SectionA.Section161.670,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection161.670,toreadasfollows:
161.670.1.Notwithstandinganyotherlaw,priortoJuly1,2007,thestateboardof
2educationshallestablishthe"MissouriCourseAccessandVirtualSchoolProgram"toserve
3school-agestudentsresidinginthestate.TheMissouricourseaccessandvirtualschool
4programshalloffernonclassroom-basedinstructioninavirtualsettingusingtechnology,
5intranet,orinternetmethodsofcommunication.Anystudentundertheageoftwenty-onein
6gradeskindergartenthroughtwelvewhoresidesinthisstateshallbeeligibletoenrollinthe
7Missouricourseaccessandvirtualschoolprogrampursuanttosubsection3ofthissection.
8 2.(1)Forpurposesofcalculationanddistributionofstateschoolaid,students
9enrolledintheMissouricourseaccessandvirtualschoolprogramshallbeincludedinthe
10studentenrollmentoftheschooldistrictinwhichthestudentisenrolledundertherelevant
11provisionsofsubsection3ofthissection[; providedthatanysuch] forsuchenrollment.
12Studentattendanceforfull-timevirtualprogramstudentsshallonlybeincludedinanydistrict
13pupilattendancecalculationunderchapter163[andanycharterschoolpupilattendance
14calculationundersection160.415,] usingcurrent-yearpupilattendanceforsuchfull-time
15virtualprogrampupils[; andfurtherprovidedthat].Theaveragedailyattendanceofafull-
16timevirtualstudentwhoisengagedinrequiredinstructionalactivitiesundersubsection
174ofthissectionshallbecalculatedasifthepupil'sattendancepercentageequaledthe

21itsmonthlystateallocation,receivenolessunderthestateaidcalculationforsuchstudents
22thananamountequaltothestateadequacytargetmultipliedbytheweightedaveragedaily
23attendanceofsuchfull-timestudents.StudentsresidinginMissouriandenrolledinafull-
24timevirtualschoolprogramoperatedbyapublicinstitutionofhighereducationinthisstate
25shallbecountedforastateaidcalculationbythedepartment,andthedepartmentshallpay,
26fromfundsdedicatedtostateschoolaidpaymentsmadeundersection163.031,tosuch
27institutionanamountequaltothestateadequacytargetmultipliedbytheweightedaverage
28dailyattendanceofsuchfull-timestudents.
29 (2)TheMissouricourseaccessandvirtualschoolprogramshallreporttothedistrict
30ofresidencethefollowinginformationabouteachstudentservedbytheMissouricourse
31accessandvirtualschoolprogram:name,address,eligibilityforfreeorreduced-pricelunch,
32limitedEnglishproficiencystatus,specialeducationneeds,andthenumberofcoursesin
33whichthestudentisenrolled.TheMissouricourseaccessandvirtualschoolprogramshall
34promptlynotifytheresidentdistrictwhenastudentdiscontinuesenrollment.A"full-time
35equivalentstudent"isastudentwhoisenrolledintheinstructionalequivalentofsixcredits
36perregularterm.EachMissouricourseaccessandvirtualschoolprogramcourseshallcount
37asoneclassandshallgeneratethatportionofafull-timeequivalentthatacomparablecourse
38offeredbytheschooldistrictwouldgenerate.
39 (3)Pursuanttoaneducationservicesplanandcollaborativeagreementunder
40subsection3ofthissection,full-timeequivalentstudentsmaybeallowedtouseaphysical
41locationoftheresidentschooldistrictforallorsomeportionofongoinginstructionalactivity,
42andtheenrollmentplanshallprovideforreimbursementofcostsoftheresidentdistrictfor
43providingsuchaccesspursuanttorulespromulgatedunderthissectionbythedepartment.
44 (4)Innocaseshallmorethanthefull-timeequivalencyofaregulartermof
45attendanceforasinglestudentbeusedtoclaimstateaid.Full-timeequivalentstudentcredit
46completedshallbereportedtothedepartmentofelementaryandsecondaryeducationinthe
47mannerprescribedbythedepartment.Nothinginthissectionshallprohibitstudentsfrom
48enrollinginadditionalcoursesunderaseparateagreementthatincludestermsforpaying
49tuitionorcoursefees.
50 (5)Afull-timevirtualschoolprogramservingfull-timeequivalentstudentsshallbe
51consideredanattendancecenterinthehostschooldistrictandshallparticipateinthe
52statewideassessmentsystemasdefinedinsection160.518.Theacademicperformanceof
53studentsenrolledinafull-timevirtualschoolprogramshallbeassignedtothedesignated
54attendancecenterofthefull-timevirtualschoolprogramandshallbeconsideredinlike

59 (6)Forthepurposesofthissection,apublicinstitutionofhighereducationoperating
60afull-timevirtualschoolprogramshallbesubjecttoallrequirementsapplicabletoahost
61schooldistrictwithrespecttoitsfull-timeequivalentstudents.
62 3.(1)AstudentwhoresidesinthisstatemayenrollinMissouricourseaccessand
63virtualschoolprogramcoursesofhisorherchoiceasapartofthestudent'sannualcourse
64loadeachschoolyear,withanycostsassociatedwithsuchcourseorcoursestobepaidbythe
65schooldistrictorcharterschoolif:
66 (a)Thestudentisenrolledfull-timeinapublicschool,includinganycharterschool;
67and
68 (b)PriortoenrollinginanyMissouricourseaccessandvirtualschoolprogram
69course,astudenthasreceivedapprovalfromhisorherschooldistrictorcharterschool
70throughtheproceduredescribedundersubdivision(2)ofthissubsection.
71 (2)Eachschooldistrictorcharterschoolshalladoptapolicythatdelineatesthe
72processbywhichastudentmayenrollincoursesprovidedbytheMissouricourseaccessand
73virtualschoolprogramthatissubstantiallysimilartothetypicalprocessbywhichadistrict
74studentwouldenrollincoursesofferedbytheschooldistrictandacharterschoolstudent

84consistentwiththedeterminationthatwouldbemadeforsuchcourserequestunderthe
85processbywhichadistrictstudentwouldenrollinasimilarcourseofferedbytheschool
86districtandacharterschoolstudentwouldenrollinasimilarcourseofferedbythecharter
87school,exceptthatthedeterminationmayconsiderthesuitabilityofvirtualcoursesforthe
88studentbasedonpriorparticipationinvirtualcoursesbythestudent.Appealsofanycourse
89denialsunderthissubsectionshallbeconsideredunderapolicythatissubstantiallysimilarto
90thetypicalprocessbywhichappealswouldbeconsideredforastudentseekingtoenrollin

93 (3)ForstudentsenrolledinanyMissouricourseaccessandvirtualschoolprogram
94courseinwhichcostsassociatedwithsuchcoursearetobepaidbytheschooldistrictor
95charterschoolasdescribedunderthissubdivision,theschooldistrictorcharterschoolshall
96paythecontentproviderdirectlyonaproratamonthlybasisbasedonastudent'scompletion
97ofassignmentsandassessments.Ifastudentdiscontinuesenrollment,thedistrictorcharter
98schoolmaystopmakingmonthlypaymentstothecontentprovider.Noschooldistrictor

104 (4)[Forstudentsenrollinginafull-timevirtualprogram,thedepartmentof
105elementaryandsecondaryeducationshalladoptapolicythatdelineatestheprocessbywhich]
106(a)Astudentwholivesinthisstatemayenrollinavirtualprogramoftheirchoiceas
107providedinthissubdivision, andtheprovisionsofsubdivisions1to3ofthissubsection
108shallnotapplytosuchenrollmentinafull-timevirtualprogram. Eachhostschool
109districtoperatingafull-timevirtualprogramunderthissectionshalladopt,operateand
110implement[thestate]anenrollmentpolicy[, subjectto]asspecifiedbytheprovisionsofthis
111subdivision.[Thepolicyshall:
112 (a)Requirethegoodfaithcollaborationof]Thestudent,thestudent'sparentor
113guardianifthestudentisnotconsideredhomeless,thevirtualprogram,thehostdistrict,and
114theresidentdistrict[;] shallcollaborateingoodfaithtoimplementtheenrollmentpolicy
115regardingthestudent'senrollment,andtheresidentschooldistrictandthehostschool
116districtmaymutuallyagreethattheresidentdistrictshallofferorcontinuetooffer
117servicesforthestudentunderanagreementthatincludesfinancialtermsfor
118reimbursementbythehostschooldistrictforthenecessarycostsoftheresident
119schooldistrictprovidingsuchservices.Anenrollmentpolicyspecifiedunderthis
120subsectionshall:
121 [(b)]a.Requireastudent'sparentorguardian,ifthestudentisnotconsidered
122homeless,toapplyforenrollmentinafull-timevirtualprogramdirectlywiththevirtual
123program;

156 (5)InthecaseofastudentwhoisacandidateforA+tuitionreimbursementand
157takingavirtualcourseunderthissection,theschoolshallattributenolessthanninety-five
158percentattendancetoanysuchstudentwhohascompletedsuchvirtualcourse.
159 (6)TheMissouricourseaccessandvirtualschoolprogramshallensurethat
160individuallearningplansdesignedbycertifiedteachersandprofessionalstaffaredeveloped
161forallstudentsenrolledinmorethantwofull-timecourseaccessprogramcoursesorafull-

218 (c)Completedassignmentswithinaparticularprogram,curriculum,orclass;
219 (d)Testing;
220 (e)Face-to-facecommunicationsormeetingswithschoolstaff;
221 (f)Telephoneorvideoconferenceswithschoolstaff;
222 (g)School-sanctionedfieldtrips;or
223 (h)Orientation.
224 (2)Afull-timevirtualschoolshallsubmitanotificationtotheparentorguardianof
225anystudentwhoisnotconsistentlyengagedininstructionalactivities.
226 (3)Eachfull-timevirtualschoolshalldevelop,adopt,andpostontheschool'swebsite
227apolicysettingforththeconsequencesforastudentwhofailstocompletetherequired
228instructionalactivities.Suchpolicyshallstate,ataminimum,thatifastudentfailsto
229completetheinstructionalactivitiesafterreceivinganotificationundersubdivision(2)ofthis
230subsection,andafterreasonableinterventionstrategieshavebeenimplemented,thatthe
231studentshallbesubjecttocertainconsequenceswhichmayincludedisenrollmentfromthe
232school.Priortoanydisenrollment,theparentorguardianshallhavetheopportunityto
233presentanyinformationthattheparentdeemsrelevant,andsuchinformationshallbe
234consideredpriortoanyfinaldecision.
235 (4)Ifafull-timevirtualschooldisenrollsastudentundersubdivision(3)ofthis
236subsection,theschoolshallimmediatelyprovidewrittennotificationtosuchstudent'sschool
237districtofresidence.Thestudent'sschooldistrictofresidenceshallthenprovidetothe

251 (1)Establishanauthorizationprocessforcourseorfull-timevirtualschoolproviders
252thatincludesmultipleopportunitiesforsubmissioneachyear;
253 (2)Pursuanttothetimelineestablishedbythedepartment,authorizecourseorfull-
254timevirtualschoolprovidersthat:
255 (a)Submitallnecessaryinformationpursuanttotherequirementsoftheprocess;and
256 (b)Meetthecriteriadescribedinsubdivision(3)ofthissubsection;
257 (3)Review,pursuanttotheauthorizationprocess,proposalsfromprovidersto
258provideacomprehensive,full-timeequivalentcourseofstudyforstudentsthroughthe
259Missouricourseaccessandvirtualschoolprogram.Thedepartmentshallensurethatthese

267 7.Thedepartmentshallpublishtheprocessestablishedunderthissection,including

283 10.Thedepartmentshallsubmitandpubliclypublishanannualreportonthe
284Missouricourseaccessandvirtualschoolprogramandtheparticipationofentitiestothe
285governor,thechairandrankingmemberofthesenateeducationcommittee,andthechairand
286rankingmemberofthehouseofrepresentativeselementaryandsecondaryeducation
287committee.Thereportshallataminimumincludethefollowinginformation:
