SectionA.Section210.211,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection210.211,toreadasfollows:
210.211.1.Itshallbeunlawfulforanypersontoestablish,maintainoroperatea
2child-carefacilityforchildren,ortoadvertiseorholdhimselforherselfoutasbeingableto
3performanyoftheservicesasdefinedinsection210.201,withouthavingineffectawritten
4licensegrantedbythedepartmentofelementaryandsecondaryeducation;exceptthatnothing
5insections210.203to210.245shallapplyto:
6 (1)Anypersonwhoiscaringfor[six]fourorfewerchildren,includingamaximum
7of[three] twochildrenundertheageof[two] onewiththemaximumoffourchildren
8undertheageoftwo,atthesamephysicaladdress.Forpurposesofthissubdivision,
9childrenwholiveinthecaregiver'shomeandwhoareeligibleforenrollmentinapublic
10kindergarten,elementary,orhighschoolshallnotbeconsideredinthetotalnumberof
11childrenbeingcaredfor;
12 (2)Anypersonwhoreceivesfreeofcharge,andnotasabusiness,forperiodsnot
13exceedingninetyconsecutivedays,asbonafide,occasionalandpersonalgueststhechildor
14childrenofpersonalfriendsofsuchperson,andwhoreceivescustodyofnootherunrelated
15childorchildren;
16 (3)Anygradedboardingschoolthatisconductedingoodfaithprimarilytoprovide

53 2.Notwithstandingtheprovisionsofsubsection1ofthissection,nochild-care
54facilityshallbeexemptfromlicensureifsuchfacilityreceivesanystateorfederalfundsfor

56requirementsforparticipationintheChildandAdultCareFoodProgrampursuantto42
57U.S.C.Section1766.Grantstoparentsforchildcarepursuanttosections210.201to210.257
58shallnotbeconstruedtobefundsreceivedbyapersonorfacilitylistedinsubdivisions(1)
59and(17)ofsubsection1ofthissection.
60 3.Everychildcarefacilityshalldisclosethelicensurestatusofthefacilitytothe
61parentsorguardiansofchildrenforwhichthefacilityprovidescare.Nochildcarefacility
62exemptfromlicensureshallrepresenttoanyparentorguardianofchildrenforwhichthe
63facilityprovidescarethatthefacilityislicensedwhensuchfacilityisinfactnotlicensed.A
64parentorguardianutilizinganunlicensedchildcarefacilityshallsignawrittennotice
65indicatingheorsheisawareoftheunlicensedstatusofthefacility.Thefacilityshallkeepa
66copyofthissignedwrittennoticeonfile.Allchildcarefacilitiesshallprovidetheparentor
67guardianenrollingachildinthefacilitywithawrittenexplanationofthedisciplinary
68philosophyandpoliciesofthechildcarefacility.
69 4.Upto[two]fourchildren[whoarefiveyearsofageorolderand]whoarerelated
70withinthethirddegreeofconsanguinityoraffinityto,adoptedby,orunder[courtappointed]
71court-appointedguardianshiporlegalcustodyofachildcareproviderwhoisresponsiblefor
72thedailyoperationofalicensedfamilychildcarehomethatisorganizedasacorporation,
73association,firm,partnership,limitedliabilitycompany,soleproprietorship,oranyothertype
74ofbusinessentityinthisstateshallnotbeincludedinthenumberofchildrencountedtoward
75themaximumnumberofchildrenforwhichthefamilychildcarehomeislicensedunder
76section210.221.[Ifmorethanonememberofthecorporation,association,firm,partnership,
77limitedliabilitycompany,orotherbusinessentityisresponsibleforthedailyoperationofthe
78licensedfamilychildcarehome,thentherelatedchildrenofonlyonesuchmembershallbe

80ofchildren,aspermittedunderthissubsection,shalldisclosethistoparentsorguardianson

87 5.Notwithstandinganyotherprovisionoflaworregulation,apersonwho
88operatesalicensedchildcarefacilitywithonlyoneadultcaregivershallbeallowedto
89careforuptotwochildrenunderoneyearofagewiththemaximumoffourchildren
90undertwoyearsofage.Suchchildrenshallbeincludedinthemaximumnumberof
HCSHBs913&428 3 91childrenallowedbythedepartmentforpersonsoperatingalicensedchildcarefacility
92withonlyoneadultcaregiver.
93 6.Nothinginthissectionshallpreventthedepartmentfromenforcinglicensing
94regulationspromulgatedunderthischapter,including,butnotlimitedto,supervision
95requirementsandcapacitylimitationsbasedontheamountofchildcarespaceavailable.
