgment,interest,penalties,attorney'sfeesandcosts 40thenduethereon.Suchexcessshallbeappliedanddistributedinaccordancewithsubsections 413and4ofsection141.580,exclusiveofsubdivision(3)ofsubsection3thereof.Uponsuch 42confirmationbythecourt,thecollectorshallmarkthetaxbillsincludedinthejudgmentas 43"cancelledbysaletothelandbank"andshalltakecreditforthefullamountofsuchtaxbills, 44includingprincipalamount,interest,penalties,attorney'sfees,andcosts,on[his]the 45collector'sbooksandin[his]thecollector'sstatementswithanyothertaxingauthorities. 141.1009.1.Alandbankagencyshallbeauthorizedtofileanactiontoquiettitle 2pursuanttosection527.150astoanyrealpropertyinwhichthelandbankagencyhasan 3interest.Forpurposesofanyandallsuchactionsthelandbankagencyshallbedeemedtobe 4theholderofsufficientlegalandequitableinterests,andpossessoryrights,soastoqualifythe 5landbankagencyasadequatepetitionerinsuchaction. 6 2.Priortothefilingofanactiontoquiettitlethelandbankagencyshallconductan 7examinationoftitletodeterminetheidentityofanyandallpersonsandentitiespossessinga 8claimorinterestinortotherealproperty.Serviceofthepetitiontoquiettitleshallbe 9providedtoallsuchinterestedpartiesbythefollowingmethods: HCSHB587 45 10 (1)Registeredorcertifiedmailtosuchidentityandaddressasreasonably 11ascertainablebyaninspectionofpublicrecords; 12 (2)Inthecaseofoccupiedrealpropertybyfirstclassmail,addressedto"Occupant"; 13 (3)Bypostingacopyofthenoticeontherealproperty; 14 (4)Bypublicationonlineorinanewspaperofgeneralcirculationinthemunicipality 15inwhichthepropertyislocated;and 16 (5)Suchothermethodsasthecourtmayorderorasmayberequiredbyprevailing 17notionsofdueprocess. 18 3.Aspartofthepetitiontoquiettitlethelandbankagencyshallfileanaffidavit 19identifyingallpartiespotentiallyhavinganinterestintherealproperty,andtheformofnotice 20provided. 21 4.Thecourtshallscheduleahearingonthepetitionwithinninetydaysfollowing 22filingofthepetition,andastoallmattersuponwhichananswerwasnotfiledbyaninterested 23partythecourtshallissueitsfinaljudgmentwithinonehundredtwentydaysofthefilingof 24thepetition. 25 5.Alandbankagencyshallbeauthorizedtojoininasinglepetitiontoquiettitleone 26ormoreparcelsofrealproperty. 249.255.1.Shouldapublicsewerdistrictcreatedandorganizedpursuantto 2constitutionalorstatutoryauthorityplacealienuponacustomer'spropertyforunpaidsewer 3charges,thelien,onceproperlyrecorded,shallhavepriority[asandbeenforcedinthesame 4manneras]aboveallliensexceptforthosetaxesleviedforstateandcountypurposes. 5 2.Shouldthesewerchargesofapublicsewerdistrictcreatedandorganizedpursuant 6toconstitutionalorstatutoryauthorityremainunpaidforaperiodinexcessofthreemonths, 7thedistrict,afternoticetothecustomerbycertifiedmail,shallhavetheauthorityatits 8discretiontodisconnectthecustomer'ssewerlinefromthedistrict'slineorrequestany 9privatewatercompany,publicwatersupplydistrict,oranymunicipalitysupplyingwaterto 10thepremisestodiscontinueservicetothecustomeruntilsuchtimeasthesewerchargesand 11allrelatedcostsofthissectionarepaid.
