Toamendchapter575,RSMo,byaddingtheretoonenewsectionrelatingtotheoffenseof
aggravatedfleeingastopordetentionofamotorvehicle,withpenaltyprovisions.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Chapter575,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection575.151,toreadasfollows:
575.151.1.Thissectionshallbeknownandmaybecitedas"Valentine'sLaw".
2 2.Apersoncommitstheoffenseofaggravatedfleeingastopordetentionofa
3motorvehicleifheorsheknowsorreasonablyshouldknowthatalawenforcement
4officerisattemptingtodetainorstopamotorvehicle,andforthepurposeofpreventing
5theofficerfromeffectingthestopordetention,heorshefleesand:
6 (1)Suchpersonoperatesamotorvehicleatahighspeedorinanymanner
7whichcreatesasubstantialriskofseriousphysicalinjuryordeathtoanyperson;
8 (2)Asaresultofsuchflightcausesphysicalinjurytoanotherperson;or
9 (3)Asaresultofsuchflightcausesdeathtoanotherperson.
10 3.Apersonispresumedtobefleeingavehiclestopordetentionifheorshe
11continuestooperateamotorvehicleafterheorshehasseenorreasonablyshouldhave
12seenclearlyvisibleemergencylightsorhasheardorreasonablyshouldhaveheardan
13audiblesignalemanatingfromthelawenforcementvehiclepursuinghimorher.
14 4.Itisnodefensetoaprosecutionpursuanttosubsection2ofthissectionthat
15thelawenforcementofficerwasactingunlawfullyinmakingthearrest.However,
16nothinginthissectionshallbeconstruedtobarcivilsuitsforunlawfularrest.Aperson

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17neednotknowthebasisforthearrest,detention,orstop,onlythatthepersonwasbeing
18stoppedordetained.
19 5.Theoffenseofaggravatedfleeingastopordetentioninviolationof
20subdivision(1)ofsubsection2ofthissectionshallbeaclassDfelony,withouteligibility
21forprobation,parole,orconditionalreleaseuntilthedefendanthasservednolessthan
22oneyearofsuchsentence.Theoffenseofaggravatedfleeingastopordetentionin
23violationofsubdivision(2)ofsubsection2ofthissectionshallbeaclassBfelony.The
24offenseofaggravatedfleeingastopordetentioninviolationofsubdivision(3)of
25subsection2ofthissectionshallbeaclassAfelony.
