8nonuniformedattiremayreceive,inadditiontohisorhersalary,anallowancenottoexceed 9threehundredsixtydollarsperannumpayablebiweekly.Notwithstandingtheprovisionsof 10subsection1ofthissectiontothecontrary,noadditionalcompensationorcompensatorytime 11offforovertime,courttime,orstandbycourttimeshallbepaidorallowedtoanyofficerof 12therankof[sergeant] lieutenantorabove.Notwithstandinganyotherprovisionoflawtothe 13contrary,nothinginthissectionshallprohibitthepaymentofadditionalcompensation 14pursuanttothissubsectiontoofficersoftheranksofsergeantsandabove,providedthat 15fundingforsuchcompensationshallnot: 16 (1)Bepaidfromthegeneralfundsofeitherthecityortheboardofpolice 17commissionersofthecity;or 18 (2)Beviolativeofanyfederallaworotherstatelaw. 19 3.Itisthedutyofthemunicipalassemblyorcommoncouncilofthecitiestomake 20thenecessaryappropriationfortheexpensesofthemaintenanceofthepoliceforceinthe 21mannerhereinandhereafterprovided;provided,thatinnoeventshallsuchmunicipal HCSHBs702,53,213,216,306&359 3 22assemblyorcommoncouncilberequiredtoappropriateforsuchpurposes(including,butnot 23limitedto,costsoffundingpensionsorretirementplans)foranyfiscalyearasuminexcessof 24anylimitationimposedbyarticleX,section21,MissouriConstitution;andprovidedfurther, 25thatsuchmunicipalassemblyorcommoncouncilmayappropriateasuminexcessofsuch 26limitationforanyfiscalyearbyanappropriationsordinanceenactedinconformitywiththe 27provisionsofthecharterofsuchcities. 28 4.Notwithstandingtheprovisionsofsubsection1ofthissectiontothecontrary,the 29boardofpolicecommissionersshallpayadditionalcompensationforallhoursofservice 30renderedbyprobationarypatrolmen[and],patrolmen, andsergeantsinexcessofthe 31establishedregularworkingperiod,andtherateofcompensationshallbeoneandone-half 32timestheregularhourlyrateofpaytowhicheachmembershallnormallybeentitled;except 33that,thecourttimeandcourtstandbytimeshallbepaidattheregularhourlyrateofpayto 34whicheachmembershallnormallybeentitled.Nocreditshallbegivenordeductionsmade 35frompaymentsforovertimeforthepurposeofretirementbenefits. 36 5.Notwithstandingtheprovisionsofsubsection1ofthissectiontothecontrary, 37probationarypatrolmen[and], patrolmen, andsergeantsshallreceiveadditional 38compensationforauthorizedovertime,courttimeandcourtstandbytimewheneverthe 39totalaccumulatedtimeexceedsfortyhours.Theaccumulatedfortyhoursshallbetakenas 40compensatorytimeoffattheofficer'sdiscretionwiththeapprovalofhissupervisor. 41 6.Theallowanceofcompensationorcompensatorytimeoffforcourtstandbytime 42shallbecomputedattherateofone-thirdofonehourforeachhourspentoncourtstandby 43time. 44 7.Theboardofpolicecommissioners[may] shalleffectprogramstoprovide 45additionalcompensationtoitsemployeesforsuccessfulcompletionofacademicworkatan 46accreditedcollegeoruniversity,inamountsnottoexceedtenpercentoftheiryearlysalaries 47orforfieldtrainingofficerandleadofficerresponsibilitiesinamountsnottoexceedthree 48percentoftheiryearlysalariesforfieldtrainingofficerresponsibilitiesandanadditionalthree 49percentoftheiryearlysalariesforleadofficerresponsibilities.Theboardmaydesignateup 50toonehundredfiftyemployeesasfieldtrainingofficersanduptofiftyemployeesaslead 51officers. 52 8.Theboardofpolicecommissioners: 53 (1)Shallprovideorcontractforlifeinsurancecoverageandforinsurancebenefits 54providinghealth,medicalanddisabilitycoverageforofficersandemployeesofthe 55department; 56 68boardofpolicecommissionersshallpayadditionalcompensationtomembersofthepolice 69forceuptoandincludingtherankofpoliceofficerforanyfullhourworkedbetweenthe 70hoursof11:00p.m.and7:00a.m.,inamountsequalto[five]tenpercentoftheofficer'sbase 71hourlypay. 72 10.Theboardofpolicecommissioners,fromtimetotimeandinitsdiscretion,may 73payadditionalcompensationtopoliceofficers,sergeantsandlieutenantsbypaying 74commissionedofficersintheaforesaidranksforaccumulated,unusedvacationtime.Any 75suchpaymentsshallbemadeinincrementsofnotlessthanfortyhours,andatrates 76equivalenttothebasestraight-timeratesbeingearnedbysaidofficersatthetimeofpayment; 77exceptthat,nosuchofficershallberequiredtoacceptpaymentforaccumulatedunused 78vacationtime. 84.170.1.Whenanyvacancyshalltakeplaceinanygradeofofficers,itshallbe 2filledfromthenextlowestgrade;provided,however,thatprobationarypatrolmenshallserve 3atleastsixmonthsassuchbeforebeingpromotedtotherankofpatrolman;patrolmenshall 4serveatleastthreeyearsassuchbeforebeingpromotedtotherankofsergeant;sergeants 5shallserveatleastoneyearassuchbeforebeingpromotedtotherankoflieutenant; 6lieutenantsshallserveatleastoneyearassuchbeforebeingpromotedtotherankofcaptain; 7andinnocaseshallthechieforassistantchiefbeselectedfrommennotmembersoftheforce 8orbelowthegradeofcaptain.Patrolmenshallserveatleastthreeyearsassuchbefore 9promotiontotherankofdetective;theinspectorshallbetakenfrommenintheranknot 10belowthegradeoflieutenant. 11 2.Theboardsofpoliceareherebyauthorizedtomakeallsuchrulesandregulations, 12notinconsistentwithsections84.010to84.340,orotherlawsofthestate,astheymayjudge 9dutiesbysuchsectionsimposeduponhimorher,shallbesubjecttoapenaltyofone 10thousanddollarsforeachoffense,recoverablebytheboardsbyactionatlawinthe 11nameofthestate,andshallforeverthereafterbedisqualifiedfromholdingorexercising 12anyofficeoremploymentwhatsoeverunderthemayororcommoncouncilormunicipal 5toprovideforanorderlyandappropriatetransitioninthegovernanceofthepolice HCSHBs702,53,213,216,306&359 6 6forceandprovideforanequitableemploymenttransitionforcommissionedandcivilian 7personnel. 8 2.Upontheassumptionofcontrolbytheboardofpolicecommissionersunder 9subsection1ofthissection,anymunicipalpolicedepartmentwithinanycitynotwithin 10acountyshallconvey,assign,andotherwisetransfertotheboardtitleandownershipof 11allindebtednessandassets,including,butnotlimitedto,allfundsandrealandpersonal 12propertyheldinthenameoforcontrolledbythemunicipalpolicedepartment.Such 13cityshallthereafterceasetheoperationofanypolicedepartmentorpoliceforce. 14 3.Upontheassumptionofcontrolbytheboardofpolicecommissionersunder 15subsection1ofthissection,thestateshallacceptresponsibility,ownership,andliability 16assuccessor-in-interestforcontractualobligationsandotherlawfulobligationsofthe 17municipalpolicedepartment. 18 4.Theboardofpolicecommissionersshallinitiallyemploy,withoutareduction 19inrank,salary,orbenefits,allcommissionedandcivilianpersonnelofthemunicipal 20policedepartmentwhowereemployedbythemunicipalpolicedepartmentimmediately 21priortothedatetheboardassumedcontrol.Theboardshallrecognizeallaccrued 22yearsofservicethatsuchcommissionedandcivilianpersonnelhadwiththemunicipal 23policedepartment,aswellasallaccruedyearsofservicethatsuchcommissionedand 24civilianpersonnelhadpreviouslywiththeboardofpolicecommissioners.Such 25personnelshallbeentitledtothesameholidays,vacation,sickleave,sickbonustime, 26andannualstep-increasestheywereentitledtoasemployeesofthemunicipalpolice 27department. 28 27thepersonwhomtheemployeeclaimstohavecommittedtheunlawfulactorviolationofa 28clearmandateofpublicpolicy; 29 (5)"Themotivatingfactor",theemployee'sprotectedclassificationactuallyplayeda 30roleintheadversedecisionoractionandhadadeterminativeinfluenceontheadverse 31decisionoraction. 32 3.Thissectionisintendedtocodifytheexistingcommonlawexceptionstotheat- 33willemploymentdoctrineandtolimittheirfutureexpansionbythecourts.Thissection,in 34additiontochapter213andchapter287,shallprovidetheexclusiveremedyforanyandall 35claimsofunlawfulemploymentpractices. 36 4.Itshallbeanunlawfulemploymentpracticeforanemployertodischargean 37individualdefinedasaprotectedpersoninthissectionbecauseofthatperson'sstatusasa 38protectedperson. 39 5.Aprotectedpersonaggrievedbyaviolationofthissectionshallhaveaprivate 40rightofactionforactualdamagesforviolationsofthissectionbutnotforpunitivedamages. 41However,ifaprivaterightofactionfordamagesexistsunderanotherstatutoryorregulatory 42scheme,whetherunderstateorfederallaw,noprivaterightofactionshallexistunderthis 43statute. 44 6.Anypartytoanyactioninitiatedunderthissectionmaydemandatrialbyjury. 45 7.Aprotectedpersonaggrievedbyaviolationofthissectionshallhaveaprivate 46rightofactionthatmaybefiledinacourtofcompetentjurisdiction.Theonlyremedies 47availableinsuchanactionshallbe: 48 (1)Backpay; 49 (2)Reimbursementofmedicalbillsdirectlyrelatedtoaviolationofthissection;and 50 (3)Additionally,ifaprotectedpersonproves,byclearandconvincingevidence,that 51theconductoftheemployerwasoutrageousbecauseoftheemployer'sevilmotiveorreckless 52indifferencetotherightsofothers,then,suchpersonmayreceivedoubletheamountawarded 53undersubdivisions(1)and(2)ofthissubsection,asliquidateddamages.Inapplyingthis 54subdivision,theprovisionsofsection510.263shallbeappliedasthoughliquidateddamages 3chiefsappointedafterAugust28,2023,shallattendachiefofpolicetrainingcourse 4certifiedbythePOSTcommissionnotlaterthansixmonthsaftertheperson’s 5appointmentasachiefofpolice. 6 2.Achiefofpolicemayrequestanexemptionfromthetraininginsubsection1 7ofthissectionbysubmittingtothePOSTcommissionproofofcompletionoftheFederal 8BureauofInvestigation'snationalacademycourseoranyotherequivalenttraining 9course. 10 3.AnylawenforcementagencythathasachiefofpoliceappointedafterAugust 1128,2023,whofailstocompleteachiefofpolicetrainingcoursewithinsixmonthsof 12appointmentshallbeprecludedfromreceivinganyPOSTcommissiontrainingfunds, 13stategrantfunds,orfederalgrantfunds,untilthepolicechiefhascompletedthe 14trainingcourse. 15 4.Whileattendingachiefofpolicetrainingcourse,thechiefofpoliceshall 16receivecompensationinthesamemannerandamountasifcarryingoutthepowersand 17dutiesofthechiefofpolice.Thecostofthechiefofpolicetrainingcoursemaybepaid 18bymoneysfromthepeaceofficerstandardsandtrainingcommissionfundcreatedin 19section590.178. [84.175.1.Uponrecommendationofthechiefofpolice,theboard 2 mayauthorizeandprovidefortheorganizationofapolicereserveforce 3 composedofmemberswhoreceiveaserviceretirementundertheprovisions 4 ofsections86.200to86.366andwhoqualifyundertheprovisionsofsection 5 84.120.Suchreserveforceshallbeunderthecommandofthechiefofpolice 6 andshallbeprovidedtraining,equipment,uniforms,andarmsasthechief 7 shalldirectwiththeapprovaloftheboard.Membersofthereserveforceshall 8 possessallofthepowersofregularpoliceofficersandshallbesubjecttoall 9 lawsandregulationsapplicabletopoliceofficers;provided,however,thatthe 10 citycouncilorothergoverningbodyofanysuchcitymayinitsdiscretionfixa 11 totalinnumberwhichthereserveforcemaynotexceed. 12 2.Ineventofriotorotheremergenciesasdeclaredanddefinedbythe 13 mayor,inconcurrencewiththeboard,theboard,uponrecommendationofthe 14 chief,mayappointspecialofficersorpatrolmenfortemporaryservicein 15 additiontothepolicereserveforcehereinprovidedfor,butthelengthoftime 16 forwhichsuchofficersorpatrolmenshallbeemployedshallbelimitedtothe 17 timeduringwhichsuchemergencyshallexist.] [84.341.Noelectedorappointedofficialofthestateoranypolitical 2 subdivisionthereofshallactorrefrainfromactinginanymannertoimpede, 3 obstruct,hinder,orotherwiseinterferewithanymemberofamunicipalpolice 4 forceestablishedundersections84.343to84.346intheperformanceofhisor 5 herjobduties,orwithanyaspectofanyinvestigationarisingfromthe 6 performanceofsuchjobduties.Thissectionshallnotbeconstruedtoprevent 7 suchofficialsfromactingwithinthenormalcourseandscopeoftheir 8 employmentorfromactingtoimplementsections84.343to84.346.Any 9 personwhoviolatesthissectionshallbeliableforapenaltyoftwothousand 10 fivehundreddollarsforeachoffenseandshallforeverbedisqualifiedfrom 11 holdinganyofficeoremploymentwhatsoeverwiththegovernmentalentity 12 thepersonservedatthetimeoftheviolation.Thepenaltyshallnotbepaidby 13 thefundsofanycommitteeasthetermcommitteeisdefinedinsection 14 130.011.Thissectionshallnotbeconstruedtointerferewiththepunishment, 15 underanylawsofthisstate,ofacriminaloffensecommittedbysuchofficials, 16 norshallthissectionapplytodulyappointedmembersofthemunicipalpolice 17 superior,governmentagency,orthepresstheconductofanotheremployee 6 thatthereportingemployeebelieves,ingoodfaith,isillegal. 7 2.Anyemployeeofthemunicipalpoliceforcemaybringacauseof 8 actionforgeneralorspecialdamagesbasedonaviolationofthissection.] [84.343.1.Subjecttotheprovisionsofsections84.344to84.346,any 2 citynotwithinacountymayestablishamunicipalpoliceforceforthe 3 purposesof: 4 (1)Preservingthepublicpeace,welfare,andorder; 5 (2)Preventingcrimeandarrestingsuspectedoffenders; 6 (3)Enforcingthelawsofthestateandordinancesofthecity; 7 (4)Exercisingallpowersavailabletoapoliceforceundergenerally 8 applicablestatelaw;and 9 (5)Regulatingandlicensingallprivatewatchmen,privatedetectives, 10 andprivatepolicemenservingoractingassuchinsaidcity. 11 2.Anypersonwhoactsasaprivatewatchman,privatedetective,or 12 privatepolicemaninsaidcitieswithouthavingobtainedawrittenlicensefrom 13 saidcitiesisguiltyofaclassAmisdemeanor.] [84.344.1.Notwithstandinganyprovisionsofthischaptertothe 2 contrary,anycitynotwithinacountymayestablishamunicipalpoliceforce HCSHBs702,53,213,216,306&359 12 3 onorafterJuly1,2013,accordingtotheproceduresandrequirementsofthis 4 section.Thepurposeoftheseproceduresandrequirementsistoprovideforan 5 orderlyandappropriatetransitioninthegovernanceofthepoliceforceand 6 provideforanequitableemploymenttransitionforcommissionedandcivilian 7 personnel. 8 2.Upontheestablishmentofamunicipalpoliceforcebyacityunder 9 sections84.343to84.346,theboardofpolicecommissionersshallconvey, 10 assign,andotherwisetransfertothecitytitleandownershipofall 11 indebtednessandassets,including,butnotlimitedto,allfundsandrealand 12 personalpropertyheldinthenameoforcontrolledbytheboardofpolice 13 commissionerscreatedundersections84.010to84.340.Theboardofpolice 14 commissionersshallexecutealldocumentsreasonablyrequiredtoaccomplish 15 suchtransferofownershipandobligations. 16 3.Ifthecityestablishesamunicipalpoliceforceandcompletesthe 17 transferdescribedinsubsection2ofthissection,thecityshallprovidethe 18 necessaryfundsforthemaintenanceofthemunicipalpoliceforce. 19 4.Beforeacitynotwithinacountymayestablishamunicipalpolice 20 forceunderthissection,thecityshalladoptanordinanceaccepting 21 responsibility,ownership,andliabilityassuccessor-in-interestfor 22 contractualobligations,indebtedness,andotherlawfulobligationsofthe 23 boardofpolicecommissionerssubjecttotheprovisionsofsubsection2of 24 section84.345. 25 5.Acitynotwithinacountythatestablishesamunicipalpoliceforce 26 shallinitiallyemploy,withoutareductioninrank,salary,orbenefits,all 27 commissionedandcivilianpersonneloftheboardofpolicecommissioners 28 createdundersections84.010to84.340thatwereemployedbytheboard 29 immediatelypriortothedatethemunicipalpoliceforcewasestablished.Such 30 commissionedpersonnelwhopreviouslywereemployedbytheboardmay 31 onlybeinvoluntarilyterminatedbythecitynotwithinacountyforcause.The 32 cityshallalsorecognizeallaccruedyearsofservicethatsuchcommissioned 33 andcivilianpersonnelhadwiththeboardofpolicecommissioners.Such 34 personnelshallbeentitledtothesameholidays,vacation,andsickleavethey 35 wereentitledtoasemployeesoftheboardofpolicecommissioners. 36 6.(1)Commissionedandcivilianpersonnelofamunicipalpolice 37 forceestablishedunderthissectionwhoarehiredpriortoSeptember1,2023, 38 shallnotbesubjecttoaresidencyrequirementofretainingaprimaryresidence 39 inacitynotwithinacountybutmayberequiredtomaintainaprimary 40 residencelocatedwithinaone-hourresponsetime. 41 (2)Commissionedandcivilianpersonnelofamunicipalpoliceforce 42 establishedunderthissectionwhoarehiredafterAugust31,2023,maybe 43 subjecttoaresidencyrulenomorerestrictivethanarequirementofretaininga 44 primaryresidenceinacitynotwithinacountyforatotalofsevenyearsandof 45 thenallowingthepersonneltomaintainaprimaryresidenceoutsidethecity 46 notwithinacountysolongastheprimaryresidenceislocatedwithinaone- 47 hourresponsetime. 48 7.Thecommissionedandcivilianpersonnelwhoretirefromservice 49 withtheboardofpolicecommissionersbeforetheestablishmentofa 50 municipalpoliceforceundersubsection1ofthissectionshallcontinuetobe HCSHBs702,53,213,216,306&359 13 51 entitledtothesamepensionbenefitsprovidedunderchapter86andthesame 52 benefitssetforthinsubsection5ofthissection. 53 8.Ifthecitynotwithinacountyelectstoestablishamunicipalpolice 54 forceunderthissection,thecityshallestablishaseparatedivisionforthe 55 operationofitsmunicipalpoliceforce.Thecivilservicecommissionofthe 56 citymayadoptrulesandregulationsappropriatefortheuniqueoperationofa 57 policedepartment.Suchrulesandregulationsshallreserveexclusive 58 authorityoverthedisciplinaryprocessandproceduresaffectingcommissioned 59 officerstothecivilservicecommission;however,untilsuchtimeasthecity 60 adoptssuchrulesandregulations,thecommissionedpersonnelshallcontinue 61 tobegovernedbytheboardofpolicecommissioner'srulesandregulationsin 62 effectimmediatelypriortotheestablishmentofthemunicipalpoliceforce, 63 withthepolicechiefactinginplaceoftheboardofpolicecommissionersfor 64 purposesofapplyingtherulesandregulations.Unlessotherwiseprovidedfor, 65 existingcivilservicecommissionrulesandregulationsgoverningtheappealof 66 disciplinarydecisionstothecivilservicecommissionshallapplytoall 67 commissionedandcivilianpersonnel.Thecivilservicecommission'srules 68 andregulationsshallprovidethatrecordspreparedfordisciplinarypurposes 69 shallbeconfidential,closedrecordsavailablesolelytothecivilservice 70 commissionandthosewhopossessauthoritytoconductinvestigations 71 regardingdisciplinarymatterspursuanttothecivilservicecommission'srules 72 10.Acitynotwithinacountythatestablishesamunicipalpoliceforce 101 undersections84.343to84.346shallestablishatransitioncommitteeoffive 102 membersforthepurposeof:coordinatingandimplementingthetransitionof 103 authority,operations,assets,andobligationsfromtheboardofpolice 104 commissionerstothecity;windingdowntheaffairsoftheboard;making 105 nonbindingrecommendationsforthetransitionofthepoliceforcefromthe 106 boardtothecity;andotherrelatedduties,ifany,establishedbyexecutive 107 orderofthecity'smayor.Oncetheordinancereferencedinthissectionis 108 enacted,thecityshallprovidewrittennoticetotheboardofpolice 109 commissionersandthegovernorofthestateofMissouri.Withinthirty 110 daysofsuchnotice,themayorshallappointthreememberstothecommittee, 111 twoofwhomshallbemembersofastatewidelawenforcementassociation 112 thatrepresentsatleastfivethousandlawenforcementofficers.Theremaining 113 membersofthecommitteeshallincludethepolicechiefofthemunicipal 114 policeforceandapersonwhocurrentlyorpreviouslyservedasa 115 commissionerontheboardofpolicecommissioners,whoshallbeappointed 116 tothecommitteebythemayorofsuchcity.] [84.345.1.Exceptasrequiredfortheboardofpolicecommissioners 2
