HB978--HOME-BASEDWORK SPONSOR: Falkner Thisbillamendsprovisionsthatprohibitcounties,municipalities, andtownshipsfromenactingazoningordinanceorregulationthat prohibitscertainaspectsofhome-basedwork. Thedefinitionofhome-basedworkisamendedtoclarifythatthe workperformedcanbedonebytheresidentonthebehalfofanother personorentityorinconnectionwiththeresident'sself- employmentaslongasnonresidentemployeesorcoworkersarenot regularlypresentandworkingattheresidentialproperty. Currently,azoningordinanceorregulationcannotprohibitcertain aspectsofhome-basedworksuchasmail-orderortelephonesales. Thebilladdsotheractivitiescustomarilyrelatedtoanofficeto thelistofthingsthatcannotbeprohibited. Thehoursofoperationforhome-basedworkcannotberestricted, butthebilladdsanexceptionforwork-relatedactivities producingorrequiringadditionallight,noise,orotheroffensive conditionsdetectableacrosspropertylinesduringthelateevening orearlymorningtimeperiods. Thebillestablishesthatapplicationofthissectiondoesnot curtailapoliticalsubdivision'sgeneralabilitytoenactor enforcenarrowly-tailoredregulationstoprotectpublichealth, safety,orwelfare,oraffectanyperson'sobligationtocomply withapoliticalsubdivision'snuisance,health,andsafety ordinances,rules,andregulations. Thisbillalsorepealsthesectionthatprovidesthatapolitical subdivisionmustnotprohibittheoperationofano-impact,home- basedbusinessorrequireapersontoapplyforanypermitor licensetooperatesuchabusiness,butallowsapolitical subdivisiontoestablishreasonableregulationsonsuchbusinesses thatarenarrowlytailoredforthepurposeofprotectingpublic healthandensuringthebusinessesarecompliantwithstateand federallaw.
