JOINTRESOLUTION
SubmittingtothequalifiedvotersofMissourianamendmentrepealingSection39(e)of
ArticleIIIoftheConstitutionofMissouri,andadoptingonenewsectioninlieu
thereofrelatingtogaming.
BeitresolvedbytheHouseofRepresentatives,theSenateconcurringtherein:
ThatatthenextgeneralelectiontobeheldinthestateofMissouri,onTuesdaynext
2followingthefirstMondayinNovember,2024,orataspecialelectiontobecalledbythe
3governorforthatpurpose,thereisherebysubmittedtothequalifiedvotersofthisstate,for
4adoptionorrejection,thefollowingamendmenttoArticleIIIoftheConstitutionofthestate
5ofMissouri:
SectionA.Section39(e),ArticleIII,ConstitutionofMissouri,isrepealedandone
2newsectionadoptedinlieuthereof,tobeknownasSection39(e),toreadasfollows:
Section39(e).1.ThegeneralassemblyisauthorizedtopermitupontheMississippi
2andMissouriRiversonly,whichshallincludeartificialspacesthatcontainwaterandthatare
3within1000feetoftheclosestedgeofthemainchannelofeitherofthoserivers,lotteries,gift
4enterprisesandgamesofchancetobeconductedonexcursiongamblingboatsandfloating
5facilities.Anylicenseissuedbeforeoraftertheadoptiondateofthisamendmentforany
6excursiongamblingboatorfloatingfacilitylocatedinanysuchartificialspaceshallbe
7deemedtobeauthorizedbytheGeneralAssemblyandtobeincompliancewiththisSection.

11 2.Notwithstandinganyotherprovisionoflawtothecontrary,lotteries,gift
12enterprises,andgamesofchancemaybeconductedonexcursiongamblingboatsand
13floatingfacilitieslicensedbytheMissourigamingcommissionupontheportionofthe
14OsageRiverfromtheMissouriRivertotheBagnellDam,whichshallincludeartificial
15spacesthatcontainwaterandthatarewithin1000feetofthehighwatermarkofthe
16closestedgeofthemainchanneloftheriver,asdefinedbytheU.S.ArmyCorpsof
17Engineers.
18 3.Notwithstandinganyotherprovisionoflawtothecontrary,inadditionto
19suchlicensesashavebeenauthorizedpriortoJanuary1,2023,theMissourigaming
20commissionshallissueoneadditionalexcursiongamblingboatlicense.Suchlicense
21shallbeissuedonlytoanexcursiongamblingboatthatwilloperateupontheportionof
22theOsageRiverfromtheMissouriRivertotheBagnellDam.
