SectionA.Chapter444,RSMo,isamendedbyaddingtheretotwonewsections,tobe
2knownassections444.779and444.781,toreadasfollows:
444.779.1.Asusedinthissection,thefollowingwordsmean:
2 (1)"County",acountyinthisstateinwhichanyportionoftheLamotte
3Sandstonegeologicformationislocated;
4 (2)"Healthboard",acounty'sboardofhealthortheequivalentcountyentity.
5 2.Acountycommissionorhealthboard,orboth,mayenactreasonable
6ordinances,orders,orregulationsapplicabletoanyminingorsurfaceminingconducted
7inanyportionoftheLamotteSandstonegeologicformationlocatedinsuchcounty.
8 3.Anyordinance,order,orregulationenactedunderthissectionmayimpose
9requirementsandstandardsdeemednecessarybylocalelectedofficialstoprotectthe
10publichealth,publicsafety,propertyvalues,ortheenvironment.Notwithstandingany
11otherprovisionoflawtothecontrary,noprovisionofsections444.760to444.790shall
12beconstruedtoprohibitacountycommissionorhealthboardfromadoptingand
13enforcinglocalordinances,orders,orregulationsthatareequaltoormorestringent
14thantherulesorregulationsadoptedbythedepartmentundersections444.760to
15444.790.
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 16 4.Anyordinance,order,orregulationenactedunderthissectionwillbe
17construedtosupplementexistingstatelawandshallnotbeconstruedtoconstitute
18zoningunderchapter64.
19 5.Anyordinance,order,orregulationenactedunderthissectionshallnotbe
20construedtoapplytoanyexistingminingorsurfaceminingactivityinactiveoperation
21asofJanuary1,2022,thatisconductedinanyportionoftheLamotteSandstone
22geologicformationortoanyminingorsurfaceminingactivitynotconductedinthe
23LamottegeologicSandstoneformation.
24 6.Toprotectthepublichealth,publicsafety,propertyvalues,andthe
25environment,theprovisionsofthissectionshallbeconstruedtoapplytoanysuch
26ordinance,order,orregulationenactedbyacountycommissionorhealthboardonor
27afterJanuary1,2022.
444.781.1.Thissectionshallnotapplytoanyminingfacilityactivelyengagedin
2theminingoftheLamotteSandstonegeologicformationpriortoAugust28,2023.
3 2.Exceptasprovidedinsubsection1ofthissection,anyoperatordesiringto
4engageintheminingoftheLamotteSandstonegeologicformationforSandstoneor
5silicasandshallcomplywiththerequirementsinsection444.772andthissection.
6 3.Anapplicantshallsubmitapermitapplicationtothedepartment.Inaddition
7totheapplicationinformationrequiredinsubsection2ofsection444.772,anapplication
8subjecttothissectionshallinclude:
9 (1)Evidenceoftheapplicant'slegalrighttominethelandaffectedbythe
10permit,whichshallbeestablishedbyacurrentleaseagreementvestingtheaffected
11mineralrightsintheapplicant,adeedvestingtheaffectedmineralrightsinthe
12applicant,orevidenceoftheapplicant'sfeeownershipofthepropertyandaffected
13mineralrights;and
14 (2)Suchotherinformationthatthecommissionmayrequire.
15 4.Anapplicantshalldemonstratethatthepropertylinesofthemineplanarea
16shallbelocatedatleasttwothousandsixhundredfortyfeetorone-halfofamilefrom:
17 (1)Thedefinedincorporatedlimitsofanycity,town,orvillage;
18 (2)Anyschoolorpropertyownedandoperatedbyanyschooldistrictor
19accreditededucationalinstitutionthathasbeeninexistenceforatleastfiveyears;
20 (3)Anychurchorplaceofworship;
21 (4)Anyplattedsubdivision;
22 (5)Anypark,ballfield,orotherpublicrecreationalarea;or
23 (6)Anypublicorprivatewellusedforpurposesofsupplyingwaterfordomestic
24orindustrialuse.Thissubdivisionshallnotbeconstruedtoapplytoanywellusedsolely
25andexclusivelyforlivestockwatering.
HB982	2 26 5.Anapplicantshalldemonstratethatthepropertylinesofthemineplanarea
27willbelocatedatleastonethousandthreehundredtwentyfeetorone-fourthofamile
28from:
29 (1)Anyoccupiedresidentialdwelling;
30 (2)Anycaveorsinkhole;
31 (3)Anylosingstreamortributaryofanylosingstream;
32 (4)Anystreamsegmentortributarythereofofanydepartment-designated
33outstandingstateresourcewaters;or
34 (5)Anystreamsegmentortributarythereofthathasabeneficialusedesignation
35bythedepartment.
36 6.Allsetbackdistancesdescribedinsubsections4and5ofthissectionshallbe
37measuredfromthenearestcornerorfoundationofsuchpropertiesorlistedfeaturesin
38astraightlinetotheclosestpropertylineofthemineplanarea.
39 7.Thesetbackdistancesdescribedinsubsections4and5ofthissectionmaybe
40modifiedthroughexistingorfuturewrittenleases,easements,orotheragreements
41betweentheapplicantoroperatorofthemineandtheaffectedresidenceoradjoining
42landowner,asthecaserequires.
43 8.Inadditiontotheapplicationinformationrequiredinsubsection4ofsection
44444.772,anapplicationsubjecttothissectionshallinclude:
45 (1)Anapplicationfeeintheamountoffivethousanddollars;and
46 (2)Afeeforeachacrebondedbytheoperatorundersection444.778inthe
47amountofonethousanddollarsperacre.
48 9.Inadditiontotherequirementsinsubsection10ofsection444.772,the
49operatorshallsendnoticeofintenttooperateasurfaceminebycertifiedmailtothe
50governingbodyofthecountiesorcitiesinwhichtheproposedareaislocated,andtothe
51lastknownaddressesofallrecordlandownerswhosepropertyiswithinfivethousand
52twohundredeightyfeetoronemilefromtheborderoftheproposedmineplanarea.
53 10.Anypersonwithadirect,personalinterestinoneormoreofthefactorsthe
54directormayconsiderinissuingapermitmayrequestapublicmeetingorfilewritten
55commentstothedirectornotlaterthanfifteendaysfollowingthefinalpublicnotice
56publicationdate.Uponsuchrequest,theapplicantshallconductapublicmeetingand
57shallcoordinatewiththedirectorinmakingallnecessaryarrangementsforthepublic
58meeting,whichshallbeheldinareasonablyconvenientlocationandatareasonable
59timeforinterestedparticipantstoattend,andtheapplicantshallbearallexpenses.
60 11.Allapplicationsforapermitshallbefiledwiththedirector,whoshall
61promptlyinvestigatetheapplicationtoensuretheapplicationcomplieswiththe
62requirementsinsection444.772andthissection.Followingsuchinvestigation,the
HB982	3 63directorshallmakeadecisionwithinsixweeksafterthepublicmeeting.Ifthedirector
64determinesthattheapplicationhasfullycompliedwiththegeneralrequirementsin
65section444.772,thespecificrequirementsinthissection,andanyrulesorregulations
66promulgatedundersection444.772orthissection,thedirectorshallissueapermit.If
67thedirectordeterminesthattheapplicationdoesnotfullycomplywiththeprovisionsof
68section444.772,thissection,oranyrulesorregulationspromulgatedundersection
69444.772orthissection,thedirectorshalldenythepermitapplication.Thedirectorshall
70consideranypubliccommentswhenmakingthedecisiontoissueordenythepermit.In
71issuingapermit,thedirectormayimposereasonableconditionsconsistentwiththe
72provisionsofsections444.760to444.790.Thedirector'sdecisionshallbedeemedtobe
73thedecisionofthedirectorofthedepartmentofnaturalresourcesandshallbesubject
74toappealbyanyaffectedpartytotheadministrativehearingcommissionasprovidedin
75sections640.013and621.250.
76 12.FeesimposedunderthissectionshallbecomeeffectiveAugust28,2023,and
77shallexpireonDecember31,2028.Nootherprovisionsofthissectionshallexpire.
