2sections,tobeknownassections27.110,56.930,56.933,and106.320,toreadasfollows:
27.110.Theattorneygeneralshallcompileastatewidereportsummarizingthe
2informationprovidedbyeachprosecutingandcircuitattorneyundersection56.933ina
3uniformfashionandsortablebyoffenseandjurisdiction.Thereportshallbemade
4availabletothepublicandsubmittedtothegovernorandthespeakerofthehouseof
5representativesandthepresidentprotemporeofthesenate,whoshalldistributethe
6reporttothecommitteeshavingjurisdictionoverjudiciarymatters.
56.930.Inanycountyormunicipalityinwhichthegovernorfindsthatthe
2prosecutingorcircuitattorneyhasfailedtoexecutethedutiesassignedorisunableto
3competentlyorfaithfullyexecutesuchdutiesinextraordinarycircumstances,including
4publiccorruption,publiclawlessnessordisorder,orpersistentandwidespreadunsolved
5orunprosecutedcriminalactivity,thegovernormayappointqualifiedspecial
6prosecutorswithconcurrentauthoritytoprosecuteoffensesorcasesdesignatedby
7thegovernorinthatcountyormunicipality.Suchspecialprosecutorsshallbeemployed
8andcompensatedbytheattorneygeneral.Thegovernorshallhavediscretiontoappoint
9specialprosecutorseitherunderthedirectionoforindependentfromtheattorney
10general.Apersonappointedtoserveasaspecialprosecutorshallhavethesamepowers
11astheprosecutingorcircuitattorneyofthecountyormunicipality,includingequal

56.933.Ifaprosecutingorcircuitattorneydeclinestofileanindictmentor
2informationordoesnotfileanindictmentorinformationwithinthirtydaysofanarrest
3oriftheattorneygeneraldeterminesthataprosecutingorcircuitattorneyisnot
4activelyorproperlyinvestigatinganoffense,theattorneygeneralmayassumethe
5authoritytoinvestigateorprosecuteanoffense.Insuchcircumstances,theattorney
6generalshallhavethesamepowersastheprosecutingorcircuitattorneyofthecounty
7ormunicipality,includingequalaccesstoallrelevantinvestigativeandprosecutorial
8materials,resources,andauthoritiesoftheprosecutingorcircuitattorney.
106.320.Thegovernormaysuspendfromofficeanyprosecutingorcircuit
2attorney,orassistantthereof,forthatattorney'sneglectorfailuretoperformtheduties
3oftheoffice.Suchneglectorfailuretoperformthedutiesoftheofficeincludes
4instancesinwhichtheattorneyfailstoperformsomedutyrequiredofhimorherfor
5reasonsincluding,butnotlimitedto,willfulness,malice,ignorance,oversight,or
6incompetence.Ifthegovernorsuspendsaprosecutingorcircuitattorneyunderthis
7section,thegovernorshallappointaninterimprosecutingorcircuitattorneytoservein
8thatpositionuntilthenextregularlyscheduledelection.
