No. 3347H.02C Bill No. HCS for HB 1630 Page 3 of February 27, 2024 NM:LR:OD FISCAL ANALYSIS ASSUMPTION §483.083 – Salaries of Circuit Clerks Officials from the Office of the State Courts Administrator (OSCA) assume the proposed legislation modifies provisions relating to the Salaries of Circuit Clerks. Section 483.083 states each circuit clerk shall annually receive compensation in the amount equal to sixty – two percent the annual salary of an Associate Circuit Judge. Based upon the FY25 projected Associate Circuit Judge salaries, the fiscal impact for Circuit Clerks would be a cost of $ 3,358,248. Oversight does not have information to the contrary and therefore, Oversight will reflect the estimate as provided by the OSCA. Oversight notes OSCA did not respond to the request for fiscal impact for the original bill in time for the fiscal note to be prepared for the hearing. Oversight assumes OSCA’s amount represents the salary portion only for this proposal. Using a 37% fringe benefit rate, Oversight has estimated the new circuit clerks cost as follows: Therefore, Oversight will reflect an annual cost of $4,600,800 for this proposal. FISCAL DESCRIPTION Currently, salaries for circuit clerks are established in statute and vary by county classification. As specified in this bill, the annual salaries of circuit clerks shall be equal to 62% of the annual salaries of associate circuit judges, as established in Section 476.405, RSMo. This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
