140.010.1.Allrealestateuponwhichthetaxesremainunpaidonthefirstdayof
2January,annually,aredelinquent,andthecountycollectorshallenforcethelienofthestate
3thereon,asrequiredbythischapter.Anyfailuretoproperlyreturnthedelinquentlist,as
4requiredbythischapter,innowayaffectsthevalidityoftheassessmentandlevyoftaxes,nor
5oftheforeclosureandsalebywhichthecollectionofthetaxesisenforced,norinanymanner
6affectsthelienofthestateonthedelinquentrealestateforthetaxesunpaidthereon.
7 2.Alternatively,anycountymay,byadoptionofaresolutionororderofthe
8countycommissionofsuchcounty,electtooperateundertheprovisionsofsections
9141.210to141.810foranyparcelforwhichthereisanunpaidtaxbillforaperiodofat
10leasttwoyearsafterthedateonwhichitbecamedelinquent.Anycountyelectingto
11operateassuchshallbecalleda"partialopt-incounty".Nocountyeligibletoestablish
12alandbankagencyundersubsection1ofsection140.981shallelecttooperateasa
13partialopt-incountyunlessthecountyfirstelectstoestablishalandbankagencyas
14providedinsubsection1ofsection140.981.Inaccordancewithsection141.290,after
15theadoptionofsuchresolutionororderbyacountycommission,thecollectorofthe
16countyshalldecidewhichtax-delinquentparcelsshallproceedaccordingtothe
17provisionsofsections141.210to141.810.Suchparcelsshallbeexemptfromthe
18provisionsofsections140.030to140.722.Thecollectorshallremovesuchparcelsfrom
19anylistofparcelsadvertisedforfirst,second,third,orpost-thirdsales.
140.190.1.Onthedaymentionedinthenotice,thecountycollectorshallcommence
2thesaleofsuchlands,andshallcontinuethesamefromdaytodayuntileachparcelassessed
3orbelongingtoeachpersonassessedshallbesoldaswillpaythetaxes,interestandcharges
4thereon,orchargeabletosuchpersoninsaidcounty.
5 2.Thepersonorlandbankagencyofferingatsaidsale,whetherinpersonorby
6electronicmedia,topaytherequiredsumforatractshallbeconsideredthepurchaserofsuch
7land;provided,nosaleshallbemadetoanypersonordesignatedagentwhoiscurrently
8delinquentonanytaxpaymentsonanyproperty,otherthanadelinquencyontheproperty
9beingofferedforsale,andwhodoesnotsignanaffidavitstatingsuchatthetimeofsale.
10Failuretosignsuchaffidavitaswellassigningafalseaffidavitmayinvalidatesuchsale.No
11bidshallbereceivedfromanypersonnotaresidentofthestateofMissourioraforeign
12corporationorentityalldeemednonresidents.Anonresidentshallfilewithsaidcollectoran
13agreementinwritingconsentingtothejurisdictionofthecircuitcourtofthecountyinwhich
14suchsaleshallbemade,andalsofilingwithsuchcollectoranappointmentofsomecitizenof
15saidcountyasagentofsaidnonresident,andconsentingthatserviceofprocessonsuchagent
16shallgivesuchcourtjurisdictiontotryanddetermineanysuitgrowingoutoforconnected
HCSHB587	2 17withsuchsalefortaxes.Afterthedelinquentauctionsale,anycertificateofpurchaseshallbe
18issuedtotheagent.Aftermeetingtherequirementsofsection140.405,thepropertyshallbe
19conveyedtotheagentonbehalfofthenonresident,andtheagentshallthereafterconveythe
20propertytothenonresident.Acollectormayprecludeaprospectivebidderfrom
21participatinginasaleforfailuretocomplywithanyoftheprovisionsofthissection.
22 3.Allsuchwrittenconsentstojurisdictionandselectiveappointmentsshallbe
23preservedbythecountycollectorandshallbebindinguponanypersonorcorporation
24claimingunderthepersonconsentingtojurisdictionandmakingtheappointmentherein
25referredto;providedfurther,thatintheeventofthedeath,disabilityorrefusaltoactofthe
26personappointedasagentofsaidnonresidentthecountyclerkshallbecometheappointeeas
27agentofsaidnonresident.
28 4.Nopersonresidinginanyhomerulecitywithmorethanseventy-onethousandbut
29fewerthanseventy-ninethousandinhabitantsshallbeeligibletooffertopurchaselandsunder
30thissectionunlesssuchpersonhas,nolaterthantendaysbeforethesaledate,demonstrated
31tothesatisfactionoftheofficialchargedbylawwithconductingthesalethatthepersonisnot
32theownerofanyparcelofrealpropertythathastwoormoreviolationsofthemunicipality's
33buildingorhousingcodes.Aprospectivebiddermaymakesuchademonstrationby
34presentingstatementsfromtheappropriatecollectionandcodeenforcementofficialsofthe
35municipality.Thissubsectionshallnotapplytoanytaxingauthorityorlandbankagency,and
36entitiesshallbeeligibletobidatanysaleconductedunderthissectionwithoutmakingsucha
37demonstration.
140.250.1.Wheneveranylandshavebeenorshallhereafterbeofferedforsalefor
2delinquenttaxes,interest,penaltyandcostsbythecollectorofthepropercountyforanytwo
3successiveyearsandnopersonshallhavebidthereforasumequaltothedelinquenttaxes
4thereon,interest,penaltyandcostsprovidedbylaw,thensuchcountycollectorshallatthe
5nextregulartaxsaleoflandsfordelinquenttaxessellsametothehighestbidder,exceptthe
6highestbidshallnotbelessthanthesumequaltothedelinquenttaxes,interest,penalties,and
7costs,andthereshallbeaninety-dayperiodofredemptionfromsuchsalesasspecifiedin
8section140.405.
9 2.Acertificateofpurchaseshallbeissuedastosuchsales,andthepurchaseratsuch
10salesshallbeentitledtotheissuanceanddeliveryofacollector'sdeeduponcompletionof
11titlesearchactionasspecifiedinsection140.405.
12 3.Ifanylandsorlotsarenotsoldatsuchthirdoffering,thenthecollector,in[his]the
13collector'sdiscretion,neednotagainadvertiseoroffersuchlandsorlotsforsalemoreoften
14thanonceeveryfiveyearsafterthethirdofferingofsuchlandsorlots,andsuchofferingshall
15tolltheoperationofanyapplicablestatuteoflimitations.
HCSHB587	3 16 4.Apurchaseratanysalesubsequenttothethirdofferingofanylandorlots,whether
17bythecollectororatrusteeasprovidedinsection140.260,shallbeentitledtotheimmediate
18issuanceanddeliveryofacollector'sdeedandthereshallbenoperiodofredemptionfrom
19suchpost-thirdyearsales;provided,however,beforeanypurchaseratasaletowhichthis
20sectionisapplicableshallbeentitledtoacollector'sdeeditshallbethedutyofthecollector
21todemand,andthepurchasertopay,inadditionto[his]thepurchaser'sbid,alltaxesdue
22andunpaidonsuchlandsorlotsthatbecomedueandpayableonsuchlandsorlots
23subsequenttothedateofthetaxesincludedinsuchadvertisementandsale.Thecollector's
24deedortrustee'sdeedshallhavepriorityoverallotherliensorencumbrancesontheproperty
25soldexceptforrealpropertytaxes.
26 5.Apurchaseratanysalesubsequenttothethirdofferingofanylandorlots,
27whetherbythecollectororatrusteeasprovidedinsection140.260,mayelecttoproceed
28undersubsection1ofthissectionandsubsection6ofsection140.405bygivingnoticeto
29thecollectorpriortotheissuanceofacollector'sdeed.
30 6.Intheeventtherealpurchaseratanysaletowhichthissectionisapplicableshall
31betheownerofthelandsorlotspurchased,orshallbeobligatedtopaythetaxesforthe
32nonpaymentofwhichsuchlandsorlotsweresold,thennocollector'sdeedshallbeissuedto
33suchpurchaser,ortoanyoneactingfororonbehalfofsuchpurchaser,withoutpaymenttothe
34collectorofsuchadditionalamountaswilldischargeinfullalldelinquenttaxes,penalty,
35interestandcosts.
140.420.Ifnopersonshallredeemthelandssoldfortaxespriortotheexpirationof
2therighttoredeem,attheexpirationthereof,andonproductionofthecertificateofpurchase
3anduponproofsatisfactorytothecollectorthatapurchaseror[hisorher]thepurchaser's
4heirs,successors,orassignsareauthorizedtoacquirethedeed[,]:
5 (1)Thecollectorofthecountyinwhichthesaleofsuchlandstookplaceshall
6executetothepurchaser[, his]or[her]thepurchaser'sheirsorassigns,inthenameofthe
7state,aconveyanceoftherealestatesosold,whichshallvestinthegranteeanabsoluteestate
8infeesimple,subject,however,toallclaimsthereonforunpaidtaxesexceptsuchunpaid
9taxesexistingattimeofthepurchaseofsaidlandsandthelienforwhichtaxeswasinferiorto
10thelienfortaxesforwhichsaidtractorlotoflandwassold;and
11 (2)ThestateofMissourioranyperson,taxingauthority,taxdistrict,judgment
12creditor,orlienholderthathadaright,title,interest,claim,orequityofredemptionon

140.981.1.Any[homerulecitywithmorethanseventy-onethousandbutfewerthan
2seventy-ninethousandinhabitants] countywithmorethanonemillioninhabitantsmay
3establishalandbankagencyforthemanagement,sale,transfer,andotherdispositionof
4interestsinrealestateownedbysuchlandbankagency.Anysuchcountymayestablish
5alandbankagencybyordinance,resolution,orrule,asapplicable.Suchordinance,
6resolution,orruleshallspecifythenameofthelandbankagency.Nocountyinwhicha
7landbankagencyhasbeenestablishedundertheprovisionsofsections141.980to
8141.1015shallelecttoestablishalandbankagencyunderthissection.
9 2.Anymunicipalitywithmorethanonethousandfivehundredinhabitantsnot
10locatedwithinacountythatiseligibletoestablishalandbankagencyundersubsection
111ofthissectionmayestablishalandbankagencyforthemanagement,sale,transfer,and
12otherdispositionofinterestsinrealestateownedbysuchlandbankagency.[Anysuchland
13bankagencyshallbeestablishedtofosterthepublicpurposeofreturningland,includingland
14thatisinanonrevenue-generating,nontax-producingstatus,touseinprivateownership.] A
15[city] municipalitymayestablishalandbankagencybyordinance,resolution,orrule,as
16applicable.
17 [2.Alandbankagencyshallnotownanyinterestinrealestatelocatedwhollyor
18partiallyoutsidethecitythatestablishedthelandbank.]

20orownedtaxbillsagainsttherespectiveparcelsofrealestateacquiredbysuchlandbank
21agencypursuanttoasaleconductedundersection140.190,140.240,or140.250,andtheir
22respectiveinterestsineachparcelofrealestateshallbetotheextentandinproportiontothe
23prioritiesdeterminedbythecourtonthebasisthattheprincipalamountoftheirrespectivetax
24billsboretothetotalprincipalamountofallofthetaxbillsdescribedinthejudgment.] Any
25suchlandbankagencyshallbeestablishedtofosterthepublicpurposeofreturning
26land,includinglandthatisinanon-revenue-generating,non-tax-producingstatus,to
27useinprivateownership.
28 4.Alandbankagencycreatedunderthechapter140landbankactshallbeapublic
29bodycorporateandpoliticandshallhavepermanentandperpetualdurationuntilterminated
30anddissolvedinaccordancewiththeprovisionsofsection140.1012.
140.982.[Thegoverningbodyofthecityestablishingalandbankagency,orthechief
2administrativeofficerofthecityestablishingalandbankagency,shallhavethepowerto
3organizeandreorganizetheexecutive,administrative,clerical,andotherdepartmentsofthe
4landbankagencyandtofixtheduties,powers,andcompensationofallemployees,agents,
5andconsultantsofthelandbankagency.]1.Ifacountyestablishesalandbankagency
6undersubsection1ofsection140.981,themembersofthefirstboardofdirectorsofa
7landbankagencyshallbeappointedwithinninetydaysaftertheeffectivedateofthe
8ordinance,resolution,orrulepassedestablishingsuchlandbankagency.Ifany
9appointingauthorityfailstomakeanyappointmentofaboardmemberwithinthetime
10framethefirstappointmentsarerequired,theappointmentshallbemadebythecounty
11council.Thefollowingrequirementsshallapplytotheboardofdirectors:
12 (1)Theboardofdirectorsshallconsistofsevenmembers:
13 (a)Twoofwhomshallbeappointedbythecountyexecutive,oneofwhomshall
14haveprofessionalexpertiserelevanttothelandbankagency;
15 (b)Oneofwhomshallbeappointedbythememberofthecountycouncil
16representingthedistrictwiththehighestnumberoftax-delinquentparcels.Suchboard
17membershallmaintainaprimaryresidencewithinsuchdistrict;
18 (c)Oneofwhomshallbeappointedbythememberofthecountycouncil
19representingthedistrictwiththesecondhighestnumberoftax-delinquentparcels.
20Suchboardmembershallmaintainaprimaryresidencewithinsuchdistrict;
21 (d)Oneofwhomshallbeappointedbyconsensusofthecountyexecutiveandthe
22presidentofthemunicipalleagueofthecounty;and
23 (e)Twoofwhomshallberesidentrepresentatives.Residentrepresentatives
24shallbeappointedbyamajorityvoteoftheotherboardmembers,andeachresident

26municipalitiescontainingthehighestpercentageoftax-delinquentparcels;
27 (2)Thetermofofficeofamembershallbefouryears.Eachmember'sprimary
28residenceshallbeinthecountythathasestablishedthelandbankagency.Each
29memberservesatthepleasureofthemember'sappointingauthority,maybean
30employeeoftheappointingauthority,andshallservewithoutcompensation;
31 (3)Nopublicofficershallbeeligibletoserveasaboardmember.Forpurposes
32ofthissubdivision,"publicofficer"meansapersonwhoisholdinganelectedpublic
33office.Anypublicemployeeshallbeeligibletoserveasaboardmember;
34 (4)Themembersoftheboardshallselectannuallyfromamongthemselvesa
35chair,avicechair,atreasurer,andsuchotherofficersastheboardmaydetermineand
36shallestablishtheirduties,asmayberegulatedbyrulesadoptedbytheboard;
37 (5)Theboardshallestablishrulesandrequirementsrelativetotheattendance
38andparticipationofmembersinitsmeetings,regularorspecial.Suchrulesand
39regulationsmayprescribeaprocedurewhereby,ifanymemberfailstocomplywith
40suchrulesandregulations,suchmembermaybedisqualifiedandremoved
41automaticallyfromofficebynolessthanamajorityvoteoftheremainingmembers
42oftheboard,andthatmember'spositionshallbevacantasofthefirstdayofthenext
43calendarmonth.Anypersonremovedundertheprovisionsofthissubdivisionshallbe
44ineligibleforreappointmenttotheboardunlesssuchreappointmentisconfirmed
45unanimouslybytheboard;
46 (6)Avacancyontheboardshallbefilledinthesamemannerastheoriginal
47appointment.Ifanyappointingauthorityfailstomakeanyappointmentofaboard
48memberwithinsixtydaysafteranytermexpires,theappointmentshallbemadebythe
49countycouncil;
50 (7)Boardmembersshallservewithoutcompensation.Theboardmay
51reimburseanymemberforexpensesactuallyincurredintheperformanceofdutieson
52behalfofthelandbankagency;
53 (8)Theboardshallhavethepowertoorganizeandreorganizetheexecutive,
54administrative,clerical,andotherdepartmentsofthelandbankagencyandtofixthe
55duties,powers,andcompensationofallemployees,agents,andconsultantsoftheland
56bankagency.Theboardmayreimburseanymemberforexpensesactuallyincurredin
57theperformanceofdutiesonbehalfofthelandbankagency;
58 (9)Theboardshallmeetinregularsessionaccordingtoascheduleadoptedby
59theboardandalsoshallmeetinspecialsessionasconvenedbythechairoruponwritten
60noticesignedbyamajorityofthemembers.Thepresenceofamajorityoftotal
61membership,excludingvacancies,shallconstituteaquorum;

63majorityofthemembersofthatboardpresentandvoting.However,noactionofthe
64boardshallbeauthorizedonthefollowingmattersunlessapprovedbyamajorityofthe

66 (a)Adoption,amendment,orrepealofbylawsandotherrulesandregulations
67forconductofthelandbankagency'sbusiness;
68 (b)Hiringorfiringofanyemployeeorcontractorofthelandbankagency.This
69functionmay,bymajorityvote,bedelegatedbytheboardtoaspecifiedofficeror
70committeeofthelandbankagencyundersuchtermsandconditionsandtotheextent
71thattheboardmayspecify;
72 (c)Theincurringofdebt,including,withoutlimitation,borrowingofmoneys
73andissuanceofbonds,notes,orotherobligations;
74 (d)Adoptionoramendmentoftheannualbudget;and
75 (e)Sale,lease,encumbrance,oralienationofrealproperty,improvements,or
76personalpropertywithavalueofmorethanfiftythousanddollars;
77 (11)Membersofaboardshallnotbeliablepersonallyonthebondsorother
78obligationsofthelandbankagency,andtherightsofcreditorsshallbesolelyagainst
79suchlandbankagency;and
80 (12)Votebyproxyshallnotbepermitted.Anymembermayrequestarecorded
81voteonanyresolutionoractionofthelandbankagency.
82 2.Ifamunicipalityestablishesalandbankagencyundersubsection2ofsection
83140.981,theordinance,resolution,orrule,asapplicable,mayspecifythefollowing:
84 (1)Thenameofthelandbankagency;
85 (2)Thenumberofmembersoftheboardofdirectors,whichshallconsistofan
86oddnumberofmembersandshallbenofewerthanfivemembersnormorethaneleven
87members;
88 (3)Theinitialindividualstoserveasmembersoftheboardofdirectorsandthe
89lengthoftermsforwhichthemembersaretoserve;and
90 (4)Thequalifications,mannerofselectionorappointment,andtermsofofficeof
91membersoftheboard.
92 3.Alandbankagencymayemployasecretary,anexecutivedirector,itsowncounsel
93andlegalstaff,technicalexperts,andotheragentsandemployees,permanentortemporary,as
94itmayrequireandmaydeterminethequalificationsandfixthecompensationandbenefitsof
95suchpersons.Alandbankagencymayalsoenterintocontractsandagreementswithpolitical
96subdivisionsforstaffingservicestobeprovidedtothelandbankagencybypolitical
97subdivisionsoragenciesordepartmentsthereof,orforalandbankagencytoprovidesuch
98staffingservicestopoliticalsubdivisionsoragenciesordepartmentsthereof.
HCSHB587	8 140.983.Alandbankagencyestablishedunderthechapter140landbankactshall
2haveallpowersnecessaryorappropriatetocarryoutandeffectuatethepurposesand
3provisionsofthechapter140landbankact,includingthefollowingpowersinadditionto
4thosehereinotherwisegranted:
5 (1)Toadopt,amend,andrepealbylawsfortheregulationofitsaffairsandthe
6conductofitsbusiness;
7 (2)Tosueandbesued,initsownname,andpleadandbeimpleadedinallcivil
8actionsincluding,butnotlimitedto,actionstocleartitletopropertyofthelandbankagency;
9 (3)Toadoptasealandtoalterthesameatpleasure;
10 (4)Toborrowfromprivatelenders,politicalsubdivisions,thestate,andthefederal
11governmentasmaybenecessaryfortheoperationandworkofthelandbankagency;
12 (5)Toissuenotesandotherobligationsaccordingtotheprovisionsofthischapter;
13 (6)Toprocureinsuranceorguaranteesfrompoliticalsubdivisions,thestate,the
14federalgovernment,oranyotherpublicorprivatesourcesofthepaymentofanybond,note,
15loan,orotherobligation,orportionthereof,incurredbythelandbankagencyandtopayany
16feesorpremiumsinconnectiontherewith;
17 (7)Toenterintocontractsandotherinstrumentsnecessary,incidental,orconvenient

4holderofsufficientlegalandequitableinterests,andpossessoryrights,soastoqualifythe
5landbankagencyasanadequatepetitionerinsuchaction.
6 2.Priortothefilingofanactiontoquiettitle,thelandbankagencyshallconductan
7examinationoftitletodeterminetheidentityofanyandallpersonsandentitiespossessinga
8claimorinterestinortotherealproperty.Serviceofthepetitiontoquiettitleshallbe

7 2.Thetaxingauthorityorpersonfilingsuchlistshallpaytothecollectorafilingfee

9chargedagainsteachparcelandcollectedandaccountedforbythecollectorasothercosts.
10 3.Noschooldistrictnoranyothertaxingauthoritywhosetaxesarerequiredbylawto
11becollectedbythecollectorshallfileanylistnorpaythefilingfeehereinprovided.
12 4.Ifthetaxesofanytaxingauthorityaretwoormoreyearsdelinquent,theother
13taxingauthorities[shall,] andothertaxbillowners[may,]shallincludeinthesaidlistalltax
14liensagainstthesaidparcel,eventhough[they] thetaxesarenottwoyearsdelinquent.
141.290.1.Thecollectorshallcompilelistsofallstate,county,school,andothertax
2billscollectibleby[himwhich] thecollectorthataredelinquentaccordingto[his]the
3collector'srecords, and[he]thecollectorshallcombinesuchlistswiththelistfiledbyany
4taxingauthorityortaxbillowner.
5 2.Forpartialopt-incounties,thecollectorshalldecidewhichtax-delinquent
6parcelsshallproceedaccordingtotheprovisionscontainedherein.Theremaining
7parcelsshallproceedundersuchotherprovisionsasmaybeprovidedbylaw.
8 3.Thecollectorshallassignaserialnumbertoeachparcelofrealestateineachlist
