BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Section161.670,RSMo,isrepealedandonenewsectionenactedinlieu 2thereof,tobeknownassection161.670,toreadasfollows: 161.670.1.Notwithstandinganyotherlaw,priortoJuly1,2007,thestateboardof 2educationshallestablishthe"MissouriCourseAccessandVirtualSchoolProgram"toserve 3school-agestudentsresidinginthestate.TheMissouricourseaccessandvirtualschool 4programshalloffernonclassroom-basedinstructioninavirtualsettingusingtechnology, 5intranet,orinternetmethodsofcommunication.Anystudentundertheageoftwenty-onein 6gradeskindergartenthroughtwelvewhoresidesinthisstateshallbeeligibletoenrollinthe 7Missouricourseaccessandvirtualschoolprogrampursuanttosubsection3ofthissection. 8 2.(1)Forpurposesofcalculationanddistributionofstateschoolaid,students 9enrolledintheMissouricourseaccessandvirtualschoolprogramshallbeincludedinthe 10studentenrollmentoftheschooldistrictinwhichthestudentisenrolledundertherelevant 11provisionsofsubsection3ofthissection[; providedthatanysuch] forsuchenrollment. 12Studentattendanceforfull-timevirtualprogramstudentsshallonlybeincludedinanydistrict 13pupilattendancecalculationunderchapter163[andanycharterschoolpupilattendance 14calculationundersection160.415,] usingcurrent-yearpupilattendanceforsuchfull-time 15virtualprogrampupils[; andfurtherprovidedthat].Theaveragedailyattendanceofafull- 16timevirtualstudentwhoisengagedinrequiredinstructionalactivitiesundersubsection 174ofthissectionshallbecalculatedasifthepupil'sattendancepercentageequaledthe EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18hostdistrict'sprior-yearaverageattendancepercentage,andtheprovisionsofsection 19162.1250shallnotapplytosuchfundingcalculation.Inthecaseofahostschooldistrict 20enrollingoneormorefull-timevirtualschoolstudents,suchenrollingdistrictshall,aspartof 21itsmonthlystateallocation,receivenolessunderthestateaidcalculationforsuchstudents 22thananamountequaltothestateadequacytargetmultipliedbytheweightedaveragedaily 23attendanceofsuchfull-timestudents.StudentsresidinginMissouriandenrolledinafull- 24timevirtualschoolprogramoperatedbyapublicinstitutionofhighereducationinthisstate 25shallbecountedforastateaidcalculationbythedepartment,andthedepartmentshallpay, 26fromfundsdedicatedtostateschoolaidpaymentsmadeundersection163.031,tosuch 27institutionanamountequaltothestateadequacytargetmultipliedbytheweightedaverage 28dailyattendanceofsuchfull-timestudents. 29 (2)TheMissouricourseaccessandvirtualschoolprogramshallreporttothedistrict 30ofresidencethefollowinginformationabouteachstudentservedbytheMissouricourse 31accessandvirtualschoolprogram:name,address,eligibilityforfreeorreduced-pricelunch, 32limitedEnglishproficiencystatus,specialeducationneeds,andthenumberofcoursesin 33whichthestudentisenrolled.TheMissouricourseaccessandvirtualschoolprogramshall 34promptlynotifytheresidentdistrictwhenastudentdiscontinuesenrollment.A"full-time 35equivalentstudent"isastudentwhoisenrolledintheinstructionalequivalentofsixcredits 36perregularterm.EachMissouricourseaccessandvirtualschoolprogramcourseshallcount 37asoneclassandshallgeneratethatportionofafull-timeequivalentthatacomparablecourse 38offeredbytheschooldistrictwouldgenerate. 39 (3)Pursuanttoaneducationservicesplanandcollaborativeagreementunder 40subsection3ofthissection,full-timeequivalentstudentsmaybeallowedtouseaphysical 41locationoftheresidentschooldistrictforallorsomeportionofongoinginstructionalactivity, 42andtheenrollmentplanshallprovideforreimbursementofcostsoftheresidentdistrictfor 43providingsuchaccesspursuanttorulespromulgatedunderthissectionbythedepartment. 44 (4)Innocaseshallmorethanthefull-timeequivalencyofaregulartermof 45attendanceforasinglestudentbeusedtoclaimstateaid.Full-timeequivalentstudentcredit 46completedshallbereportedtothedepartmentofelementaryandsecondaryeducationinthe 47mannerprescribedbythedepartment.Nothinginthissectionshallprohibitstudentsfrom 48enrollinginadditionalcoursesunderaseparateagreementthatincludestermsforpaying 49tuitionorcoursefees. 50 (5)Afull-timevirtualschoolprogramservingfull-timeequivalentstudentsshallbe 51consideredanattendancecenterinthehostschooldistrictandshallparticipateinthe 52statewideassessmentsystemasdefinedinsection160.518.Theacademicperformanceof 53studentsenrolledinafull-timevirtualschoolprogramshallbeassignedtothedesignated 54attendancecenterofthefull-timevirtualschoolprogramandshallbeconsideredinlike HB2287 2 55mannertootherattendancecenters.Theacademicperformanceofanystudentwhodisenrolls 56fromafull-timevirtualschoolprogramandenrollsinapublicschoolorcharterschoolshall 57notbeusedindeterminingtheannualperformancereportscoreoftheattendancecenteror 58schooldistrictinwhichthestudentenrollsfortwelvemonthsfromthedateofenrollment. 59 (6)Forthepurposesofthissection,apublicinstitutionofhighereducationoperating 60afull-timevirtualschoolprogramshallbesubjecttoallrequirementsapplicabletoahost 61schooldistrictwithrespecttoitsfull-timeequivalentstudents. 62 3.(1)AstudentwhoresidesinthisstatemayenrollinMissouricourseaccessand 63virtualschoolprogramcoursesofhisorherchoiceasapartofthestudent'sannualcourse 64loadeachschoolyear,withanycostsassociatedwithsuchcourseorcoursestobepaidbythe 65schooldistrictorcharterschoolif: 66 (a)Thestudentisenrolledfull-timeinapublicschool,includinganycharterschool; 67and 68 (b)PriortoenrollinginanyMissouricourseaccessandvirtualschoolprogram 69course,astudenthasreceivedapprovalfromhisorherschooldistrictorcharterschool 70throughtheproceduredescribedundersubdivision(2)ofthissubsection. 71 (2)Eachschooldistrictorcharterschoolshalladoptapolicythatdelineatesthe 72processbywhichastudentmayenrollincoursesprovidedbytheMissouricourseaccessand 73virtualschoolprogramthatissubstantiallysimilartothetypicalprocessbywhichadistrict 74studentwouldenrollincoursesofferedbytheschooldistrictandacharterschoolstudent 75wouldenrollincoursesofferedbythecharterschool.Thepolicymayincludeconsultation 76withtheschool'scounselorandmayincludeparentalnotificationorauthorization.Thepolicy 77shallensurethatavailableopportunitiesforin-personinstructionareconsideredpriorto 78movingastudenttovirtualcourses.Thepolicyshallallowforcontinuousenrollment 79throughouttheschoolyear.Iftheschooldistrictorcharterschooldisapprovesastudent's 80requesttoenrollinacourseorcoursesprovidedbytheMissouricourseaccessandvirtual 81schoolprogram,thereasonshallbeprovidedinwritinganditshallbeforgoodcause.Good 82causejustificationtodisapproveastudent'srequestforenrollmentinacourseshallbea 83determinationthatdoingsoisnotinthebesteducationalinterestofthestudent,andshallbe 84consistentwiththedeterminationthatwouldbemadeforsuchcourserequestunderthe 85processbywhichadistrictstudentwouldenrollinasimilarcourseofferedbytheschool 86districtandacharterschoolstudentwouldenrollinasimilarcourseofferedbythecharter 87school,exceptthatthedeterminationmayconsiderthesuitabilityofvirtualcoursesforthe 88studentbasedonpriorparticipationinvirtualcoursesbythestudent.Appealsofanycourse 89denialsunderthissubsectionshallbeconsideredunderapolicythatissubstantiallysimilarto 90thetypicalprocessbywhichappealswouldbeconsideredforastudentseekingtoenrollin HB2287 3 91coursesofferedbytheschooldistrictandacharterschoolstudentseekingtoenrollincourses 92offeredbythecharterschool. 93 (3)ForstudentsenrolledinanyMissouricourseaccessandvirtualschoolprogram 94courseinwhichcostsassociatedwithsuchcoursearetobepaidbytheschooldistrictor 95charterschoolasdescribedunderthissubdivision,theschooldistrictorcharterschoolshall 96paythecontentproviderdirectlyonaproratamonthlybasisbasedonastudent'scompletion 97ofassignmentsandassessments.Ifastudentdiscontinuesenrollment,thedistrictorcharter 98schoolmaystopmakingmonthlypaymentstothecontentprovider.Noschooldistrictor 99charterschoolshallpay,foranyonecourseforastudent,morethanthemarketnecessary 100costsbutinnocaseshallpaymorethanfourteenpercentofthestateadequacytarget,as 101definedundersection163.011,ascalculatedattheendofthemostrecentschoolyearforany 102single,year-longcourseandnomorethansevenpercentofthestateadequacytargetas 103describedaboveforanysinglesemesterequivalentcourse. 104 (4)[Forstudentsenrollinginafull-timevirtualprogram,thedepartmentof 105elementaryandsecondaryeducationshalladoptapolicythatdelineatestheprocessbywhich] 106(a)Astudentwholivesinthisstatemayenrollinavirtualprogramoftheirchoiceas 107providedinthissubdivision, andtheprovisionsofsubdivisions1to3ofthissubsection 108shallnotapplytosuchenrollmentinafull-timevirtualprogram. Eachhostschool 109districtoperatingafull-timevirtualprogramunderthissectionshalladopt,operateand 110implement[thestate]anenrollmentpolicy[, subjectto]asspecifiedbytheprovisionsofthis 111subdivision.[Thepolicyshall: 112 (a)Requirethegoodfaithcollaborationof]Thestudent,thestudent'sparentor 113guardianifthestudentisnotconsideredhomeless,thevirtualprogram,thehostdistrict,and 114theresidentdistrict[;] shallcollaborateingoodfaithtoimplementtheenrollmentpolicy 115regardingthestudent'senrollment,andtheresidentschooldistrictandthehostschool 116districtmaymutuallyagreethattheresidentdistrictshallofferorcontinuetooffer 117servicesforthestudentunderanagreementthatincludesfinancialtermsfor 118reimbursementbythehostschooldistrictforthenecessarycostsoftheresident 119schooldistrictprovidingsuchservices.Anenrollmentpolicyspecifiedunderthis 120subsectionshall: 121 [(b)]a.Requireastudent'sparentorguardian,ifthestudentisnotconsidered 122homeless,toapplyforenrollmentinafull-timevirtualprogramdirectlywiththevirtual 123program; 124 b.Specifytimelinesfortimelyparticipationbythevirtualprogram,thehostdistrict, 125andresidentdistrict;providedthattheresidentdistrictshallprovideanyrelevantinformation 126andinputontheenrollmentwithintenbusinessdaysofnoticefromthevirtualprogramofthe 127enrollmentapplication; 140 [(g)]g.Requirethevirtualprogramtodeterminewhetheranenrollingstudentwillbe 141admitted,basedontheenrollmentpolicy,inconsiderationofallrelevantfactorsandprovide 142thebasisforitsdeterminationandanyserviceplanforthestudent,inwriting,tothestudent, 143thestudent'sparentorguardian,thehostdistrict,andtheresidentdistrict;and 144 [(h)]h.Provideaprocessforreviewingappealsofdecisionsmadeunderthis 145subdivision[; and]. 146 [(i)Require] (b)Thedepartment[to]shallpublishanannualreportbasedonthe 147enrollmentsandenrollmentsurveysconductedunderthissubdivisionthatprovidesdataatthe 148statewideanddistrictlevelsofsufficientdetailtoallowanalysisoftrendsregardingthe 149reasonsforparticipationinthevirtualprogramatthestatewideanddistrictlevels;provided 150thatnosuchsurveyresultswillbepublishedinamannerthatrevealsindividualstudent 151information.Thedepartmentshallalsoinclude,intheannualreport,dataatthestatewideand 152districtlevelsofsufficientdetailtoallowdetectionandanalysisoftheracial,ethnic,and 153socio-economicbalanceofvirtualprogramparticipationamongschoolsanddistrictsatthe 154statewideanddistrictlevels,providedthatnosuchsurveyresultswillbepublishedina 155mannerthatrevealsindividualstudentinformation. 156 (5)InthecaseofastudentwhoisacandidateforA+tuitionreimbursementand 157takingavirtualcourseunderthissection,theschoolshallattributenolessthanninety-five 158percentattendancetoanysuchstudentwhohascompletedsuchvirtualcourse. 159 (6)TheMissouricourseaccessandvirtualschoolprogramshallensurethat 160individuallearningplansdesignedbycertifiedteachersandprofessionalstaffaredeveloped 161forallstudentsenrolledinmorethantwofull-timecourseaccessprogramcoursesorafull- 162timevirtualschool. 163 (7)Virtualschoolprogramsshallmonitorindividualstudentsuccessandengagement 164ofstudentsenrolledintheirprogram[,] and,forstudentsenrolledinvirtualcoursesona HB2287 5 165part-timebasis,thevirtualschoolprogramshallprovideregularstudentprogressreports 166foreachstudentatleastfourtimesperschoolyeartotheschooldistrictorcharterschool, 167providethehostschooldistrictandtheresidentschooldistrictongoingaccesstoacademic 168andotherrelevantinformationonstudentsuccessandengagement,andshallterminateor 169alterthecourseofferingifitisfoundthecourse[orfull-timevirtualschool] isnotmeetingthe 170educationalneedsofthestudentsenrolledinthecourse. 171 (8)Thedepartmentofelementaryandsecondaryeducationshallmonitorthe 172aggregateperformanceofprovidersandmakesuchinformationavailabletothepublicunder 173subsection11ofthissection. 174 (9)Pursuanttorulestobepromulgatedbythedepartmentofelementaryand 175secondaryeducation,whenastudenttransfersintoaschooldistrictorcharterschool,credits 176previouslygainedthroughsuccessfulpassageofapprovedcoursesundertheMissouricourse 177accessandvirtualschoolprogramshallbeacceptedbytheschooldistrictorcharterschool. 178 (10)Pursuanttorulestobepromulgatedbythedepartmentofelementaryand 179secondaryeducation,ifastudenttransfersintoaschooldistrictorcharterschoolwhile 180enrolledinaMissouricourseaccessandvirtualschoolprogramcourseorfull-timevirtual 181school,thestudentshallcontinuetobeenrolledinsuchcourseorschool. 182 (11)Nothinginthissectionshallprohibithomeschoolstudents,privateschool 183students,orstudentswishingtotakeadditionalcoursesbeyondtheirregularcourseloadfrom 184enrollinginMissouricourseaccessandvirtualschoolprogramcoursesunderanagreement 185thatincludestermsforpayingtuitionorcoursefees. 186 (12)Nothinginthissubsectionshallrequireanyschooldistrict,charterschool,virtual 187program,orthestatetoprovidecomputers,equipment,orinternetaccesstoanystudent 188unlessrequiredundertheeducationservicesplancreatedforaneligiblestudentunder 189subdivision(4)ofthissubsectionorforaneligiblestudentwithadisabilitytocomplywith 190federallaw.Aneducationservicesplanmayrequireaneligiblestudenttohaveaccessto 191schoolfacilitiesoftheresidentschooldistrictduringregularschoolhoursforparticipation 192andinstructionalactivitiesofavirtualprogramunderthissection,andtheeducationservices 193planshallprovideforreimbursementoftheresidentschooldistrictforsuchaccesspursuantto 194rulesadoptedbythedepartmentunderthissection. 195 (13)Theauthorizationprocessshallprovideforcontinuousmonitoringofapproved 196providersandcourses.Thedepartmentshallrevokeorsuspendortakeothercorrectiveaction 197regardingtheauthorizationofanycourseorprovidernolongermeetingtherequirementsof 198theprogram.Unlessimmediateactionisnecessary,priortorevocationorsuspension,the 199departmentshallnotifytheproviderandgivetheproviderareasonabletimeperiodtotake 200correctiveactiontoavoidrevocationorsuspension.Theprocessshallprovideforperiodic 201renewalofauthorizationnolessfrequentlythanonceeverythreeyears. HB2287 6 202 (14)CoursesapprovedasofAugust28,2018,bythedepartmenttoparticipateinthe 203Missourivirtualinstructionprogramshallbeautomaticallyapprovedtoparticipateinthe 204Missouricourseaccessandvirtualschoolprogram,butshallbesubjecttoperiodicrenewal. 205 (15)Anyonlinecourseorvirtualprogramofferedbyaschooldistrictorcharter 206school,includingthoseofferedpriortoAugust28,2018,whichmeetstherequirementsof 207section162.1250shallbeautomaticallyapprovedtoparticipateintheMissouricourseaccess 208andvirtualschoolprogram.Suchcourseorprogramshallbesubjecttoperiodicrenewal.A 209schooldistrictorcharterschoolofferingsuchacourseorvirtualschoolprogramshallbe 210deemedanapprovedprovider. 211 (16)Ahostdistrictmaycontractwithaprovidertoperformanyrequired 212servicesinvolvedwithdeliveringafull-timevirtualeducation. 213 4.(1)Asusedinthissubsection,theterm"instructionalactivities"meansclassroom- 214basedornonclassroom-basedactivitiesthatastudentshallbeexpectedtocomplete, 215participatein,orattendduringanygivenschoolday,suchas: 216 (a)Onlineloginstocurriculaorprograms; 217 (b)Offlineactivities; 218 (c)Completedassignmentswithinaparticularprogram,curriculum,orclass; 219 (d)Testing; 220 (e)Face-to-facecommunicationsormeetingswithschoolstaff; 221 (f)Telephoneorvideoconferenceswithschoolstaff; 222 (g)School-sanctionedfieldtrips;or 223 (h)Orientation. 224 (2)Afull-timevirtualschoolshallsubmitanotificationtotheparentorguardianof 225anystudentwhoisnotconsistentlyengagedininstructionalactivities. 226 (3)Eachfull-timevirtualschoolshalldevelop,adopt,andpostontheschool'swebsite 227apolicysettingforththeconsequencesforastudentwhofailstocompletetherequired 228instructionalactivities.Suchpolicyshallstate,ataminimum,thatifastudentfailsto 229completetheinstructionalactivitiesafterreceivinganotificationundersubdivision(2)ofthis 230subsection,andafterreasonableinterventionstrategieshavebeenimplemented,thatthe 231studentshallbesubjecttocertainconsequenceswhichmayincludedisenrollmentfromthe 232school.Priortoanydisenrollment,theparentorguardianshallhavetheopportunityto 233presentanyinformationthattheparentdeemsrelevant,andsuchinformationshallbe 234consideredpriortoanyfinaldecision. 235 (4)Ifafull-timevirtualschooldisenrollsastudentundersubdivision(3)ofthis 236subsection,theschoolshallimmediatelyprovidewrittennotificationtosuchstudent'sschool 237districtofresidence.Thestudent'sschooldistrictofresidenceshallthenprovidetothe 238parentsorguardianofthestudentawrittenlistofavailableeducationaloptionsandpromptly HB2287 7 239enrollthestudentintheselectedoption.Anystudentdisenrolledfromafull-timevirtual 240schoolshallbeprohibitedfromreenrollinginthesamevirtualschoolfortheremainderofthe 241schoolyear. 242 (5)Forthepurposeofsubsection2ofthissection,theaveragedailyattendance 243ofafull-timevirtualstudentwhoiscompletingrequiredinstructionalactivitiesunder 244thissubsectionshallbecalculatedasifthepupil'sattendancepercentageequaledthe 245hostdistrict'sprior-yearaverageattendancepercentage. 246 5.Schooldistrictsorcharterschoolsshallinformparentsoftheirchild'srightto 247participateintheprogram.Availabilityoftheprogramshallbemadeclearintheparent 248handbook,registrationdocuments,andfeaturedonthehomepageoftheschooldistrictor 249charterschool'swebsite. 250 6.Thedepartmentshall: 251 (1)Establishanauthorizationprocessforcourseorfull-timevirtualschoolproviders 252thatincludesmultipleopportunitiesforsubmissioneachyear; 253 (2)Pursuanttothetimelineestablishedbythedepartment,authorizecourseorfull- 254timevirtualschoolprovidersthat: 255 (a)Submitallnecessaryinformationpursuanttotherequirementsoftheprocess;and 256 (b)Meetthecriteriadescribedinsubdivision(3)ofthissubsection; 257 (3)Review,pursuanttotheauthorizationprocess,proposalsfromprovidersto 258provideacomprehensive,full-timeequivalentcourseofstudyforstudentsthroughthe 259Missouricourseaccessandvirtualschoolprogram.Thedepartmentshallensurethatthese 260comprehensivecoursesofstudyaligntostateacademicstandardsandthatthereis 261consistencyandcompatibilityinthecurriculumusedbyallprovidersfromonegradelevelto 262thenextgradelevel; 263 (4)Withinthirtydaysofanydenial,provideawrittenexplanationtoanycourseor 264full-timevirtualschoolprovidersthataredeniedauthorization; 265 (5)Allowacourseorfull-timevirtualschoolproviderdeniedauthorizationtoreapply 266atanypointinthefuture. 267 7.Thedepartmentshallpublishtheprocessestablishedunderthissection,including 268anydeadlinesandanyguidelinesapplicabletothesubmissionandauthorizationprocessfor 269courseorfull-timevirtualschoolprovidersonitswebsite. 270 8.Ifthedepartmentdeterminesthatthereareinsufficientfundsavailablefor 271evaluatingandauthorizingcourseorfull-timevirtualschoolproviders,thedepartmentmay 272chargeapplicantcourseorfull-timevirtualschoolprovidersafeeupto,butnogreaterthan, 273theamountofthecostsinordertoensurethatevaluationoccurs.Thedepartmentshall 274establishandpublishafeescheduleforpurposesofthissubsection.
