4countyandtheprosecutingattorneyofeachcountyorthecircuitattorneyofacitynotwithin
5acountyshallsubmitcertaincriminalarrest,charge,anddispositioninformationtothe
6centralrepositoryforfilingwithoutunduedelayintheformandmannerrequiredbysections

8 2.Alllawenforcementagenciesmakingmisdemeanorandfelonyarrestsas
9determinedbysection43.506shallfurnishwithoutunduedelay,tothecentralrepository,
10fingerprints,photograph,andifavailable,anyotheruniquebiometricidentificationcollected,
11charges,appropriatechargecodes,anddescriptionsofallpersonswhoarearrestedforsuch
12offensesonstandardfingerprintformssuppliedorapprovedbythehighwaypatrolor
13electronicallyinaformatandmannerapprovedbythehighwaypatrolandincompliancewith

15IdentificationSystemoritssuccessorprogram.Allsuchagenciesshallalsonotifythecentral
16repositoryofalldecisionsnottorefersucharrestsforprosecution.Anagencymakingsuch
17arrestsmayenterintoarrangementswithotherlawenforcementagenciesforthepurposeof
18furnishingwithoutunduedelaysuchfingerprints,photograph,andifavailable,anyother
19uniquebiometricidentificationcollected,charges,appropriatechargecodes,anddescriptions
20tothecentralrepositoryuponitsbehalf.
21 3.InorderfortheMissouriofficeofprosecutionservicestomaintaincomplete
22andaccuratestatewidereports,beginningJanuary1,2027,andthereafter,allpolice
23officersofthisstate,thesheriffandeachdeputysheriffofeachcounty,andthechieflaw
24enforcementofficialofacitynotwithinacountyandhisorherofficersshallsubmit
25referralsforanytrafficviolation,ordinanceviolation,ormisdemeanororfelonyoffense
26referredtoaprosecutingorcircuitattorneyintheformandmannerapprovedbythe
27Missouriofficeofprosecutionservicesasrequiredbysubdivision(7)ofsubsection1of
28section56.750.Ataminimum,anyreferralforafelonyoffenseshallincludeaprobable
29causestatementandaninvestigativereport.
30 4.Ininstanceswhereanindividuallessthanseventeenyearsofageandnotcurrently
31certifiedasanadultistakenintocustodyforanoffensewhichwouldbeafelonyifcommitted
32byanadult,thearrestingofficershalltakefingerprintsforthecentralrepository.These
33fingerprintsshallbetakenonfingerprintcardssuppliedbyorapprovedbythehighwaypatrol
34ortransmittedelectronicallyinaformatandmannerapprovedbythehighwaypatrolandin
35compliancewiththestandardssetbytheFederalBureauofInvestigationinitsAutomated
36FingerprintIdentificationSystemoritssuccessorprogram.Thefingerprintcardsshallbeso
37constructedthatthenameofthejuvenileshouldnotbemadeavailabletothecentral
38repository.Theindividual'snameandtheuniquenumberassociatedwiththefingerprintsand
39otherpertinentinformationshallbeprovidedtothecourtofjurisdictionbytheagencytaking
40thejuvenileintocustody.Thejuvenile'sfingerprintsandotherinformationshallbe
41forwardedtothecentralrepositoryandthecourtswithoutunduedelay.Thefingerprint
42informationfromthecardshallbecapturedandstoredintheautomatedfingerprint
43identificationsystemoperatedbythecentralrepository.Intheeventthefingerprintsare
44foundtomatchothertenprintsorunsolvedlatentprints,thecentralrepositoryshallnotifythe
45submittingagencywhoshallnotifythecourtofjurisdictionasperlocalagreement.Under
46section211.031,ininstanceswhereajuvenileoverfifteenandone-halfyearsofageisalleged
47tohaveviolatedastateormunicipaltrafficordinanceorregulation,whichdoesnotconstitute
48afelony,andthejuvenilecourtdoesnothavejurisdiction,thejuvenileshallnotbe
49fingerprintedunlesscertifiedasanadult.
HCSHB1763	2 50 [4.]5.Uponcertificationoftheindividualasanadult,thecertifyingcourtshallorder
51alawenforcementagencytoimmediatelyfingerprintandphotographtheindividualand
52certificationpaperswillbeforwardedtotheappropriatelawenforcementagencywiththe
53orderforfingerprinting.Thelawenforcementagencyshallsubmitsuchfingerprints,
54photograph,andcertificationpaperstothecentralrepositorywithinfifteendaysandshall
55furnishtheoffensecyclenumberassociatedwiththefingerprintstotheprosecutingattorney
56orthecircuitattorneyofacitynotwithinacountyandtotheclerkofthecourtorderingthe
57subjectfingerprinted.Ifthejuvenileisacquittedofthecrimeandisnolongercertifiedasan
58adult,theprosecutingattorneyshallnotifywithinfifteendaysthecentralrepositoryofthe
59changeofstatusofthejuvenile.Recordsofachildwhohasbeenfingerprintedand
60photographedafterbeingtakenintocustodyshallbeclosedrecordsasprovidedundersection

103biometricidentificationcollected,forwardedtothecentralrepository,normallyobtainedfrom
104apersonatthetimeofthearrest,maybeobtainedatanytimethesubjectisinthecriminal
105justicesystemorcommittedtothedepartmentofmentalhealth.Alawenforcementagency
106orthedepartmentofcorrectionsmayfingerprint,photograph,andcaptureanyotherunique
107biometricidentificationofthepersonunlesscollectingotheruniquebiometricidentification
108ofthepersonisnotfinanciallyfeasibleforthelawenforcementagency,andobtainthe
109necessaryinformationatanytimethesubjectisincustody.Ifatthetimeofanycourt
110appearance,thedefendanthasnotbeenfingerprintedandphotographedforanoffensein
111whichafingerprintandphotographisrequiredbystatutetobecollected,maintained,or
112disseminatedbythecentralrepository,thecourtshallorderalawenforcementagencyor
113courtmarshaltofingerprintandphotographimmediatelythedefendant.Theorderfor
114fingerprintsshallcontaintheoffense,chargecode,dateofoffense,andanyotherinformation
115necessarytocompletethefingerprintcard.Thelawenforcementagencyorcourtmarshal
116shallsubmitsuchfingerprints,photograph,andifavailable,anyotheruniquebiometric
117identificationcollected,tothecentralrepositorywithoutunduedelayandwithinthirtydays
118andshallfurnishtheoffensecyclenumberassociatedwiththefingerprintstotheprosecuting

121 [9.]10.Thedepartmentofcorrectionsandthedepartmentofmentalhealthshall
122furnishthecentralrepositorywithallinformationconcerningthereceipt,escape,execution,
123death,release,pardon,parole,commutationofsentence,grantingofexecutiveclemency,

125custodyforanyoffenseswhicharemandatedbylawtobecollected,maintainedor

[56.265.1.Thecountyprosecutingattorneyinanycounty,otherthan
2 inacharteredcounty,shallreceiveanannualsalarycomputedusingthe

31 3.Tenpercentofthesalaryshallbepayabletoanyprosecutingattorneyonlyif
32theprosecutingattorneyhascollectedthedatadescribedinsubsection2ofsection
3356.750inamannerapprovedbytheprosecutorscoordinatorstrainingcounciland
34makesthedatadescribedinsubsection2ofsection56.750readilyaccessibletothe
35Missouriofficeofprosecutionservices.TheMissouriofficeofprosecutionservicesshall
36provideacertificateofcompliancetoeachprosecutingattorneywhocomplieswiththis
37subsectionandshallsendalistofanycertifiedprosecutingattorneytotherespective
38treasurerofeachcountyorcitynotwithinacounty.
39 4.Fivepercentofthesalaryshallbepayabletoanyprosecutingattorneyonlyif
40theprosecutingattorneyhasprovideddiscoveryinamannerapprovedbythe
41prosecutorscoordinatorstrainingcouncil.TheMissouriofficeofprosecutionservices
42shallprovideacertificateofcompliancetoeachprosecutingattorneywhocomplieswith
43thissubsectionandshallsendalistofanycertifiedprosecutingattorneytothe
44respectivetreasurerofeachcountyorcitynotwithinacounty.
45 5.Asusedinthissection,theterm"prosecutingattorney"includesthecircuitattorney

47 [4.]6.Theprosecutingattorneyofanycountywhichbecomesacountyofthefirst
48classificationduringafour-yeartermofofficeoracountywhichpassedtheproposition

56.602.1.The"ProsecutingandCircuitAttorneyReviewCommittee"ishereby
2establishedtoreviewcomplaintsformallylodgedwiththecommitteeasprovidedinthis
3section.
4 2.Theprosecutingandcircuitattorneyreviewcommitteeshallhavefive
5members.Themembersshallinclude:
6 (1)TheexecutivedirectorfortheMissouriofficeofprosecutionservices
7(MOPS);and
8 (2)Fourcurrentorformerelectedprosecutingorcircuitattorneys.These
9membersshallbeappointedbytheprosecutorscoordinatorstrainingcouncil.Twoof
10themembersshallhavebeenelectedasRepublicans,andtwoofthemembersshallhave
11beenelectedasDemocrats.Allfourofsuchmembersshallhaveservedaminimumof
12twofulltermsasanelectedorappointedprosecutingorcircuitattorneypriortobeing
HCSHB1763	7 13appointedtoserveontheprosecutingandcircuitattorneyreviewcommittee.Initially,
14twomembers,oneRepublicanandoneDemocrat,shallbeappointedforafour-year
15term.Theothertwomembers,oneRepublicanandoneDemocrat,shallbeappointed
16foratwo-yearterm.TheseinitialappointmentsshallcommenceonJanuary1,2028.
17Whentheseinitialtermsexpire,allnewappointmentsshallbeforfour-yearterms.The
18appointmentsshallbemadenolaterthanDecemberfirstoftheyearprecedingthe
19beginningofthefirstdayofthetermonJanuaryfirst.Ifavacancyoccursduringa
20term,aqualifiedcurrentorformerprosecutingorcircuitattorneyshallbeselectedto
21finishtheexistingterm.Nopersonshallservemorethanthreetermsortwelveyears,
22whicheverisgreater,ontheprosecutingandcircuitattorneyreviewcommittee.
23 3.AformalcomplaintshallbelodgedtotheMissouriofficeofprosecution
24serviceswhenthereisathreattopublicsafetyandhealthinajurisdiction.Athreatto
25publicsafetyandhealthinajurisdictionisconsideredtoexistif:
