15forsuchoverrulingarespreaduponitsminutes,whichreasonsshallalsobecertifiedtothe
16countyplanningcommission.

64.820.1.Fromandaftertheadoptionoftheofficialmasterplanorportionthereof
2anditspropercertificationandrecording,thereafternoimprovementofatypeembraced
3withintherecommendationsoftheofficialmasterplan,orpartthereof,shallbeconstructedor
4authorizedwithoutfirstsubmittingtheproposedplansthereoftothecountyplanning
5commissionandreceivingthewrittenapprovalorrecommendationsofthecommission.This
6requirementshallbedeemedtobewaivedifthecountyplanningcommissionfailstomakeits
7reportandrecommendationswithinforty-fivedaysafterreceiptoftheproposedplans.
8 2.(1)Inthecaseofanypublicimprovementsponsoredorproposedtobemadeby
9anymunicipalityorotherpoliticalorcivilsubdivisionofthestate,orpublicboard,

11planningcommissionmaybeoverruledbyatwo-thirdsvote,properlyenteredofrecordand

16 (2)Notwithstandingtheprovisionsofsubdivision(1)ofthissubsection,aboard
17governingalibraryestablishedunderchapter182shallnothavethepowertooverrule

65.665.1.Fromandaftertheadoptionoftheofficialmasterplanorportionthereof
2anditspropercertificationandrecording,thereafternoimprovementofatypeembraced
3withintherecommendationsofsuchofficialmasterplanorpartthereofshallbeconstructed
4orauthorizedwithoutfirstsubmittingtheproposedplansthereoftothetownshipplanning
5commissionandreceivingthewrittenapprovalorrecommendationsofthetownshipplanning
6commission.Thisrequirementshallbedeemedtobewaivedifthetownshipplanning
7commissionfailstomakeitsreportandrecommendationswithinforty-fivedaysafterreceipt
8oftheproposedplans.
9 2.(1)Inthecaseofanypublicimprovementsponsoredorproposedtobemadeby
10anymunicipalityorotherpoliticalorcivilsubdivisionofthestate,orpublicboard,

19thedisapprovalorrecommendationsofthetownshipplanningcommission.
89.380.1.Wheneverthecommissionadoptstheplanofthemunicipalityoranypart
2thereof,nostreetorotherpublicfacilities,ornopublicutility,whetherpubliclyorprivately
3owned,and,thelocation,extentandcharacterthereofhavingbeenincludedinthe
4recommendationsandproposalsoftheplanorportionsthereof,shallbeconstructedor
5authorizedinthemunicipalityuntilthelocation,extentandcharacterthereofhasbeen
6submittedtoandapprovedbytheplanningcommission.
7 2.Incaseofdisapprovalthecommissionshallcommunicateitsreasonstothe
8council,andthecouncil,byvoteofnotlessthantwo-thirdsofitsentiremembership,may
9overrulethedisapprovaland,upontheoverruling,thecouncilortheappropriateboardor
10officermayproceed[, exceptthat].
11 3.Notwithstandingtheprovisionsofsubsection2ofthissection,ifthepublic
12facilityorutilityisonetheauthorizationorfinancingofwhichdoesnotfallwithinthe
13provinceofthecouncil,[then] thefollowingprovisionsshallapply:
14 (1)Thesubmissiontotheplanningcommissionshallbebytheboardhaving
15jurisdiction[,]; and
16 (2)Theplanningcommission'sdisapprovalmaybeoverruledby[that] theboard
17describedinsubdivision(1)ofthissubsectionbyavoteofnotlessthantwo-thirdsofits
18entiremembership, exceptthataboardgoverningalibraryestablishedunderchapter
19182shallnothavethepowertooverruletheplanningcommission'sdisapproval.
20 4.Theacceptance,widening,removal,extension,relocation,narrowing,vacation,
21abandonment,changeofuse,acquisitionoflandfor,saleorleaseofanystreetorotherpublic
22facilityissubjecttosimilarsubmissionandapproval,andthefailuretoapprovemaybe
23similarlyoverruledtotheextentallowedundersubsection3ofthissection.
24 5.Thefailureofthecommissiontoactwithinsixtydaysafterthedateofofficial
25submissiontoitshallbedeemedapproval.
143.183.1.Asusedinthissection,thefollowingtermsmean:
2 (1)"Nonresidententertainer",apersonresidingorregisteredasacorporationoutside
3thisstatewho,forcompensation,performsanyvocal,instrumental,musical,comedy,
4dramatic,danceorotherperformanceinthisstatebeforealiveaudienceandanyotherperson
5travelingwithandperformingservicesonbehalfofanonresidententertainer,includinga
6nonresidententertainerwhoispaidcompensationforprovidingentertainmentasan
7independentcontractor,apartnershipthatispaidcompensationforentertainmentprovidedby
8nonresidententertainers,acorporationthatispaidcompensationforentertainmentprovided

10providedbynonresidententertainers;
11 (2)"Nonresidentmemberofaprofessionalathleticteam",aprofessionalathleticteam
12memberwhoresidesoutsidethisstate,includinganyactiveplayer,anyplayeronthedisabled
13listifsuchplayerisinuniformonthedayofthegameatthesiteofthegame,andanyother
14persontravelingwithandperformingservicesonbehalfofaprofessionalathleticteam;
15 (3)"Personalserviceincome"includesexhibitionandregularseasonsalariesand
16wages,guaranteedpayments,strikebenefits,deferredpayments,severancepay,bonuses,and
17anyothertypeofcompensationpaidtothenonresidententertainerornonresidentmemberof
18aprofessionalathleticteam,butdoesnotincludeprizes,bonusesorincentivemoneyreceived
19fromcompetitioninalivestock,equineorrodeoperformance,exhibitionorshow;
20 (4)"Professionalathleticteam"includes,butisnotlimitedto,anyprofessional
21baseball,basketball,football,soccerandhockeyteam.
22 2.Anyperson,venue,orentitywhopayscompensationtoanonresidententertainer
23shalldeductandwithholdfromsuchcompensationasaprepaymentoftaxanamountequalto
24twopercentofthetotalcompensationiftheamountofcompensationisinexcessofthree
25hundreddollarspaidtothenonresidententertainer.Forpurposesofthissection,theterm
26"person,venue,orentitywhopayscompensation"shallnotbeconstruedtoincludeany
27person,venue,orentitythatisexemptfromtaxationunder26U.S.C.Section501(c)(3),as
28amended,andthatpaysanamounttothenonresidententertainerfortheentertainer's
29appearancebutreceivesnobenefitfromtheentertainer'sappearanceotherthanthe
30entertainer'sperformance.
31 3.Anyperson,venue,orentityrequiredtodeductandwithholdtaxpursuantto
32subsection2ofthissectionshall,foreachcalendarquarter,onorbeforethelastdayofthe
33monthfollowingthecloseofsuchcalendarquarter,remitthetaxeswithheldinsuchformor
34returnasprescribedbythedirectorofrevenueandpayovertothedirectorofrevenueortoa
35depositorydesignatedbythedirectorofrevenuethetaxessorequiredtobedeductedand
36withheld.
37 4.Anyperson,venue,orentitysubjecttothissectionshallbeconsideredanemployer
38forpurposesofsection143.191,andshallbesubjecttoallpenalties,interest,andadditionsto
39taxprovidedinthischapterforfailuretocomplywiththissection.
40 5.Notwithstandingotherprovisionsofthischaptertothecontrary,thecommissioner
41ofadministration,foralltaxableyearsbeginningonorafterJanuary1,1999,butnoneafter
42December31,2030,shallannuallyestimatetheamountofstateincometaxrevenues
43collectedpursuanttothischapterwhicharereceivedfromnonresidentmembersof
44professionalathleticteamsandnonresidententertainers.Forfiscalyear2000,andforeach
45subsequentfiscalyearforaperiodofthirty-oneyears,sixtypercentoftheannualestimateof

47shallbeallocatedannuallytotheMissouriartscounciltrustfund,andshallbetransferred,
48subjecttoappropriations,fromthegeneralrevenuefundtotheMissouriartscounciltrust
49fundestablishedinsection185.100andanyamounttransferredshallbeinadditiontosuch
50agency'sbudgetbaseforeachfiscalyear.Thedirectorshallbyruleestablishthemethodof
51determiningtheportionofpersonalserviceincomeofsuchpersonsthatisallocableto
52Missouri.
53 6.Notwithstandingtheprovisionsofsections186.050to186.067tothecontrary,the
54commissionerofadministration,foralltaxableyearsbeginningonorafterJanuary1,1999,
55butfornoneafterDecember31,2030,shallestimateannuallytheamountofstateincometax
56revenuescollectedpursuanttothischapterwhicharereceivedfromnonresidentmembersof
57professionalathleticteamsandnonresidententertainers.Forfiscalyear2000,andforeach
58subsequentfiscalyearforaperiodofthirty-oneyears,tenpercentoftheannualestimateof
59taxesgeneratedfromthenonresidententertainerandprofessionalathleticteamincometax
60shallbeallocatedannuallytotheMissourihumanitiescounciltrustfund,andshallbe
61transferred,subjecttoappropriations,fromthegeneralrevenuefundtotheMissouri
62humanitiescounciltrustfundestablishedinsection186.055andanyamounttransferredshall

64 7.Notwithstandingotherprovisionsofsection182.812tothecontrary,the

76 8.Notwithstandingotherprovisionsofsection185.200tothecontrary,the
77commissionerofadministration,foralltaxableyearsbeginningonorafterJanuary1,1999,
78butfornoneafterDecember31,2030,shallestimateannuallytheamountofstateincometax
79revenuescollectedpursuanttothischapterwhicharereceivedfromnonresidentmembersof
80professionalathleticteamsandnonresidententertainers.Forfiscalyear2000,andforeach
81subsequentfiscalyearforaperiodofthirty-oneyears,tenpercentoftheannualestimateof
82taxesgeneratedfromthenonresidententertainerandprofessionalathleticteamincometax
HCSHB986	5 83shallbeallocatedannuallytotheMissouripublictelevisionbroadcastingcorporationspecial
84fund,andshallbetransferred,subjecttoappropriations,fromthegeneralrevenuefundtothe
85Missouripublictelevisionbroadcastingcorporationspecialfund,andanyamounttransferred
86shallbeinadditiontosuchagency'sbudgetbaseforeachfiscalyear;provided,however,that
87twenty-fivepercentofsuchallocationshallbeusedforgrantstopublicradiostationswhich
88werequalifiedbythecorporationforpublicbroadcastingasofNovember1,1996.Such
89grantsshallbedistributedtoeachofsuchpublicradiostationsinthisstateafterreceiptofthe
90station'scertificationofoperatingandprogrammingexpensesforthepriorfiscalyear.
91Certificationshallconsistofthemostrecentfiscalyearfinancialstatementsubmittedbya
92stationtothecorporationforpublicbroadcasting.Thegrantsshallbedividedintotwo
93categories,anannualbasicservicegrantandanoperatinggrant.Thebasicservicegrantshall
94beequaltothirty-fivepercentofthetotalamountandshallbedividedequallyamongthe
95publicradiostationsreceivinggrants.Theremainingamountshallbedistributedasan
96operatinggranttothestationsonthebasisoftheproportionthatthetotaloperatingexpenses
97oftheindividualstationinthepriorfiscalyearbearstotheaggregatetotalofoperating
98expensesforthesamefiscalyearforallMissouripublicradiostationswhicharereceiving
99grants.
100 9.Notwithstandingotherprovisionsofsection253.402tothecontrary,the
101commissionerofadministration,foralltaxableyearsbeginningonorafterJanuary1,1999,
102butfornoneafterDecember31,2030,shallestimateannuallytheamountofstateincometax
103revenuescollectedpursuanttothischapterwhicharereceivedfromnonresidentmembersof
104professionalathleticteamsandnonresidententertainers.Forfiscalyear2000,andforeach
105subsequentfiscalyearforaperiodofthirty-oneyears,tenpercentoftheannualestimateof
106taxesgeneratedfromthenonresidententertainerandprofessionalathleticteamincometax
107shallbeallocatedannuallytotheMissouridepartmentofnaturalresourcesMissourihistoric
108preservationrevolvingfund,andshallbetransferred,subjecttoappropriations,fromthe
109generalrevenuefundtotheMissouridepartmentofnaturalresourcesMissourihistoric
110preservationrevolvingfundestablishedinsection253.402andanyamounttransferredshall
111beinadditiontosuchagency'sbudgetbaseforeachfiscalyear.
112 10.Thissectionshallnotbeconstruedtoapplytoanypersonwhomakesa
113presentationforprofessionalortechnicaleducationpurposesortoapplytoanypresentation
114thatispartofaseminar,conference,convention,school,orsimilarprogramformatdesigned
115toprovideprofessionalortechnicaleducation.
182.645.1.ThefiscalyearforeachconsolidatedpubliclibrarydistrictshallbeJuly
2firsttoJunethirtiethunlessotherwisesetbytheboardoftrustees, andeachyearthe
3librarianshallsubmittotheboardoftrusteesabudgetfortheforthcomingfiscalyear.The
4boardshallapprovethebudgetaftermakinganychangesthereinthatitdeemsnecessary.The
HCSHB986	6 5budgetshallbeapprovedonorbefore[Junethirtieth] thelastdayofthefiscalyear
6precedingthefiscalyearforwhichthebudgetwasprepared.Theboardonitsownmotionor
7attherequestofthelibrarian,fromtimetotime,mayamendormodifytheapprovedbudget.
8Acopyoftheapprovedbudgetshallbefiledwitheachcountycommissionorcounty
9executiveofficeofthecountiescomprisingtheconsolidatedpubliclibrarydistrict,andwith
10thestateauditor.
11 2.Thetreasureroftheboardoftrusteesofaconsolidatedpubliclibrarydistrictshall
12receiveandbethecustodianofallmoneybelongingtothedistrictfromwhateversource
13derived.Allfundsoftheconsolidatedpubliclibrarydistrictderivedfromlocaltaxationtobe
14usedfornormaloperationsofthedistrictandreceivedfromthecountycollector,shallbekept
15inaconsolidatedlibraryoperatingfund.Allfundsbelongingtothedistrictwhicharetobe
16usedforbuildingpurposesshallbekeptinaconsolidatedlibrarybuildingfund;allfunds
17derivedfromstateaidorfederalgrants,otherthanland,buildingandfurnishinggrants,shall
18bekeptintheconsolidatedlibraryoperatingfund;andtheboardmayestablishanyother
19fundsthatitdeemsnecessary.Thetreasurershalldepositallmoneysbelongingtothe
20consolidatedpubliclibrarydistrictinthedepositariesthatareselectedbytheboardof
21trustees.Thetreasurershallalsobethecustodianofallbondsorothersecuritiesbelongingto
22theconsolidatedpubliclibrarydistrict.
23 3.Consolidatedpubliclibrarydistrictmoneysshallbedisbursedbythetreasurerby
24appropriateinstrumentofpaymentonlyupondueauthorizationoftheconsolidatedpublic
25librarydistrictboardoftrusteesanddulycertifiedforpaymentbythepresident.The
26certificationshallspecifytheamounttobepaid,towhompaymentistobemadeandthe
27purposeforwhichpaymentisbeingmade.Theboardbyresolutionmaydirectthatthe
28signatureofthepresidentortreasurerbeafacsimilesignatureinthemannerprovidedby
29sections105.273to105.278.
30 4.Noauthorizationorcertificationshallbemade,andnoinstrumentofpayment
31issuedforthepaymentofanyconsolidatedpubliclibrarydistrictindebtednessunlessthereis
32sufficientmoneyinthetreasuryandtheproperfundforthepaymentoftheindebtednessand
33beintheproperform.
34 5.Thetreasureroftheboardoftrusteesshallsubmittotheboardoftrustees,ateach
35regularlyscheduledmeetingoftheboard,anaccountingreflectingreceiptanddisbursement
36offundsbelongingtotheconsolidatedpubliclibrarydistrict.
182.819.Notwithstandinganyprovisionofthischapteroranyotherlaw,any
2realpropertyownedbyaboardgoverningalibraryestablishedunderthischaptershall
3notbeusedforanypurposethatviolatesanyzoningordinancesorregulationsadopted
4underchapter64,65,or89bythecounty,city,town,village,ortownshipinwhichthe

6shall:
7 (1)Besubjecttosuchzoningordinancesorregulationswithrespecttoitsreal
8propertywithoutregardtoanypowersoftheboardoutlinedinthischapter;and
9 (2)Nothavethepowertooverruleanydecisionrelatingtozoningadoptedunder
10chapter64,65,or89.
488.426.1.Thejudgesofthecircuitcourt,enbanc,inanycircuitinthisstatemay
2requireanypartyfilingacivilcaseinthecircuitcourt,atthetimeoffilingthesuit,todeposit
3withtheclerkofthecourtasurchargeinadditiontoallotherdepositsrequiredbylaworcourt
4rule.Sections488.426to488.432shallnotapplytoproceedingswhencostsarewaivedor
5aretobepaidbythecountyorstateoranycity.
6 2.ThesurchargeineffectonAugust28,2001,shallremainineffectuntilchangedby
7thecircuitcourt.Thecircuitcourtinanycircuit,exceptthecircuitcourtinJacksonCounty,
8thecircuitcourtinthecityofSt.Louis,orthecircuitcourtinanycircuitthatreimbursesthe
9stateforthesalariesoffamilycourtcommissionersunderandpursuanttosection487.020,
10maychangethefeetoanyamountnottoexceedfifteendollars.ThecircuitcourtinJackson
11County, thecircuitcourtinthecityofSt.Louis,orthecircuitcourtinanycircuitthat
12reimbursesthestateforthesalariesoffamilycourtcommissionersunderandpursuantto
13section487.020maychangethefeetoanyamountnottoexceedtwentydollars.Achangein
14thefeeshallbecomeeffectiveandremainineffectuntilfurtherchanged.
15 3.Sections488.426to488.432shallnotapplytoproceedingswhencostsarewaived
16orarepaidbythecountyorstateoranycity.
17 4.Inadditiontoanyfeeauthorizedbysubsection1ofthissection,anycountyofthe
18firstclassificationwithmorethanonehundredonethousandbutfewerthanonehundred
19fifteenthousandinhabitantsmayimposeanadditionalfeeoftendollarsexcludingcases
20concerningadoptionandthoseinsmallclaimscourt.Theprovisionsofthissubsectionshall
21expireonDecember31,2019.
