64.008.1.Asusedinthissection,theterm"home-basedwork"meansanylawful
2occupationperformedbyaresidentwithinaresidentialhomeoraccessorystructure,whichis
3clearlyincidentalandsecondarytotheuseofthedwellingunitforresidentialpurposesand
4doesnotchangetheresidentialcharacteroftheresidentialbuildingoradverselyaffectthe
5characterofthesurroundingneighborhood, whetherperformedbytheresidentonbehalf
6ofanotherpersonorentityorinconnectionwiththeresident'sself-employment,solong
7asnonresidentemployeesorcoworkersarenotregularlypresentandworkingatthe
8residentialproperty.
9 2.Azoningordinanceorregulationadoptedpursuanttothischapterthatregulates

11 (1)Prohibitmailorderortelephonesales,orotheractivitiescustomarilyrelatedto

15 (4)Restrictthehoursofoperationforhome-basedwork, exceptthatanysuch
16zoningordinanceorregulationmayimposereasonableprohibitionsagainstwork-

[71.990.1.Asusedinthissection,thefollowingtermsmean:
2 (1)"Goods",anymerchandise,equipment,products,supplies,or
3 materials;
4 (2)"Home-basedbusiness",anybusinessoperatedinaresidential
5 dwellingthatmanufactures,provides,orsellsgoodsorservicesandthatis
6 ownedandoperatedbytheownerortenantoftheresidentialdwelling.
7 2.Anypersonwhoresidesinaresidentialdwellingmayusethe
8 residentialdwellingforahome-basedbusinessunlesssuchuseisrestrictedby:
9 (1)Anydeedrestriction,covenant,oragreementrestrictingtheuseof
10 land;or
11 (2)Anymasterdeed,bylaw,orotherdocumentapplicabletoa
12 common-interestownershipcommunity.
13 3.Exceptasprescribedundersubsection4ofthissection,apolitical
14 subdivisionshallnotprohibittheoperationofano-impact,home-based
15 businessorotherwiserequireapersontoapplyfor,registerfor,orobtainany
16 permit,license,variance,orothertypeofpriorapprovalfromthepolitical
17 subdivisiontooperateano-impact,home-basedbusiness.Forthepurposesof
18 thissection,ahome-basedbusinessqualifiesasanoimpact,home-based
19 businessif:
20 (1)Thetotalnumberofemployeesandclientsonsiteatonetimedoes
21 notexceedtheoccupancylimitfortheresidentialdwelling;and
22 (2)Theactivitiesofthebusiness:
23 (a)Arelimitedtothesaleoflawfulgoodsandservices;
24 (b)Mayinvolvehavingmorethanoneclientonthepropertyatone
25 time;
26 (c)Donotcauseasubstantialincreaseintrafficthroughtheresidential
27 area;
28 (d)Donotviolateanyparkingregulationsestablishedbythepolitical
29 subdivision;
30 (e)Occurinsidetheresidentialdwellingorintheyardofthe
31 residentialdwelling;
32 (f)Arenotvisiblefromthestreet;and
33 (g)Donotviolateanynarrowlytailoredregulationestablishedunder
34 subsection4ofthissection.
35 4.Apoliticalsubdivisionmayestablishreasonableregulationsona
36 home-basedbusinessiftheregulationsarenarrowlytailoredforthepurpose
37 of:
HB978	4 38 (1)Protectingthepublichealthandsafety,includingregulations
39 relatedtofireandbuildingcodes,healthandsanitation,transportationor
40 trafficcontrol,solidorhazardouswaste,pollution,andnoisecontrol;or
41 (2)Ensuringthatthebusinessactivityiscompliantwithstateand
42 federallawandpayingapplicabletaxes.
43 5.Nopoliticalsubdivisionshallrequireaperson,asaconditionof
44 operatingahome-basedbusiness,to:
45 (1)Rezonethepropertyforcommercialuse;
46 (2)Obtainahome-basedbusinesslicense;or
47 (3)Installorequipfiresprinklersinasingle-familydetached
48 residentialdwellingoranyresidentialdwellingwithnomorethantwo
49 dwellingunits.
50 6.Whetheraregulationcomplieswiththissectionisajudicial
