providedthatanysuch] forsuchenrollment. 12Studentattendanceforfull-timevirtualprogramstudentsshallonlybeincludedinanydistrict 13pupilattendancecalculationunderchapter163[andanycharterschoolpupilattendance SSHB2287 2 14calculationundersection160.415,] usingcurrent-yearpupilattendanceforsuchfull-time 15virtualprogrampupils[; andfurtherprovidedthat].Forthepurposeofcalculatingaverage 16dailyattendanceinfulltimevirtualprogramsunderthissection,averagedaily 17attendanceshallbedefinedasthequotientorthesumofthequotientsobtainedby 18dividingthetotalnumberofhoursattendedinatermbyenrolledpupilsbetweenthe 19agesoffiveandtwenty-onebytheactualnumberofhoursthattheprogramwasin 20sessioninthatterm,andtheprovisionsofsection162.1250shallnotapplytosuch 21fundingcalculation.Suchcalculationshallbegeneratedbythevirtualproviderand 22providedtothehostdistrictforsubmissiontothedepartmentofelementaryand 23secondaryeducation.Suchstudentsmaycompletetheirinstructionalactivities,as 24definedinsubsection4ofthissection,duringanyhourofthedayandduringanydayof 25theweek.Thehoursattendedforeachenrolledpupilshallbedocumentedbythepupil's 26weeklyprogressintheeducationalprogramaccordingtoaprocessdeterminedbythe 27virtualprogramandpublishedannuallyinthevirtualprogram'senrollmenthandbook 28orpolicy.Totheaveragedailyattendanceofthefollowingschooltermshallbeadded 29thefull-timeequivalentaveragedailyattendanceofsummerschoolstudents.Inthecase 30ofahostschooldistrictenrollingoneormorefull-timevirtualschoolstudents,suchenrolling 31districtshall, aspartofitsmonthlystateallocation,receivenolessunderthestateaid 32calculationforsuchstudentsthananamountequaltothestateadequacytargetmultipliedby 33theweightedaveragedailyattendanceofsuchfull-timestudents.Studentsresidingin 34Missouriandenrolledinafull-timevirtualschoolprogramoperatedbyapublicinstitutionof 35highereducationinthisstateshallbecountedforastateaidcalculationbythedepartment, 36andthedepartmentshallpay,fromfundsdedicatedtostateschoolaidpaymentsmadeunder 37section163.031,tosuchinstitutionanamountequaltothestateadequacytargetmultipliedby 38theweightedaveragedailyattendanceofsuchfull-timestudents. 39 (2)TheMissouricourseaccessandvirtualschoolprogramshallreporttothedistrict 40ofresidencethefollowinginformationabouteachstudentservedbytheMissouricourse 41accessandvirtualschoolprogram:name,address,eligibilityforfreeorreduced-pricelunch, 42limitedEnglishproficiencystatus,specialeducationneeds,andthenumberofcoursesin 43whichthestudentisenrolled.TheMissouricourseaccessandvirtualschoolprogramshall 44promptlynotifytheresidentdistrictwhenastudentdiscontinuesenrollment.A"full-time 45equivalentstudent"isastudentwhoisenrolledintheinstructionalequivalentofsixcredits 46perregularterm.EachMissouricourseaccessandvirtualschoolprogramcourseshallcount 47asoneclassandshallgeneratethatportionofafull-timeequivalentthatacomparablecourse 48offeredbytheschooldistrictwouldgenerate. 49 (3)Pursuanttoaneducationservicesplanandcollaborativeagreementunder 50subsection3ofthissection,full-timeequivalentstudentsmaybeallowedtouseaphysical SSHB2287 3 51locationoftheresidentschooldistrictforallorsomeportionofongoinginstructionalactivity, 52andtheenrollmentplanshallprovideforreimbursementofcostsoftheresidentdistrictfor 53providingsuchaccesspursuanttorulespromulgatedunderthissectionbythedepartment. 54 (4)Innocaseshallmorethanthefull-timeequivalencyofaregulartermof 55attendanceforasinglestudentbeusedtoclaimstateaid.Full-timeequivalentstudentcredit 56completedshallbereportedtothedepartmentofelementaryandsecondaryeducationinthe 57mannerprescribedbythedepartment.Nothinginthissectionshallprohibitstudentsfrom 58enrollinginadditionalcoursesunderaseparateagreementthatincludestermsforpaying 59tuitionorcoursefees. 60 (5)Afull-timevirtualschoolprogramservingfull-timeequivalentstudentsshallbe 61consideredanattendancecenterinthehostschooldistrictandshallparticipateinthe 62statewideassessmentsystemasdefinedinsection160.518.Theacademicperformanceof 63studentsenrolledinafull-timevirtualschoolprogramshallbeassignedtothedesignated 64attendancecenterofthefull-timevirtualschoolprogramandshallbeconsideredinlike 65mannertootherattendancecenters.Theacademicperformanceofanystudentwhodisenrolls 66fromafull-timevirtualschoolprogramandenrollsinapublicschoolorcharterschoolshall 67notbeusedindeterminingtheannualperformancereportscoreoftheattendancecenteror 68schooldistrictinwhichthestudentenrollsfortwelvemonthsfromthedateofenrollment. 69 (6)Forthepurposesofthissection,apublicinstitutionofhighereducationoperating 70afull-timevirtualschoolprogramshallbesubjecttoallrequirementsapplicabletoahost 71schooldistrictwithrespecttoitsfull-timeequivalentstudents. 72 3.(1)AstudentwhoresidesinthisstatemayenrollinMissouricourseaccessand 73virtualschoolprogramcoursesofhisorherchoiceasapartofthestudent'sannualcourse 74loadeachschoolyear,withanycostsassociatedwithsuchcourseorcoursestobepaidbythe 75schooldistrictorcharterschoolif: 76 (a)Thestudentisenrolledfull-timeinapublicschool,includinganycharterschool; 77and 78 (b)PriortoenrollinginanyMissouricourseaccessandvirtualschoolprogram 79course,astudenthasreceivedapprovalfromhisorherschooldistrictorcharterschool 80throughtheproceduredescribedundersubdivision(2)ofthissubsection. 81 (2)Eachschooldistrictorcharterschoolshalladoptapolicythatdelineatesthe 82processbywhichastudentmayenrollincoursesprovidedbytheMissouricourseaccessand 83virtualschoolprogramthatissubstantiallysimilartothetypicalprocessbywhichadistrict 84studentwouldenrollincoursesofferedbytheschooldistrictandacharterschoolstudent 85wouldenrollincoursesofferedbythecharterschool.Thepolicymayincludeconsultation 86withtheschool'scounselorandmayincludeparentalnotificationorauthorization.Thepolicy 87shallensurethatavailableopportunitiesforin-personinstructionareconsideredpriorto SSHB2287 4 88movingastudenttovirtualcourses.Thepolicyshallallowforcontinuousenrollment 89throughouttheschoolyear.Iftheschooldistrictorcharterschooldisapprovesastudent's 90requesttoenrollinacourseorcoursesprovidedbytheMissouricourseaccessandvirtual 91schoolprogram,thereasonshallbeprovidedinwritinganditshallbeforgoodcause.Good 92causejustificationtodisapproveastudent'srequestforenrollmentinacourseshallbea 93determinationthatdoingsoisnotinthebesteducationalinterestofthestudent,andshallbe 94consistentwiththedeterminationthatwouldbemadeforsuchcourserequestunderthe 95processbywhichadistrictstudentwouldenrollinasimilarcourseofferedbytheschool 96districtandacharterschoolstudentwouldenrollinasimilarcourseofferedbythecharter 97school,exceptthatthedeterminationmayconsiderthesuitabilityofvirtualcoursesforthe 98studentbasedonpriorparticipationinvirtualcoursesbythestudent.Appealsofanycourse 99denialsunderthissubsectionshallbeconsideredunderapolicythatissubstantiallysimilarto 100thetypicalprocessbywhichappealswouldbeconsideredforastudentseekingtoenrollin 101coursesofferedbytheschooldistrictandacharterschoolstudentseekingtoenrollincourses 102offeredbythecharterschool. 103 (3)ForstudentsenrolledinanyMissouricourseaccessandvirtualschoolprogram 104courseinwhichcostsassociatedwithsuchcoursearetobepaidbytheschooldistrictor 105charterschoolasdescribedunderthissubdivision,theschooldistrictorcharterschoolshall 106paythecontentproviderdirectlyonaproratamonthlybasisbasedonastudent'scompletion 107ofassignmentsandassessments.Ifastudentdiscontinuesenrollment,thedistrictorcharter 108schoolmaystopmakingmonthlypaymentstothecontentprovider.Noschooldistrictor 109charterschoolshallpay,foranyonecourseforastudent,morethanthemarketnecessary 110costsbutinnocaseshallpaymorethanfourteenpercentofthestateadequacytarget,as 111definedundersection163.011,ascalculatedattheendofthemostrecentschoolyearforany 112single,year-longcourseandnomorethansevenpercentofthestateadequacytargetas 113describedaboveforanysinglesemesterequivalentcourse. 114 (4)[Forstudentsenrollinginafull-timevirtualprogram,thedepartmentof 115elementaryandsecondaryeducationshalladoptapolicythatdelineatestheprocessbywhich] 116(a)Astudentwholivesinthisstatemayenrollinavirtualprogramoftheirchoiceas 117providedinthissubdivision, andtheprovisionsofsubdivisions1to3ofthissubsection 118shallnotapplytosuchenrollmentinafull-timevirtualprogram. Eachhostschool 119districtoperatingafull-timevirtualprogramunderthissectionshalladopt,operateand 120implement[thestate]anenrollmentpolicy[, subjectto]asspecifiedbytheprovisionsofthis 121subdivision.[Thepolicyshall: 122 (a)Requirethegoodfaithcollaborationof]Thestudent,thestudent'sparentor 123guardianifthestudentisnotconsideredhomeless,thevirtualprogram,thehostdistrict,and 124theresidentdistrict[;] shallcollaborateingoodfaithtoimplementtheenrollmentpolicy SSHB2287 5 125regardingthestudent'senrollment,andtheresidentschooldistrictandthehostschool 126districtmaymutuallyagreethattheresidentdistrictshallofferorcontinuetooffer 127servicesforthestudentunderanagreementthatincludesfinancialtermsfor 167takingavirtualcourseunderthissection,theschoolshallattributenolessthanninety-five 168percentattendancetoanysuchstudentwhohascompletedsuchvirtualcourse. 169 (6)TheMissouricourseaccessandvirtualschoolprogramshallensurethat 170individuallearningplansdesignedbycertifiedteachersandprofessionalstaffaredeveloped 171forallstudentsenrolledinmorethantwofull-timecourseaccessprogramcoursesorafull- 172timevirtualschool. 173 (7)Virtualschoolprogramsshallmonitorindividualstudentsuccessandengagement 174ofstudentsenrolledintheirprogram[,] and,forstudentsenrolledinvirtualcoursesona 175part-timebasis,thevirtualschoolprogramshallprovideregularstudentprogressreports 176foreachstudentatleastfourtimesperschoolyeartotheschooldistrictorcharterschool, 177providethehostschooldistrictandtheresidentschooldistrictongoingaccesstoacademic 178andotherrelevantinformationonstudentsuccessandengagement,andshallterminateor 179alterthecourseofferingifitisfoundthecourse[orfull-timevirtualschool] isnotmeetingthe 180educationalneedsofthestudentsenrolledinthecourse. 181 (8)Thedepartmentofelementaryandsecondaryeducationshallmonitorthe 182aggregateperformanceofprovidersandmakesuchinformationavailabletothepublicunder 183subsection11ofthissection. 184 (9)Pursuanttorulestobepromulgatedbythedepartmentofelementaryand 185secondaryeducation,whenastudenttransfersintoaschooldistrictorcharterschool,credits 186previouslygainedthroughsuccessfulpassageofapprovedcoursesundertheMissouricourse 187accessandvirtualschoolprogramshallbeacceptedbytheschooldistrictorcharterschool. 188 (10)Pursuanttorulestobepromulgatedbythedepartmentofelementaryand 189secondaryeducation,ifastudenttransfersintoaschooldistrictorcharterschoolwhile 190enrolledinaMissouricourseaccessandvirtualschoolprogramcourseorfull-timevirtual 191school,thestudentshallcontinuetobeenrolledinsuchcourseorschool. 192 (11)Nothinginthissectionshallprohibithomeschoolstudents,privateschool 193students,orstudentswishingtotakeadditionalcoursesbeyondtheirregularcourseloadfrom 194enrollinginMissouricourseaccessandvirtualschoolprogramcoursesunderanagreement 195thatincludestermsforpayingtuitionorcoursefees. 196 (12)Nothinginthissubsectionshallrequireanyschooldistrict,charterschool,virtual 197program,orthestatetoprovidecomputers,equipment,orinternetaccesstoanystudent 198unlessrequiredundertheeducationservicesplancreatedforaneligiblestudentunder SSHB2287 7 199subdivision(4)ofthissubsectionorforaneligiblestudentwithadisabilitytocomplywith 200federallaw.Aneducationservicesplanmayrequireaneligiblestudenttohaveaccessto 201schoolfacilitiesoftheresidentschooldistrictduringregularschoolhoursforparticipation 202andinstructionalactivitiesofavirtualprogramunderthissection,andtheeducationservices 203planshallprovideforreimbursementoftheresidentschooldistrictforsuchaccesspursuantto 204rulesadoptedbythedepartmentunderthissection. 205 (13)Theauthorizationprocessshallprovideforcontinuousmonitoringofapproved 206providersandcourses.Thedepartmentshallrevokeorsuspendortakeothercorrectiveaction 207regardingtheauthorizationofanycourseorprovidernolongermeetingtherequirementsof 208theprogram.Unlessimmediateactionisnecessary,priortorevocationorsuspension,the 209departmentshallnotifytheproviderandgivetheproviderareasonabletimeperiodtotake 210correctiveactiontoavoidrevocationorsuspension.Theprocessshallprovideforperiodic 211renewalofauthorizationnolessfrequentlythanonceeverythreeyears. 212 (14)CoursesapprovedasofAugust28,2018,bythedepartmenttoparticipateinthe 213Missourivirtualinstructionprogramshallbeautomaticallyapprovedtoparticipateinthe 214Missouricourseaccessandvirtualschoolprogram,butshallbesubjecttoperiodicrenewal. 215 (15)Anyonlinecourseorvirtualprogramofferedbyaschooldistrictorcharter 216school,includingthoseofferedpriortoAugust28,2018,whichmeetstherequirementsof 217section162.1250shallbeautomaticallyapprovedtoparticipateintheMissouricourseaccess 218andvirtualschoolprogram.Suchcourseorprogramshallbesubjecttoperiodicrenewal.A (b)Offlineactivities; 228 (c)Completedassignmentswithinaparticularprogram,curriculum,orclass; 229 (d)Testing; 230 (e)Face-to-facecommunicationsormeetingswithschoolstaff; 231 (f)Telephoneorvideoconferenceswithschoolstaff; 232 (g)School-sanctionedfieldtrips;or 233 (h)Orientation. 260 (2)Pursuanttothetimelineestablishedbythedepartment,authorizecourseorfull- 261timevirtualschoolprovidersthat: 262 (a)Submitallnecessaryinformationpursuanttotherequirementsoftheprocess;and 263 (b)Meetthecriteriadescribedinsubdivision(3)ofthissubsection; 5 (b)Uponthebasisofexamination; 6 (2)Bythestateboard,underrulesandregulationsprescribedbythestateboardwith 7advicefromtheadvisorycouncilestablishedbysection168.015toanyindividualwho 8presentstothestateboardavaliddoctoraldegreefromanaccreditedinstitutionofhigher 9educationaccreditedbyaregionalaccreditingassociationsuchasNorthCentralAssociation. 10Suchcertificateshallbelimitedtothemajorareaofpostgraduatestudyoftheholder,shallbe 11issuedonlyaftersuccessfulcompletionoftheexaminationrequiredforgraduationpursuant 12torulesadoptedbythestateboardofeducation,andshallberestrictedtothosecertificates 13establishedpursuanttosubdivision(2)ofsubsection3ofthissection; 20 b.Thedepartmentofelementaryandsecondaryeducationshalldevelopand 21maintainaneighteenhour(onethousandeightyminutes)onlineteacherpreparation 22programrelatedtosubjectsappropriateforelementaryandsecondaryeducation 23settings.AnycharitableorganizationregisteredinMissourithatisexemptfromfederal 24taxationundertheInternalRevenueCodeof1986,asamended,maysubmitateacher 25preparationprogramtothedepartmentofelementaryandsecondaryeducationfor 26approval.Onceapproved,thecharitableorganizationshallbecertifiedtodevelopand 27maintainateacherpreparednessprogram.Approvedteacherpreparednessprograms 28createdbyacharitableorganizationshallbemadeavailablebythedepartmentof 29elementaryandsecondaryeducation.Anindividualwithabachelor'sdegreemay 30completeaneighteenhouronlinetrainingprogram,eithercreatedbythedepartmentor SSHB2287 14 31byacharitableorganization,andreceiveateachercertificate.Suchcertificateshallnot 32beacceptedbyMissouripublicschools,andnon-publicschoolsshallnotberequiredto 33acceptthecertificate; 34 (b)a.SuccessfulattainmentoftheMissouriqualifyingscoreontheexitassessment 35forteachersoradministratorsdesignatedbythestateboardofeducation; 36 b.(i)Applicantswhohavenotsuccessfullyachievedaqualifyingscoreonthe 37designatedexaminationswillbeissuedatwo-yearnonrenewableprovisionalcertificate; 38 (ii)Duringthetwo-yearnonrenewableprovisionalcertification,anindividualteacher 39maygainfullprofessionalcertificationby: 40 i.Achievingaqualifyingscoreonthedesignatedexam;or 41 ii.Successfullyachievinganacceptablescoreonthestate-approvedteacher 42evaluationsystemfromsevenwalk-throughevaluations,twoformativeevaluations,andone 43summativeevaluationforeachofthetwoprobationaryyearsandbeingofferedathird 44contractbytheemployingdistrict.Foranyapplicantwhohasachangeinjobstatusbecause 45ofareductionintheworkforceorachangeinlifecircumstances,thescoresrequiredunder 46thisitemmaybescoresachievedinanyschooldistrictduringthetwo-yearnonrenewable 47provisionalcertificationperiod;and 48 (iii)Theemployingschooldistrictshallrecommendtothedepartmentofelementary 49andsecondaryeducationthattheindividualteacherbeawardedafullprofessional 50certificationbythestateboardunderrulesprescribedbythestateboard;and 51 (c)Uponcompletionofabackgroundcheckasprescribedinsection168.133and 52possessionofavalidteachingcertificateinthestatefromwhichtheapplicant'steacher 53preparationprogramwascompleted; 54 (4)Bythestateboard,underrulesprescribedbyit,onthebasisofarelevant 55bachelor'sdegree,orhigherdegree,andapassingscoreforthedesignatedexitexamination, 56forindividualswhoseacademicdegreeandprofessionalexperiencearesuitabletoprovidea 57basisforinstructionsolelyinthesubjectmatterofbankingorfinancialresponsibility,atthe 58discretionofthestateboard.Suchcertificateshallbelimitedtothemajorareaofstudyofthe 59holderandshallberestrictedtothosecertificatesestablishedundersubdivision(2)of 60subsection3ofthissection.Holdersofcertificatesgrantedunderthissubdivisionshallbe 61exemptfromtheteachertenureactundersections168.102to168.130andeachschooldistrict 62shallhavethedecision-makingauthorityonwhethertohiretheholdersofsuchcertificates; 63 (5)Bythestateboard,underrulesandregulationsprescribedbyit,onthebasisof 64certificationbytheAmericanBoardforCertificationofTeacherExcellence(ABCTE)and 65verificationofabilitytoworkwithchildrenasdemonstratedbysixtycontacthoursinanyone 66ofthefollowingareasasvalidatedbytheschoolprincipal:sixtycontacthoursinthe 67classroom,ofwhichatleastforty-fivemustbeteaching;sixtycontacthoursasasubstitute SSHB2287 15 68teacher,withatleastthirtyconsecutivehoursinthesameclassroom;sixtycontacthoursof 69teachinginaprivateschool;orsixtycontacthoursofteachingasaparaprofessional,foran 70initialfour-yearABCTEcertificateoflicensetoteach,exceptthatsuchcertificateshallnotbe 71grantedfortheareasofearlychildhoodeducation,orspecialeducation.Forcertificationin 72theareaofelementaryeducation,ninetycontacthoursintheclassroomshallberequired,of 73whichatleastthirtyshallbeinanelementaryclassroom.Uponthecompletionofthe 74followingrequirements,anapplicantshallbeeligibletoapplyforacareercontinuous 75professionalcertificateundersubdivision(3)ofsubsection3ofthissection: 76 (a)Completionofthirtycontacthoursofprofessionaldevelopmentwithinfouryears, 77whichmayincludehoursspentinclassinanappropriatecollegecurriculum; 92 b.Appropriateandrelevantbachelor'sdegreeorhigher,occupationallicense,or 93industry-recognizedcredential; 94 c.Completionoftheapplicationforaone-yearvisitingscholarscertificate;and 95 d.Completionofabackgroundcheckasprescribedundersection168.133. 96 (b)Theinitialvisitingscholarscertificateshallcertifytheholderofsuchcertificateto 97teachforoneyear.Anapplicantshallbeeligibletorenewaninitialvisitingscholars 98certificateamaximumoftwotimes,baseduponthecompletionoftherequirementslisted 99undersubparagraphsa.,b.,andd.ofparagraph(a)ofthissubdivision;completionof 100professionaldevelopmentrequiredbytheschooldistrictandschool;andattainmentofa 101satisfactoryperformance-basedteacherevaluation. 102 2.Allvalidteachingcertificatesissuedpursuanttolaworstateboardpoliciesand 103regulationspriortoSeptember1,1988,shallbeexemptfromtheprofessionaldevelopment 104requirementsofthissectionandshallcontinueineffectuntiltheyexpire,arerevokedor SSHB2287 16 105suspended,asprovidedbylaw.Whensuchcertificatesarerequiredtoberenewed,thestate 106boardoritsdesigneeshallgranttoeachholderofsuchacertificatethecertificatemostnearly 107equivalenttotheonesoheld.Anyonewhoholds,asofAugust28,2003,avalidPC-I,PC-II, 108orcontinuousprofessionalcertificateshall,uponexpirationofsuchperson'scurrent 109certificate,beissuedtheappropriatelevelofcertificatebasedupontheclassificationsystem 110establishedpursuanttosubsection3ofthissection. 111 3.(1)Certificatesoflicensetoteachinthepublicschoolsofthestateshallbebased 112uponminimumrequirementsprescribedbythestateboardofeducationwhichshallinclude 113completionofabackgroundcheckasprescribedinsection168.133.Thestateboardshall 114provideforthefollowinglevelsofprofessionalcertification:aninitialprofessionalcertificate 115andacareercontinuousprofessionalcertificate. 116 (2)Theinitialprofessionalcertificateshallbeissueduponcompletionof 117requirementsestablishedbythestateboardofeducationandshallbevalidbasedupon 118verificationofactualteachingwithinaspecifiedtimeperiodestablishedbythestateboardof 119education.Thestateboardshallrequireholdersofthefour-yearinitialprofessionalcertificate 120to: 121 (a)Participateinamentoringprogramapprovedandprovidedbythedistrictfora 122minimumoftwoyears; 123 (b)Completethirtycontacthoursofprofessionaldevelopment,whichmayinclude 124hoursspentinclassinanappropriatecollegecurriculum,orforholdersofacertificateunder 125subdivision(4)ofsubsection1ofthissection,anamountofprofessionaldevelopmentin 126proportiontothecertificateholder'shoursintheclassroom,ifthecertificateholderis 127employedlessthanfulltime;and 128 (c)Participateinabeginningteacherassistanceprogram. 129 (3)(a)Thecareercontinuousprofessionalcertificateshallbeissuedupon 130verificationofcompletionoffouryearsofteachingundertheinitialprofessionalcertificate 131anduponverificationofthecompletionoftherequirementsarticulatedinparagraphs(a)to 132(c)ofsubdivision(2)ofthissubsectionorparagraphs(a)to(d)ofsubdivision(5)of 133subsection1ofthissection. 134 (b)Thecareercontinuousprofessionalcertificateshallbecontinuousbasedupon 135verificationofactualemploymentinaneducationalpositionasprovidedforinstateboard 136guidelinesandcompletionoffifteencontacthoursofprofessionaldevelopmentperyear 137whichmayincludehoursspentinclassinanappropriatecollegecurriculum.Shouldthe 138possessorofavalidcareercontinuousprofessionalcertificatefail,inanygivenyear,tomeet 139thefifteen-hourprofessionaldevelopmentrequirement,thepossessormay,withintwoyears, 140makeupthemissinghours.Inordertomakeupformissinghours,thepossessorshallfirst 141completethefifteen-hourrequirementforthecurrentyearandthenmaycounthoursinexcess SSHB2287 17 142ofthecurrentyearrequirementasmake-uphours.Shouldthepossessorfailtomakeupthe 143missinghourswithintwoyears,thecertificateshallbecomeinactive.Inordertoreactivate 144thecertificate,thepossessorshallcompletetwenty-fourcontacthoursofprofessional 145developmentwhichmayincludehoursspentintheclassroominanappropriatecollege 146curriculumwithinthesixmonthspriortoorafterreactivatingthepossessor'scertificate.The 147requirementsofthisparagraphshallbemonitoredandverifiedbythelocalschooldistrict 148whichemploystheholderofthecareercontinuousprofessionalcertificate. 149 (c)Aholderofacareercontinuousprofessionalcertificateshallbeexemptfromthe 150professionaldevelopmentcontacthourrequirementsofparagraph(b)ofthissubdivisionif 151suchteacherhasalocalprofessionaldevelopmentplaninplacewithinsuchteacher'sschool 152districtandmeetstwoofthethreefollowingcriteria: 153 a.Hastenyearsofteachingexperienceasdefinedbythestateboardofeducation; 154 b.Possessesamaster'sdegree;or 155 c.Obtainsarigorousnationalcertificationasapprovedbythestateboardof 156education. 157 4.Policiesandproceduresshallbeestablishedbywhichateacherwhowasnot 158retainedduetoareductioninforcemayretainthecurrentlevelofcertification.Thereshall 159alsobeestablishedpoliciesandproceduresallowingateacherwhohasnotbeenemployedin 160aneducationalpositionforthreeyearsormoretoreactivatetheteacher'slastlevelof 161certificationbycompletingtwenty-fourcontacthoursofprofessionaldevelopmentwhich 162mayincludehoursspentintheclassroominanappropriatecollegecurriculumwithinthesix 163monthspriortoorafterreactivatingtheteacher'scertificate. 164 5.Thestateboardshall,uponcompletionofabackgroundcheckasprescribedin 165section168.133,issueaprofessionalcertificateclassificationintheareasmostclosely 166alignedwithanapplicant'scurrentareasofcertification,commensuratewiththeyearsof 167teachingexperienceoftheapplicant,toanypersonwhoishiredtoteachinapublicschoolin 168thisstateandwhopossessesavalidteachingcertificatefromanotherstateorcertification 169undersubdivision(4)ofsubsection1ofthissection,providedthatthecertificateholdershall 170annuallycompletethestateboard'srequirementsforsuchlevelofcertification,andshall 171establishpoliciesbywhichresidentsofstatesotherthanthestateofMissourimaybeassessed 172afeeforacertificateoflicensetoteachinthepublicschoolsofMissouri.Suchfeeshallbein 173anamountsufficienttorecoveranyorallcostsassociatedwiththeissuingofacertificateof 174licensetoteach.Theboardshallpromulgaterulestoauthorizetheissuanceofaprovisional 175certificateoflicense,whichshallbevalidforthreeyearsandshallallowtheholdertoassume 176classroomdutiespendingthecompletionofacriminalbackgroundcheckundersection 177168.133,foranyapplicantwho: 178 (1)IsthespouseofamemberoftheArmedForcesstationedinMissouri;
