32 (10)"Parent",achild'sparent,legalcustodianorguardian; 33 (11)"Vlog",contentsharedonanonlineplatforminexchangefor 34compensation; 35 (12)"Vlogger",anindividualorfamilythatcreatesvideocontentperformedin 36Missouriinexchangeforcompensationandincludesanyproprietorship,partnership, 37company,orothercorporateentityassumingthenameoridentityofaparticular 38individualorfamilyforthepurposesofthatcontentcreation."Vlogger"doesnot 39includeanypersonundersixteenyearsofagewhoproduceshisorherownvlogs. 294.035.1.Achildundersixteenyearsofageisconsideredengagedinthework 2ofvloggingwhenthefollowingcriteriaaremetatanytimeduringtheprevioustwelve- 3monthperiod: 4 (1)Atleastthirtypercentofthevlogger'scompensatedvideocontentproduced 5withinathirty-dayperiodincludedthelikeness,name,orphotographofthechild. 6Contentpercentageismeasuredbythepercentageoftimethelikeness,name,or 7photographofthechildvisuallyappearsoristhesubjectofanoralnarrativeinavideo 8segment,ascomparedtothetotallengthofthesegment;and 9 (2)Thenumberofviewsreceivedpervideosegmentonanyonlineplatformmet 10theonlineplatform'sthresholdforthegenerationofcompensationorthevlogger 11receivedactualcompensationforvideocontentequaltoorgreaterthantencentsper 12view. 13 2.Uponreachingtheageofmajority,anyindividualwhowasachildengagedin 14theworkofvloggingasdescribedinsubsection1mayrequestthepermanentdeletionof 15anyvideosegmentorcontentincludingthelikeness,name,orphotographofthe HB1998 2 16individualfromanyonlineplatformthatprovidedcompensationtoavloggerin 17exchangeforvideocontentthatfeaturedthechildengagedintheworkofvlogging.An 18onlineplatformshalltakeallreasonablestepstopermanentlydeletethevideosegment 19orcontentafteritreceivestherequestfromanindividualdescribedinthissubsection. 20 3.Withtheexceptionofsections294.011and294.036,theprovisionsofthis 21chapterdonotapplytoaminorengagedintheworkofvlogging. 22 4.Allvloggerswhosecontentfeaturesachildundersixteenyearsofageengaged 23intheworkofvloggingshallmaintainthefollowingrecordsandshallprovidethemto 24thechildonanongoingbasis: 25 (1)Thenameanddocumentaryproofoftheageofthechildengagedinthework 26ofvlogging; 27 (2)Thenumberofvlogsthatgeneratedcompensationasdescribedinsubsection 281duringthereportingperiod; 29 (3)Thetotalnumberofminutesofthevlogsthatthevloggerreceived 30compensationforduringthereportingperiod; 31 (4)Thetotalnumberofminuteseachchildwasfeaturedinvlogsduringthe 32reportingperiod; 33 (5)Thetotalcompensationgeneratedfromvlogsfeaturingachildduringthe 34reportingperiod;and 35 (6)Theamountdepositedintothetrustaccountforthebenefitofthechild 36engagedintheworkingofvlogging,asrequiredbysection294.036. 37 5.Ifavloggerwhosevlogcontentfeaturesachildundersixteenyearsofage 38engagedintheworkofvloggingfailstomaintaintherecordsasprovidedunder 39subsection4,thechildmaycommenceacivilactiontoenforcetheprovisionsofthis 40section. 294.036.1.Achildsatisfyingthecriteriadescribedinsubsection1ofsection 2294.035shallbecompensatedbythevlogger.Thevloggershallsetasidegrossearnings 3onthevideocontent,includingthelikeness,name,orphotographofthechildinatrust 4accounttobepreservedforthebenefitofthechilduponreachingtheageofmajority, 5accordingtothefollowingdistribution: 6 (1)Whereonlyonechildmeetsthecontentthresholddescribedundersection 7294.035,thepercentageoftotalgrossearningsonanyvideosegment,includingthe 8likeness,name,orphotographofthechildthatisequaltoorgreaterthanhalfofthe 9contentpercentagethatincludesthechildasdescribedunder294.035;or 10 (2)Wheremorethanonechildmeetsthecontentthresholddescribedinsection 11294.035andavideosegmentincludesmorethanoneofthosechildren,thepercentage 12describedinsubdivision(1)forallchildreninanysegmentshallbeequallydivided HB1998 3 13betweenthechildren,regardlessofdifferencesinpercentageofcontentprovidedbythe 14individualchildren. 15 2.Atrustaccountrequiredunderthissectionshallprovide,ataminimum,the 16following: 17 (1)Thatthefundsintheaccountshallbeavailableonlytothechildengagedin 18theworkofvlogging; 19 (2)(a)Thattheaccountshallbeheldbyabankortrustcompany,assuchterms 20aredefinedundersection362.332;oracorporatefiduciary,assuchtermisdefined 21underthissubdivision; 22 (b)A"corporatefiduciary"isdefinedasatrustcompany;thetrustdepartment 23ofabank,savingsbank,savingsandloanassociation,orforeignbankingcorporation 24authorizedtoconductbusinessunderMissourilaws;oranypersonthatisrequiredto 25andhasreceivedacertificateofauthorityunderchapter362authorizingtheexerciseof 26trustpowers.Theterm"corporatefiduciary"alsoincludesanationalbankorfederally 27charteredsavingsandloanassociationorsavingsbankwhichisauthorizedbythe 28appropriatefederalagencytoacceptandexecutetrustsandwhichhasitsprincipal 29placeofbusinessinthisstate,wheneversuchconstructionisnecessarysothatthe 30nationalbankorfederallycharteredsavingsandloanassociationorsavingsbankmay 31enjoyandexerciseinthisStateallofthepowers,rightsandprivilegesauthorizedor 32permittedtoacorporatefiduciary; 33 (3)Thatthefundsintheaccountshallbecomeavailabletothechildengagedin 34theworkofvlogginguponthechildattainingeighteenyearsofageoruntilthechildis 35declaredemancipated;and 36 (4)ThattheaccountmeetstherequirementsoftheMissouritransferstominors 37lawundersections404.005to404.094. 38 3.Ifavloggerknowinglyorrecklesslyviolatesthissection,achildsatisfyingthe 39criteriadescribedinsubsection1ofsection294.035maycommenceanactiontoenforce 40theprovisionsofthissectionregardingthetrustaccount.Thecourtmayaward,toa 41childwhoprevailsinanyactionbroughtinaccordancewiththissection,thefollowing 42damages: 43 (1)Actualdamages; 44 (2)Punitivedamages;and 45 (3)Thecostsoftheaction,includingattorney'sfeesandlitigationcosts. 46 4.Thissectiondoesnotaffectarightorremedyavailableunderanyotherlawof 47thestate. 48 5.Nothinginthissectionshallbeinterpretedtohaveanyeffectonapartythatis 49neitherthevloggernorthechildengagedintheworkofvlogging.
